Abstract

Perkembangan industri perkebunan di Kalimantan Barat memicu beberapa permasalahan baru yaitu sengketa lahan dan kerusakan terhadap lingkungan hidup yang akhirnya mereduksi hak-hak masyarakat adat oleh kapitalisme bentuk baru yang biasa disebut sebagai kapitalis patriarki, yang pada tahapan akhirnya memarjinalisikan hak-hak kaum perempuan dayak. Metode penelitian yang digunakan adalah sosiologis yuridis. Rumusan masalah dalam penelitian ini adalah bagaimana perempuan Dayak berperan dalam menjaga lingkungan hidup dengan paradigma ekofeminisme terhadap hukum lingkungan di Kalimantan Barat. Penelitian bertujuan untuk menganalisis dan menemukan peran perempuan Dayak dalam menjaga lingkungan hidup dengan perspektif ekofeminisme terhadap hukum lingkungan di Kecamatan Sengah Temila, Kabupaten Landak.

Abstract

The Community Service Program (KKN) of Group 15 from Panca Bhakti University in Sungai Nipah Village was designed to foster village independence through a holistic and participatory approach. The program addressed key challenges, including limited digitalization among local MSMEs, farmers' reliance on conventional agricultural methods, low legal literacy, and insufficient awareness of environmental preservation. Implementation was carried out in collaboration with the village government and community, focusing on education, infrastructure, and agriculture. Key outcomes included enhanced legal awareness through the "law-conscious village" campaign, improved digital economy skills via training on e-commerce platforms and non-cash transactions, as well as anti-bullying initiatives. In agriculture, productivity was supported through the introduction of bird pest repellent tools and the establishment of farmer group signboards. Environmental awareness was strengthened with educational signboards promoting waste management. The program's success was marked by strong community and government participation. Overall, this KKN initiative contributed not only to tangible improvements in the village's physical and non-physical development but also to the establishment of sustainable partnerships for long-term progress

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk dan implikasi disharmoni regulasi antara pemerintah pusat dan daerah dalam penanggulangan Penambangan Emas Tanpa Izin (PETI), serta mengkaji pengaturan kewenangan berdasarkan hukum positif Indonesia. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis, melalui studi terhadap bahan hukum primer, sekunder, dan tersier. Analisis dilakukan menggunakan teori otonomi daerah dan teori harmonisasi hukum sebagai landasan konseptual. Hasil penelitian menunjukkan bahwa telah terjadi ketidaksinkronan antara Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, yang menekankan desentralisasi kewenangan, dengan Undang-Undang Nomor 3 Tahun 2020 tentang Pertambangan Mineral dan Batubara, yang bersifat sentralistik. Disharmoni ini menyebabkan ambiguitas kewenangan antara pusat dan daerah dalam pengawasan serta penegakan hukum terhadap PETI di Provinsi Kalimantan Barat. Kondisi tersebut melemahkan efektivitas hukum dan menimbulkan ketidakpastian dalam pelaksanaan tugas pemerintahan daerah. Penelitian ini menegaskan pentingnya harmonisasi regulasi vertikal dan horizontal agar pembagian kewenangan antara pusat dan daerah menjadi lebih jelas, seimbang, dan efektif untuk mendukung penegakan hukum serta pengelolaan sumber daya alam yang berkelanjutan.

Abstract

The implementation of Public Information Disclosure (Keterbukaan Informasi Publik/KIP) and public participation in the formulation of the Regional Spatial Plan (RTRW) of West Kalimantan Province for 2024–2044 continues to face structural and procedural challenges. Although Law Number 14 of 2008 on Public Information Disclosure guarantees the right of access to information, the practice of drafting the RTRW reveals a significant gap between legal norms and their empirical implementation. This study employs an empirical legal method with a socio-legal approach, conducted from January to August 2024, involving 18 informants comprising local government officials, members of the Regional House of Representatives (DPRD), academics, and representatives of civil society. Data were collected through in-depth interviews, document analysis, and participatory observation, and were examined using Arnstein’s Ladder of Citizen Participation as an analytical framework. The findings demonstrate that proactive disclosure of strategic documents, particularly the Strategic Environmental Assessment (KLHS) and the draft Regional Regulation (Raperda), remains inadequate through official governmental channels. Public participation mechanisms tend to be procedural and formalistic, falling short of the principles of public information disclosure, Free, Prior and Informed Consent (FPIC), and meaningful participation. Previous studies have not specifically examined the implementation of public information disclosure in the formulation of regional spatial planning regulations using Arnstein’s participatory framework, thereby leaving an empirical gap at the subnational level. The novelty of this research lies in integrating normative analysis of public information law with an empirical assessment grounded in participation theory to determine the actual degree of participation. Formally, participation reaches the level of consultation (tokenism), yet substantively it descends into therapy or manipulation (non-participation). These findings underscore the urgency of restructuring spatial governance to ensure substantive transparency and participatory legitimacy in regional policymaking.
