Abstract

The implementation of CSR can reflect the good or bad image of a company itself, if CSR can be implemented well and in accordance with procedures then this can provide benefits for the company, not only the company, but also for the government, and can improve the welfare of the surrounding community. Company. The concept of CSR itself means that an organization is not only concerned with itself but also pays attention to the rights of the people in its environment. In its implementation, it is necessary to know how a company carries out its responsibilities in implementing CSR in order to improve the welfare of the community, as well as what obstacles the company experiences in implementing CSR. This research uses normative or doctrinal research methods, the data used is primary data obtained from statutory regulations, and secondary data obtained from books, articles related to the research object, as well as tertiary data obtained from the Law Dictionary, Indonesian Dictionary, Encyclopedia, and so on. The data collection uses library research.

Abstract

Road Users are those who have the right to use and get guaranteed order on the road. In addition, road users are also specified with pedestrians and motorcycle users. In this case, the use of public facilities or road sidewalks that become places for pedestrians, as regulated in Article 19 C of Regional Regulation Number 8 of 2015 concerning the Implementation of Roads and Transportation. In the Bangkalan area there are many violations, one of which is PT. Telkomsel, however, how about the procedures regarding marinating that can be done to use sidewalks has not been further regulated, and the application of sanctions for those who violate the provisions of the law is not clearly regulated.

Abstract

Problems regarding the status of Village-Owned Enterprises (often called BUMDes) which were originally business entities changed to legal entities after the enactment of the Job Creation Law, but in fact there are still many BUMDes that have not been registered as legal entities due to a lack of knowledge from the village government itself or there is no desire to do so. BUMDes is a legal entity. The aim of this research was to analyze problems regarding BUMDes regulations which state they are legal entities and the legal consequences if BUMDes is not registered as a legal entity. The method used in this research is normative juridical, using a statutory and conceptual approach.

Abstract

In running a company, you need principles that make a company good and run according to the rules. This research is in the form of an analysis of the application of Good Corporate Governance (GCG) principles at PT. Sari Amerta Utama Denpasar and providing solutions to PT. Sari Amerta Utama Denpasar so as not to violate GCG principles and applicable laws. The results of this research indicate that PT. Sari Amerta Utama Denpasar has violated GCG principles which have been carried out by Shareholders, Directors and Board of Commissioners. In this way, researchers provide a solution in the form of understanding the human resources at PT. Sari Amerta Utama Denpasar, evaluates the company's SOPs or policies, and carries out evaluation activities on the duties, principals and functions of each company organ.

Abstract

In a Limited Liability Company, share ownership can be owned by shareholders whose names are registered in the shareholder register. Over time, shares can also be owned by people specifically appointed to act on behalf of the person who appointed them or the Beneficial Owner. According to Presidential Decree Number 13 of 2018, beneficial owners can participate in the management or not participate in the management, so this position is often used as the right position to gain profits from the Company without participating in the management of the Company, so many people use this position to hold multiple positions. One of them is Setya Novanto, who also serves as Chairman of the DPR, who committed e-KTP corruption, in which case there are no regulations regarding holding the DPR's dual position as a Beneficial Owner. The research method used is a normative research method. The approach method used in this research is the statutory approach and the case approach. The absence of these regulations could worsen the possibility of the Company becoming a money laundering medium.

Abstract

This research analyzes the principle of volunteerism in the context of implementing Corporate Social Responsibility (CSR) by companies that are subject to the Limited Liability Company Law. The main objective of the research is to explore the concept of the Voluntary Principle and understand its relevance in the context of corporate social responsibility, with special emphasis on Article 74 of the Limited Liability Company Law as the legal basis for CSR. This research uses normative juridical legal research methods with a statutory regulatory approach. Research findings show that the implementation of CSR in Indonesia, as mandated by Article 74 of Law Number 40 of 2007, creates a contradiction between legal obligations and the Voluntary Principles contained in CSR which was originally interpreted as voluntary corporate charity. However, as time goes by, where companies primarily operating in the Natural Resources sector have contributed to serious damage to the environment, now the Voluntary Principle can be interpreted as company compliance with regulations while making voluntary efforts to exceed existing legal limits. Conclusion of the research illustrates that good integration between Voluntary Principles and legal obligations can create a solid foundation for CSR implementation. Even though CSR obligations are mandatory, companies still have the freedom to determine programs and budgets according to their respective volunteers and abilities. A holistic and sustainable CSR strategy can have a greater positive impact than simply complying with regulations.

Abstract

Deficit funding for the State Revenue and Expenditure Budget (APBN) is an important challenge for the government in maintaining fiscal stability and supporting development policies. In order to find an effective funding alternative, the issuance of state bonds has become an option. This study aims to analyze the position of issuing state bonds as an alternative to funding the state budget deficit. This study uses a descriptive-analytical approach by collecting data from various related sources. The analysis was carried out through a literature review, data from the Indonesian Ministry of Finance, and regulations regarding the issuance of Government Bonds. The results of the study show that the issuance of state bonds has several benefits as an alternative to financing the state budget deficit, namely diversifying government funding sources, reducing dependence on tax revenues and other income, providing flexibility in the schedule of interest and principal payments, in accordance with the government's financial capacity, attracting investor participation. institutional and retail, increasing financial market liquidity. APBN Deficit Funding is dominated by State Bonds, which of course the issuance of state bonds as an instrument for funding the APBN deficit makes fiscal space narrow. When the space for fiscal movement becomes limited, it means that the government faces limitations in collecting revenue or in managing government spending.

Abstract

The development of digital technology has had a significant impact on the use of demand deposits in the trading business. This discussion aims to analyze the effect of the application of digital technology on the use of demand deposits in the retail industry. Several retail companies are still facing challenges related to technological infrastructure and the availability of reliable internet access. In order to optimize the use of demand deposits in the trading business with the adoption of digital technology, retail companies need to involve employees in training and developing technology skills. Attention to data protection and customer privacy is also required and the development of strategies to promote consumer acceptance of digital payment methods.

Abstract

Counterfeiting of securities is a serious illegal act with the potential for significant legal consequences. The author provides an in-depth review of the criminal law aspects associated with counterfeiting securities. The aim of this research was to analyze and understand the legal framework governing counterfeiting of securities, including the criminal considerations and sanctions applied. This study also explains the concept of counterfeiting securities and how this action violates applicable law. In addition, this study also discusses the elements that must be present in an act of counterfeiting securities such as intentionality and the intention to make a profit. Furthermore, this study also analyzes the penalties and sanctions that can be applied to perpetrators of counterfeiting securities. In conclusion, this study emphasizes the importance of effective law enforcement in dealing with counterfeit securities. Perpetrators of counterfeiting securities must be held responsible for the actions that have been taken and be faced with sanctions in accordance with applicable criminal law.

Abstract

Bankruptcy occurs when a debtor is unable to pay his debts to creditors. Countries can also experience financial difficulties leading to bankruptcy. The purpose of the bankruptcy process in a limited company is to speed up the liquidation process and distribution of company assets to creditors. As a corporation that has characteristics like private law, a limited company separates its assets from the management of the company. However, if the limited company goes bankrupt and disbands, can the management of the company still be held accountable or not?
