Abstract

In an effort to tackle corruption that impedes Indonesia's social and economic progress, this service project focuses on the effectiveness of anti-corruption counseling to increase integrity and transparency among students, education personnel, and the community. Using Service Learning methodology, this activity involves counseling integrated in the learning process and community service delivery, with the cooperation of the West Java High Prosecutor's Office to ensure the relevance of the material. Results showed an increase in participants' awareness and competence in identifying and countering corruption, with 85% reporting increased capacity. The outreach also successfully promoted a culture of integrity and triggered local initiatives for greater transparency in resource management, strengthening the legal and institutional framework through policy advocacy. The findings support the need for expansion of similar programs and increased collaboration between sectors to strengthen corruption eradication efforts in Indonesia.

Abstract

Legal enforcement of criminal acts of freedom of expression based on the ITE Law regarding violations of human rights can be said that the ITE Law should no longer regulate punishment for freedom of opinion, but should focus more on legal issues regarding electronic media as a whole, because the punishment itself is regulated in the Criminal Code. Meanwhile, to minimize the occurrence of multiple interpretations, the ITE Law must include limitations on freedom of opinion in its articles. Legal protection for the right to freedom of expression in Indonesia in the ITE Law has not received the protection it should. In the ITE Law, there is only one article provision relating to the right to freedom of expression via internet media, namely in Article 27 A. Legal provisions regarding violations of the ITE Law are regulated in Article 27 A in conjunction with Article 45 paragraph (4). This article contains provisions that still have multiple interpretations, and even tend to be subjective, so that in their implementation they will cause many problems. Keywords: Crime, Freedom of Opinion, Human Rights  AbstrakPenegakan hukum tindak pidana kebebasan berpendapat berdasarkan UU ITE terkait pelanggaran hak asasi manusia dapat dikatakan bahwa seharusnya UU ITE tidak lagi mengatur pemidanaan terhadap kebebasan berpendapat, akan tetapi lebih fokus ke masalah hukum media elektronik secara keseluruhan, karena pemidanaan sendiri sudah diatur dalam KUHP. Adapun untuk meminimalisir terjadinya multitafsir, UU ITE di dalam pasalnya harus dituangkan batasan kebebasan berpendapat. Perlindungan hukum terhadap hak kebebasan berpendapat di Indonesia dalam UU ITE belum mendapat perlindungan sebagaimana mestinya. Dalam UU ITE, hanya terdapat satu ketentuan pasal yang berkaitan dengan hak kebebasan menyatakan pendapat melalui media internet, yaitu dalam Pasal 27 A. Ketentuan hukum terhadap pelanggaran UU ITE diatur dalam Pasal 27 A juncto Pasal 45 ayat (4). Dalam pasal tersebut memuat ketentuan yang masih multitafsir, bahkan cenderung subjektif, sehingga dalam pelaksanaannya akan menimbulkan banyak permasalahan. Kata Kunci: Ancaman Pidana, Kebebasan Berpendapat, HAM

Abstract

Penelitian ini membahas perlindungan hukum terhadap peserta program Jaminan Kesehatan Nasional (BPJS Kesehatan) di Indonesia, dengan fokus pada tanggung jawab rumah sakit dalam memenuhi hak-hak pasien. Jaminan sosial kesehatan merupakan salah satu cara untuk memastikan bahwa setiap individu mendapatkan akses terhadap layanan kesehatan yang layak, sesuai dengan Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Meskipun demikian, banyak rumah sakit yang masih gagal memenuhi hak-hak pasien, yang dapat mengakibatkan pelanggaran hukum. Penelitian ini menggunakan metode yuridis normatif untuk menganalisis peraturan yang berlaku, termasuk Undang-Undang Nomor 44 Tahun 2009 tentang Rumah Sakit dan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Hasil penelitian menunjukkan bahwa rumah sakit memiliki kewajiban untuk memberikan pelayanan yang aman dan berkualitas, serta menerima kritik dari pasien. Selain itu, terdapat sanksi administratif bagi rumah sakit yang menolak memberikan layanan kepada peserta BPJS. Dengan demikian, perlindungan hukum yang kuat diperlukan untuk memastikan bahwa hak-hak pasien dihormati dan dilindungi, serta untuk meningkatkan kualitas layanan kesehatan di Indonesia. Penelitian ini diharapkan dapat memberikan wawasan bagi pembuat kebijakan dan pemangku kepentingan dalam meningkatkan sistem jaminan kesehatan di Indonesia.

Abstract

Penegakan hukum terhadap tindak pidana korporasi, khususnya yang berkaitan dengan pencemaran lingkungan, menjadi isu penting di Indonesia. Penelitian ini bertujuan untuk menganalisis tantangan dan efektivitas penegakan hukum dalam konteks kebakaran hutan yang disebabkan oleh aktivitas perusahaan. Meskipun terdapat peraturan perundang-undangan yang mengatur tanggung jawab pidana korporasi, penerapannya masih minim. Kesulitan dalam membuktikan niat kriminal (mens rea) dan pertanggungjawaban korporasi, serta adanya lobi kuat dari korporasi, menjadi hambatan signifikan dalam proses hukum. Metode penelitian yang digunakan adalah yuridis normatif, dengan fokus pada analisis norma hukum yang relevan. Hasil penelitian menunjukkan bahwa dampak jangka panjang dari kejahatan korporasi terhadap lingkungan memerlukan penegakan hukum yang lebih efektif. Oleh karena itu, disarankan untuk meningkatkan kapasitas penegak hukum, memperkuat regulasi yang mengatur tanggung jawab pidana korporasi, serta mendorong partisipasi masyarakat dalam pengawasan. Selain itu, pengembangan mekanisme penyelesaian sengketa yang efisien, seperti mediasi, dapat membantu menyelesaikan konflik antara korporasi dan masyarakat. Penelitian ini diharapkan dapat memberikan gambaran komprehensif mengenai keadaan hukum yang berlaku dan mendorong langkah-langkah konkret untuk memperkuat penegakan hukum terhadap kejahatan korporasi di Indonesia.

Abstract

Corruption in Indonesia is a serious problem that not only results in significant financial losses, but also has the potential to destroy social, economic, and democratic stability. Corruption has become a systematic crime, causing state losses of trillions of rupiah every year. This study aims to analyze various factors that affect the increase in corruption cases and the effectiveness of legal policies in eradicating them. Using a normative juridical approach, this study examines applicable regulations, including Law Number 20 of 2001 which regulates the reversal of the burden of proof in corruption cases. This study found that the implementation of a reverse evidentiary system can speed up the legal process and help uncover the material truth. However, the main challenges in eradicating corruption are low law enforcement, a permissive culture of law violations, and incompatibility of the law with the dynamics in the field. Therefore, periodic evaluation of regulations, strengthening the integrity of law enforcement officials, and strict supervision of the state budget are necessary. It is hoped that with these steps, efforts to eradicate corruption in Indonesia can be more optimal and have a positive impact on people's welfare.

Abstract

The government as a state implementing agency must strive for health insurance for every citizen, so that every citizen truly gets the right and protection to be healthy, as stipulated in Law Number 40 of 2004 concerning the National Social Security System. In fact, many residents complain about being rejected by the hospital when they are seeking treatment using BPJS services. The purpose of this study was to find out the reasons for the hospital's refusal of patients participating in the Social Security Administering Body (BPJS), and to find out the form of legal protection for BPJS Health's accountability regarding hospital refusal to the BPJS program participant community. The method used in this study is descriptive analytical with a normative juridical approach. The results of the study stated that there were cases of refusal from several hospitals to patients in terms of providing emergency services, this arrangement was explained in the RI Minister of Health. Number 1 of 2012 concerning the Individual Health Service Referral System. Rejection on purpose or in room mode has violated the MoU with BPJS as well as Law no. 24 of 2011 concerning BPJS. All patients must be accepted and served properly, no rejections. According to Law Number 24 of 2011 concerning BPJS, private and government hospitals are prohibited from turning away patients or asking for advance payments as regulated in Article 85 of the health Law. As for the suggestions that the author wants to convey, it is necessary to carry out more socialization to the community so that they can use BPJS Health properly. By taking into account the aspects of liquidity, solvency, prudence, security of funds, and adequate results and there should be strict sanctions for refusal of hospitals that are BPJS Health partners and addition of hospitals that are BPJS partners

Abstract

This research aims to explore the potential implementation of restorative justice in the resolution of press offense disputes in Indonesia, with a focus on Law No. 40/1999 on the Press. The urgency of this research arises from the need to reduce the burden on the increasingly heavy judicial system and increase the effectiveness of media dispute resolution. In this context, restorative justice can be a more humane and efficient alternative to conventional litigation approaches. The scope of the problem includes the lack of regulations supporting restorative mechanisms in the Press Law, as well as practical challenges in implementing mediation in Indonesia. The main findings show that restorative justice can help restore social relations between the parties involved, in a more constructive way, rather than simply imposing punishment. The novelty of this research lies in identifying the potential application of restorative justice in the context of press disputes, as well as the role of the Press Council as a mediator in dispute resolution mechanisms. The method used in this research is legal analysis and comparison of legal systems in other countries, as well as a study of restorative justice theory and its application in press disputes in Indonesia.

Abstract

This study aims to evaluate the application of restorative justice (RJ) in reducing recidivism in Indonesia, focusing on its effectiveness, implementation challenges, and potential development in the adult criminal justice system. The method used was a qualitative approach with interviews with judges, prosecutors, and mediators at the Bogor District Court as well as case studies of RJ implementation. The results show that although restorative justice (RJ) offers a more rehabilitative solution compared to conventional approaches, its application in Indonesia is still limited by a lack of understanding of legal officers, social resistance, and limited resources. For example, while in New Zealand the recidivism rate of RJ participants is only 17%, in Indonesia, barriers such as lack of mediator training and limited mediation facilities reduce the effectiveness of the program. This study concludes that the implementation of restorative justice (RJ) can reduce recidivism if followed by increased resource capacity, training of legal officers, and community support. The contribution of this research to science is to provide insights into the implementation of RJ in the Indonesian context, as well as suggest measures to overcome the challenges, in order to improve a more rehabilitative criminal justice system.

Abstract

In this article, the author will analyze the ratio decidendi of the judge's decision in the case of marriage annulment which shows the existence of an antinomy between Justice and Legal Certainty based on decision Number 3617/Pdt.G/2021PA. Dpk, decision Number 36/Pdt.G/2022/PTA. Bdg and decision Number 811 K/Ag/2022. The results of the study show that in marriage annulment cases, the panel of judges of first instance, the panel of appellate judges and the panel of cassation have different ratios decidendi in their legal considerations, so that from the three decisions there is an antinomy (contradiction) between justice and certainty. The panel of judges of the first instance, which considers one legal fact, but ignores other legal facts, causes the lack of legal certainty. The Appellate Panel considered that Article 27 paragraph (3) of Law Number 1 of 1974 had fulfilled legal certainty, but ignored other legal facts so as to ignore the values of justice. On the other hand, the Cassation Panel in its ratio decidendi decision has considered various legal facts, both formally and materially, so that it has considered two legal ideals, namely justice and legal certainty in a proportionate and balanced manner.

Abstract

This study aims to explore the legal protection for consumers who use the services of dentists for braces in Indonesia. People need good dental health services, but many turns to dentists who offer more affordable prices without understanding the risks involved. Dentists are legally only allowed to make and install removable dentures, while medical procedures such as braces and veneers are outside their authority. This results in many consumers experiencing serious health problems, such as swollen gums and infections, but most patients do not file complaints or lawsuits due to a lack of understanding of their rights. This study includes a normative review of applicable legal regulations, including Law Number 8 of 1999 concerning Consumer Protection, which regulates the rights and obligations of consumers and business actors. The results show that dentists have a responsibility to provide services that meet standards, as well as an obligation to provide compensation if losses occur due to negligence. The public's readiness to file criminal charges against dentists who violate the law is also identified as a problem. Therefore, educational efforts are needed for the public to understand the risks of using the services of untrained dentists and the importance of choosing services from certified professionals. This research is expected to provide insight into legal protection for consumers and increase awareness of safe dental health practices.
