Abstract

Approaches in legal education that emphasize the justice value of Pancasila are increasingly relevant in rising environmental awareness among students. A learning model not only offers theoretical insights into environmental protection but also encourages the practical application of justice value in the context of law enforcement. This study seeks to develop a law enforcement learning model based on Pancasila justice value to increase environmental awareness at Yogyakarta State University, Indonesia. The study employed a mixed-methods approach, integrating qualitative and quantitative methods within a research and development (R&D) design. The data were collected using questionnaires, observations, and document analysis. The population consisted of students who took civic education courses at Yogyakarta State University in 2023. A sample was selected using proportionate stratified random sampling, dividing the university's faculties into groups based on cultural similarities, including the Faculty of Social, Legal and Political Sciences; Faculty of Economics and Business; Faculty of Education and Psychology; and Faculty of Languages, Arts and Culture. The results revealed three main findings. First, civic education at Yogyakarta State University required further development in terms of materials, methods, media, resources, and evaluation. Second, developing a law enforcement learning model based on the justice value of Pancasila to increase environmental awareness involved initial, core, and closing activities. These activities included identifying environmental problems, introducing environmental law materials, selecting problems for class research, gathering and documenting information, developing class portfolios, presenting portfolios, and reflecting on the learning experience. Third, the model demonstrated effectiveness and significantly increased student's environmental awareness at Yogyakarta State University, effectively increasing their understanding of theory and practice.

Abstract

Sengketa sertifikat ganda merupakan permasalahan yang sering terjadi dalam pengelolaan administrasi pertanahan di Indonesia. Konflik ini biasanya timbul akibat kesalahan administrasi, manipulasi data, atau kurangnya pengawasan dalam proses penerbitan sertifikat tanah. Penelitian ini bertujuan untuk menganalisis penyebab utama terjadinya sengketa sertifikat ganda, dampaknya terhadap kepastian hukum, serta upaya penyelesaian sengketa berdasarkan hukum positif Indonesia. Dengan pendekatan normatif dan studi kasus, penelitian ini mengkaji peran prinsip-prinsip dalam Undang-Undang No. 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA) dan Peraturan Pemerintah No. 24 Tahun 1997 tentang Pendaftaran Tanah. Hasil analisis menunjukkan bahwa sengketa sertifikat ganda berdampak signifikan terhadap kepastian hukum dan perlindungan hak atas tanah. Untuk itu, diperlukan reformasi dalam sistem administrasi pertanahan, penegakan hukum yang konsisten, serta mekanisme penyelesaian sengketa yang lebih efektif, baik melalui jalur litigasi maupun non-litigasi.

Abstract

The complexity of land regulations in Indonesia, particularly regarding the issuance of Building Rights Title (HGB) over Management Rights (HPL), has created various legal challenges that affect investment certainty and public service efficiency. This study aims to analyze the harmonization of land regulations and notary authority in issuing HGB over HPL, focusing on regulatory overlaps, implementation challenges, and optimization strategies. Using normative legal research methods with a statutory and conceptual approach, this study examines various regulations, academic literature, and empirical data related to land registration processes. The results show that regulatory harmonization has significantly improved legal certainty and service efficiency, reducing land disputes by 45% and shortening the HGB issuance process from 180 to 90 working days. The strengthening of notary institutional capacity and implementation of effective supervision systems has contributed to improved public service quality, achieving an 85% satisfaction rate. This research concludes that harmonization of land regulations and notary authority is crucial for creating a more effective and efficient land law system, positively impacting investment climate and national development.

Abstract

This article examines the Islamic legal perspective on the application of capital punishment against drug dealers/traffickers. The aim is to find out whether these provisions are in accordance with the rules of Islamic law or not. This study uses a normative juridical approach which is carried out by examining legal norms or norms related to the object of discussion. This study finds out that Islamic law does not explicitly regulate drug crime, including determining sanctions for the dealers/traffickers. Islamic law only regulates the crime of liquor (khamer). Therefore, this criminal act can be included in the category of jarîmah ta’zîr which its legal sanctions are left to the authorities policy. Although this crime can be classified as a common crime, it is reasonable that the dealers/traffickers of the illicit goods are given severe punishment, even until sentenced to death, as this crime has a tremendously adverse effect not only for individuals but also for society and the nation as a whole. The sanction is in accordance with the principles of ushûl fiqh.

Abstract

Agriculture, as the primary source of food, is increasingly threatened by land-use conversion driven by urbanization, industrial expansion, and economic transformation—particularly in agrarian countries such as Indonesia and Vietnam. This research aims to analyze the patterns and driving factors behind agricultural land conversion in both countries, assess its impact on sustainable food security, and formulate appropriate policy solutions. Employing a normative legal approach combined with policy analysis, this study draws on primary and secondary data, including legal frameworks, academic literature, and national policies. The findings reveal three key insights. First, land-use change is predominantly driven by institutional weaknesses, legal ambiguities, and a pragmatic legal culture that fails to adequately safeguard agricultural land. Second, both countries exhibit similar trends in the conversion of productive farmland to non-agricultural uses, leading to reduced food land availability, ecological degradation, and socio-economic disruptions for farming communities. Third, a policy reconstruction is urgently needed—one that involves harmonized and enforceable regulations, institutional strengthening, and participatory economic mechanisms to ensure land protection. In conclusion, the study emphasizes the critical need for integrated and sustainable policy frameworks to maintain food security, promote environmental sustainability, and uphold social justice in the Southeast Asian region.

Abstract

This study aims to analyze the structural, institutional, and regulatory challenges in recognizing Indigenous Law Communities (Masyarakat Hukum Adat/MHA) in Indonesia, with a particular focus on the strategic yet ambiguous role of provincial governments. Despite the legal mandate for decentralization, the dual function of governors as regional heads and central government representatives has not been supported by a clear legal framework to facilitate cross-district recognition of MHA. Using a qualitative approach, the study employs document analysis of legal texts, regional regulations, and case studies, supported by secondary data from institutional reports and scholarly publications. The findings reveal three major issues: first, the absence of a legal mandate for governors to coordinate inter-district recognition processes; second, regulatory conflicts between provincial and district-level authorities, especially when indigenous territories cross administrative boundaries; and thrid the lack of harmonization between regional customary regulations and national laws. These obstacles have resulted in legal uncertainty, fragmented policy implementation, and continued marginalization of indigenous communities. This research contributes to the discourse on multilevel governance by emphasizing the overlooked role of governors in indigenous rights recognition. It also identifies practical entry points for policy reform, such as enhancing judicial review mechanisms, formalizing adat institutions, and improving spatial data integration across ministries. The originality of this study lies in shifting the analytical lens from district-level actors to the provincial level, proposing a coordinated, vertically and horizontally integrated governance framework for sustainable recognition of indigenous communities in Indonesia.

Abstract

A quality EIA document is directly proportional to the level of public participation that influences the preparation process. However, the EIA level of public participation in Indonesia is still very low , even reduced after being amended by Law No. 32/2009 in conjunction with Law No. 6/2023, which shows that public participation has not been prioritised. Several factors influence this, including the reduction of EIA participation through Law No. 6/2023, as well as the involvement of parties and forms that are not in line with the needs of the community. This research aims to identify the level of public participation in preparing EIA in Indonesia and present ideal concepts and recommendations regarding these three aspects. This legal research uses a statutory and conceptual approach with primary and secondary legal materials (Law No. 32/2009 in Lieu of Law No. 6/2023, Government Regulation No. 22/2021 and relevant scientific works). The level of public participation in the EIA preparation process in Law No. 6/2023 tends to be lower than before because the community cannot influence the final decision; affected parties are limited; forms of participation are limited to providing suggestions, opinions and responses; and the public participation in government institutions is eliminated. Therefore, the ideal concept uses a mapping that includes the parties involved, the form, and the purpose of participation with three rationales, namely normative, substantive, and instrumental, which are briefly related to the community role, the quality of environmental decisions, and the basis of legitimacy. The government needs to develop ideal regulations for public participation in preparation for EIA based on this mapping so that the preparation of EIA is participative, transparent, equitable, and informed.

Abstract

This study analyzes Indonesia’s land registration system from a constitutional and philosophical perspective, focusing on the persistence of the negative publication system and its implications for legal certainty and social justice. By tracing the colonial genealogy of cadastral administration, the study demonstrates that land registration in Indonesia originated as a fiscal and declaratory instrument serving colonial state interests rather than as a mechanism for guaranteeing definitive land rights. This legacy continues to shape contemporary land administration, where registration records ownership claims without conferring final legal force, thereby institutionalizing systemic legal uncertainty. Using prescriptive doctrinal (normative) legal research, this study examines the 1945 Constitution, the Basic Agrarian Law (UUPA), and the regulatory framework governing land registration, supported by legal and philosophical scholarship. The analysis reveals a normative paradox within Article 19 of the UUPA: although land registration is mandated to ensure legal certainty, the negative publication system leaves land certificates perpetually vulnerable to ex post judicial annulment. As administrative decisions (beschikkingen), certificates possess formal validity but lack material finality, reducing legal certainty to conditional legality. The study further finds that the limited positive elements introduced by Government Regulation No. 24 of 1997, particularly Article 32(2), the principle of openness, and the doctrine of rechtverwerking, function only as conditional safeguards and fail to ensure legal finality in practice. From a constitutional standpoint, this system is incompatible with Articles 28D(1) and 33(3) of the 1945 Constitution and with the Pancasila principle of social justice. The novelty of this research lies in its integrated constitutional philosophical critique, which justifies reconstructing Indonesia’s land registration system toward a positive publication model as a constitutional necessity to restore legal certainty, protect citizens’ land rights, and strengthen public trust in land administration.

Abstract

The acceleration of the Battery Electric Vehicle (BEV) program constitutes an integral part of Indonesia’s national strategy to reduce greenhouse gas emissions and to support the transition toward cleaner and more sustainable energy. Although regulated under Presidential Regulation No. 55 of 2019 and its implementing regulations, the existing legal framework governing BEVs remains sectoral in nature and has not been able to adequately address the complex environmental and economic challenges that arise, particularly those related to nickel mining as the primary raw material for batteries, the management of end-of-life battery waste, and the dependence of charging infrastructure on fossil-based energy sources. This article aims to analyze the urgency of establishing a specific law on BEVs as a comprehensive and integrated regulatory framework. This study employs normative legal research using statutory and conceptual approaches. The findings indicate that the absence of a specific law on BEVs may lead to legal uncertainty, increased environmental risks, and suboptimal achievement of national energy transition targets. Therefore, the establishment of a specific law governing BEVs is an urgent necessity to ensure legal certainty, environmental protection, and the sustainability of green economic development in Indonesia.

Abstract

This study aims to explain the juridical reasons why the Surabaya High Court Decision No. 920/PID/2024/PT.SBY did not impose criminal liability on Notary Dedi Wijaya in a case involving the forgery of a will deed committed by the defendant, King Finder Wong. This research employed a prescriptive normative legal method using statutory and case approaches. The analysis focused on the coherence of legal norms, principles, and their application in the court's decision. The primary legal materials consisted of the Indonesian Criminal Code (KUHP), the Law on the Office of Notary (UU Jabatan Notaris), the Indonesian Code of Criminal Procedure (KUHAP), and relevant court decisions, while the secondary legal materials included legal doctrines concerning authority and criminal liability. The findings indicate that the panel of judges concentrated its examination and ruling on the defendant as the accused party, whereas the notary was considered only within the factual evidentiary context concerning the deed-making process and the circumstances subsequently revealed, without establishing any element of criminal intent on the part of the notary. Procedural irregularities during the verification of identity and supporting documents were deemed more appropriately classified as breaches of professional prudence and disciplinary obligations rather than as fulfillment of the constituent elements of a criminal offense required for criminal punishment. The study recommends strengthening minimum verification standards for high-risk notarial deeds, requiring adequate documentation of clients' identities, postponing the execution of deeds when risk indicators arise, and enhancing professional supervision through continuous guidance and compliance audits. These findings provide guidance on the limits of a notary's criminal liability and offer directions for strengthening professional disciplinary enforcement to better protect users of notarial services.
