Abstract

Abstract: This study will discuss the concept of barambangan  in the Banjar community which is used in resolving conflicts between husbands and wives during a marriage that is almost on the verge of divorce. This research is different from other researchers because it emphasizes the findings about the argumentation of separation by peaceful means or can also unite household disputes by way of reconciliation through tetuha. The research method used is normative with legal material from the 18th century Sultan Adam Law, then observations in society with an anthropological sociological approach to the Banjar community are studied based on the facts of people who were in conflict in the household at the time of their marriage. This study found that conflicts that do not end without divorce according to the Banjar custom, namely barambangan , can be a solution in ending household disputes, through religious leaders (tetuha) to determine legal certainty regarding the status of the husband-wife relationship. The formalization of barambang as a customary institution promises a good balance between legal certainty and benefits.Keywords: barambangan , banjar, conflict, marriageAbstrak: Penelitian ini akan membahas tentang konsep Barambangan di Masyarakat Banjar yang digunakan dalam penyelesaian konflik antara suami dan istri pada masa pernikahan yang sudah hampir pada perceraian. Penelitian ini berbeda dengan peneliti lainnya karena lebih menekankan temuan tentang adanya argumentasi perpisahan dengan cara damai atau dapat juga menyatukan pertikaian rumah tangga dengan cara islah melalui tetuha. Metode penelitian yang digunakan bersifat normative dengan bahan hukum dari Undang-undang Sultan Adam abad ke-18, kemudian pengamatan di masyarakat dengan pendekatan antropologi sosiologi masyarakat Banjar yang diteliti berdasarkan fakta masyarakat yang bertikai dalam rumah tangga pada masa pernikahannya. Penelitian ini menemukan bahwa konflik yang tidak berkesudahan tanpa ada perceraian menurut adat Banjar yaitu Barambangan   dapat menjadi solusi dalam menyudahi pertikaian rumah tangga, melalui pemuka agama (tetuha) untuk menentukan kepastian hukum dari status hubungan suami-istri tersebut. Formalisasi barambangan  sebagai sebuah lembaga adat menjanjikan keseimbangan yang baik antara kepastian hukum dan manfaat.Katakunci: barambangan , Banjar, konflik, pernikahan

Abstract

Cultural negotiation is essential because the process always involves conflict and differences. Malay-Chinese is one of the minority groups in South Kalimantan. This study aims to find out how Malay-Chinese culture negotiates differences in the legal culture of inheritance distribution between Chinese customary law, Malay custom, and Islamic law. This research is empirical legal research conducted under an interdisciplinary umbrella. This type of research is field research or research, empirical law. In this study, the author uses a legal sociology approach or practical juridical approach, which is an approach that looks at the legal reality in society, and a legal anthropological approach. The research findings show that Malay-Chinese negotiates differences in Islamic values and religion by choosing or combining the two cultural values. The negotiation process is carried out by applying cultural values as they are ethnic and adapt to the cultural values of Malay Islam. This cultural negotiation process then builds a hybrid Malay-Chinese identity. Resistance, their hybridity is used to survive and to fight the dominant Malay Islamic cultural values.

Abstract

This article explores the synergy between Samin culture and the concept of environmental fiqh in Central Java. This research employs qualitative methods, including in-depth observations, participatory observations, and documentation studies. This research seeks to provide a deeper insight into how local culture that has interacted with environmental fiqh can stop the plan to establish a cement factory as a pretext for national development. More specifically, this study uses the concepts of culture, ecology, and environmental fiqh to analyze the resistance of the Samin community to the plan to build the cement factory. The research findings show that the synergy of Samin culture with environmental fiqh was able to stop the plan to establish a cement factory on Mount Kendeng, Pati Regency, Central Java. This study offers a new perspective on formulating policies that are more inclusive and sustainable by strengthening the synergy between local culture and environmental fiqh principles.

Abstract

Artikel ini mendeskripsikan tentang pengesahan nikah atas pernikahan yang terjadi dengan wali muhakkam di pengadilan agama. Dalam fikih wali muhakkam diperbolehkan dan memiliki implikasi hukum disahkannya perkawinannya. Namun pengambilalihan pendapat fikih tentang wali muhakkam ini apabila dikaji dengan teori tujuan hukum, maka akan menyebabkan tujuan dari regulasi perundang-undangan tentang perkawinan akan tidak tercapai. Karena dengan pemahaman konvensional fikih wali muhakkam ini, masyarakat mendapatkan celah untuk sesukanya menikah sirri bahkan untuk pernikahan di bawah umur sekalipun. Penelitian ini adalah penelitian kepustakaan (library research) dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum primernya adalah UU Perkawinan, Kompilasi Hukum Islam, dan Putusan Nomor 149/Pdt.P/2022/PA.Bjb. Penelitian ini menemukan bahwa pengesahan nikah atas pernikahan sirri dengan wali muhakkam dikabulkan oleh majelis hakim. Rekonstruksi yang penulis temukan adalah menyatakan bahwa pernikahan dengan wali muhakkam harus dianggap tidak sah dan permohonan atas pengesahan atas pernikahan tersebut patut untuk ditolak.

Abstract

As part of safeguarding human rights, Indonesia has issued regulations on halal products that encourage entrepreneurs to certify their products. To facilitate this effort, the country has implemented several policies. Adopting a human rights perspective, this article aims to elucidate the government's policies on halal products at the regulatory and implementation levels. To attain a more comprehensive understanding, this research employs a legal comparative approach, using Malaysia as a benchmark. The findings of this study indicate that normatively, Indonesia has generated a range of legal instruments serving as the foundation for halal products. These legal instruments are systematically implemented, from the central government down to the grassroots level. However, this implementation encounters challenges such as normative ambiguity and the expansive interpretation of products that require halal certification. This is in contrast to Malaysia, which regulates halal products in a more dynamic and flexible manner.

Abstract

The Covid-19 epidemic has influenced numerous facets of human existence. There are a large number of layoffs which has a negative economic impact on the family. According to data made accessible by the Banjarmasin Religious Court, the divorce rate increased from 13729 cases in 2020 to 1652 cases in 2021. This study intended to identify the contribution to the cause of divorce in Banjarmasin during the Covid-19 pandemic. The method employed was empirical legal research, and the approaches were legal sociology and legal psychology. The results revealed that the covid-19 pandemic has contributed to the rising divorce rate. Economic issues, domestic abuse, and the presence of a third party are the leading causes of divorce. In addition, this study indicated that husbands were victims of domestic violence.

Abstract

The Tionghoa Muslim community is part of the life of the nation and state as a whole, one of the many ethnicities that are the features of the social identity of the archipelago. The history of the development of Islam and Tionghoa in Banjarmasin has an affiliation. This study aims to determine how the distribution of Tionghoa ethnic Muslim heritage in Banjarmasin. The method used is empirical legal research/field research, and the approach used in the sociology of law approach. The results of this study indicate the existence of legal integration. The pattern of behavior in the distribution of inheritance of Tionghoa descendants who are Muslim in Banjarmasin basically contains three main divisions of inheritance, namely through traditional heir deliberation, not dividing the inheritance, and dividing through the provisions of Islamic inheritance law. The use of inheritance law for Tionghoa Muslims in Banjarmasin is not fully subject to Islamic inheritance law, even though the inheritance law that applies to them is Islamic inheritance law. This happens because of the diversity of religions that exist in a family so that they put forward the principles of harmony and kinship so that there are no disputes.

Abstract

The Dayak Community, as an agrarian community, respects and upholds the noble values of their ancestors. This value strongly affects their social and cultural system, including the customs and traditions of inheritance settlement. This research is descriptive-analytic using a phenomenology approach. The aim is to identify the uniqueness of the traditional heritage of the Ngaju Dayak tribe in Palangka Raya through the perspective of acculturation theory of culture and law. The study shows that the acculturation model that occurs in Palangka Raya is an adjustment model, in which the process of adjustment and adaptation of one culture to other cultures occurs without forming a new culture. In addition, this study also finds that the community kinship system influences the application of inheritance law among the Ngaju Dayak indigenous people, Palangka Raya, Central Kalimantan.

Abstract

The practice of wealth transfer beyond the obligatory mahr (dower) in customary marriage represents a complex socio-legal phenomenon, as it holds not only symbolic significance but also directly impacts gender relations, household economic responsibilities, and the perpetuation of social hierarchies. Within the Banjarese community of South Kalimantan, this practice is institutionalized through the tradition of jujuran, which involves the groom’s family transferring money and personal items to the bride before the marriage contract. Originally intended to support wedding expenses, provide initial capital for household establishment, and demonstrate respect toward the bride’s family, this practice frequently evolves into a transactional burden that may delay or even obstruct marriage. This article examines the Islamic legal thought of Muhammad Arsyad al-Banjari regarding balanja al-nikāḥ as articulated in his work Kitāb al-Nikāḥ. Employing library research with a normative-historical approach, the study reveals that Arsyad al-Banjari categorized balanja al-nikāḥ into three financial components: mahr as a religious obligation, and clothing and maintenance as social obligations institutionalized through the jujuran tradition. The groom’s ability to fulfill these components determines the legal status of the marriage: it is considered sunnah (recommended) if fulfilled and makrūh (reprehensible) if not. These findings indicate that Arsyad al-Banjari adopted a strategy of moderate reform by redefining jujuran as a form of gift and solidarity rather than as a prerequisite for the validity of marriage. This approach provides a model for harmonizing Islamic law and custom within the framework of legal pluralism. It offers a normative foundation for reformulating customary marriage practices in a manner that is more equitable, proportional, and consistent with the objectives of Islamic law (maqāṣid al-sharīʿah). [Praktik pemberian harta di luar kewajiban mahar dalam perkawinan adat merupakan fenomena sosio-legal yang kompleks karena tidak hanya bersifat simbolik, tetapi juga membawa implikasi langsung terhadap relasi gender, beban ekonomi keluarga, dan reproduksi hierarki sosial. Dalam masyarakat Banjar di Kalimantan Selatan, praktik ini dilembagakan melalui tradisi jujuran—penyerahan sejumlah uang dan perlengkapan pribadi calon mempelai perempuan oleh pihak laki-laki sebelum akad nikah—yang pada mulanya dimaksudkan untuk membantu biaya resepsi, menyediakan modal awal rumah tangga, serta menjadi simbol kehormatan bagi keluarga perempuan, namun dalam praktik sering berkembang menjadi beban transaksional yang berpotensi menunda bahkan menghalangi perkawinan. Artikel ini menganalisis pemikiran hukum Islam Muhammad Arsyad al-Banjari mengenai balanja al-nikāḥ dalam karyanya yang berjudul Kitāb al-Nikāḥ. Dengan menggunakan metode penelitian kepustakaan dan pendekatan normatif-historis, penelitian ini menemukan bahwa Arsyad al-Banjari mengklasifikasikan balanja al-nikāḥ ke dalam tiga komponen finansial—mahar sebagai kewajiban syariat, serta pakaian dan nafkah sebagai kewajiban sosial yang dilembagakan melalui tradisi jujuran. Kemampuan calon suami memenuhi ketiganya menentukan status hukum perkawinan: sunah bila terpenuhi dan makruh bila tidak. Temuan ini menunjukkan bahwa Arsyad al-Banjari menerapkan strategi reformasi moderat dengan menegaskan jujuran sebagai hibah dan bentuk solidaritas, bukan syarat sah akad nikah, sehingga menghadirkan model harmonisasi antara hukum Islam dan adat dalam kerangka pluralisme hukum serta memberikan dasar normatif bagi reformulasi praktik perkawinan adat yang lebih adil, proporsional, dan sejalan dengan maqāṣid al-sharīʿah.]
