Abstract

The community and the Government of Denpasar City took the initiative to save Bali Island, which is known as the last paradise island, "The Last Island Paradise" with the hope of having an impact on preserving the universe. Public reactions to the issuance of Regional Regulation Number 97 of 2018 are very diverse. There are those who agree and then provide support with the real action not to use plastic-based containers. The purpose of this study is to reveal the inhibiting factors for the implementation of Bali Governor Regulation Number 97 of 2018 against the restriction of single-use plastic bags in Denpasar City and the impact of implementing Bali Governor Regulation Number 97 of 2018 on Tourism Development in Denpasar City. The type of research used in this research is empirical law research. Based on the research that has been done, it is an inhibiting factor for the implementation of Governor Regulation Number 97 of 2018 concerning Reducing the Use of Plastic Bags, among others: lack of public awareness, lack of facilities to manage waste, the culture of the community using plastic bags is still high, law enforcement of Denpasar Mayor Regulation Number 36 of 2018 is still weak.

Abstract

Cases of molestation against children are rife today. This is a problem that becomes the duty of law enforcement officers and the community to fight. Abuse of children is carried out by offenders to fulfill thier lust and also because of sexual abnormalities. Related to this problem, law enforcement agencies in particular and the community must play an active role in making efforts to overcome these problems. Imposition of sanctions is a repressive effort that can be done to provide a deterrent effect for the perpetrators. Based on this problem, this study was conducted to describe how the legal protection of child victims of sexual abuse and how sanctions for perpetrators of sexual abuse of children. This study used a normative method, and research data are sourced from the opinions of legal scholars and the Law. The results of this study indicate that the government and the community are required to provide special protection such as rehabilitation efforts and keep victims from surrounding labeling or suffering from their identity as victims of sexual abuse or violence, as Article 64 Paragraph (1) and (3) of Law Number 23 Year 2002 JO Law Number 35 of 2014 concerning Child Protection regulates it. Based on Decision Number 29 / Pid. Sus-Anak / 2018 / PN Dps determined that the defendant BASID fulfilled the elements of the formulation in Article 82 paragraph (1) Jo Article 76 E of the Child Protection Act No. 35 of 2014 concerning amendments to the Law of the Republic of Indonesia Number 23 of 2002 concerning child protection and was sentenced to 13 (thirteen) years in prison along with job training at Mercy Indonesia Foundation Jalan Intan LC II Gang IV No.1 Gatot Subroto Denpasar for 6 (six) months as in a single indictment of the Public Prosecutor

Abstract

Anturan Village, which is still included in the tourist area of North Bali, has enormous potential to be developed into an adat village-based tourist destination. This village, has a unique culture, religion and customs. The potential of the Anturan traditional village in particular has Kerta Desa a kind of traditional court that can reconcile civil disputes, in the indigenous Anturan community, especially those who are Hindu. This means that prior to the enactment of Indigenous Village Law No. 4 of 2019 concerning Indigenous Villages which obliged to form a Kerta Desa, the Anturan traditional village already had a Kerta Desa. The problem arises that, even though the Kerta Desa has authority in peace in adat villages based on adat law by making decisions in accordance with awig-awig and / perarem. In the Empowerment of Anturan Indigenous Village Empowerment there are problems namely: (1) legal issues related to tourism activities in Anturan Village cannot be comprehensively solved. (2) The form of Kerta Desa's relationship with Bendesa adat and community leaders in resolving tourism cases has not been synergistic so that the law can mean coexistence. (3) There is no Kerta Desa Empowerment model, in the context of state law enforcement and Balinese customary law. (4) The absence of kerta desa in tourism law enforcement is in accordance with the interests of the local community. Solution offered: (1) Existence of Policy Study on Empowerment of Village-based Tourism Village that involves the kerta desa in handling cases of traditional village land and land in the form of investment; (2) Increased knowledge and the existence of legal awareness in the management of traditional village-based Tourism Villages concerning land for investment purposes; (3) Able to develop the implementation of state law and customary law of Bali and tourism law to resolve the case of tourism investment in the traditional village of Anturan; (4) Can have a positive impact on society and can improve human resources, and the Kerta Desa in handling investment cases in tourism can apply the law in coexistence. The method used in the form of empowerment Kerta Desa with the pattern of assistance, FGD and find the real core of the problem. Legal issues are very complex, can find hidden problems in travel cases, and inventory problems and solve problems that arise with village officials, custom officers and indigenous community leaders in Anturan. Target outcomes to be achieved are publication of national journals / or proseding ISBN National publications, mass media publications, videos on broadcast activities. Activities in Empowering Anturan Indigenous Village Empowerment in resolving land issues in tourism investment by providing assistance and counseling to Kerta Desa, Prajuru Desa adat and community leaders who are relevant to Land Cases and investments in Anturan village.

Abstract

The development of religious tourism in Ped Village has promising prospects. From a legal perspective, the management of religious tourism has its own opportunities and challenges. Therefore, a study of legal aspects is needed so that they are able to seize opportunities from the development of religious tourism and avoid the negative impacts that arise. This PKM seeks to provide an understanding of legal aspects that need to be considered in the development of religious tourism in Ped Village. The method applied is through legal counseling and assistance in preparing the required regulations. The results of the implementation show that religious tourism in Ped Village has the opportunity to be developed, considering that Balinese people are generally very enthusiastic about carrying out religious activities to come to holy places (temples). Religious tourism is developed based on Balinese culture which breathes Hinduism, is magical/sacred and is combined with natural beauty. The challenge faced is the absence of complete and comprehensive regulations in regulating religious tourism. There is no legal instrument that can provide protection for religious tourism objects, so that there is no pollution and damage or harassment of religious tourism objects. It is important to have regulations drafted in the management of religious tourism in Ped Villages that involve stakeholders

Abstract

Indonesia is a maritime country, this is shown through its territory consisting of islands with very long coastal boundaries. Coastal and coastal areas are very rich in marine life and others. Aside from being a place of livelihood for fishermen, it is also a place for traditional salt farmers whose production has a specificity. Beaches in Bali not only have economic and social functions, but also have cultural aspects or religious functions. For this reason, the existence of beaches and their coasts is very important and strategic, it is necessary for people who live on the coast to be empowered in order to preserve culture and the environment. Because every traditional village in Bali there is a ceremony process in the coastal area, including the Karolahan Traditional village, Tianyar village. With these conditions, there needs to be an understanding and knowledge of the existing community empowerment efforts on the coast, as well as playing a role in environmental conservation efforts. Activities that need to be carried out through legal counseling to Krama Desa Adat, considering that fishermen and traditional salt farmers are part of Krama Desa Adat.

Abstract

The traditional village of Penglipuran Kubu, Bangli Regency has the potential as a tourist village. The potential of culture and natural resources can be managed into a tourism village product by collaborating with culture, natural resources, human resources, and tourism village management. In order for the management of the tourist village to be sustainable, the management strategy and laws related to the tourist village become the manager's reference. It was found that the management of the tourist village is still weak. The problem of tourist villages can use the absorption method from research results found both from service research results and from other researchers to be expected to provide solutions to the Penglipuran indigenous peoples who manage tourist villages. The role of the government after the development of the Penglipuran tourist village has decreased, it should remain a dynamist for the Penglipuran indigenous people. The methods used in legal issues in the management of tourism villages, focus group discussions (FGD), mentoring, lectures on legal science, dissect cases related to tourism village institutions, find potential strategies for local wisdom to strengthen tourism villages based on local wisdom, ensure continuity Penglipuran tourism village, assisting tourism awareness groups in managing tourism villages in growing the creative economy. The results of the service show that the Penglipuran tourist village, the lands that are used as tourist village objects are customary lands (Tanah Ayahan Desa). There is a legal problem that AYDs land is certified by Krama Adat. Another problem, which needs legal assistance, and legal counseling that the Penglipuran tourist village is managed by a tourism village management business entity, then a new problem arises with the Regional Regulation Number 4 of 2019 concerning customary villages, that Traditional Villages have Utsaha, to be managed by BUPDA (Baga Utsaha Padruwen Desa adat) based on customary law.

Abstract

American writer wrote a book, dubbing the island of Bali "The Last Paradise". Bali does not have natural resources, but when the Dutch ruled Bali, this culture was exploited for profit. During the era of independence and the New Order's development, it was planned to develop Bali as a tourism destination. Then Nusa Dua developed as mass tourism, and Kuta from ecotourism developed into mass tourism so that tourism capitalism drives the tourism business sector in Kuta. North Badung is now being developed into an ecotourism and/or tourism village. North Badung, especially Abiansemal Village, is a village in the Abiansemal District, Badung Regency, Bali Province. Abiansemal Village is one of the villages in the Abiansemal sub-district, which is located 1.5 Kilometers from the District Capital, and 10 Kilometers from the Regency City. At present the Abiansemal Village is led by Mr. Perbekel Ida Bagus Bhisma Wiratma S.H. The boundaries of the Abiansemal Village area are to the north by the Setra/Kembengan Cemetery, to the south by the Tukad / Campuhan Gerih River, to the west by the Tukad / Bangiang River, and to the east by the Tukad / Ayung River.

Abstract

Economic growth in a country is crucial for the well-being of its society. This research utilizes the normative research method, which is a scientific research method to discover truths based on scholarly logic from a normative perspective. Legal materials in normative research can include primary legal sources, secondary legal sources, and non-legal sources. The results of this research explain that various forms of institutions have been established in efforts to develop the community's economy at the village level, such as Village-Owned Enterprises (BUM Desa) and Cooperatives, as mandated by Law Number 6 of 2014 concerning Villages.

Abstract

Penelitian ini bertujuan untuk merumuskan konsep model pengelolaan hutan desa berbasis desa adat di desa Selat, kabupaten Buleleng. Metode pendekatan yang digunakan dalam perumusan konsep model pengelolaan hutan desa berbasis desa adat yaitu metode dengan aspek perancangan dan aspek sumber daya alam, sedangkan metoda pendekatan untuk warga masyarakat/krama desa dalam kegiatan pelestarian hutan yaitu keterlibatan langsung sebagai pengelola BUM Desa dalam menjaga terjadinya kerusakan hutan desa. Hasil penelitian ini menunjukkan bahwa a) konsep penyempurnaan terhadap Awig-awig Desa Pakraman Pandan Banten Selat menjadi sangat penting untuk dilakukan penyesuaian sejalan dengan perkembangan keberadaan warga masyarakat/krama desa di sekitar kawasan hutan desa. Sebagai antisipasi awal terhadap semakin merebaknya adanya pengerusakan terhadap hutan oleh warga masyarakat/krama desa diperlukan pengaturan semakin tegas dengan cakupan pengaturan lebih luas melalui pararem. b) Konsep pemberdayaan ini dilakukan terhadap keberadaan pecalang jagawana dalam menjaga keamanan dan pelestraian hutan desa. Mengingat tantangan terhadap perilaku warga masyarakat/krama desa akan semakin banyak. Dipandang perlu untuk penambahan (kuantitas) tenaga pecalang jagawana, agar mampu mengcover cakupan luas hutan. Termasuk peningkatan sarana dan prasarana pendukung dalam rangka pengamanan hutan. c) Konsep Rehabilitasi ini dilakukan dalam upaya tetap terjaganya kelestarian hutan. Sehingga program/kegiatan yang dilaksanakan BUM Desa Pandan Harum melakukan rehabilitasi hutan dengan penanaman pohon secara berkelanjutan.

Abstract

Tujuan penyuratan awig-awig di Desa adat Siangan adalah sebagai implementasi dari kehendak Peraruran Daerah Nomor 3 tahun 2001 tentang Desa Pakraman, setiap Desa adat/Pakraman menyuraktan awig-awig. Selain itu, yang sangat urgen adalah kehendak masyarakat adat Siangan untuk merevisi awig-awig yang tidak sesuai dengan perkembangan jaman. Hal yang sangat penting dilaksanakan penyuratan awig-awig adalah untuk menghindari konflik tapal batas desa, atas dasar yang saling seluk dengan tetangga desa adat yang bersebelahan, dan juga untuk menghindari saling klaim wilayah yang berpotensi ekonomis. Dalam hukum adat secara sosiologis, bahwa hukum adat sifatnya tidak tertulis. Namun mulai diberlakunya Peraturan Daerah Propinsi Daerah Tingkat I Bali Nomor: 06 tahun 1986 tentang kedudukan, Fungsi dan Peranan Desa Adat dalam Propinsi Tingkat I Bali, desa Adat, diperintahkan untuk penyuratan awig-awig di seluruh desa adat di Bali. Dalam penyuratan awig-awig sosialisasi sangat penting untuk menjaring masukan dari tokoh-tokoh masyarakat, prajuru adat, kelompok yang berkepentingan berkaitan dengan isi awig-awig tidak boleh bertentangan dengan asas kepatutan dan peraturan perundang-undangan serta ideologi Pancasila.
