Abstract

This study evaluates the effectiveness of implementing the Prodeo and Sidang Keliling at the Boroko Religious Court in PERMA No. 1 of 2014. The research method used is qualitative with a juridical-empirical approach, including data collection through in-depth interviews, observations, and document analysis. The results showed that implementing the two programs significantly increased access to justice for the underprivileged. However, fluctuations were found in the realization of annual cases, highlighting the need for budget adjustments and more effective socialization strategies. The discussion emphasized the importance of adapting legal services to the needs of local communities and integrating the provider approach into the broader justice system. The conclusion of this study suggests that with improved management and socialization, the Prodeo and Sidang keliling can continue to effectively support the principles of social justice and broader access to legal services. The implications of this study lead to policy recommendations to optimize resource allocation and socialization strategies in the Indonesian judicial system, especially in the Boroko Religious Court.

Abstract

This study aimed to examine the deradicalism in the family at Tahuna on Sangihe Islands, North Sulawesi with the potential to raise radicalism. This area is the transmission line for terrorists to Indonesia from Mindanao. Furthermore, the entry of transnational Islam emphasizes religious textuality and intolerance of others. This study is a type of empirical legal research, namely a legal research method taken from the facts that exist in the Tahuna Muslim community. The data was collected using observation, interviews, and documentation and analyzed through the maqashid al-shari'a approach. The result was expected to help prevent family radicalism, and mobilize women's majlis taklim in mosques at the Tahuna area in each recitation. Furthermore, they could help transfer moderate Islamic ideas emphasizing discussing hifzh al-nafs and hifzh al-nasl, especially in family partnerships in the family. This would ensure women or wives are no longer subordinated to men and the tolerance values inculcated among people of the same and different religions. In general, the tolerance values are transferred through local wisdom adages in the Sangihe Islands, including mepalose and pantuhu makasalentiho somahe kai kehage, as reinforcement of family deradicalism.

Abstract

Interfaith marriages remain a controversial subject among scholars in Indonesia. Despite the legal prohibition, the practice of interfaith marriage continues to persist. This article analyses various legal norms, decisions of the state courts and the Indonesian Constitutional Court related to interfaith marriages, revealing disparities between legal norms and practical implementation. Employing a normative approach through a literature review, this research finds that the state legislation strictly prohibits interfaith marriage. Paradoxically, couples navigate a legal workaround, exploiting a loophole in Population Administration Law No. 23 of 2006 to formalise their marriages. They submit applications to the district court, and the court’s decisions serve as the basis for recording their union. Some couples also employ an alternative strategy by marrying abroad and subsequently registering their unions upon returning to Indonesia. The article argues that the state’s legal expression in regulating the practice of interfaith marriages in Indonesia manifests ‘double face’. This study holds significant implications, particularly in enhancing policy comprehension, providing profound insights into the legal dynamics of interfaith marriages in Indonesia, and assessing its impact on citizens’ religious freedom. [Perkawinan beda agama di Indonesia masih menjadi isu kontroversial di kalangan para sarjana. Meskipun hukum negara telah melarangnya, praktik perkawinan beda agama masih terus berjalan hingga saat ini. Artikel ini menganalisis sejumlah hukum negara, putusan Pengadilan Negeri, dan putusan Mahkamah Konstitusi terkait perkawinan beda agama di Indonesia, mengungkap disparitas antara aturan hukum dan praktik. Menggunakan penelitian kepustakaan dengan pendekatan normatif, penelitian ini menemukan bahwa hukum negara telah mengatur secara ketat perkawinan beda agama dengan melarangnya. Namun, para pasangan beda agama memanfaatkan celah hukum dalam Undang-Undang No. 23 Tahun 2006 tentang Administrasi Kependudukan untuk mencatatkan perkawinan mereka. Mereka mengajukan permohonan ke pengadilan negeri dan ketetapannya digunakan sebagai dasar untuk mencatatkan perkawinan mereka. Sebagian dari mereka juga memanfaat “pintu belakang” dengan menikah di luar Indonesia dan kembali untuk mencatatkan administrasi perkawinan mereka. Dengan demikian, tulisan ini berpendapat bahwa ekspresi hukum negara dalam mengatur praktik perkawinan beda agama di Indonesia mencerminkan “dua wajah”. Abstract

The Government has made the rule about age of marriage, namely the male must be at least 19 years old and the female must be at least 16 years old. Nevertheless, early marriages or under-age mariages are still common in Indonesia since people reffer to the prophet’s Sunnah fi’liyyah who was married to ‘Âisyah. Passion and courage from policy makers to revise the rule of minimum marriage age are required to revise that rule and reviewing the Sunnah is also imperative. It is important because the right of children is a part of human rights that must be guaranteed, protected, and filled by parents, family, society and government.

Abstract

Persoalan nikah beda agama menjadi masalah tersendiri dalam Islam, terutama terkait dengan ahl al-kitab. Para ulama berbeda pendapat dalam memahami makna ahl al-kitab, ada yang mengkategorikannya sebagai musyrik, dan ada pula yang membedakan keduanya secara tegas. Pencarian hakikat dalam memahami larangan pernikahan beda agama antara Muslimah dengan ghair al-Muslim  mengandung makna yang dalam dan berdampak luas terhadap psikologis, dan sosiologis. Tiap-tiap agama telah memiliki ketentuan tersendiri yang melarang perkawinan antar agama, sehingga jika seorang umat melanggar aturan agama, maka sesungguhnya ia telah melecehkan agamanya tersebut.

Abstract

Historically, the rule of Islamic family law existed and has been practiced since the early arrival of Islam in the archipelago. This is indicated by the phenomenon of massive application of fiqh madzhab asy-syafi’iyyah in the colonialization era.. After the day of Independence, the efforts to established Islamic family law through political institutions has begun, starting from the old order era until the reform era. The reform movement grew stronger mainly after CLD-KHI was echoed to make KHI ( Collection of Islamic Law) a new Marriage Act. Unfortunately, this movement received a negative response from a number of Islamic organizations; so the plan was canceled by the Government. Nevertheless, the struggles between liberal and conservative-fundamentalist Islamic thought still continue to this day.

Abstract

This article aims to explore the models of application of Islamic law in Indonesia by the State, ranging from traditional to modern, including aspects of reform. This research found the fact that at the beginning of the entry of Islam to the archipelago, the propagators of Islam had partially applied Islamic law, especially after the establishment of Islamic kingdoms in several areas. However, after the establishment of the Unitary State of the Republic of Indonesia, the model of applying Islamic law underwent renewal with formalistic, religious-ethics, and convergence models. Unfortunately, in the production stage, the implementation encountered many obstacles because it had to enter the realm of practical politics. Therefore, its development continues to move partially, such as the issuance of the Marriage Law, Zakat, Hajj, and so on, including through material review in the Constitutional Court.

Abstract

Research Objective: This study examines internal and external challenges in the Islamic world using Islamic constitutional and criminal law perspectives. It focuses on how principles, particularly those rooted in maqāṣid al-sharīah, can be applied to address legal fragmentation, underdevelopment, Islamophobia, and marginalization. Research Method: A qualitative normative approach was used, supported by thematic and comparative analysis. It draws on primary Islamic texts, constitutions, international legal sources, and academic literature. Case studies from Indonesia and the UAE illustrate different applications of Islamic law in governance and justice. Results: The findings indicate that challenges stem primarily from structural, rather than theological, issues. Internally, these include stagnant education systems, fragmented financial structures, and inconsistent Sharia application. Externally, they involve widespread Islamophobia and limited global representation. Findings and Implications: Islamic legal norms align with democratic values such as equity, participation, and justice. Ethical tenets like maṣlaḥaḥ and shūra support pluralistic governance. Institutional reform and contextual application of Islamic law can improve both domestic legitimacy and international engagement. Conclusion: Islamic legal systems hold the flexibility and strength to meet governance needs. Realizing their potential requires structural reform and aligning jurisprudence with contemporary legal frameworks. Contribution: This study contributes to Islamic legal scholarship by presenting a model that connects classical jurisprudence with modern constitutional practice. It adds to interdisciplinary work, promoting Islamic law in global legal discourse. Limitations and Suggestions: The non-empirical nature and limited jurisdictional scope of the study constrain broader generalization. Future research should incorporate empirical approaches and explore how digital innovation can support Islamic governance reforms.

Abstract

Masyarakat pesisir di Sindulang Dua sangatlah majemuk, dengan kuantitas muslim sebagai minoritas dan tingkat ekonomi berada pada level pra sejahtera, akibatnya muncul berbagai problem sosial-keagamaan seperti lemahnya pengetahuan agama sehingga ada beberapa yang keluar dari Islam, terjadi kekerasan dalam rumahtangga hingga berdampak pada perceraian dan broken home pada anak, bahkan terjadi kriminalitas di wilayah setempat karena faktor kebutuhan ekonomi. Inilah urgensi dilakukannya pengabdian kepada masyarakat di wilayah tersebut dengan fokus pembinaan keluarga bahagia, tahsin al-Qur'an, perbaikan arah kiblat, dan pembinaan ekonomi syari'ah. Metode yang dilakukan adalah penyuluhan, pelatihan, dan pendampingan kepada selupuh orang peserta aktif, dengan pendekatan Asset-Based Community Development. Hasilnya dari sepuluh orang peserta tersebut; mampu memahami dengan baik beberapa norma tentang hak dan kewajiban dalam rumahtangga beserta implikasinya; memahmi dan mempraktikkan kembali tahsin al-Qur'an; perbaikan arah kiblat Musholla Al-Huda berdasarkan ilmu falak dan teknologi modern; dan penyuluhan tentang praktik ekonomi syari'ah beserta pelatihan memproduksi abon cakalang yang halal lagi baik.

Abstract

Abstract This study investigates the perceptions of scholars concerning transgender people's legal status on their Hajj ritual validity. In North Sulawesi, seven scholars are considered the opinion-makers and authorities following their understanding of Hajj ritual procedures in Islamic law. The data were analyzed using qualitative methods through interviews and the needs theory by al-Shāṭibī, Ibn Khaldun, and Maslow. The results showed that the gender status of those yet to transition remains original. In contrast, the transitioned transgenders’ status should change to the original law following the court's decision. Second, the scholars approved Hajj rituals for those yet to transition because they had their actual gender and sex. Furthermore, Hajj rituals for transgenders were also legally acceptable in Islamic law following the new status exception by the court. The transgenders' Hajj rituals are valid based on their initial gender or the court's decision. The hajj practices are invalid for those who illegally transition or without court approval.
