Abstract

Pelayanan publik merupakan tujuan dari negara hukum dalam meciptakan kesejahteraan negara karena dari pelayanan publik perizinan diselenggarakan. Skripsi ini membahas tentang peranan Dinas Penanaman Modal Dan Pelayanan Perizinan Terpadu Satu Pintu dalam pemberian perizinan berusaha di Kota Banjar Patroman. Tujuan penelitian ini untuk menganalisis peranan Dinas Penanaman  Modal  Dan  Pelayanan  Perizinan  Terpadu  Satu  Pintu mengenai pemberian perizinan berusaha melalui sistem OSS, maupun kendala yang dihadapi dalam perizinan berusaha melalui sistem OSS. Jenis penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan analisis. Data yang digunakan adalah data sekunder yang berupa peraturan perundang-undangan, dan buku-buku literatur. Berdasarkan hasil penelitian dan pembahasan dapat ditarik kesimpulan peranan dinas sebagai penyelenggara pelayanan perizinan berusaha berada di bidang administrasi dalam pemenuhan komitmen izin sampai nanti saat izin usaha yang diterbitkan tersebut berlaku efektif. Pelaku usaha yang melakukan permohonan perizinan dihadapkan dengan kendala pada pemenuhan komitmen izin.Kata Kunci: Peranan, Dinas, Perizinan, Sistem, OSS

Abstract

Discussions related to the implementation of Corporate Social Responsibility (CSR) programs are often not accompanied by the impact produced, this often makes the implementation of CSR only limited to charity activities without having an impact on the community in a sustainable manner. The empowerment-based CSR approach model is one of the options in the implementation of programs that are considered to be able to increase the role of the community and make it a subject and not just an object. This research is a qualitative research by taking primary data through observation and interview activities, while secondary data is sourced from supporting documents found in the field. Using an environmental ecology approach, this study looks not only at natural phenomena, but also investigates how human activities can affect the balance of ecosystems and the quality of the environment. The results of this study show that the CSR program has had an impact on 4 main dimensions, namely: the natural dimension, the economic dimension, the social dimension and the wellbeing dimension.

Abstract

The appointment of active TNI (Indonesian National Armed Forces) officers to civilian positions has sparked controversy within Indonesia’s legal and democratic framework. The 1998 Reform Movement emphasized the restriction of military involvement in civilian governance, as stipulated in Law Number 34 of 2004 concerning the TNI. However, legal loopholes allow active-duty officers to occupy civilian posts under certain conditions, as reflected in the appointment of the Cabinet Secretary pursuant to Presidential Regulation Number 148 of 2024. This study analyzes the policy from a legal-political perspective by examining regulatory inconsistencies and the implications for civilian supremacy. The research employs a normative juridical method with political, statutory, and conceptual approaches. The findings indicate that the appointment of active-duty military personnel to civilian positions lacks clear urgency and contradicts the principle of civilian supremacy in a democratic system. Furthermore, this policy reflects a tug-of-war between political stability and the interests of ruling elites, potentially hindering military reform and creating regulatory overlaps. Therefore, clearer and more consistent regulations are needed to maintain the balance between national interests and civilian supremacy within Indonesia’s legal system.

Abstract

The regulation of Industrial affair between women labour with company or entrepreneur, contain in Law Number 13 Year 2003 concerning Labour, and the regulation that protect women labour contain in Law Number 7 Year 1984 concerning Convention Of The Elimination Of All Forms Of Discrimation Against Women. But in the reality, there are many problems in the labour environment. Especially, if it concerning the unfairness of gender for the women, like the case in PT. DIDACHI, Tangerang.  In this research, revealed about the entrepreneur policy that not only againts the regulation, but also in gender perspective they do the unfairness of gender in the term of behavior and policy. The labeling and the wrong interpretation about gender cause many policy that make the unfairness condition for the women labour in PT. DIDACHI, Tangerang. Kata kunci: Gender, interpretation of gender, unfairness of gender, women labour,  entrepreneur, company.

Abstract

Criminal Code (KUHP) is a legacy of the Dutch colonial era. Its substance and principles are still influenced by individualistic and colonialist views that are not in line with the ideological values of the Indonesian nation. With the enactment of Law Number 1 of 2023 concerning the Criminal Code, Indonesia seeks to reform its criminal law system to be more in line with social, cultural values, and current and future societal conditions. This study aims to analyze the differences or disparities in criminal sanctions between the old Criminal Code and Law Number 1 of 2023 concerning the Criminal Code. The method used is normative legal research, namely by examining the provisions of sanctions in both regulations in depth and systematically. The results of the study indicate that criminal sanctions and actions in the National Criminal Code for their imposition on perpetrators must pay attention to the provisions of 1) the purpose of punishment (Article 51-Article 52); 2) guidelines for punishment (Article 53-Article 56); 3) guidelines for the application of imprisonment with a single formulation and alternative formulation (Article 57); 4) aggravation of the sentence (Article 58-Article 59); 5) other provisions regarding sentencing (Article 60-Article 63). This is quite different from the use of types of criminal sanctions in the Criminal Code, which does not recognize these five important things to pay attention to because they are not regulated in the Criminal Code. The purpose of sentencing is one important aspect that forms the basis for analyzing the provisions of the main criminal sanctions in both regulations.
