Abstract

The prevalence of land and space concerns presents considerable hurdles in giving information and awareness of their management to village society. Land clinics are one of the activities that provide land services to help local people handle land issues. It is intended that the information transfer supplied would be able to enhance public understanding about the issues that face communities, such as strong institutional and political bureaucratic elements, regional geographic diversity, and community educational background. This article provides the findings of qualitative research conducted in Bejiharjo Village (Kalurahan), with data collected through the focus group discussion (fgd) technique and interviews with locals who had land issues. The debate centered on presenting the range of regional possibilities worth developing, while interviews were utilized to pose concerns concerning land and space issues. The findings suggest that advising on regional potential and solving village-based land concerns may empower society, improve land services, and satisfy community land security needs. However, standardized land service demands, ease of bureaucracy in each institution, and government political commitment to help residents are the keys to social success. === Permasalahan keterbatasan tanah (lahan) dan ruang menimbulkan tantangan besar dalam menyebarkan informasi dan meningkatkan kesadaran masyarakat pedesaan mengenai pengelolaannya. Klinik pertanahan adalah suatu bentuk inisiatif berbasis masyarakat yang bertujuan untuk menawarkan layanan pertanahan untuk membantu individu lokal dalam mengelola permasalahan pertanahan secara efektif. Tujuan pemberian transfer informasi melalui klinik pertanahan adalah untuk meningkatkan pemahaman masyarakat terhadap tantangan yang dihadapi masyarakat, termasuk faktor-faktor seperti kuatnya komponen kelembagaan dan birokrasi politik, dan latar belakang pendidikan masyarakat. Artikel ini menyajikan hasil penelitian kualitatif yang dilakukan di Desa (Kalurahan) Bejiharjo dengan metode focus group discussion dan wawancara terhadap masyarakat yang terkena dampak permasalahan lahan. Fokus perdebatan berkisar pada pemaparan tentang potensi atau peluang regional yang perlu ditelusuri. Selain itu, wawancara juga dilakukan untuk mengatasi permasalahan terkait tanah dan tata ruang. Hasil penelitian menunjukkan bahwa pemberian penyuluhan tentang keberagaman potensi daerah dan memberikan solusi permasalahan pertanahan di tingkat desa dapat berkontribusi terhadap community empowerment, memperbaiki dan meningkatkan kualitas pelayanan kantor pertanahan, dan memberikan jaminan atas keamanan tanah masyarakat. Faktor-faktor penting untuk mencapai keberhasilan sosial mencakup penyelarasan persyaratan layanan pertanahan, penyederhanaan proses birokrasi di dalam lembaga, dan komitmen pemerintah untuk mendukung penduduk di wilayah tersebut.

Abstract

Penguasaan tanah merupakan aspek utama dalam kepemilikan lahan. Tak diragukan lagi, semua orang ingin memperjuangkan hak atas tanah terhadap lahan yang dimilikinya. Tak terkecuali para nelayan yang bermukim di kawasan rumah pelantar di beberapa wilayah Provinsi Kepulauan Riau, salah satunya Kabupaten Kepulauan Anambas. Dikarenakan rumah yang mereka tempati tersebut dibangun diatas air, maka timbul ketidakjelasan status penguasaan yang mereka miliki. Lantaran bukti kepemilikan yang dimiliki oleh para nelayan tersebut hanya sebatas berdasar kepada alas hak yang dikeluarkan oleh Kantor Desa Tempata. Maksud dari penulisan artikel ini adalah untuk mengetahui bagaimana perlakuan yang diberikan terhadap wilayah pemukiman pelantar yang berdiri diatas permukaan air dengan menggunakan metode kualitatif untuk kemudian dianalisis secara induktif. Kesimpulan dari artikel ini adalah untuk mengetahui hasil yang didapat oleh para nelayan dan juga sebagian masyarakat adat yang menghuni kawasan pemukiman pelantar bisa mempunyai hak atas tanah yang diterbitkan oleh kantor pertanahan yang ada di Kabupaten Kepulauan Anambas, Provinsi Kepulauan Riau, hal ini dilakukan demi terciptanya kepastian hukum yang sah dan berlaku.

Abstract

Keberadaan Lembaga Perkreditan Desa (LPD) sebagai lembaga keuangan milik Desa Adat di Bali semakin kuat dengan terbitnya UU LKM dan Perda LPD. Kegiatan usaha LPD mendapat tanggapan yang positif dari krama desa, terutama dalam memberikan modal usaha melalui pinjaman. Dalam melaksanakan salah satu kegiatan perbankan tersebut, LPD melakukan pengikatan jaminan melalui pembebanan Hak Tanggungan (HT), namun disisi lain LPD merupakan lembaga milik adat yang hanya tunduk terhadap hukum adat. Penelitian ini mengkaji bagaimana status hukum pemberian HT kepada LPD dikaitkan dengan bentuk hukum kelembagaan LPD dan mengkaji upaya yang ditempuh LPD dalam menyelesaikan kasus wanprestasi. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan. Hasil penelitian ini menunjukkan bahwa pemberian HT kepada LPD sah dan berkepastian hukum. Selain itu upaya yang ditempuh oleh LPD dalam menyelesaikan kasus wanprestasi adalah penyelesaian secara adat berdasarkan awig-awig atau gugatan di pengadilan dimana proses penyelesaian sengketa selalu diawali dengan paruman adat.

Abstract

Indonesia’s transmigration program, despite its scale and strategic intent, has generated persistent structural issues, including agrarian disputes and social tensions. This study investigates the ineffectiveness of sustainable development governance in transmigration areas and proposes evidence-based policy solutions, with a focus on Lampung Province. Employing a mixed-methods approach, the research integrates in-depth interviews, focus group discussions, field observations, and literature review. The study was conducted in four transmigration sites: Rawa Pitu, Mesuji, Way Tuba, and Ngambur. Data were collected from 35 key informants and secondary sources, and analyzed thematically and spatially using ArcMap 10.8.2 software, alongside a descriptive-narrative method. The findings reveal that, by 2023, a total of 6,397 land plots across 24 locations remained uncertified due to overlapping claims. Besides, approximately 40% of issued land certificates did not match the actual physical boundaries. As of 2024, 65% of land disputes have not been resolved, primarily due to institutional fragmentation and overlapping mandates between the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and the Ministry of Environment and Forestry (KLHK). Social conflicts, such as those observed in Papan Rejo Village, reflect the limitations of top-down policy approaches and the neglect of local communities’ historical land rights. The study recommends structural reforms in integrating land governance systems, accelerating spatially-based land certification, and adopting inclusive and participatory conflict resolution mechanisms.

Abstract

This study analyzes the implementation of the waqf land registration acceleration program in Jember Regency as an effort to increase recognition and legal protection of waqf assets. The method used is descriptive-qualitative by combining primary data from interviews and secondary data. This program is implemented through three main approaches: local acceleration, integration with the 2023 PTSL program, and a cross-sector scheme (Lintor) involving the regional government, Ministry of Religious Affairs, Land Office, and Indonesian Waqf Agency. Of the target of 1,000 plots, only 752 waqf plots and 87 lintor plots were successfully certified. The main obstacles include limited KUA infrastructure, unsystematic rotation of officials, data asynchrony between institutions, and low public legal awareness of the importance of certification. This study concludes that the effectiveness of the program is determined by the simplification of procedures, institutional synergy, and public education through religious institutions. Theoretically, this study expands the study of religious agrarian governance by applying a multi-actor approach and offering a collaborative model that can be replicated in other areas. Capacity building of Nazir and sustainable funding are also recommended to encourage the legalization of waqf land nationally and ensure long-term legal certainty.

Abstract

Integration of Agrarian Literacy in Citizenship Education. Objective: This study aims to formulate an integration model of land literacy within social education to enhance students’ critical awareness and serve as a preventive strategy against agrarian conflict in Indonesia. Method: This qualitative literature analysis draws on Paulo Freire's critical pedagogy to combine recent empirical findings with agrarian policy advances. Finding: Apart from unequal land ownership, the study shows those agrarian conflicts result from young people's ignorance of land rights, legal procedures, and history. Civic education in schools also emphasizes excessive memorization and fails to connect with students' local realities. The current curriculum does not address local agrarian issues, and teaching methods are mostly one-sided, failing to encourage critical thinking or active participation from students. To address this, the study suggests a model for agrarian literacy that includes three key components: (1) a curriculum that covers local agrarian topics like customary rights, land disputes, and agrarian law; (2) engaging learning methods like project-based learning and real-life case studies of land conflicts; and (3) partnerships with organizations like the National Land Agency, traditional institutions, and non-governmental organizations in the agrarian field. Conclusion: Agrarian literacy is an important citizenship competency that helps form citizens who are legally aware, sensitive to social justice, and capable of actively resolving land conflicts. Therefore, agrarian literacy needs to be systematically integrated into the national education framework. Keywords: land literacy, civic education, agrarian conflict, critical pedagogy, civic engagement.

Abstract

This research analyzes ownership patterns and the process of legalizing customary land in Manggarai Regency. The research method used is qualitative with a descriptive approach and uses secondary data. Normative socio-juridical methods are also used to view and analyze the research data that has been collected. Data was collected through observations and interviews with traditional elders and members of traditional communities. The results showed that the legalization of Ulayat land greatly affected the pattern of land ownership in Manggarai and the change of entities from indigenous land to non-indigenous land that was initially jointly controlled or communal into individual rights due to the legalization or registration of land. Legalization of Ulayat land with a public dimension can only be done by measuring, mapping, and recording it in the land register. Meanwhile, Ulayat land with private dimensions can be issued a land certificate for individuals with a release mechanism from the customary leader to be used as state land. This legalization resulted in the depreciation of Ulayat land and the fading of customary bonds in Manggarai. This research provides insight into land legalization's legal and social impacts on Manggarai, highlighting significant changes in ownership structures and the loss of customary values.

Abstract

One of the problems in mixed marriages of different nationalities is joint property. Most mixed-married couples do not make property separation agreements because they are unaware that the Marriage Law governs them. The absence of a marriage agreement results in a mix of assets, which means that foreigners own half of the joint property. The provisions in the land law/ UUPA state that foreigners are prohibited from having land rights except for usufructuary rights and rental rights. This study applied the normative legal research method with a statutory and case-based approach. This study showed that if mixed marriage actors did not have a property separation agreement, Indonesian citizens' land rights ownership status was equal to that of the foreigners. Second, jurisprudence still required a separation of properties in mixed marriages. The agreement could be made before, during, or after the marriage. Third, marriage institutions could conduct legal smuggling to obtain land rights in Indonesia through borrowing names (nominees), usually carried out in an unregistered marriage.

Abstract

This study aims to analyze the position of Serat Palilah as the basis for the management and utilization of Sultan Ground land by PT KAI DAOP 6 Yogyakarta, specifically in regulating the Bong Suwung emplacement area, which has long been occupied illegally by the community. This study uses an empirical juridical method, namely by examining applicable legal norms and social facts through interviews and field studies. The results of the study indicate that, although Serat Palilah is not recognized as a legal basis in the national legal system, this document is valid and has legal force in the context of Yogyakarta's special law. This report provides legitimacy for PT KAI to regulate buildings standing in the railway safety zone. However, the regulation process faces obstacles in the form of community resistance due to a lack of legal understanding, economic dependence on the location, and compensation deemed inadequate. The implications of these findings point to the need to strengthen inter-agency coordination, as well as encourage further studies related to Serat Palilah as a basis for long-term land use and the development of fairer compensation and relocation schemes for affected communities.   Penelitian ini bertujuan untuk menganalisis kedudukan Serat Palilah sebagai dasar pengelolaan dan pemanfaatan tanah Sultan Ground oleh PT KAI DAOP 6 Yogyakarta, khususnya dalam penertiban kawasan emplasemen Bong Suwung yang telah lama dihuni secara oleh masyarakat. Penelitian ini menggunakan metode yuridis empiris, yaitu dengan mengkaji norma hukum yang berlaku serta fakta sosial melalui wawancara dan studi lapangan. Hasil penelitian menunjukkan bahwa meskipun Serat Palilah tidak diakui sebagai alas hak dalam sistem hukum nasional, dokumen ini sah dan memiliki kekuatan hukum dalam konteks hukum keistimewaan Yogyakarta. Hal tersebut memberi legitimasi bagi PT KAI untuk menertibkan bangunan yang berdiri di zona keselamatan jalur kereta api. Namun, proses penertiban menghadapi hambatan berupa penolakan warga akibat minimnya pemahaman hukum, ketergantungan ekonomi terhadap lokasi, dan kompensasi yang dianggap tidak layak. Implikasi temuan ini mengarah pada kebutuhan untuk memperkuat koordinasi antar lembaga, serta mendorong kajian lanjutan terkait Serat Palilah sebagai dasar pemanfaatan tanah jangka panjang dan pengembangan skema kompensasi serta relokasi yang lebih adil bagi masyarakat terdampak.

Abstract

The expansion of Domine Eduard Osok (DEO) Airport forced the Kokoda tribe community in Sorong City, West Papua, to relocate to Maibo Village. However, community control over plots of land in the village is unclear because it is an area with former cultivation rights. This study aims to clarify and resolve the issue of control of the Kokoda Tribe community over former HGU areas within the framework of the redistribution of former HGU land belonging to indigenous communities. The study employs a historical method and a qualitative descriptive approach. The research results reveal two distinct perspectives on the treatment and control of the former HGU land in Maibo Village, slated for designation as a land reform object. According to the land office, the land has returned to state land, and according to the local indigenous community, the land has returned to customary land. The land office successfully resolved the land control issue and redistributed the land to the Kokoda Tribe, despite differences in the treatment of former HGU land in Maibo Village. This research concludes that the national land law system still applies partially, especially to areas where there are traditional communities and very strong customary law. Ideally, the state should consider general arrangements to ensure appropriate and mutually beneficial protection for indigenous peoples. Masyarakat adat Suku Kokoda di Kota Sorong, Papua Barat, tergusur ke Kampung Maibo akibat pelebaran Bandara Domine Eduard Osok (DEO). Namun demikian, penguasaan masyarakat atas bidang-bidang tanah di Kampung Maibo hanya sebatas penguasaan fisik dan belum secara yuridis karena merupakan wilayah bekas Hak Guna Usaha (HGU). Studi ini bertujuan untuk memperjelas dan mendudukkan persoalan penguasaan masyarakat Suku Kokoda atas bidang-bidang tanah dalam wilayah bekas HGU. Metode penelitian yang digunakan adalah metode historis dengan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa terdapat dua persepsi terhadap perlakuan penguasaan tanah bekas HGU di Kampung Maibo yang akan ditetapkan sebagai Tanah Objek Reforma Agraria. Menurut kantor pertanahan, tanah tersebut kembali menjadi tanah negara dan menurut masyarakat adat setempat, tanah tersebut kembali menjadi tanah adat. Meskipun terdapat dua perbedaan perlakuan terhadap tanah bekas HGU di Kampung Maibo, namun persoalan penguasaan tanah tersebut mampu diselesaikan oleh kantor pertanahan dan telah diredistribusikan kepada masyarakat Suku Kokoda. Penelitian ini menyimpulkan bahwa sistem hukum tanah nasional masih berlaku parsial, terutama terhadap wilayah-wilayah yang memiliki ikatan masyarakat adat dan hukum adat yang sangat kuat. Idealnya, negara memikirkan pengaturan secara umum agar perlindungan terhadap masyarakat adat dapat diwujudkan secara tepat dan saling menguntungkan.
