Abstract

Corruption and money laundering are classified as extraordinary crimes due to their significant impact on state finances and their potential to destabilize the national economy. These crimes not only result in the direct loss of public funds but also undermine trust in state institutions, obstruct development programs, and damage Indonesia's international reputation. Given the magnitude of these threats, there is an urgent need for effective legal mechanisms to recover stolen assets swiftly and efficiently. This study explores the urgency of ratifying the Asset Confiscation Bill as a critical step in enhancing Indonesia’s legal framework for combating corruption and money laundering. Currently, Indonesia’s asset recovery mechanisms are limited by procedural constraints embedded in existing laws on corruption and money laundering. These laws generally require a court decision with permanent legal force before any assets can be confiscated. Such a requirement often hampers swift action and allows perpetrators to conceal or transfer illicit assets during lengthy legal processes. This study, which uses a normative legal research method, relies on an analysis of laws, legal doctrines, relevant literature, and legal dictionaries to assess the shortcomings of current asset confiscation regulations. The findings suggest that the Asset Confiscation Bill holds great potential to fill these legal gaps. If enacted, the bill could provide a legal basis for the non-conviction-based confiscation of assets, enabling law enforcement to act more decisively in reclaiming assets suspected to be linked to corruption or money laundering. Such a reform would significantly bolster Indonesia’s efforts to combat economic crimes and protect national financial integrity.

Abstract

"Enhancing business competitiveness and empowering Micro, Small, and Medium Enterprises (UMKM) is crucial for sustainable economic development. Law Number 20 of 2016 serves as a legal policy, with trademark protection being a key aspect in strengthening the position and contribution of UMKM in an increasingly complex market competition. This research explores the roles and challenges faced by UMKM. Through analysis of various related literature, it is found that UMKM often encounter obstacles in understanding and implementing trademark protection.This study adopts a normative juridical approach through literature review to identify concepts relevant to the issues of trademark protection for UMKM. The research results indicate that the legal policies governing UMKM, such as Republic of Indonesia Law Number 20 of 2008 concerning UMKM and Law Number 20 of 2016, can serve as government methods to provide business protection to UMKM through the protection of their intellectual property in the form of trademarks. The recognition of trademarks shared among UMKM serves as a means to protect their intellectual property against large industries or other business entities that may attempt to obtain intellectual property owned by UMKM without proper authorization. Disputes arising from trademark ownership are typically resolved based on the trademark certificate as evidence of ownership, unless the trademark is invalidated through trademark litigation brought before the Commercial Court. UMKM associations can serve as bridges for UMKM to access information, business networks, and even skill development opportunities, thereby enhancing the capabilities of UMKM.

Abstract

Pendahuluan: Pemenuhan Hak Korban Kekerasan Seksual terhadap Perempuan melalui Program Sahabat Saksi dan Korban di wilayah Manggarai dengan mata pencaharian mayoritas pemulung dan tukang ojek. Beberapa Kegiatan Komunitas Jendela Kelurahan Manggarai RT.008/01 dalam kegiatan Sosialisasi Peraturan Daerah, Pendampingan Pencegahan Kekerasan Seksual pada Anak dan Remaja. Studi ini bertujuan untuk melindungi hak Perempuan korban kekerasan seksual. Metode: Metode yang digunakan yaitu workshop, praktikum, dan lain-lain kepada orang tua ibu-ibu dan anak-anak Perempuan wilayah Manggarai. Hasil: Kasus di wilayah Manggarai dengan pemenuhan Hak yang harus dilindungi dan terdaftar di permohonan sebagai pemenuhan hak Perempuan korban kekerasan seksual. Kesimpulan: Diharapkan dapat melindungi hak-hak Perempuan dan memulihkan hak Perempuan dari sisi psikologis dan hukum.

Abstract

Program pengabdian kepada masyarakat ini bertujuan untuk memperkuat perlindungan serta pemenuhan hak anak korban kekerasan seksual melalui penerapan model pendampingan berbasis komunitas di Kelurahan Manggarai, Kecamatan Tebet, Jakarta Selatan. Program Sahabat Saksi dan Korban dirancang sebagai respons terhadap keterbatasan kapasitas masyarakat dalam melakukan pencegahan, penanganan awal, dan pendampingan anak korban kekerasan seksual. Metode pelaksanaan meliputi observasi awal, pemetaan kebutuhan, diskusi kelompok terarah, pelatihan relawan komunitas, serta sosialisasi kepada masyarakat yang melibatkan ketua RT/RW, tokoh masyarakat, orang tua, dan relawan. Hasil kegiatan menunjukkan adanya peningkatan yang signifikan dalam pengetahuan dan kesadaran masyarakat mengenai isu kekerasan seksual pada anak, serta meningkatnya kesiapan kader dalam merespons kasus secara cepat dan tepat. Relawan yang telah dilatih mampu memahami prinsip-prinsip perlindungan anak, memberikan pertolongan pertama psikososial, serta mendampingi keluarga korban dalam mengakses layanan rujukan resmi seperti kelurahan, kepolisian, dinas sosial, dan P2TP2A. Pembahasan menunjukkan bahwa pendekatan berbasis komunitas mampu memperkuat koordinasi lintas pihak dan menciptakan lingkungan sosial yang lebih responsif terhadap perlindungan anak. Secara keseluruhan, program ini menyimpulkan bahwa model pendampingan berbasis komunitas efektif dalam memperkuat sistem dukungan sosial bagi anak korban kekerasan seksual dan memiliki potensi untuk direplikasi di wilayah lain dengan karakteristik sosial yang serupa.

Abstract

The study examined the regulation of party switching among members of Indonesia’s Regional People’s Representative Councils (DPRD) through an integrated analysis of constitutional law, political rights theory, and Indonesian Islamic jurisprudence. It critically evaluated Constitutional Court Decision No. 88/PUU-XXI/2023 to assess how individual political rights are balanced with institutional stability. Employing a normative legal research approach, the study combined statutory, case-based, and conceptual analyses, enriched with comparative insights from Malaysia, Pakistan, India, and South Africa. The findings found out that current legal mechanisms, particularly the Inter-Temporal Replacement (PAW) procedure under Article 193 of Law No. 23 of 2014, disproportionately empower political parties, undermining electoral legitimacy and legislators’ autonomy. By integrating maqāṣid al-sharī‘ah principles, including al-‘adl (justice), al-maṣlaḥah (public welfare), amanah (trust), and ḥurriyyah siyāsiyyah (political freedom), the study proposed normative and practical reforms to enhance proportionality, transparency, and fairness in regulating party switching. The research contributed to scholarship by linking constitutional law, political representation, and Islamic ethical principles, providing theoretical insights and actionable recommendations to strengthen democratic representation, protect political rights, and reinforce institutional legitimacy in Indonesia.
