Abstract

Environment is an essential element of life. The domain offers a variety of advantages and functions for humans to carry out activities and reside there. This is normative legal research using secondary sources. According to the study's findings, environmental law enforcement can be conducted both punitively and preventatively, depending on its effectiveness and nature. The lack of coordination between sectors (government officials), the absence of a monitoring plan, and the lack of environmental supervisors are obstacles to ecological monitoring.

Abstract

Abstract Through Law No. 32 of 2004 concerning Regional Government, direct regional head elections (Pilkada) can finally be realized. In accordance with the mandate of Article 24C paragraph (1) of the 1945 Constitution, it stipulates that one of the powers of the Constitutional Court is to decide disputes over election results, which means that this includes post-conflict local election disputes. In this context, the Constitutional Court performs its role to maintain the purity of the people’s voice if there is a voting dispute in the election process. Upholding the constitution is a form of protecting the constitutional rights of citizens and is a consequence of the adherence to the notion of constitutionalism that the 1945 Constitution chose. In this context, the constitution becomes a living constitution in the life of the nation and state. Constitutional values and norms will always be ‘alive’ in the sense that they are constantly developing and enriched with new values and systems based on the practice of the constitution itself and real experiences in everyday life. To maintain the election process in order to achieve the expected results, it cannot rely on only one or two institutions. It requires the cooperation of all state organs, including KPU, Bawaslu, DKPP, police, prosecutors, courts, and the Constitutional Court. All these state organs must work together to make the local elections a success to maintain the sovereignty of the people. Abstrak Melalui UU No. 32 Tahun 2004 tentang Pemerintahan Daerah, pemilihan kepala daerah (Pilkada) secara langsung akhirnya dapat diwujudkan. Sesuai amanat Pasal 24C ayat (1) UUD 1945 menetapkan salah satu kewenangan Mahkamah Konstitusi adalah memutus sengketa hasil pemilu, yang berarti di dalamnya termasuk pula sengketa pemilukada. Dalam konteks inilah Mahkamah Konstitusi melakukan perannya, yaitu untuk menjaga kemurnian suara rakyat jika terdapat sengketa suara dalam proses pilkada. Penegakan konstitusi merupakan wujud dari perlindungan hak atas konstitusional warga negara, dan merupakan konsekuensi dari dianutnya paham konstitusionalisme yang dipilih oleh pembentuk UUD 1945. Dalam konteks inilah, konstitusi menjadi “a living constitution”, dalam kehidupan berbangsa dan bernegara. Nilai dan norma konstitusi akan selalu ‘hidup’, dalam arti senantiasa berkembang dan diperkaya dengan nilai dan sistem baru, berdasarkan praktek konstitusi itu sendiri, dan pengalaman nyata dalam kehidupan sehari-hari. Untuk menjaga proses pilkada agar mencapai hasil sesuai yang diharapkan, tentu tidak dapat disandarkan kepada satu atau dua lembaga saja, dibutuhkan kerjasama seluruh organ negara, diantaranya KPU, Bawaslu, DKPP, kepolisian, kejaksaan, pengadilan, serta Mahkamah Konstitusi. Keseluruhan organ negara tersebut, harus bersinergi untuk mensukseskan pilkada demi terjaganya kedaulatan rakyat. Kata kunci: Pemilu Serentak, Mahkamah Konstitusi, Demokrasi, Indonesia

Abstract

The regulation of using foreign employees as a tool for technology and knowledge transfer, roadblocks that arise while implementing technology and knowledge transfer, and government initiatives to promote the quickening of technology and knowledge transfer are all examined in this study. This study is a normative legal investigation. Legal main and secondary sources are examples of primary data. The method for gathering data was a literature review, which involved reading books, looking over rules and regulations, and looking over other relevant research findings. The findings of this study suggest that Indonesia's laws governing the employment of foreign workers have not explicitly restricted the means through which technology can be transferred through foreign workers.

Abstract

Geothermal utilization is generally used as clean green energy because of its contribution to gradually eliminating high carbon energy. However, in practice, geothermal damage to the environment, even regulation of its utilization does not guarantee environmental justice. This research study aims to determine environmentally just geothermal regulations to eliminate negative environmental impacts and public rejection of geothermal utilization. This study uses normative legal research. The results of this study indicate that geothermal potential can replace high-carbon energy even though it still has a damaging impact on the environment. Community rejection occurs in various areas where geothermal exploitation occurs in conservation forest areas. Geothermal energy regulation in Indonesia is no more pro-ecological than in the USA. Based on the analysis of the legal gap between the theory of ecological justice and the legal triangle and energy policy, it is found that the principles of geothermal regulation must prioritize ecology, not mere exploitation. The findings of this study are strengthening the principles of geothermal regulation based on ecological justice. Standardization of handling and monitoring of environmental impacts must be carried out in an integrated manner based on area category to avoid the widening of the ecological impact of geothermal utilization which results in rejection of the next project.

Abstract

Smoking is still a problem in Indonesia to fulfill the human rights of the Indonesian people in the form of a healthy and clean environment. As a form of the seriousness of the Surakarta City government to answer environmental and health problems caused by smoking, the Surakarta City government issued Regional Regulation Number 9 of 2019 concerning Smokefree Areas. The regulation states that there are 7 (seven) places that are included in the category of Non-Smoking Areas, and one of them is a place of worship. Al-Ikhlas Mosque Jebres Surakarta is one of the non-smoking areas in the form of Muslim places of worship in the city of Surakarta. The purpose of writing this article is to find out the implementation of the non-smoking area policy at the Al-Ikhlas Jebres Surakarta Mosque. The research method used is descriptive normative -doctrinal legal research.  The data used are primary legal materials, and secondary legal materials using analysis techniques in the form of the syllogism deduction method. The results showed that the implementation of the no-smoking area at the Al-Ikhlas Mosque in Jebres Surakarta has not been running as it should and the local regulations regarding the No-Smoking Area have not been able to function as an instrument to minimize violations of the smoking ban at the Al-Ikhlas Mosque in Surakarta. Therefore, the results of this study will provide input to the Surakarta city government as a policy maker to improve the Surakarta City Regional Regulation Number 9 of 2019 concerning Smokefree Areas so that the regional regulation can become an instrument in minimizing violations of the smoking ban at the Al-Ikhlas Surakarta Mosque.

Abstract

Strict liability is absolute responsibility imposed on perpetrators of environmental violations that result in losses to both the environment and the community around the environment. The research used in this paper is juridical normative and uses a statutory approach, a conceptual approach and a case approach. The development of strict liability in positive law in Indonesia has experienced development and refinement over time, indicated by the application made in several cases concerning environmental violations by several irresponsible parties. Basically, the implementation of strict liability really helps the aggrieved parties, especially the common people, in enforcing environmental laws in Indonesia.

Abstract

This research aims to understand the effectiveness of the current tax law regulations regarding e-commerce in Indonesia on state tax revenue. Additionally, it discusses the potential of e-commerce taxation, inhibiting factors, and efforts made by the Directorate General of Taxes to increase tax revenue in Indonesia. This study is an empirical legal research with a qualitative approach. Types and sources of data include primary and secondary data. Data collection techniques used were interviews with representatives from the Direktorat Jendral Pajak, followed by qualitative data analysis techniques. The research findings indicate that the current regulations do not yet cover the taxation of e-commerce itself. The imprecision of regulations leads to the existence of untapped tax potentials if e-commerce taxation is further regulated. Moreover, there are still many taxable entrepreneurs (PKP) who are not compliant in tax payments and reporting. The constantly changing regulations contribute to legal uncertainty in society. Inadequate supervision is also one of the inhibiting factors in realizing the potential increase in tax revenue from e-commerce transactions in Indonesia.

Abstract

The Anti-SLAPP mechanism in Indonesia still needs to fulfill the four fundamental dimensions of effective Anti-SLAPP. Deciding on Anti-SLAPP in an interim decision is a progressive step because it is a translation of the Anti-SLAPP mechanism in the form of a case dismissal procedure as early as possible. Because no complete rules govern it, this creates confusion for judges. This research aims to analyze the philosophical orientation of judges in resolving disputes for anti-strategic lawsuits against public participation fighters based on Pancasila justice. This research is normative legal research employing two approaches—a philosophical approach and a conceptual approach—and collects and obtains data through direct interviews with judges. This research shows that the Judge's decision in resolving anti-SLAPP disputes based on Pancasila values still needs to be stronger. So, development that damages the environment and benefits the government and corporations will continue. Based on these facts, it is known that the regulation and implementation of anti-SLAPP in Indonesia still do not provide justice for all elements of it because one of the causes is the limitations of the existing anti-SLAPP rules in Indonesia. The factors that caused the Judge's decision not to be based on Pancasila justice can be seen from the lack of legal protection for environmental fighters in Indonesia. Then, the Judge's philosophical orientation in resolving Anti-SLAPP disputes with Pancasila justice refers to the five principles of Pancasila.

Abstract

This research examines the urgency of reconstructing land policy in the context of digital transformation of the land registration system, focusing on the expansion of notary authority. Using a normative juridical research method with conceptual and statutory approaches, this study analyzes the transformation from conventional to electronic land registration systems. The results indicate that optimizing the electronic land registration system requires three main pillars: adequate technological infrastructure, a comprehensive legal framework, and human resource capacity development. The implementation of electronic systems has proven to increase time efficiency by 60% and reduce operational costs by 40%. The role of notaries has undergone significant expansion, including authority for electronic document verification and digital signature validation. The optimization model developed includes land database integration, digital verification systems, and artificial intelligence-based monitoring mechanisms. The implications of this research provide theoretical and practical foundations for land policy reform that is adaptive to digital technology developments.
