Abstract

Kebijakan Integral Penanggulangan Kejahatan adalah sebuah upaya yang menerapkan pendekatan komprehensif dan holistik untuk mengatasi masalah kejahatan di masyarakat. Kebijakan ini mencakup penguatan dan integrasi berbagai aspek penanggulangan kejahatan seperti pencegahan, penindakan, serta rehabilitasi dengan tujuan menciptakan lingkungan yang aman dan nyaman bagi seluruh warga. Melalui kerjasama dan koordinasi antara pemerintah, lembaga penegak hukum, dan masyarakat, efektivitas penanggulangan kejahatan diharapkan meningkat. Pendekatan ini juga melibatkan pencegahan melalui pendidikan, sosialisasi, serta pembangunan infrastruktur yang mendukung keamanan dan ketertiban. Pelaksanaan kebijakan ini melibatkan strategi, program, dan kegiatan terintegrasi seperti peningkatan patroli keamanan, kesadaran masyarakat tentang kejahatan, serta bantuan dan rehabilitasi bagi pelaku kejahatan. Dengan demikian, diharapkan terbentuk lingkungan yang aman, sejahtera, dan bebas dari kejahatan. Kata kunci: Pendekatan Komprehensif, Kerjasama Multisektoral, Rehabilitasi Kejahatan

Abstract

Case No.135/Pdt.G/2022/MS/Ttn is a divorce case filed by the husband because it cannot be defended anymore. One of the consequences is that the husband is burdened to pay maintenance, namely madhiyah, iddah, and mut'ah. A wife can apply to the Panel of Judges to request payment of maintenance if the husband does not fulfill his obligation to provide. This research aims to find out the judge's consideration by not giving 1/3 of the salary to the ex-wife who is divorced by a husband who works as a civil servant. Whereas as in Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 the wife gets 1/3 of the salary of the husband who is a civil servant after the divorce. This research is a type of library research and uses a statutory approach (statue approach) case approach and uses an analytical descriptive method and uses a deductive mindset. Legal materials consist of primary legal materials, namely decision No.135/Pdt.G/2022/MS/Ttn, Marriage Law Number 1 of 1974, Compilation of Islamic Law, Government Regulation No.10 of 1983 jo Government Regulation No. 45 of 1990. The result of this research is that the Judge does not issue 1/3 husband's salary based on Government Regulation No. 8 of 1983 jo Government Regulation No. 45 of 1990 to the divorced ex-wife. With consideration because the Respondent/wife is also a civil servant. The judge prioritizes the principle of justice for the community that is not a civil servant. Abstract

The purpose of this study is to determine the relationship between the issuance of Supreme Court Decision Number 73/KMA/HK.01/IX/2015 with the Multibar concept and to determine the negative impact of the Multibar concept if applied to the Advocate Organization in Indonesia. The problem in this study is because there has been a debate on the Supreme Court Decision Number 73/KMA/HK.01/IX/2015 which tends to favor the Multibar concept . This study uses the Normative Juridical method, namely analyzing problems through a legal principles approach that refers to legal norms contained in legislation. The results of the discussion, namely the issuance of the Supreme Court Decision Number 73/KMA/HK.01/IX/2015, show that if the decision is more in favor of the Multibar Concept, in this case it can certainly cause debate, chaos, violate higher laws, divide the Advocate Organization and can harm the Advocate profession.

Abstract

This study aims to analyze the role of advocates in realizing distributive justice and commutative justice, especially in the context of defending client rights in the legal system. The problem of this research focus on how advocates play a role in both types of justice, both in the fair distribution of resources ( distributive justice ) and in ensuring a balance of rights and Obsessions in relationships between individuals ( commutative justice ). This research is motivated by the strategic role of advocates in the justice system that can support the achievement of justice through defending the rights of individual and groups. Distributive justice is related to the fair distribution of resources, while commutative justice emphasizes the fulfillment of equal obligations in legal relationships between parties. This study uses a normative research method, namely by analyzing legal norms that regulate the role of advocates in realizing both types of justice, as well as various relevant legal literature. The roles of advocates shows that advocates have an important role in supporting distributive justice by helping marginalized or disadvantaged clients get their rights, and play a role in creating commutative justice by ensuring the exchange of rights and obligations between parties involved in the dispute. This study provides insight into the importance of the role of advocates in realizing more equitable and balanced justice in society.

Abstract

The aim of this research is to examine the role of advocates in upholding the principles of justice in the judiciary , and the challenges they face . How important is the existence of advocates in the justice system in Indonesia, because advocates in carrying out their professions are free to enter all stages of the investigation process , police investigations , prosecutors and courts ( civil , criminal , administrative , labor , business competition , and so on ). An advocate can even provide legal advice and assistance to people who have legal problems outside the judicial process (non- litigation) resolution ). Thus , advocates as law enforcement officer play an important role in creating certainty , justice and legal benefits in the Indonesian justice system . The role of advocates is very important in upholding the principles of justice in Indonesian courts , especially in the adversarial justice system . Their main task is to protect clients ' rights and ensure that the legal process takes place fairly and transparently . What are the roles of advocates in upholding the principles of justice in the judiciary ? And what challenges do advocates face in carrying out their function to uphold justice ? This research uses a normative method that combined literature reviews to explore these dynamics . It is hope that the research results will provide a better understanding of how advocates can increase their effectiveness in upholding justice , as well as support the reforms needed to create a legal system that is fairer and more responsive to the needs of society . Thus , this research will contribute to a deeper understanding of the challenges and opportunities face by advocates in carrying out their profession in the modern era .

Abstract

This research aims to analyze and find out how legal protection for creditors. Fintech Peer to Peer Landing Syariah raises a legal problem such as bad credit or default by the debtor so that it has an impact on losses to creditors. This research uses normative legal research methods. Legal protection for online loan users is a major issue in the development of peer to peer lending. Consumer protection regulations are regulated in various rules, one of which is the Financial Services Authority Regulation Number 22 of 2023. In this case, the lender as a creditor has the right to collect and can cooperate with other parties to collect credit or financing from debtors who default. And the form of responsibility of the organizer should be able to provide protection funds in the form of credit or financing insurance. In the view of Islam, insurance is allowed as long as it is in accordance with Islamic principles, sharia insurance uses a tabarru 'contract which has the aim of helping. The legal basis of Islamic insurance is Al-Maidah verse 2, An-Nisa verse 9 and the narration of HR Muslim Abu Hurairah, Fatwa No. 21/DSN-MUI/X/2001, Fatwa No. 51/DSN-MUI/III/2006, Fatwa No. 52/DSN-MUI/III/2006, and Minister of Finance Regulation No. 18/PMK.010/2010.

Abstract

Advocates are one of the key pillars in upholding the law, serving as a bridge between society and the judicial system. From an Islamic perspective, justice is a fundamental value that must be upheld in every action, including in the practice of advocacy. This study aims to examine the responsibilities of advocates in defending clients based on the Islamic perspective and to analyze the legal consequences for advocates who fail to defend clients with fairness, honesty, and truthfulness. The method used in this research is normative juridical. The study reveals that advocates in Islam are responsible for upholding justice ('adl) in accordance with Sharia principles. Their defense must be based on the values of truth (haqq), without manipulating facts or defending unjust cases. Advocates who violate these principles are not only at risk of facing legal sanctions under the law but also bear spiritual consequences in the form of grave sins. In Islam, justice is not merely procedural but also substantial, emphasizing balance, honesty, and moral integrity. This study recommends strengthening regulations, raising awareness of Islamic values, and integrating Islamic principles of justice into advocacy practices to ensure that the profession contributes to achieving true justice, both in this world and in the hereafter.

Abstract

The purpose of this study is to analyze the factors that cause violations of the code of ethics committed by an advocate so that in exercising his authority he can act in accordance with applicable moral and professional standards. Every professional profession has moral principles that are regulated in a code of ethics, including advocates. The application of the code of ethics in the Advocate profession is very important because it is used as a form of moral resilience for the Advocate profession. In reality, the implementation of law in the field there are still advocates who violate the advocate code of ethics. This research aims to analyze the code of ethics applied by the advocate profession so that in exercising its authority it can act in accordance with applicable moral and professional standards. This research uses qualitative methods with library research techniques emphasizing sources of information from law books, journals and papers that have a relevant relationship with the title discussed. The results obtained ideally professional ethics is a regulator of law enforcement behavior as part of efforts to realize good and fair law enforcement. The advocate's code of ethics as a juridical basis in carrying out the profession acts to guarantee and provide protection to advocates from deviant actions, although on the other hand humanity certainly imposes a great responsibility for an advocate in carrying out his profession. Advocates have a code of ethics which is regulated in the articles in the Indonesian Advocates Code of Ethics (KEAI) 2002. Advocates also have a supervisory board formed by the advocate organization and is authorized to oversee the implementation of the professional code of ethics

However, even though role this is very important, advocate face various challenges, including lack of understanding about draft diversion, discontinuity regulation, inequality power in mediation, as well as obstacle cultural and social. Abstract

The legal norm contained within Article 42 of the Marriage Law rigidly stipulates that the legal validity of a child depends on the legality of the marriage of their biological parents. The provisions of this norm have raised legal problems for children from illegitimate marriages, especially concerning their civil rights. Departing from the Constitutional Court Decision Number 46/PUU-VIII/2010 which gave rise to a controversial discourse by giving illegitimate children the right to a civil relationship with their father, the Religious Court formulated a new norm for the status of children as biological children to accommodate the protection of children's rights, but there remain legal issues in determining such status and in practice, it remains unable to accommodate children's civil rights. This study aims to explore the considerations of the Religious Court's decision in determining biological children and its legal consequences for the enforcement of children's civil rights, and then offer a legal reconstruction of the determination of biological children. This  is a normative legal research with a statutory approach, a case approach, and a conceptual approach. Data analysis is qualitative with seven thematic steps. The results of this study indicate that in considering the decision of the Religious Court, the judge considered the marriage carried out by the parties invalid because the marriage witnesses and marriage guardians were invalid. In the judge's view, an illegitimate marriage is adultery, so that the child born from it is a child of adultery, so he cannot be related to his father, but they can still obtain other limited civil rights. This study concludes that there is a fatal misconception in placing children from illegitimate marriages as children of adultery or biological children. Determination of the child's status as a biological child in the decision of the Religious Court is a legal formulation that is contrary to the norms of the Marriage Law, Islamic Law, and fiqh. The legal construction in determining the status of a biological child is not oriented towards substantial justice for children, contrary to the principle of liability based on fault, retributive justice, and the principle of nemo commodum capere potest de injuria sua propria. However, this legal construction is based on the norm of Article 42 of the Marriage Law, for that it must be reconstructed. The substantial justice approach requires that children born in or as a result of an illegitimate marriage must continue to be treated as legitimate children with all the legal consequences.Keywords: Biological Children, Illegal Marriage, Religious Court Decisions, Legal Reconstruction AbstrakNorma Pasal 42 Undang-Undang Perkawinan menetapkan secara rigid hukum keabsahan anak bergantung pada keabsahan pernikahan orang tua biologisnya. Ketentuan norma ini telah menimbulkan problematika hukum terhadap anak hasil perkawinan yang tidak sah, terutama menyangkut hak-hak perdatanya. Berangkat dari Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 yang melahirkan wacana kontroversial dengan memberikan anak luar kawin hak berupa hubungan perdata dengan ayahnya, Peradilan Agama memformulasi norma baru status anak berupa anak biologis untuk mengakomodasi perlindungan hak anak, tetapi terdapat problem hukum dalam penetapan status ini dan dalam praktiknya tidak benar-benar dapat mengakomodasi hak perdata anak.  Penelitian ini hendak menggali pertimbangan putusan Pengadilan Agama dalam penetapan anak biologis dan akibat hukumnya terhadap penegakan hak-hak perdata anak, dan selanjutnya menawarkan rekonstruksi hukum terhadap penetapan anak biologis. Penelitian ini bersifat hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Analisis data bersifat kualitatif dengan tujuh langkah tematik. Hasil penelitian ini menunjukkan bahwa dalam pertimbangan putusan Pengadilan Agama, hakim menilai pernikahan yang dilakukan oleh para pihak tidak sah karena tidak sahnya saksi nikah dan wali nikah. Dalam pandangan hakim, pernikahan yang tidak sah itu adalah zina, sehingga anak yang dilahirkan darinya adalah anak zina, maka ia tidak dapat dinasabkan kepada ayahnya, tetapi ia tetap dapat memperoleh hak-hak perdata lainnya secara terbatas. Penelitian ini menyimpulkan bahwa terdapat salah kaprah yang fatal dengan mendudukkan anak hasil perkawinan tidak sah sebagai anak zina atau anak biologis. Penetapan status anak sebagai anak biologis dalam putusan Pengadilan Agama merupakan formulasi hukum yang bertentangan dengan norma Undang-Undang Perkawinan, KHI, dan fikih. Konstruksi hukum dalam penetapan status anak biologis tersebut tidak berorientasi pada keadilan substansial bagi anak, bertentangan dengan prinsip liability based on fault, keadilan retributif, dan asas nemo commodum capere potest de injuria sua propria. Namun, kontruksi hukum ini berpangkal dari norma Pasal 42 Undang-Undang Perkawinan, untuk itu harus dilakukan rekonstruksi terhadapnya. Pendekatan keadilan substansial menghendaki anak yang dilahirkan dalam atau sebagai akibat perkawinan yang tidak sah harus tetap didudukkan sebagai anak yang sah dengan segala akibat hukumnyaKata Kunci: Anak Biologis, Perkawinan Tidak Sah, Putusan Pengadilan Agama, Rekonstruksi Hukum
