Abstract

Land Preparation is the activity of providing land by by providing reasonable and fair compensation to the rightful parties. While Environmental Management is an integrated effort in development by paying attention to the environment with structuring, utilization, development, maintenance, recovery, supervision and control of the environment. The approach used in this study is the statute approach. The purpose of this research is to explore the embodiment of the application of the participation principles in land preparation for the public interest in terms of environmental governance and to know clearly the mechanism of land preparation in the implementation of environmental governance. The result of this research is the principle of public participation in the land preparation for the public benefit has a position in environmental governance that is to provide advice and input related to compensation in its implementation in order to be fair and also evenly distributed to parties entitled to compensation.

Abstract

Technological developments in the era of globalization have crept into the financial world. The high demand for people in financial matters makes financial technology grow rapidly. Community problems in meeting financing needs are increasingly needed so funding sources are needed. In practice, there are insufficient funding sources to help the community, the process is complicated and requires a long time to make peer to peer lending begin to be looked at by Indonesians who are looking for sources of funding. Legal norms in positive law and by type of library research. The conclusion of this research is that users must protect more in carrying out all activities that require financial technology, borrowing money, and in conducting peer to peer lending practices in order to guarantee legal certainty in accordance with the laws and regulations in force in Indonesia

Abstract

Abstract UUD NRI 1945 mandates the government to protect the rights of every citizen, one of which is the protection of the rights of indigenous people (adat) to inhabit the indigenous forests. The legal issues in this research is how the position of indigenous and tribal peoples in the indigenous forest inhabit and how the protection of the constitutional rights of indigenous forest communities by the government. This study uses normative juridical approach made to the things that are theoretical principles of law. Based on this research, it is known that the position of indigenous and tribal peoples as subjects of law and customary rights to the forest owner. While legal protection by the government in the form of guaranteeing legal certainty of tenure of indigenous forest by indigenous and tribal peoples is to produce local law as a form of protection and recognition of indigenous peoples. Keywords : Forests; Governments; Indigenous And Tribal Peoples (adat); Abstrak UUD NRI 1945 mengamanatkan pemerintah untuk melindungi hak setiap warga negara, salah satunya adalah perlindungan terhadap hak masyarakat hukum adat dalam mendiami hutan adat. Isu hukum dalam penelitian ini adalah bagaimana kedudukan masyarakat hukum adat dalam mendiami hutan adat dan bagaimana perlindungan terhadap hak konstitusional masyarakat hutan adat oleh pemerintah. Penelitian ini menggunakan pendekatan yuridis normative yang dilakukan terhadap hal-hal yang bersifat teoritis asas-asas hukum. Berdasarkan hasil penelitian, dapat diketahui bahwa kedudukan masyarakat hukum adat sebagai subjek hukum dan pemilik hak atas hutan adat. Sedangkan perlindungan hukum yang dilakukan oleh pemerintah berupa penjaminan kepastian hukum atas penguasaan hutan adat oleh masyarakat hukum adat adalah dengan menghasilkan produk hukum daerah sebagai wujud perlindungan dan pengakuan masyarakat hukum adat. Abstract

This legal research aims to examine the implementation of regulations on the Complete Systematic Land Registration in order to achieve legal certainty in Indonesia. This legal research is a normative or doctrinal legal study conducted with a review of the literature. The research approach is conducted using statue approach and legal comparison approach (comparative law). This legal research uses both primary and secondary legal materials regarding the implementation of the Complete Systematic Land Registration in Indonesia. Based on the results of this legal research, implementation of the Complete Systematic Land Registration Program is a form of policy issued by the Indonesian Government with the Ministry of Agrarian Administration/National Land Agency to register land that has not owned a proprietary certificate. In order to achieve the legal certainty for the community is required improvement of good quality of public awareness, implementation mechanisms and various parties related to the Complete Systematic Land Registration in Indonesia. Abstract

This study has purpose to determine the form of Pancasila moral relations as the legal ideology of Indonesia in guarding discretion amid political determination. In this study, the conceptual approach was used as a basis for thinking to guide answe tor the problem which then analyzed using qualitative approach. The results showed that Pancasila as the ideology of Indonesian law is able to guard discretion in the form of moral relations that are reflected in discretion users. The implication, it is necessary to optimize the interpretation of the Pancasila in Law Number 30 of 2014 concerning Government Administration to realize the ideals of justice in the bureaucracy as per the Pancasila insight. Therefore, Pancasila morals can guard the use of discretion in political determination. Keywords: Pancasila; discretion; moral

Abstract

Indonesian population growth has increased rapidly. Therefore, it needs residential land to build schools, markets, and various public places. This condition makes land conversion increase as agricultural land in Indonesia is wide and relatively easy to be converted. However, if this happen continuously, Indonesia will face endanger of food resilience. Actually, a legal instrument, Law Number 41 of 2009 on Sustainable Food Agricultural Land Protection, is a law that prevents agricultural land conversion for the sake of national food resilience Practically, agricultural land conversion unstoppable and continuously keeps happening. Therefore, judicial approach is significantly required in to comprehensively prevent agricultural land conversion.

Abstract

The purpose of this study is to find out why forest management through the development policy of the Forest Management Unit in Indonesia is needed and how the challenges of building a Forest Management Unit in the implementation of forestry in Indonesia. This study uses normative research methods with data sources in the form of primary and secondary legal materials. The results showed that the development policy of the Forest Management Unit is needed for the benefit of community development in optimizing the management and utilization of potential funding for climate management of the regional forestry sector either at the provincial, district / city level or management unit level as well as challenges in the implementation of forests in Indonesia including limitations of professional human resources (HR), support of local governments that are not optimal, the disharmony of relationships, social conflicts and economic interests.

Abstract

Indonesia has the potential for oil from old wells of 10,000 barrels per day, but this potential is not optimally regulated. Hence, its management cannot realise social justice. This research aims to provide a prescription for the distribution of benefits and public participation in managing petroleum in old wells because all provisions for old wells do not accommodate the public interest. This research uses normative legal research utilising a statutory, conceptual, and case approach to analyse the regulation policy related to old wells management. Data were collected by investigating primer and seconder legal material. The results show that the distribution of benefits related to profit-sharing for oil management services at old wells did not reflect justice. Thus, it is causing a lot of illegal mining activities. Moreover, public participation in determining policies is still at the pseudo participation (informing level). Therefore the actual participation has not been accommodated in related regulations of old wells management.

Abstract

Indonesia is the largest oil palm producer. The area of oil palm plantations is approximately 3.4 million. However, this large potential is not part away from legal issues such as illegal oil palm plantations. It is also implied by overlapping regulations and permits. This study aims to examine the policy of illegal oil palm plantations reform and the rooted regulation problem in forest areas during Joko Widodo era. This research relies on a normative legal approach. Data was collected through the investigation of legal material regarding oil palm policies. The results of this study indicate that the overlapping regulation contributes negatively to the reformation attempt. Yet, there are no legal products and policies regarding the dispute settlement of illegal oil palm in forest areas. Repressive implementation of criminal law does not solve the problem at the grassroots. The establishment of Job Creation Law provides new hope for the settlement of oil palm plantations problem by mainstreaming the nonlitigation mechanism, namely administrative sanctions.

Abstract

This study aims to examine the factors that cause forest fires in West Kalimantan Province, the impact caused by forest fires in West Kalimantan Province, and law enforcement and monitoring efforts are carried out on cases of forest fires in West Kalimantan Province. The type of research used by the author in conducting this legal research is empirical legal research. Forest fires are a natural phenomenon that often occurs in Indonesia. The main reason is because Indonesia is located on the equator so that it has a tropical climate. This condition has an impact on natural conditions in Indonesia, especially Kalimantan, because Kalimantan is an area that has a large forested area so that during the long dry season it often experiences fires caused by many factors such as rubbing twigs to the intention of the community and individuals to throw cigarette butts into the forest area for a fire to occur. Law enforcement and supervision from the central and regional governments are very necessary as an effort to protect forests for the balance of the surrounding environment and the sustainability of living things in the future.
