Abstract

Objective -This study aims to analyze the legal and contractual aspects related to the dispute over the extension of time in the PLN transmission project in Central Sumatra. This study focuses on the process, obstacles, and challenges faced in resolving the dispute. Methodology/Approach– The study uses a case study approach by analyzing contract documents, mediation processes, and related agreements between PLN and contractors. This study also examines the main elements of contracts within the Engineering, Procurement, and Construction (EPC) framework and evaluates the mediation process facilitated by the Financial and Development Supervisory Agency (BPKP). Findings– The results of the study showed that the delay in project completion, which was mostly caused by contractor inefficiency and external factors, resulted in disputes related to time extensions. Although contractors submitted justifications such as design changes, additional work, and external constraints, these reasons were considered inadequate by PLN. Mediation efforts provided a partial solution but also revealed systemic problems in contract management and dispute resolution mechanisms. Novelty/Benefits– This study contributes to the understanding of time extension disputes in large-scale infrastructure projects, and offers insights into effective dispute resolution strategies. The findings can serve as practical guidance for stakeholders in managing similar conflicts in the future while maintaining professional relationships.Keywords – Extension of time, Construction contract, Mediation,

Abstract

The implementation of green construction concept in Indonesia's construction industry is increasing as a response to the need for sustainable development. However, the application of this concept is not without challenges, which can heighten the potential for legal and regulatory issues. This study aims to explore the implications of green construction implementation from technical, legal, environment and regulatory perspectives.This research approach was conducted using qualitative methods, with data collected from literature and interviews with experts who involved in green construction. Data is gathered through literature studies and confirmation results using the Delphi method. The findings reveal that a lack of comprehensive understanding of green construction principles often leads to potential disputes among stakeholders, particularly in risk management, responsibility allocation, and different interpretations of technical and legal aspects.The study identifies key challenges such as additional cost for eco-friendly technologies and non-compliance with green building standards and government regulations as major contributors to legal issues likewise. To mitigate these risks, harmonization of regulations, strengthening of contract documents, and dissemination of green construction knowledge among stakeholders are essential.This study provides recommendation for construction industry player to manage potential legal issues in construction contract while supporting the more effective implementation of green construction in Indonesia. Abstract

Arbitration is a popular dispute resolution method in the construction industry in Indonesia because the process is fast, efficient, and the results are final and binding. However, attempts to retest or annul arbitral awards in courts often threaten the principle of finality. This study aims to analyze the legal basis for reviewing arbitral awards in Indonesia based on Articles 70-72 of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, as well as its impact on legal certainty and efficiency in resolving construction disputes. Through a normative juridical approach and case studies, this study found that courts often annull arbitral awards on the grounds of forged documents, new evidence, or fraud (Hansen, 2019). Examples of cases such as PT. Hutama Karya vs PT. Krakatau Bandar Samudera show that annulment by the district court prolongs dispute resolution and adds to costs, which highlights the weakness of the arbitration system in Indonesia and can reduce trust in it. The study concluded that legal reform is necessary to limit the grounds for reviewing arbitral awards. Indonesia is also advised to establish a special arbitration court or a judge of construction dispute experts to increase legal certainty. Training and certification of arbitrators is necessary to reduce the potential for award errors, so that arbitration can be optimal as an effective and efficient method of dispute resolution.

Abstract

Building failure is a condition of collapse or non-functioning of a building when the final handover of construction services is carried out where this is caused by negligence on the part of the Service Provider, so that they are obliged to be responsible for the failure that exists. The problems in this study include 1) How to implement legal protection for construction service providers in cases of building failure. 2) What are the weaknesses in implementing legal protection for construction service providers in cases of building failure so that they are not yet fair. 3) How to reconstruct legal protection for construction service providers in cases of building failure based on the value of justice. The approach method used is empirical juridical. In this study, the theory used is the Pancasila Justice Theory. The results of the study found that the implementation of legal protection for construction service providers, especially related to building failure problems, has not been based on the principle of justice because building failure problems should be resolved through civil law and administrative sanctions, not criminal action. And related to various weaknesses in the implementation of legal protection are still found, where this is caused by the weakness of existing legal regulations, law enforcement structures and community culture.

Abstract

Non-litigation conflicts can be settled in a number of ways, including through arbitration and mediation. "A method for testing a particular theory by examining the relationship between variables" is the quantitative approach that is employed. The study's findings indicate that the time frames for arbitrating and mediating disputes differ; specifically, the arbitration ruling must be rendered no later than 30 days following the conclusion of the dispute examination. The cost of using the mediation room is not included in the price of using mediation to settle issues in court. This period may be extended, nevertheless, by the arbitration panel or the lone arbitrator. After the mediator is chosen, the mediation procedure can take up to 40 working days, and the arbitration ruling is final and binding on the parties. A maximum extension of 14 working days may be made to this time frame. In the event that mediation produces a written agreement, the parties are required to draft and sign it. The fees for arbitrating disputes differ based on the arbitration organization and the amount of the claim; they could include Registration cost: The registration cost for the arbitration request, Cost of administration: The arbitration administration charge is determined using a tariff scale. Arbitrator's fee: The cost of hiring arbitrators is determined using a tariff scale. along with The cost of hearing: The parties, respondent, or applicant bear the pro rata costs of the arbitration hearing.

Abstract

Purpose –This study aims to analyze the legal basis related to Retention Money and Retention Bond in construction contract practices and provisions regarding the implementation of the transition from Retention Money to Retention Bond in ongoing contracts. Methodology/approach –This study uses a qualitative approach with analysis of contract documents, applicable legal regulations, and technical data related to the project. It also analyzes additional information obtained through previous literature reviews. Findings –In Retention Money, the Owner will directly withhold payment for the work until an agreed amount is reached, but in the development of construction this will certainly hinder the investment capabilities of the party implementing the work. Novelty/value –Considering the risks that may occur during the construction period, and ensuring the ability to carry out the work during the Defect Notification Period, retention is usually required. In its development, Retention Bond can be used to protect the Owner against the failure of the work implementer to perform after the work is carried out (Taking Over Certificate). Retention Bond can be constructed as an accessoir agreement, namely an additional or accompanying agreement and cannot stand alone without a preceding principal agreement.

Abstract

Sengketa dalam suatu kontrak kerja konstruksi adalah suatu hal yang jamak terjadi. Standar kontrak pekerjaan konstruksi menentukan mekanisme penyelesaian sengketa karena masing-masing standar kontrak memiliki tahapan waktu dan proses penyelesaian sengketa yang berbeda. Penyelesaian sengketa kontrak juga dipengaruhi oleh sistem hukum yang menjadi acuan negara setempat, dimana Indonesia menganut sistem hukum Civil Law. Hasil analisis dan perbandingan penyelesaian sengketa antara standar kontrak Pemerintah dan standar kontrak FIDIC, ditemukan dua perbedaan utama yang berkaitan dengan pengaturan waktu peyelesaian sengketa dan tahapan/prosedur penyelesaian sengketa, dimana standar kontrak Pemerintah tidak mengatur secara jelas durasi waktu penyelesaian, serta proses penyelesaian sengketa masih sebagai suatu pilihan bukan tahapan sehingga tidak relevan dengan ketentuan didalam Undang-undang Nomor 2 tahun 2017 tentang Jasa Konstruksi. Urutan tahap penyelesaian sengketa tersebut adalah dengan cara melakukan musyawarah untuk mufakat, tahapan berikutnya adalah melalui proses mediasi, konsiliasi dan arbitrase. Pelaksanaan mediasi dan konsiliasi juga dapat digantikan dengan pembentukan Dewan Sengketa.

Abstract

The transformation of traditional industrial areas into eco-smart zones has become a strategic solution for reducing environmental impacts while improving operational efficiency. This study aims to analyze investment and technology challenges in the transformation of traditional industrial estates towards eco-smart industrial estates, as well as evaluate their impact on the company's environmental, economic, and social sustainability. The research employs a mixed-methods approach, integrating quantitative data analysis from the implementation of eco-smart technology across various industrial sectors with interviews involving key stakeholders. Quantitative data includes CO2 emission reductions, operational cost efficiencies, and natural resource management, while interviews explore the challenges and opportunities in technology adoption. The findings reveal that implementing eco-smart technology over four years successfully reduced CO2 emissions by 50%, achieved 40% energy cost efficiency, and generated a total operational cost saving of 26%. Additionally, the use of natural resources, such as water and energy, decreased by 20%. The main challenges identified include high initial investment and the need for collaboration among stakeholders to accelerate technology adoption. This study concludes that despite the hurdles in investment and technology implementation, transitioning to eco-smart systems offers significant environmental and economic benefits. These findings provide valuable insights for policymakers and industry players in developing sustainable industrial zones.

Abstract

Proyek LRT Jabodebek merupakan bagian dari Proyek Strategis Nasional (PSN) yang dirancang untuk menyediakan moda transportasi massal modern guna mengatasi kemacetan di kawasan Jabodebek sekaligus meningkatkan mobilitas masyarakat urban. Namun, pelaksanaannya dihadapkan pada kompleksitas hukum yang melibatkan berbagai aspek, seperti hukum perdata, hukum administrasi negara, hukum pidana, hukum ketenagakerjaan, hukum pertanahan, hukum pendanaan, dan hukum lingkungan. Penelitian ini menggunakan metode yuridis normatif untuk menganalisis aspek hukum yang relevan dalam pelaksanaan proyek LRT Jabodebek. Hasil analisis menunjukkan bahwa aspek hukum perdata memastikan legalitas kontrak kerja konstruksi, sementara hukum administrasi negara mengatur pemenuhan izin seperti AMDAL, PBG, dan SLF. Kepatuhan terhadap hukum pidana diperlukan untuk mencegah tindakan korupsi, hukum ketenagakerjaan untuk menjamin perlindungan hak pekerja, dan hukum pertanahan untuk melindungi hak masyarakat serta pemilik lahan. Selain itu, pengelolaan pendanaan yang optimal serta mitigasi dampak lingkungan yang efektif mendukung penerapan prinsip keberlanjutan. Proyek LRT Jabodebek menjadi contoh keberhasilan integrasi antara pembangunan infrastruktur modern dengan kepatuhan terhadap regulasi hukum yang mampu memberikan manfaat ekonomi, sosial, dan lingkungan. Studi ini menekankan pentingnya penerapan aspek hukum yang komprehensif untuk mendukung infrastruktur yang berkelanjutan dan berkualitas tinggi, sekaligus menjadi acuan untuk pembangunan proyek strategis nasional lainnya.
