Abstract

This paper examines the legal status and registration of Pauman land in the Karangasem Regency of Bali. The concept of Pauman land is unique to this region and is considered a gift from the King of Karangasem. Recently, there have been disputes over the registration of Pauman land as individual plots through PTSL, leading to questions about its legal status and ownership. The study uses an empirical legal approach, including statute, historical, case, analytical, conceptual, and legal sociology approaches. The research highlights the gap between the predetermined norm and the implementation of Pauman land practices. Pauman cannot be considered a legal entity that can hold land rights under state law, but it can be recognized as a subject of the Temple according to the Decree of the Minister of Home Affairs. The paper recommends issuing a Certificate of Property Rights (SHM) in the name of the Temple to strengthen the position of Pauman land ownership without changing its communal and cultural heritage status. The use of the Temple's subject name is preferable to borrowing the name Klian for registering Pauman land as communal property. The study also predicts potential disputes due to re-recognition by the puri family, which needs to be anticipated by Pauman. Overall, this paper provides insights into the unique legal status and registration of Pauman land in the Karangasem Regency of Bali and offers recommendations to ensure the preservation of its communal and cultural heritage status.

Abstract

The urgency of this research is to find certainty regarding the duration of the lease and the position of foreign citizens in the transfer of lease rights. Therefore, the relevant issues discussed are the civil responsibilities of the party transferring the lease rights concerning objects that are still under lease, and the legal protection that should be provided to good-faith tenants. The research method used is a normative legal method with legislative, analytical, and case study approaches, and the analysis of the legal materials used is an analysis based on content. The research results show that foreign nationals who transfer lease rights without a valid legal basis are civilly liable for the losses incurred, whether through compensation mechanisms, lawsuits for breach of contract, unlawful acts, or annulment of documents. Meanwhile, a good faith tenant, who obtains rights legally and is unaware of any legal defects, is entitled to legal protection based on the principles of justice and legal certainty. Therefore, it is recommended that notaries can design the lease period and residence permits for the foreign nationals, and in case of disputes, judges are expected to provide legal certainty and protection for good faith tenants.

Abstract

The purpose of this research is to analyze the validity of lease transfer agreements from Foreign Nationals to Indonesian Citizens and to examine the legal consequences of land lease agreements by Foreign Nationals. The type of legal research used is normative legal research, with statutory and analytical approaches. This legal research utilizes two types of legal materials, namely primary legal materials and secondary legal materials. The research results indicate that the validity of the lease transfer agreement by a foreign national with a Visa on Arrival (VoA) in Supreme Court Decision No. 2099 K/Pdt/2017 is deemed invalid because foreign nationals do not meet the legal capacity requirements as per Article 1320 of the Civil Code in conjunction with Article 45 of the UUPA. The temporary nature of the Visa on Arrival (VoA) does not satisfy the requirement of being domiciled in Indonesia, which necessitates a valid and ongoing residence permit. The legal consequences of this agreement are that it can be annulled due to the failure to meet the subjective requirements in Article 1320 of the Civil Code. This means that the agreement remains formally valid but can be annulled by the aggrieved party through a court ruling.
