Abstract

Indonesia's natural resources are very useful to meet the needs of their people, one of the most important needs is land. But land often causes disputes among the people, a fair settlement, in accordance with the applicable administration is highly expected. The formulation of the problem in this study is how the absolute competence of the State Administrative Court and General Courts related to the tangent point in land disputes and how to consider the Denpasar State Administrative Court Judges in dropping the Decision regarding the tangency point of authority of the State Administrative Court and District Court case study No. verdict 27 / G / 2017 / PTUN.DPS. This study uses normative legal research, StatuteApproach, Conceptual Approach and case approach. The State Administrative Court and the General Court (Civil) have competencies that intersect in land disputes. To certify land that has something to do with customary land in Bali as well as village land (AYDS), it is regulated at the Provincial Government of Bali number: 3 of 2011 concerning Pakramman village. Which in order to be able to certify a land of Ayahan Desa (AYDS) that the community wants to ask for has not been permitted, this is done so that Adat and Balinese culture remain steady and sustainable. The customary land in Bali is inseparable from the obligation to pay for or give services to the village, therefore for village karma it is prohibited to trade and buy it. Sumber daya alam Indonesia sangat bermanfaat untuk memenuhi kebutuhan hidup masyarakatnya salah satu kebutuhan yang sangat penting adalah tanah. Namun tanah sering menimbulkan sengketa di kalangan masyarakat, penyelesaian yang adil, sesuai dengan administrasi yang berlaku sangat diharapkan. Rumusan masalah dalam penelitian ini bagaimana kompetensi absolut Peradilan Tata Usaha Negara dan Peradilan Umum terkait titik singgung dalam sengketa pertanahan dan Bagaimana pertimbangan Hakim Pengadilan Tata Usaha Negara Denpasar dalam menjatuhkan Putusan terkait titik singgung kewenangan Pengadilan Tata Usaha Negara dan Pengadilan Negeri studi kasus putusan nomor 27/G/2017/PTUN.DPS. Penelitian ini menggunakan penelitian hukum normatif, pendekatan Per Undang-Undangan, Pendekatan Konseptual dan pendekatan kasus. Pengadilan Tata Usaha Negara dan Pengadilan Umum (Perdata) mempunyai kompetensi yang bersinggungan dalam sengketa pertanahan. Untuk mensertifikatkan tanah yang ada kaitannya dengan tanah adat di Bali seperti halnya tanah ayahan desa (AYDS) di atur pada Perda Prov bali nomor: 3 Tahun 2011 tentang desa pakraman dimana untuk dapat mensertifikatkan suatu tanah Ayahan Desa (AYDS) yang ingin dimohonkan oleh masyarakat sebelum di perijinkan maka dalam hal ini dilakukan supaya Adat dan budaya Bali tetap ajeg dan lestari. Tanah adat yang ada di bali tak terlepas dari kewajiban-kewajiban untuk ngayah atau memberi ayahan kepada desa, oleh karena itu bagi krama desa dilarang untuk memperjual belikannya.

Abstract

The company is a place where it aims to improve the lives of the people. In its development in the economic and business sectors the role of the company in terms of improving the country's economy is a responsibility of each company, in this case it is called corporate social responsibility (CSR). In this study, focusing on the implementation of CSR in BPR in Badung Regency, where the BPR is expected to be able to prosper the surrounding community and carry out the mandate of the PERDA of Badung Regency No. 6 of 2013 concerning Corporate Social Responsibility. This research was analyze the regulation of social responsibility (CSR) in the annual and the implementation of the annual activity plan that regulates social responsibility (CSR) in rural banks in Badung Regency. The method used is empirical research method, which is research directly in the field. The results of this are social responsibility is the company's commitment to improving the economy of the community that benefits the company and the general public, where the regulation of corporate social responsibility in BPR in Badung Regency is Law No. 40 of 2007 concerning Limited Liability Companies, PP No. 47 of 2012, and Badung District Regulation No. 6 of 2013. In its implementation social responsibility (CSR) in BPR in Badung Regency has been running well as in terms of education providing scholarships to outstanding students and the introduction of banking products to the local community. Perusahaan merupakan suatu wadah yang bertujuan besar untuk meningkatkan taraf kehidupan masyarakat. Dalam pengembangannya pada sektor ekonomi dan bisnis peran perusahaan dalam hal meningkatkan perekonomian Negara merupakan suatu tanggung jawab dari setiap perusahaan, dalam hal ini disebut tanggung jawab sosial perusahaan (CSR). Dalam penelitian ini memfokuskan penerapan CSR pada BPR di Kabupaten Badung yang mana BPR ini diharapkan mampu mensejahterakan masyarakat sekitar dan menjalankan amanat PERDA Kabupaten Badung No 6 Tahun 2013 tentang Tanggung Jawab Sosial Perusahaan. Penelitian ini menganalisis tentang pengaturan tangung jawab sosial (CSR) pada rencana kegiatan tahunan dan pelaksanaan rencana kegiatan tahunan yang mengatur tanggung jawab sosial (CSR) pada BPR di Kabupaten Badung. Metode yang digunakan yaitu metode penelitian empiris, yang mana penelitian secara langsung kelapangan. Hasil dari ini yaitu tanggung jawab sosial merupakan komitmen perusahaan dalam meningkatkan perekonomian masyarakat yang bermanfaat bagi perusahaan dan masyarakat umum yang dimana pengaturan tanggung jawab sosial perusahaan pada BPR di Kabupaten Badung yaitu UU No 40 Tahun 2007 Tentang Perseroan Terbatas, PP No 47 Tahun 2012, dan Peraturan Daerah Kabupaten Badung No 6 Tahun 2013. Dalam pelaksanaannya tanggung jawab sosial (CSR) pada BPR di Kabupaten Badung sudah berjalan baik seperti dalam hal pendidikan pemberian beasiswa kepada siswa/siswi yang berprestasi dan pengenalan produk perbankan kepada masyarakat setempat.

Abstract

Crimes against property are a crime blackmail either accompanied by violence or otherwise accompanied by violence. In this case the crime of extortion is the most frequent crimes committed by some people in carrying out the intentions and deeds for the sake of their interests. So that law enforcers are mainly public prosecutors need to prevent any legal process and need the right applied in criminal acts of extortion in order to give a deterrent effect as well as give rise to legal protection of the community. Problems in the writing of this legal arrangement, namely the Prosecutor in conducting the prosecution of criminal acts of extortion and threatening as well as the procedure of making the demands of the public prosecutor in making demands about the criminal acts of extortion and threatening. Research methods used in this thesis are the normative legal research in assessment based on legal materials and literature is a process to find the rule threatening of law, legal principles or doctrine law in order to answer the legal issues at hand. Approach to the problem of use, i.e. approach legislation and the approach to the case. In this research it can be concluded that based on the law No. 16-year 2004 about the Prosecutor's Office of the Republic of Indonesia is the country that is implementing the power of the State, especially in the field of prosecution and in the field criminal set duties and authorities of the Attorney as specified in article 30. Associated with cases of extortion and threatening relic in Gianyar District Court, Prosecutor in making demands under article 368 of the book the laws of criminal law. Kejahatan terhadap harta kekayaan adalah kejahatan pemerasan baik yang disertai dengan kekerasan ataupun tidak disertai dengan kekerasan. Dalam hal ini kejahatan pemerasan merupakan kejahatan yang paling sering dilakukan oleh sebagian orang dalam melaksanakan niat dan perbuatan demi kepentingannya. Sehingga para penegak hukum terutama jaksa penuntut umum perlu mencegah dan perlu memproses hukum apa yang tepat diterapkan dalam tindak pidana pemerasan guna memberikan efek jera serta menimbulkan perlindungan hukum terhadap masyarakat. Permasalahan dalam penulisan ini yaitu pengaturan hukum jaksa penuntut umum dalam melakukan penuntutan tindak pidana pemerasan dan pengancaman serta prosedur pembuatan tuntutan jaksa penuntut umum dalam membuat tuntutan perihal tindak pidana pemerasan dan pengancaman. Metode penelitian yang digunakan dalam skripsi ini adalah penelitian hukum normatif yaitu dalam pengkajianya berdasarkan bahan-bahan hukum dan literatur yang merupakan suatu pelaksaan untuk menemukansuatu aturan hukum maupun prinsip-prinsip hukum yang nantinya dapat menjawab permasalahan hukum yang dihadapi. Pendekatan yang digunakan penulis yaitu pendekatan perundang-undangan dan pendekatan kasus. Dalam penelitian ini dapat disimpulkan bahwa berdasarkan Undang-Undang kejaksaan Republik Indonesia no. 16 tahun 2004 merupakan Lembaga Negara yang melaksanakan kekuasaan Negara, khususnya dibidang penuntutan dan dalam bidang pidana mengatur tugas dan wewenang kejaksaan sebagaimana ditentukan dalam pasal 30. Terkait dengan kasus pemerasan dan pengancaman diwilayah Pengadilan Negeri Gianyar, jaksa dalam membuat tuntutan berdasarkan pasal 368 Kitab Undang-Undang Hukum Pidana.

Abstract

Pre prosecution is the authority of the public prosecutor to examine and study investigation and interrogation report before the investigation assigned to the Court. The police act as investigators while the prosecutor's office is a public prosecutor, because the Criminal Code Procedure provides different authority. As a result of differences in authority, investigation and interrogation report made by investigators must be examined first before being delegated to the trial. This research is about: (1) how is the authority of the police and prosecutors in the pre-prosecution stage? (2) What is the procedure for the settlement of criminal investigation and interrogation report in pre-prosecution stage at the Denpasar District Prosecutor's Office? This study uses normative legal research methods with sources of primary, secondary and tertiary legal materials. The results of this study can be concluded (1) the authority of the police in the pre-prosecution stage is to conduct an investigation and make a case file. The authority of the prosecutor's office in the pre-prosecution process only checks and examines case files whether the case files made by the investigator have met the terms and conditions of the Criminal Procedure Code. (2) The procedure for settling this case file is carried out by receiving a notification letter on the start of investigation, the appointment of a public prosecutor, research of case files by prosecutors, prosecution, delegation of suspects and evidence, additional inspection by the prosecutor general, transfer of case files, suspects and evidence to court.

Abstract

Abstract—Crime is an act or series of acts that can be subject to criminal law. One form of crime is persecution. Persecution is a form of harming or torturing people or intentionally reducing and damaging the health of others. The main problem is how the application of sanctions for criminal acts of abuse by public prosecutors and how the judges consider in the case of criminal acts of abuse. The research method used in writing this thesis is a type of normative legal research. Whereas the approach uses the conceptual approach, the legal approach and the case approach. The application of criminal sanctions for maltreatment by public prosecutors refers to article 351 paragraphs (1) of the Criminal Code which has been adjusted to article 3 of the Supreme Court Regulation of the Republic of Indonesia No.2 of 2012 concerning adjustments to the limits of minor criminal offenses and the amount of fines in KHUP. Whereas the judge considers each indictment from the public prosecutor, the defendant has fulfilled a single indictment and is based on the process of examining evidence, namely testimony of witnesses, letters, statements of the defendant, instructions, and evidence. In the trial the facts that ordinary crimes had been committed were proven. Thus the Panel of Judges ruled with a sentence of 4 (four) months imprisonment.

Abstract

Suspension of debt payment obligation institutions (hereinafter abbreviated as PKPU) and Bankruptcy Institutions are two complementary institutions in an effort to regulate debt payments. These two institutions can be used by debtors who have difficulty paying their debts. In addition to being able to be used by debtors, these institutions can also be used by creditors, and agencies that are authorized by law act for and on behalf of creditors. One of the cases resolved with the PKPU process that was filed without the application for a bankruptcy statement submitted by the creditor was the case of Decision No. 03 / PKPU / 2010 / PN.Niaga.Sby PT. Nikki Puri. The formulation of the problem raised in this study is; (1) what is the procedure for requesting a delay in the obligation to pay debt to a limited liability company? And (2) what are the legal consequences of the decision to postpone debt repayment obligations? This study is a normative study with a legal, conceptual and case approach. Based on the results of the study it can be concluded that 1) The procedure for submitting a PKPU application can be carried out after the application for a bankrupt statement and without a request for a bankrupt statement, by completing formal and substantial requirements 2) The legal effect of the PKPU decision on the legal status of the debtor is the limitation in taking action on his assets, to creditors, namely the position of preferred creditors and separatist creditors to be the same as concurrent creditors, especially in carrying out collateral execution and debt collection.

Abstract

Tujuan penelitian ini yaitu untuk mengetahui identitas sebuah negara merupakan suatu tandapengenal bagi setiap negara untuk dapat mengenal serta membedakan suatu negara dengan negaralainya. Sepertihalnya di Indonesia salah satu identitas nasionalya yakni bendera merah putih. Seluruh masyarakat sudahseharusnya menjaga serta menghormati keberadaan bendera merah putih ini, akan tetepai pada beberapa aksimasyarakat kerap kali terjadinya penodaan terhadap bendera merah putih. Rumusan maslah yang ingin di bahassesuai dengan tujuan di atas yakni bagaimanakah pengawasan terhadap bendera merah putih sebagai lambangNegara dan bagaimanakah sanksi terhadap penodaan bendera merah putih sebagai lambang Negara?. Metodeyang digunakan ialah penelitian hukum normatif. Belum ada badan penegakan hukum yang secara resmi yangperuntukan pada tindak penodaan bendera merah putih, penegakan hukum dalam hal ini bisa dilakukan secarapreventif yaitu dilakukan dengan cara pengawasan serta penegakan hukum, sedangkan secara refresif dapatdilakukan dengan penerapan saknksi terhadap pelakau penodaan bendera.
