Abstract

The dominance of algorithms in the social, economic, and political life of the 21st century has created unprecedented structural dependencies, with complex socio-political implications. This research aims to uncover the mechanisms of algorithmic tyranny in social governance, analyze the transformation of AI into a totalitarian tool, and formulate a democratic oversight framework based on cross-national empirical findings. The study uses a critical-realist paradigm with post-qualitative methods, combining reverse engineering of controversial AI systems with critical analysis of over 40 reputable journals and books, and 14 policy documents (2015–2025). A rhizomatic analysis approach is used to explore the multidimensional nature of algorithmic power beyond hierarchical structures. Validity was established through catalytic validity to ensure epistemological and social impact. The research findings reveal regulatory differences across countries: the European Union leads in transparency but hinders innovation, while the US dominates with risks of fragmentation and minimal accountability. China uses AI for social control, and Singapore adopts a pro-business hybrid model. Algorithmic tyranny emerges in recommendation systems that create filter bubbles while judicial algorithms exhibit racial bias. Additionally, there is a totalitarian threat in the use of AI for mass surveillance and political deepfakes, meeting the criteria for “totalitarianism 2.0”. This study concludes with a novelty emancipatory concept to challenge algorithmic tyranny, through the instruments of an ”Algorithm Constitutionalism” and a ”Right to Algorithmic Explanation”. The policy recommendations emphasize the need for a global alliance to balance innovation with the protection of human rights in the algorithmic realm.

Abstract

Purpose of this research is to explain phenomenon of public infrastructure provision through Public Social Private Partnership (PSPP) mechanism. PSPP basically offers an opportunity for community organizations to act between the government and the private sector in the provision of public services. Sumedang is a regencythat has started the mechanism to build and develop market infrastructure through PSPP mechanism. It is intended to allow the market development activities quickly and to get legitimation from all parties. This research uses qualitative method. Data are collected through in-depth interviews and secondary literature. Thisresearch is important to gain theoretical support as well as practice at the level of the actors. Result of the research indicates that PSPP offers multi-actor involvement in the process of providing public infrastructure, however this engagement results a more difficult proces in fulfilling their interests. Tujuan dari penelitian ini adalah untuk menjelaskan fenomena penyediaan infrastruktur publik yang dilakukan melalui mekanisme Public Social Private Partnership (PSPP). PSPP secara prinsiptual menawarkan kesempatan kepada organisasi masyarakat untuk bertindak antara pemerintah dan swasta dalam penyediaan layanan publik. Kabupaten Sumedang merupakan kabupaten yang telah memulai sebuah mekanisme untuk merencanakan pengembangan dan pembangunan infrastruktur pasar melalui mekanisme PSPP dengan tujuan agar kegiatan pengembangan pasar tersebut dapat terlaksana dalam waktu yang cepat dan mendapatkan legitimasi dari semua pihak. Metode penelitian yang digunakan adalah kualitatif dengan mengutamakan wawancara mendalam dan studi literatur sebagai teknik pengumpulan datanya. Kajian ini menjadi penting terutama untuk mendapatkan dukungan secara teoritis, maupun secara praktis pada tingkat aktor-aktor yang terlibat. Sebagai kesimpulan, PSPP menawarkan keterlibatan multi-aktor dalam proses penyediaan infrastruktur publik, namun di sisi lain keterlibatan ini mempengaruhi proses yang lebih sulit untuk memenuhi kepentingan di antara para aktor yang terlibat. Abstract

Indonesia sebagai negara megadiversitas menghadapi ancaman serius terhadap keanekaragaman hayatinya akibat deforestasi, perdagangan satwa liar ilegal, dan lemahnya penegakan hukum. Undang-Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistem yang diformulasikan sebagai landasan hukum utama tidak terimplementasi secara konsisten. Penelitian ini bertujuan menganalisis kesenjangan antara ketentuan normatif dan praktik penegakan hukum konservasi di Indonesia. Metode yang digunakan dari penelitian ini adalah penelitian hukum normatif dengan pendekatan studi kasus empiris, menganalisis peraturan perundang-undangan, putusan pengadilan, dan studi kasus di Taman Nasional Gunung Rinjani, Taman Nasional Gunung Ciremai, kawasan lindung laut, serta perdagangan satwa liar. Hasil penelitian ini menunjukkan bahwa fragmentasi kelembagaan, koordinasi yang lemah, sanksi pidana yang tidak memadai, serta tekanan sosial-ekonomi masyarakat menjadi penyebab utama kegagalan penegakan hukum konservasi di Indonesia. Selain itu, pengabaian terhadap sistem hukum adat dan pengelolaan hutan adat memperparah kegagalan penegakan hukum konservasi. Oleh karena itu, reformasi hukum yang meliputi peningkatan sanksi, pengakuan hak masyarakat adat, penguatan kapasitas kelembagaan, dan integrasi pendekatan berbasis masyarakat diperlukan untuk mencapai penegakan hukum konservasi yang berkelanjutan.

Abstract

This study examines the effect of fiscal decentralization on regional budget absorption performance in Indonesia, using panel data from 34 provinces for 2021–2023. The analysis method employed is fractional probit regression with the Mundlak approach, along with a robustness test using Quasi Maximum Likelihood Estimation (QMLE). The results indicate that fiscal decentralization, both in revenue and expenditure, has a positive, statistically significant impact on the probability of regional budget absorption. Regions with higher fiscal autonomy and higher expenditure-to-revenue ratios tend to exhibit better budget absorption performance. In addition, fiscal independence also contributes positively to expenditure absorption. Simultaneously, several control variables, such as population growth, show a positive effect, while others, including the unemployment rate, GRDP per capita, and population density, have a significant negative impact. These findings emphasize the importance of strengthening local fiscal capacity and regional institutional quality to improve budget management effectiveness and ensure the successful implementation of fiscal decentralization.
