Abstract

The background of this research is the existence of leasing transactions (ijarah) where the lessee and the lessee (goods owner) have an agreement to sell or grant the leased goods at the end of the lease term, so that this transaction ends with a transfer of ownership of the leased property. In fact, the ownership of the leased assets is not transferred in the Ijarah contract. However, if the lessee wishes to own the property for lease, this can be exercised through put options and/or grants at the end of the contract. The form of leasing in Contemporary Fiqh Mu'amalah above is called Ijarah Muntahiya Bit Tamlik (IMBT) and this transaction already contains provisions as the basis for its implementation in the form of a DSN-MUI fatwa. With the innovation of the contract in the rental contract, it is inseparable from the problem of disputes that might arise in it. Therefore, this study aims to find out the settlement of disputes in Ijarah Muntahiya Bit Tamlik based on MUI Fatwa Number: 27/DSN-MUI/III/2022. The transaction, known as Ijarah Muntahiya Bit Tamlik (IMBT), is a kind of combination of a lease agreement with a sale and purchase contract or a lease agreement with a grant, or more precisely, a lease agreement that ends with the ownership of the rented object in the hands of the lessee. The nature of the transfer of ownership is also what distinguishes it from ijarah in general. As for IMBT financing in Islamic banking, it has the same treatment as murabahah contract financing. The similarity between the two is that the financing is included in the natural certainty contract category, and basically is a sale and purchase contract. The difference between these two types of financing is only in the object of the transaction being traded. In murabahah financing, the object of the transaction is goods such as a house or car, whereas in ijarah financing, the object of the transaction is a service, both benefits for goods and benefits for labour. The implementation of the IMBT contract in Islamic banking is that the bank provides financing to the customer by procuring an item which is then leased to the customer, and at the end of the lease the ownership of the item passes to the customer, after the customer has paid off the lease as well as the remainder of the purchase. This transfer of ownership can use a sale and purchase contract or a grant contract. In financing Ijarah Mutahiya Bit Tamlik (IMBT), if in the future there is a dispute between the customer and the bank, then according to the DSN-MUI Fatwa Number: 27/DSN-MUI/III/2002 concerning Ijarah Mutahiya Bit Tamlik (IMBT) it can be resolved through two options, namely by way of deliberation and/or through the Sharia Arbitration Board. The Sharia Arbitration Board is the final step in resolving IMBT disputes after deliberations cannot resolve the dispute.

Abstract

Artikel ini bertujuan untuk menjelaskan tentang pelaksanaan akad murabahah bil wakalah pada KCP Bank Syariah Indonesia di Pamanukan. Adapun penelitian yang dilaksanakan dalam artikel ini menggunakan metode kualitatif. Sumber data ini diambil dari sumber tertulis yang berikan dengan akad murabahah bil wakalah pada dunia perbankan. Jenis data yang diambil dalam artikel ini adalah jenis data kualitatif. Teknik pengumpulan data ini diambil dari beberapa jurnal dan wawancara. serta informasi informasi yang ada di internet. Teknik analisis data dalam artikel ini menggunakan teknis narasi. Berdasarkan penelitian yang telah dilakukan menyatakan bahwa penerapan atau pelaksanaan murabahah bil wakalah dapat diterapkan dalam transaksi jual beli. Yang mana didalamnya ketika pembelian diwakilkan oleh pihak nasabah dan jika produk tersebut telah didapatkan maka, produk dikembalikan lagi pda pihak bank. Dan pihak bank dapat menjual nya dengan cara menyebutkan keuntungan awalnya kepada nasabah. Transaksi ini merupakan transaksi yang banyak dan mudah dilaksanakan. Selain untuk melakukan transaksi, akad murabahah bil wakalah digunakan oleh bank syariah indonesia kcp pamanukan ini untuk menyediakan modal kerja atau usaha nasabah.

Abstract

RSUD dr. Rasidin merupakan rumah sakit umum tipe C yang berlokasi di Kota Padang. Salah satu unit penunjang pelayanan medis di rumah sakit ini adalah Instalasi Farmasi, yang bertanggung jawab atas penyediaan dan pengelolaan obat serta Bahan Medis Habis Pakai (BMHP). Saat ini, instalasi tersebut menangani lebih dari 743 jenis obat dan 1.259 jenis BMHP. Namun, masih terdapat beberapa permasalahan yang dihadapi, seperti sering terjadinya kekosongan stok, keterlambatan retur obat atau BMHP yang mendekati kedaluwarsa, serta lambatnya pelaporan keuangan farmasi. Permasalahan ini menunjukkan bahwa sistem yang digunakan saat ini belum mampu menyediakan informasi secara real time, cepat, dan akurat. Penelitian ini bertujuan untuk merancang sistem informasi persediaan yang terintegrasi guna membantu Instalasi Farmasi dalam mengelola data persediaan serta menyajikan laporan secara berkala dan efisien. Pengembangan sistem dilakukan dengan menggunakan metode Waterfall, yang mencakup tahap analisis kebutuhan, desain sistem, implementasi, serta pengujian. Hasil dari perancangan ini berupa aplikasi berbasis website yang mengintegrasikan seluruh data dari gudang dan depo farmasi ke dalam satu basis data pusat. Sistem ini juga mampu memberikan informasi terkait item yang sudah waktunya dipesan ulang serta obat atau BMHP yang dapat diretur, dengan menggunakan metode Min-Max Inventory. Selain itu, sistem menghitung jumlah pemesanan yang diperlukan secara otomatis, sehingga dapat mendukung kepala instalasi farmasi dalam proses pengambilan keputusan pengadaan

Abstract

This paper looks at how the community can play a significant role in promoting social justice in urban sustainability initiatives and how the practice of grassroots is relevant in achieving equitable and sustainable urban futures. Although sustainability initiatives have become the norm and are widely applied, these initiatives are not typically approached with managerial techniques framing them as a justice-providing mechanism but as a procedural requirement, which leads to exclusion and tokenism and marginalizes vulnerable populations. This study relies on a qualitative research design based on the in-depth interviews, focus groups discussions, and field observation within urban populations in an attempt to understand the experiences of participation, the challenge, and redefinition of participation as experienced by the bottom-up. The results show that communities implement justice in a variety of ways, among which are integration of local knowledge, solidarity networks, inclusion and engagement strategies, grassroots advocacy, and the everyday ethics of care. The practices exemplify the ways distributive, procedural, and relational aspects of justice are integrated into community everyday life and tend to fill gaps that may exist in formal institutions. This paper presents a thesis that sustainability management should remake participation not as symbolic gesture but as power-sharing process that considers communities as co-producers of justice and sustainability. This necessitates that managers should integrate equity as a guiding concept, appreciate community-based practices as a knowledge system that is legitimate and reconfigure governance institutions to enable true collaboration. This study will lead to advances in management literature by aligning sustainability, social justice and community governance, through the centrality of justice as a part of participation, and in practical terms, to the policymaker and practitioner.
