Abstract

Dispute of dishonorable discharge of police members, with a study on Decision Number 18/G/2025/PTUN.MDN, The main focus of this research is where the plaintiff objects to the procedure and substance of his dismissal. This research aims to determine the legal considerations of the Medan PTUN panel of judges in deciding the PTDH dispute of police members in decision number 18/G/2025/PTUN.MDN from the perspective of siyāsah qaḍā’iyyah. The research method used is normative legal research with a statutory approach and a conceptual approach. Data were obtained through a literature study of relevant laws and regulations and fiqh siyāsah literature. The Medan PTUN decision in this case still raises legal debate because it does not consider the procedural and substantial aspects of the dismissal of Polri members. This research contributes to improving the practice of administrative justice in Indonesia, especially in Polri personnel disputes

Abstract

This study aims to analyze corporate responsibility in providing Personal Protective Equipment (PPE) for workers at the can manufacturing factory of CV. Murni Sarkum based on the Regulation of the Minister of Manpower of the Republic of Indonesia No. 8 of 2010 from the perspective of maqāṣid al-sharīʿah. The research employs a qualitative approach with an empirical juridical method, examining the relationship between applicable legal norms and their implementation in practice. Primary data were obtained through interviews and direct observation of workplace safety policies, while secondary data were derived from statutory regulations—particularly Ministerial Regulation No. 8 of 2010 concerning Personal Protective Equipment and Law No. 13 of 2003 on Manpower—as well as scholarly literature on maqāṣid al-sharīʿah and Islamic business ethics. The findings indicate that the provisions of Ministerial Regulation No. 8 of 2010 are substantively aligned with the principles of maqāṣid al-sharīʿah, especially ḥifẓ al-nafs (protection of life), which emphasizes the importance of occupational safety and health. However, its implementation in the factory remains suboptimal, as the provision of PPE tends to be carried out merely as an administrative obligation and is not accompanied by adequate supervision, training, and worker awareness. This study concludes that the maqāṣid al-sharīʿah approach can serve as an ethical paradigm in occupational safety and health practices, where the provision of PPE is understood not only as a legal obligation but also as a moral and social responsibility aimed at safeguarding human life and promoting public welfare.

Abstract

The rapid development of Artificial Intelligence (AI) raises complex legal questions regarding ownership and copyright protection of works generated through algorithmic systems. AI can produce text, images, music, and other creative outputs with economic value, yet it lacks legal personality, intention, and moral responsibility. This situation creates normative challenges in both contemporary copyright law and Islamic legal discourse, particularly in determining ownership and accountability for AI-generated works. In Islamic law, the absence of explicit classical rulings on AI-based creativity requires new interpretative approaches that integrate traditional legal principles with modern technological realities. This study aims to analyze the construction of ownership and copyright protection of AI-generated works from the perspective of Islamic law by examining the normative principles contained in the fatwas of the Indonesian Ulema Council (MUI). The research employs normative legal methods using conceptual, statutory, and maqasid al-shari‘ah approaches based on library research. The findings show that AI-generated works can be classified as mal hukmi (intangible property) because they possess economic value, utility, and social recognition. Their protection therefore aligns with the principle of hifz al-mal. Although no MUI fatwa explicitly regulates AI copyright, the principles in MUI Fatwa No. 24 of 2017 indicate that digital systems function only as instruments (wasilah), while legal responsibility remains with humans. Consequently, AI cannot be considered a legal subject, and copyright ownership is most appropriately attributed to users who actively direct the creative process. This study demonstrates that Islamic law, through maqasid al-shari‘ah and contemporary fatwas, provides a normative framework for addressing emerging issues of AI governance and intellectual property in the digital era.

Abstract

Perkembangan usaha jasa katering di Kota Medan belum sepenuhnya diiringi dengan kepemilikan sertifikat halal. Padahal pemerintah telah mengatur kewajiban sertifikasi halal bagi setiap pelaku usaha. Kondisi tersebut tentunya menimbulkan kekhawatiran bagi konsumen dan menunjukkan pentingnya perlindungan konsumen. Penelitian ini membahas tentang kepatuhan pelaku usaha catering di Kota Medan terhadap kewajiban sertifikasi halal berdasarkan Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal dan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Metode penelitian yang digunakan adalah metode yuridis empiris, melalui wawancara dan observasi langsung terhadap pelaku usaha catering serta konsumen di Kota Medan. Hasil penelitian menunjukkan bahwa tingkat kepatuhan pelaku usaha katering tergolong rendah. Banyak pelaku usaha yang belum memiliki sertifikat halal karena terkendala biaya, sulit mengganti bahan baku yang dianggap memengaruhi cita rasa, minimnya pengetahuan mengenai prosedur sertifikasi, serta lemahnya sosialisasi dan penegakan hukum dari pemerintah. Kepatuhan yang muncul umumnya bersifat instrumental, yaitu hanya dilakukan jika ada kepentingan seperti mengikuti tender atau kerjasama dengan pemerintah.

Abstract

Introduction : Among the gravest complications occurring during childbirth are fourth-degree perineal lacerations, characterized by complete disruption of the anal sphincter mechanism with potential for persistent sequelae including fecal incontinence and impaired sexual health. These traumatic injuries profoundly compromise women's wellbeing, with sexual health disturbances documented in 30-60% of affected women three months following delivery. The Female Sexual Function Index (FSFI) provides validated assessment across six critical dimensions: libido, arousal capacity, vaginal lubrication, orgasmic function, overall satisfaction, and dyspareunia. Case presentation: We present the clinical course of a 33 year old multiparous woman who sought consultation nine months postpartum with chronic fourth-degree perineal disruption accompanied by anal incontinence and sexual dysfunction. Initial FSFI assessment revealed a score of 16.2, demonstrating substantial sexual impairment. Surgical intervention employed a comprehensive ten-stage reconstruction protocol involving systematic restoration of anal mucosa, internal and external sphincter components, vaginal wall integrity, and perineal tissue architecture. At five-month postoperative evaluation, the patient exhibited complete continence restoration and remarkable sexual function recovery, with FSFI scoring advancing to 28.0, indicating normalization of sexual health parameters. Quality of life indicators demonstrated meaningful enhancement across all assessed dimensions. Conclusion: Secondary reconstruction of chronic fourth-degree perineal disruptions can successfully restore both continence mechanisms and sexual function when executed using meticulous surgical methodology. Prompt recognition and appropriate timing of intervention remain paramount for achieving optimal patient outcomes and restoring quality of life.
