Abstract

After the economic crisis in 1997-1998, the economy in Indonesia began to increase due to the existence of the Micro, Small and Medium Enterprises (MSMEs) group which had been used as a group to develop their potential to natural potential. One of them is the development of economy in Indonesia has been widely run by the people of Dongko Village through 3 (three) business groups, namely the Women's Cooperative (KOPWAN) "Kencana", Empowerment of Women Heads of Families (PEKKA), and the Women's Business Group (KUW) "Nurani Ibu" which consists of women. In trying, of course, it takes a legality to show that the business really exists. One of them is that currently the central and local governments require business owners to have a Business Identification Number or NIB. The Business Identification Number is the identity of the business actor issued by the government through the website of the OSS institution after the entrepreneur is registered. This NIB is used by business actors to obtain business licenses and / or business identities and meet the requirements for business licenses to operate. Mentoring methods implemented by writers (1) Surveys, (2) Interviews, and (3) Focused Discussions. Assistance in making NIB was carried out in Dongko Village, Dongko District, Trenggalek Regency. It is hoped that this NIB assistance can help MSMEs in Dongko Village to obtain business legality in order to facilitate the processing of other business letters, as well as show that the business does exist, operate and is worthy of standing. The target in this writing is around 20 MSMEs in Dongko Village.

Abstract

This study provides a legal analysis of the enforcement of court decisions in cases of breach of contract involving land title certificates. This study aims to analyze the judges’ legal reasoning in adjudicating the breach of contract case regarding the handover of a land title certificate in Judgment No. 2/Pdt.G/2025/PN Mad in conjunction with Judgment No. 470/PDT/2025/PT SBY, as well as the enforcement mechanisms available to the parties in such cases. The research method employed a normative legal approach using statutory, case-based, and conceptual approaches. The results indicate that the condemnatory order issued by the judge was appropriate; however, the validity of the subject matter of the agreement was not analyzed in depth, thereby affecting the enforceability of the judgment. The fact that the certificate is being used as collateral for a security interest by a third party opens the possibility of derden verzet under Article 195(6) of the HIR, while the rejection of the dwangsom removes the financial pressure on the defendant. If enforcement through aanmaning (Art. 195 in conjunction with Art. 196 of the HIR) is not carried out, the plaintiffs may pursue Art. 225 of the HIR as an alternative to convert the obligation to deliver into an equivalent sum of money. Abstract

Awig-awig as the foundation of local wisdom, including in the management of marine and fisheries resources in West Lombok. The awig-awig arrangements include the prohibition of bombing and potassium, zoning of fishing groups, pumice waste, and the collection of marine coral. Awig-awig is written as a guideline in fisheries management as a form of sustainable coastal community development. Awig-Awig as a form of collective awareness of the community whose obedience is very large which has adapted to the conditions of the local community.

Abstract

Penelitian ini dilatarbelakangi oleh rendahnya kemampuan public speaking warga belajar Paket C, yang ditandai dengan kesulitan mengungkapkan ide serta kurangnya kepercayaan diri. Penelitian ini bertujuan untuk menganalisis implementasi pembiasaan literasi membaca sebagai upaya mengembangkan kemampuan public speaking di PKBM Insan Cerdas Indonesia. Metode yang digunakan adalah deskriptif kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi, dan dokumentasi. Subjek penelitian meliputi pengelola PKBM, tutor, dan warga belajar. Analisis data dilakukan melalui tahapan pengumpulan, reduksi, penyajian, dan verifikasi data. Hasil penelitian menunjukkan bahwa pembiasaan literasi membaca dilaksanakan melalui tiga tahapan, yaitu perencanaan, pelaksanaan, dan evaluasi. Perencanaan mencakup pengenalan kegiatan, penjadwalan, dan membaca mandiri. Pelaksanaan meliputi kegiatan pembukaan, penyampaian hasil bacaan, diskusi, serta tanya jawab. Evaluasi dilakukan secara formatif melalui pengamatan selama kegiatan berlangsung. Program ini didukung oleh peran tutor, penjadwalan yang terstruktur, pemanfaatan teknologi, serta pemberian apresiasi. Meskipun demikian, terdapat hambatan berupa rendahnya motivasi, kondisi psikologis, dan keterbatasan intelektual. Secara umum, pembiasaan ini mampu mengembangkan kemampuan komunikasi warga belajar, meskipun sebagian masih mengalami kesulitan yang disebabkan oleh hambatan intelektual. Abstract

Women-headed households (PEKKA) are vulnerable to various economic, social, and psychological pressures, so they need the ability to cope with daily life. One form of non-formal education is the Women’s School Program (SEKOPER), which helps build women’s capacity, independence, and resilience in facing various challenges. This program provides women not only with practical skills but also with mental and social empowerment that helps them become stronger. This study aims to analyze the significance of the relationship between the SEKOPER Program and resilience as empirical evidence of the effectiveness of community-based non-formal education in enhancing the psychosocial resilience of female heads of households. This study employed a quantitative approach, specifically a correlational study. The sample consisted of 50 participants who were actively involved in the SEKOPER Program and had passed validity and reliability tests. Pearson’s product-moment correlation and SPSS were used to analyze the data. The results of the study indicate a positive and significant correlation between participation in the SEKOPER Program and the level of resilience among PEKKA members in Lakarsantri Subdistrict (r = 0.639; p = 0.000). These findings suggest that PEKKA members who participate more actively in the SEKOPER Program tend to have higher levels of resilience. The SEKOPER Program has demonstrated that it not only helps people acquire skills and become more self-reliant, but also helps women maintain their psychosocial resilience when facing various life challenges.

Abstract

Despite offering conveniences, digital bank services also pose a risk to customers, one of which is loss of balance. This research aims to analyze the forms of losses experienced by customers as well as the legal protection available to customers in cases of balance loss. The method used is normative juridical research with uses normative juridical research through a statutory regulation approach, case approach and conceptual approach. Data is collected through literature study and analyzed descriptively. The research results show that the forms of loss resulting from the loss of customer balances are material losses and immaterial losses, but the bank only provides responsibility in the form of compensation for material losses after a court decision states that the bank must be responsible for its actions. On the other hand, forms of legal protection for customers are provided through preventive and repressive efforts. Preventive protection is provided through statutory regulations and the Bank Agreement. On the other hand, repressive protection is provided through the imposition of sanctions to restore the situation, such as providing compensation to administrative sanctions. This research is expected to contribute to enhancing knowledge of customer rights and encourage a comprehensive regulation and protection mechanism to ensure customer protection.  Keywords: Legal Protection, Customers, and Digital Bank Services

Abstract

Research entitled "Exoneration Clause in the Goods Delivery Agreement through the Delivery Service", due to the Exoneration Clause, it can harm consumers. Issues discussed regarding the form of exoneration clauses in goods delivery agreements through shipping services and legal protection for owners of goods that are harmed due to exoneration clauses. The study uses a normative approach and a concept approach, a conclusion is obtained as follows. The form of the exoneration clause in the goods delivery agreement via the shipping service is the contents of the exoneration clause that has binding power for the parties involved in it, the contents of the exoneration clause that do not have binding power for the parties involved in it. The exoneration clause has binding power for the parties involved in it as signed. Regarding the location, form and disclosure of standard clauses, it can also be seen from the intention of the business actor, that the obligation of the business actor is in good faith in carrying out his business activities. Legal protection for the owner of the goods that is harmed by the exoneration clause is a protection given to legal subjects in the form of legal instruments both preventive and responsive, both written and unwritten. If something happens to the goods sent, such as lost or damaged, it would be better if between the shipping service and the consumer together to resolve the case by way of peace first. Consumers can submit a claim first after that the freight forwarder can process the loss in accordance with the agreement and does not need to involve the court or the Dispute Settlement Agency (BPSK).

Abstract

Marriage is a legal bond that aims to build a harmonious family based on religious values. In practice, this goal may be disturbed when one party changes their religion after the marriage has taken place. Such a change does not automatically end the marriage, but it can become a ground for divorce if it leads to disharmony in family life. Based on normative legal research using statutory, case, and conceptual approaches, it is found that judges do not focus on the religious conversion itself, but rather on its consequences in marital life, such as ongoing conflicts, living separately, loss of communication, and failure to fulfill marital duties properly. These conditions show that the purpose of marriage can no longer be achieved, so the marriage is considered irreparable. The legal consequences include the termination of the marital bond, the end of the legal relationship between husband and wife, and court decisions regarding maintenance and child custody, which prioritize the best interests of the child. Abstract

This study aims at finding out and analyzing the implementation of Restorative Justice for children of Cyber-porn offenders in the Sikka Regency Resort Police as well as to find out the obstacles and efforts in the implementation of Restorative Justice for children of Cyber-porn offenders. The type of this research is a type of empirical legal research that is descriptive and analytical. The type of data used in this study is peripheral data obtained through interviews with members of the Police Resort in Sikka district while secondary data uses primary legal materials, namely: Police regulation Number 8 of 2021 concerning the Handling of Criminal Acts Based on Restorative Justice, Law Number 11 of 2008 concerning Information and Electronic Transactions, Law Number 44 of 2008 concerning Pornography, Law Number 23 of 2002 concerning Child Protection and Law Number 11 of 012 concerning the Juvenile Justice System and for secondary legal materials and tertiary legal materials to support primary legal materials. Data collection is carried out by means of interviews and literature/documents. The technique used in this study uses qualitative analysis techniques. Cyber-porn crimes involving children, both perpetrators and victims in the community of Sikka Regency are still considered a disgrace so there are still many who do not want to report it to the police. In addition, investigators in implementing Restorative Justice are guided by Regulation of the Republic of Indonesia National Police Number 8 of 2021 concerning the Handling of Crimes Based on Restorative Justice, but in fact there are still many investigators who do not understand and master the application of Restorative Justice. Obstacles and efforts in the implementation of Restorative Justice for children of Cyber-porn offenders, especially in the community and Sikka Regency Resort Police officers.
