Abstract

Notary is an official authorized to make an authentic deed in accordance with the provisions of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Position of Notary (UUJNP). In carrying out his duties, the notary must uphold the moral values ​​and professional ethics and must obey the applicable law so as not to make mistakes which will carry risks for the notary himself and cause harm to the community. Risks arising from negligence for the notary public in their duties are in the form of enforcement of sanctions both civil sanctions, criminal sanctions and administrative sanctions. This study analyzes criminal enforcement of notaries, as well as norm conflicts that arise between criminal decisions by judges against notaries and the applicable laws. The aims of this study is to find out the enforcement and sanctions against notaries in the realm of criminal law and notary office law based on case study of decision number 196 / pid.b / 2019 / pn Denpasar), and to determine the form of legal protection against notaries. This study uses the normative juridical method. The results of this study revealed that there are two elements in law enforcement and protection of notaries, namely preventive and repressive. Preventive in the form of supervision of notary practices and repressively is the imposition of sanctions. The form of legal protection for notaries is carried out by the Notary Supervisory Board and the Notary Honorary Council.

Abstract

Abstrak Tujuan dari penelitian ini adalah untuk mengetahui Kewenangan Pengurus/Kuratordan Prosedur Penundaan Kewajiban Pembayaran Utang (PKPU)/ Kepailitan PT. Rendamas Realty dan Jane Christina Tjandra di Pengadilan Niaga pada Pengadilan Negeri Surabaya. Jenis penelitian yang dipergunakan adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Hasil yang diperoleh adalah Kewenangan Pengurus dalamPenundaan Kewajiban Pembayaran Utang (PKPU) PT. Rendamas Realty dan Jane Christina Tjandra di Pengadilan Niaga pada Pengadilan Negeri Surabaya adalah mengumumkan Putusan, menyelenggarakan Rapat-rapat,menerima dan menyiapkan Daftar Tagihan Kreditor,menyiapkan Rencana Perdamaian,menyiapkan Daftar Voting dan membuat Laporan.Prosedur Penundaan Kewajiban Pembayaran Utang diawali dengan adanya Permohonan yang diajukan oleh Debitor atau oleh Kreditor. Permohonan tersebut harus dikabulkan oleh Pengadilan dengan menerbitkan Putusan yang berisi Penundaan Kewajiban Pembayaran Utang Sementara (PKPUS) paling lama 45 hari dan dapat diperpanjang dengan menerbitkan Putusan Penundaan Kewajiban Pembayaran Utang Tetap (PKPUT) paling lama 270 hari. Putusan PKPU harus menunjuk Hakim Pengawas dari hakim pengadilan serta mengangkat 1 (satu) atau lebih Pengurus yang bersama dengan Debitor mengurus harta Debitor. Kata kunci: Kepailitan, Kurator, Debitor, Kreditor Abstract The purpose of the research is to know the authority of administrator and the prosedures of rescheduling debt payment/ bankruptcyPT. Rendamas Realty dan Jane Christina Tjandra at Surabaya Comercial Court. The type of research is normative law research with statute approach and case approach. The result is The Administrator/Receiver have authority to announced court statement, organizing meetings, receive registration, prepare the creditor bill list, preparing settelmen plan, prepare a voting list and make a report. The procedures of rescheduling debt payment begins with an application filed by a debtor or creditor. The application must be granted by the court by issuing a statement for 45 days and can be extended up to 270 days. Keywords: Bankrupcy, Receiver, Debtor, Creditor

Abstract

This study focuses on the application of Corporate Social Responsibility (referred in CSR) in Bank Perkreditan Rakyat (BPR), in Badung Regency. This BPR is expected to be able to prosper the surrounding community and carry out the mandate of PERDA Badung Regency No. 6 of 2013 concerning Corporate Social Responsibility. This research has two problem formulations, namely how is the arrangement of CSR in the BPR annual activity plan in Badung Regency and how is the implementation of the annual activity plan governing CSR in the BPR in Badung Regency. The method used is the empirical research method. This research is directly looking for data to the field. The results of the study show that corporate social responsibility is a company's commitment in improving the community's economy which is beneficial to the company and the general public. The regulation of corporate social responsibility at BPRs in Badung Regency, namely Law No. 40/2007 concerning Limited Liability Companies, PP No. 47/2012, and Badung Regency Regulation No. 6/2013. In the implementation of CSR in BPR in Badung Regency, it has been running well as in terms of education, scholarships for outstanding students and introduction of banking products to the local community.

Abstract

Prostitution activities that occur in society are not only caused by pimps and sex peddlers, but are also closely related to users of prostitution services. The absence of regulations that can ensnare perpetrators of prostitution practices, especially users of prostitution services, shows the government's inconsistency in combating prostitution practices. There are two problems in this study, namely, first, how is the regulation of punishment for perpetrators of criminal acts of prostitution in Indonesian positive law and second, how is the imposition of criminal sanctions against perpetrators of criminal acts of prostitution, especially users of prostitution services through complaint offenses in the Criminal Code. This study uses normative research conducted through an assessment of the legislation and legal concepts. The approach in this study uses a legal concept approach, and a statutory approach. Based on various explanations of articles in Indonesian positive law, it is not at all clear and implicit that there are articles that regulate criminal sanctions against users of prostitution services. With the absence of legal norms related to criminal sanctions for users of prostitution services, other legal remedies can be taken to ensnare users of prostitution services through the application of a complaint offense with the alleged crime of adultery as regulated in Article 284 of the Criminal Code.

Abstract

The relationship between lawyers and clients that arises as a result of the legal relationship that is established often leads to legal disputes. The dispute can result in losses for both parties, while this legal arrangement regarding the issue has not fully accommodated the needs of advocates and clients. The purpose of this study is to analyze the rights and obligations of advocates and clients and dispute resolution that can be taken by advocates and clients. This type of research is a normative legal research, using a statutory approach. The results of this study indicate that the regulation regarding the rights and obligations of advocates is regulated in Law Number 18 of 2003 concerning Advocates and the code of ethics for advocates. Meanwhile, the rights and obligations of clients, as a broader understanding of consumers, are regulated in the Law on Advocates and the Civil Code. If there is a dispute due to a legal relationship that arises between an advocate and a client, the legal settlement can be through the Advocate Code of Ethics Body, the General Court of Justice and Arbitration, Mediation and other alternative dispute resolutions.

Abstract

Corruption is an extraordinary crime whose eradication must be carried out in an extraordinary manner according to the procedures for returning and recovering state losses due to corruption. This study aims to analyze how the process of carrying out recovery and refund of state losses by prosecutors in corruption crimes and discusses efforts to recover and recover state losses due to corruption. The method used is normative legal research. This research approach is a conceptual and literature approach, with the primary legal sources coming from legislation and decisions, while the secondary legal sources come from legal journals and law books. Data collection is done by collecting data and summarizing. The result of the procedure for returning and recovering state losses due to corruption is in accordance with the procedures, namely the corruption eradication law and other regulations. Efforts to recover and recover state losses due to corruption by maximizing the return of state losses by confiscation, tracing the assets of the convict, the authority of the KPK Prosecutor must be regulated firmly and clearly. Researchers suggest that the government should provide adequate facilities and infrastructure for the Prosecutor's Office and the KPK in order to maximize the eradication of corruption.

Abstract

Penerapan Good Corporate Governance menjadi tugas dan kewajiban direksi atas pengurusan perseroan Bank. Penelitian ini bertujuan untuk mengetahui dan memahami dampak penerapan Good Corporate Governance serta tanggung jawab sebagai direksi Bank Perkreditan Rakyat. Manfaat penelitian ini untuk menambah pengetahuan mengenai penerapan Good Corporte Governance. Penelitian ini menggunakan penelitian hukum empiris. Berdasarkan hasil penelitian yang diperoleh: Penerapan Good Corporate Governance berdampak besar bagi kesehatan bank, dilihat dari angka persentase Non Performing Loan yang menjadi penilaian bank dan direksi bertanggung jawab penuh dalam melaksanakan tugasnya sesuai dengan peraturan internal bank. Dapat ditarik kesimpulan, dampak penerapan Good Corporate Governance dilihat dari perbedaan persentase Non Perfoming Loan pada masing-masing bank dan direksi bertanggung jawab dengan mendasarkan pada peraturan internal bank. Saran yang disampaikan: perlu dilakukan pengawasan rutin dan lebih memperhatikan prinsip Good Corporate Governance.

Abstract

Pengaruh budaya luar negeri dalam pergaulan di Indonesia telah menimbulkan berbagai permasalahan, seperti hubungan di luar perkawinan, yang pada akhirnya menyebabkan lahirnya anak-anak yang tidak sah di mata hukum negara. Rumusan masalah yang dapat diajukan adalah: bagaimana kedudukan hukum anak yang lahir di luar perkawinan sah menurut Undang-Undang Nomor 1 Tahun 1974? Dan bagaimana upaya pemenuhan hak keperdataan anak yang dilahirkan di luar perkawinan? Penelitian ini dilakukan dengan menggunakan tipe penelitian normatif. Pengaturan hukum terkait kedudukan anak di luar perkawinan terdapat dalam pasal 42 dan 43 Undang-Undang Perkawinan Nomor 1 Tahun 1974, serta UU Nomor 35 Tahun 2014 tentang Perubahan atas UU Nomor 23 Tahun 2002 tentang Perlindungan Anak. Anak yang lahir di luar perkawinan tidak memiliki status yang tercatat atau dianggap tidak memiliki kejelasan karena berasal dari hubungan yang tidak jelas, sehingga upaya pemenuhan hak keperdataan anak sulit untuk terpenuhi. Pemerintah sebaiknya melakukan sosialisasi tentang perkawinan dan dampak negatif dari hubungan di luar perkawinan.

Abstract

Dalam suatu negara pastinya terdapat perseberan penduduk yang datang dari berbagai daerah dengan maksud untuk mencari tempat tinggal maupun pekerjaan. Dalam konteks ini peran imigrasi sangat mempunyai peran yang sangat vital dalam mengatur serta mengurus legalitas tinggal pada suatu daerah ataupun kawasan. Berdasarkan latar belakang maka timbullah beberapa rumusan masalah antara lain: Apa yang menjadi dasar pertimbangan Surat Edaran Nomor IMI-0702.GR.01.01 Tentang Kebijakan Keimigrasian Untuk Menyederhanakan Birokrasi, Mempermudah dan Mempercepat Layanan Izin Tinggal Guna Mendukung Kebijakan Peningkatan Investasi Asing Ke Dalam Negeri tersebut diterapkan? dan bagaimana keabsahan Surat Edaran dimaksud?. Sehingga maksud tujuan dilakukannya penelitian ini yaitu untuk mengetahui dasar pertimbangan sehingga surat edaran dimaksud diberlakukan dan untuk mengetahui bagaimana keabsahan surat edaran dimaksud. Metode penelitian yang digunakan adalah metode hukum normatif. Dengan bentuk penelitian hukum secara normatif dengan konseptual dan undang-undang secara Analisa hukum. Hasil survei mengindikasikan Dasar pertimbangan surat edaran dimaksud didasari atas tindak lanjut atas instruksi Presiden Republik Indonesia.

Abstract

Tourism is a source of local revenue and its investment is a potentially vital production factor in the service production business in this field. To support tourism accommodation in the tourist area of ​​Badung Regency, guest houses (boarding houses/rented houses) and villas are needed as support. Especially in Badung Regency, in the Canggu area, many houses are used as guest houses for guests who want to stay in Bali. This study aims to determine the supervision of Guest Houses and Villas in Badung Regency, and to determine the application of sanctions against guest houses and villas that violate permits in Badung Regency. The method in this research is a type of normative legal research which is carried out with the method of recording and reviewing based on legal materials. In this study, studying and gathering information through legal science books without deviating from positive law in order to form a conclusion. The research results show that the supervision of Guest Houses and Villas in Badung Regency is given the authority by the Regional Regulation through the Civil Service Police Unit which is assigned to monitor every building that does not have a permit in the Badung Regency area, especially in the Canggu area. Then, sanctions against violators are in the form of warnings 3 times, if they do not disobey the villa owner, they will be subject to forced demolition by officers.
