Abstract

In the construction industry, the practice of direct payments by service users to subcontractors has become a common phenomenon. This practice occurs when service users, as main clients, pay subcontractors directly without going through the main contractor. This aims to speed up cash flow and ensure timely payments to subcontractors. However, the practice of direct payments also raises various problems and impacts that need to be considered. In this research, the approach used is quantitative. This research uses a causal analysis method because this research aims to test a hypothesis regarding the influence of one or several independent variables on the dependent variable. The population determined in this research includes building project stakeholders who focus on: Project Owners, and Main Contractors, Sub-contractors / Suppliers, totaling 110 respondents, using the Slovin formula with a 5% margin of error, the number of respondents was 86 people. Payment research results in direct project payments have a positive and significant effect on project costs, direct project payments have a positive and significant effect on project time, and direct project payments have a positive and significant effect on project quality.

Abstract

Tujuan penelitian ini adalah peneliti akan melakukan peninjauan dan analisa sampai sejauh mana kondisi pendemi covid-19 mempengaruhi kinerja biaya dan kinerja waktu pada proyek- proyek pembangkit listrik nasional sehingga memunculkan potensi klaim konstruksi yang berujung pada sebuah sengketa konstruksi. Penelitian ini bersifat deskriptif kuantitatif dimana tahapan yang akan dilaksanakan oleh peneliti dalam rangka mencapai tujuan penelitian ini adalah dengan membuat pertanyaan sebagai pertanyaan penelitian (research question). Peneliti akan melakukan penelitian di beberapa proyek pembangkit listrik baik itu milik perusahaan swasta maupun milik BUMN yang sedang dalam fase proses konstruksi di periode pandemic Covid-19. Hasil penelitian ini menunjukkan ada pengaruh antara kinerja waktu dan biaya pada masa pandemi covid-19 terhadap munculnya potensi klaim pada proyek-proyek pembangkit listrik nasional. Dampak pendemi Covid-19 mempengaruhi secara dominan penurunan kinerja waktu yang mengakibatkan keterlambatan waktu pada proyek-proyek konstruksi pembangkit listrik nasional. Dampak Pendemi Covid-19 mempengaruhi kinerja biaya sehingga meningkatkan biaya proyek konstruksi pada proyek-proyek konstruksi pembangkit listrik nasional namun tidak dominan atau pengaruhnya tidak sebesar kinerja waktu.

Abstract

Disputes in construction projects often arise from divergent interpretations of contracts, delays in execution, and the complex dynamics of scope changes. Within this context, arbitration has long been regarded as an alternative dispute resolution mechanism that promises efficiency, fairness, and confidentiality outside the court system. However, more than two decades after the enactment of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution, its effectiveness in the construction sector remains subject to debate and scrutiny. This study critically examines the effectiveness of arbitration in resolving construction disputes under the legal framework established by Law No. 30 of 1999. Using a normative juridical approach, it reviews statutory regulations, legal doctrines, and field practices, complemented by interviews with legal practitioners and construction arbitrators. The findings reveal that while arbitration offers advantages in terms of confidentiality, procedural flexibility, and finality of decisions, its practical effectiveness is often constrained by high procedural costs, limited contractual understanding among parties, and challenges in enforcing arbitral awards through the courts. Furthermore, the substance of Law No. 30 of 1999 appears insufficiently adaptive to the technical and multidimensional nature of modern construction disputes. This research therefore recommends revising and modernizing the law particularly by strengthening the enforceability of arbitral awards, standardizing arbitration institutions, and enhancing the competence of human resources in construction law. Ultimately, arbitration should evolve as a mechanism not only for efficient dispute resolution but also for upholding justice, legal certainty, and professional integrity in Indonesia’s construction sector.

Abstract

This study examines the civil dispute resolution process between contractors and subcontractors in a construction project, based on a case study of PT. Alfa Mandiri versus PT. Hsing Loong Indonesia (Decision Number 124/Pdt.G/2020/PN.JKT.SEL). The dispute arose from a subcontract agreement drawn up solely in English and not in Indonesian, as required by Law Number 24 of 2009 concerning the National Flag, Language, Emblem, and Anthem. Furthermore, differing interpretations of the contract's contents and disharmony in project implementation led to a lawsuit filed with the South Jakarta District Court. This study aims to analyze the parties' responsibilities, the legal basis for contract cancellation, and the civil dispute resolution mechanism in construction projects in Indonesia.

Abstract

Delays in construction work execution represent one of the most common forms of default that trigger disputes between employers and contractors. Within Indonesia’s civil law framework, such default entails legal consequences including delay penalties, compensation, contract termination, and enforcement of performance bonds. This study examines these legal implications under the Indonesian Civil Code (KUHPerdata), Law No. 2 of 2017 on Construction Services, and several Supreme Court decisions with permanent legal force namely Decisions No. 294 PK/Pdt/2014, No. 3053 K/Pdt/2011, and No. 60 K/Pdt/2020. The research adopts a normative juridical approach supported by secondary data from literature review and judicial case analysis. It also proposes a dispute-prevention hypothesis founded on effective communication through guanxi, dynamic relationship, and personal approach, aimed at reinforcing loyalty and preventing conflict. The findings reveal that Indonesia’s positive legal system remains sanction-oriented and emphasizes legal certainty, whereas sustainable dispute prevention requires a paradigm grounded in relational trust. Integrating relational approaches into construction contract practice may establish equilibrium between legal certainty and substantive justice.

Abstract

Legally, the issue of abuse of authority in development is an act that can be prosecuted under two legal frameworks, namely State Administrative Law and Criminal Law. This article analyzes the legal framework and implications of abuse of authority by government officials, with a focus on national strategic projects and the procurement of goods and services. Through normative legal research methods, this study concludes that the Government Administration Law brings a new paradigm by establishing administrative sanctions as the first resort, while criminal sanctions are placed as the last resort. Based on the lex posterior principle, the primary authority to examine the existence of abuse of authority lies with the Administrative Court. Furthermore, the findings prove that officials who unlawfully abuse their authority, causing financial losses to the state, are required to take personal responsibility for the payment of compensation. Although this legal framework aims to provide certainty and prevent the criminalization of policies, its implementation in national strategic projects has drawn criticism for potentially weakening efforts to eradicate corruption. As an implementative measure, this study recommends harmonizing perceptions, developing clear technical guidelines, and improving coordination between APIP, PTUN, and law enforcement agencies. This synergy is expected to ensure the realization of accountability.

Abstract

EPC (Engineering, Procurement, and Construction) contracts are increasingly used in large infrastructure projects in Indonesia due to their efficiency and clear division of responsibilities (Federation Internationale des Ingenieurs-Conseils [FIDIC], 2017). However, this contract is rooted in a Common Law system that is different from Indonesia's national legal system which adheres to Civil Law (Subekti, 2019; Satrio, 2021). This study aims to analyze the extent to which the Indonesian Civil Law system is able to maintain its legal sovereignty in the implementation of FIDIC Silver Book-based EPC contracts, as well as identify legal challenges that arise due to differences in legal principles. The method used is a normative juridical approach combined with conceptual and comparative analysis of the provisions of the Civil Code (1847), Law Number 2 of 2017 concerning Construction Services (Law of the Republic of Indonesia, 2017), and risk allocation and dispute resolution clauses in the FIDIC Conditions of Contract (FIDIC, 2017). The results of the study show that there are fundamental differences in the principle of risk sharing and dispute resolution mechanisms between the Common Law and Civil Law systems. Several clauses in FIDIC require harmonization to be in line with the principles of justice, legal certainty, and proportionality that apply in national law (Hidayat, 2021; Osei, 2022). This research contributes to strengthening academic and practical understanding of the harmonization between international contracts and national law. These findings are expected to be a conceptual basis for the development of adaptive construction legal norms while maintaining Indonesia's legal sovereignty (Lubis, 2020; Klee, 2021).

Abstract

The globalization of cross-border construction projects increases the need for legal certainty and uniformity in the arrangement of international construction contracts. Differences in national legal systems, the complexity of long-term projects, and the dynamics of technical and economic risks often lead to contractual imbalances and potential disputes. In this context, UNCITRAL plays an important role through the development of soft law international legal instruments, especially the UNCITRAL Legal Guide on Drawing Up International Contracts for the Construction of Industrial Works, which provides a principled normative framework for the design of international construction contracts. This study aims to analyze the role of UNCITRAL in the standardization of international construction contracts and examine the implementation of these principles in construction contract practices in Indonesia, taking into account the development of national contract standards regulated in the Regulation of the Government Goods/Services Procurement Policy Institute Number 4 of 2024 and the Regulation of the Minister of Public Works and Public Housing Number 25 of 2020. The research method used is normative legal research with a legislative, conceptual, and analytical approach to UNCITRAL instruments and relevant national regulations. The results show that UNCITRAL functions as a normative framework that emphasizes procedural clarity, proportionate risk allocation, contract adaptation to changing circumstances, and a tiered dispute resolution mechanism.

Abstract

Public procurement in Indonesia plays a pivotal role in supporting national development. However, this sector remains susceptible to abuse of authority and corrupt practices that result in significant state financial losses. This research aims to analyze the application of criminal law and other relevant legal aspects in addressing irregularities within the procurement of goods and services. The methodology employed is normative legal research, utilizing a normative-juridical approach to examine prevailing laws and regulations. Furthermore, this study examines criminal elements that are prone to occur throughout various stages of public procurement, which currently utilizes an electronic procurement system as a solution to enhance transparency and efficiency. The research findings indicate that although electronic procurement systems improve accountability and transparency, challenges regarding infrastructure and human resource capacity remain primary obstacles to implementation. Criminal law aspects represent the most vulnerable legal dimension in public procurement; nevertheless, other legal aspects, such as administrative and civil law, cannot be disregarded. Ideally, the principle of ultimum remedium should be applied in circumstances where administrative or civil errors occur in the absence of malicious intent (mens rea). This study concludes that concerted efforts are required to strengthen the existing legal system, enhance the integrity of procurement officials, and involve the public in oversight processes. Through these measures, public procurement can operate more efficiently, remain free from corruption, and provide maximum benefits for national development.
