Abstract

Riverbanks that are used as a place to build buildings will have a significant impact on the sustainability of the river and is an action prohibited by law. This research aims to examine the extent and find out what are the factors inhibiting the implementation of the Regulation of the Minister of Public Works and Public Housing Number 28 of 2015 in the Kampar Regency Area. The research method used is empirical legal research. The results of this study indicate that the legal implementation of the legal provisions in this study has not been fully implemented. The inhibiting factors are lack of communication, coordination between parties, budget factors and contingents who master the field have not been formed, and there is no solution that can benefit between parties. Suggestions from the author the government must firmly respond to these regulations, always conduct counseling, and immediately propose to relocate the community in the Kampar river border area. Abstract

The regulation of military criminal law is subject to the KUHPM and also to criminal laws outside the KUHPM, including Law No. 35 of 2009 on Narcotics. The KUHPM does not explicitly regulate narcotics abuse; therefore, military courts apply Article 2 of the KUHP, which applies to all offenders, whether civilian or military. The principle of lex specialis derogate legi generalis applies, meaning the Narcotics Law, as a special regulation, takes precedence over the KUHP. Principal penalties are imposed based on Article 10(a) of the KUHP and Article 6(a) of the KUHPM, while additional penalties such as dismissal refer to Article 26 of the KUHPM. This article is mutatis mutandis, meaning it can be applied by the judge without being proven as an element of the offense. Judges have discretion in determining sentences but must base their decisions on complete considerations. If such considerations are lacking, the Supreme Court may annul the verdict. Case analysis shows that judges place greater emphasis on juridical considerations based on trial facts and statutory provisions.

Abstract

This study aims to examine criminal law enforcement in medical malpractice cases. Using library research methods, data was collected from various sources, such as books, journals, and magazines, to analyze and address the issues under study. The results indicate that a physician can be held criminally liable for malpractice if two main elements are met: an unlawful act (objective element) and fault on the part of the perpetrator, either intentional or negligent (subjective element). Furthermore, this article outlines several parameters for identifying suspected violations of the law, including due care (zorgvuldigheid), appropriate diagnosis and therapy, and compliance with professional standards and the principle of proportionality. This study concludes that physicians need to understand their legal responsibilities to anticipate potential lawsuits from patients.

Abstract

Health law is an essential discipline that governs the rights and obligations of healthcare providers and patients. This article explores the role of health law in ensuring justice and quality in medical services in Indonesia. Using a qualitative method, the study analyzes regulations, cases, and legal frameworks relevant to medical practices. The research findings indicate that stronger legal awareness and enforcement can prevent malpractice and strengthen trust in the healthcare system.

Abstract

Sexual abuse against minors needs robust legislative safeguards within the criminal justice framework. The essential distinctions between civil law and common law systems result in divergent normative approaches that need comparative analysis to ascertain optimal procedures for safeguarding child victims. The objective of this study is to evaluate the efficacy of legal protections for child victims of rape by using a comparative normative analysis between the Indonesian civil law system and the American common law system, specifically within the framework of the criminal justice system. This study employs normative legal research techniques within a comparative legal analysis framework. Primary legal documents include legislation, federal and state laws, and 359 judicial rulings from the period 2019-2024. The analysis involved comparing laws at the same time using different methods, including looking at the law in context and interpreting it systematically and comparatively. Indonesia has a thorough legislative framework prioritizing restorative justice; yet, judicial execution reveals that just 34% of judgments adhere to the notion of the child's best interest. The United States exhibits more consistency (78%) in procedural protections via constitutional interpretation, notwithstanding the challenges of federal-state fragmentation. Both systems exhibit deficiencies in addressing cyber-facilitated abuse and developing technology. The efficacy of protection is contingent upon the uniformity of normative execution and the alignment of legislative and judicial practices. The convergence of legal systems is essential, with civil law embracing judicial flexibility and common law including systematic legislative methods to provide uniform child protection standards.

Abstract

Bahan bakar minyak adalah salah satu unsur yang sangat dibutuhkan dalam pelayanan kebutuhan masyarakat umum baik di negara-negara miskin, negara-negara berkembang maupun di negara-negara yang telah berstatus negara maju sekalipun. Bahan bakar minyak bersubsidi sangat dibutuhkan oleh masyarakat menengah kebawah untuk kegiatan mereka sehari-hari. Dalam penelitian ini terdapat dua rumusan masalah yaitu bagaimana penegakan hukum tindak pidana larangan niaga bahan bakar minyak bersubsidi berdasarkan Pasal 55 Undang-Undang Nomor 22 Tahun 2001 tentang minyak dan gas bumi di wilayah hukum Polres Kampar, serta Apa saja faktor penghambat dan upaya penyelesaian dalam Penegakan Hukum Tindak Pidana Larangan Niaga Bahan Bakar Minyak (BBM) Bersubsidi Berdasarkan Pasal 55 Undang-Undang Nomor 22 Tahun 2001 Tentang Minyak Dan Gas Bumi Di Wilayah Hukum Polres Kampar. Pasal 55 Undang-Undang Nomor 22 Tahun 2001 Tentang Minyak Dan Gas Bumi berbunyi Setiap orang yang menyalahgunakan pengangkutan dan/atau niaga bahan bakar minyak yang disubsidi pemerintah dipidana dengan pidana penjara paling lama 6 (enam) tahun dan atau denda paling tinggi Rp. 60.000.000.000,00 (enam puluh miliar). Metode yang digunakan dalam penelitian ini adalah metode empiris. Hasil dari penelitian ini adalah Penegakan hukum tindak pidana larangan niaga bahan bakar minyak bersubsidi berdasarkan Undang-Undang Nomor 22 tahun 2001 tetang minyak dan gas bumi di wilayah hukum Polres Kampar masih belum berjalan dengan baik, Tindak pidana larangan niaga bahan bakar minyak bersubsidi yang terjadi saat ini masih dapat dilakukan dengan berbagai cara, seperti mobil yang sudah dimodifikasi dengan menggunakan tangki yang terbuat dari besi dan berkapasitas lebih besar yang berada di dalam mobil, mengajak kerjasama operator SPBU dengan memberi uang tips, selanjutnya tidak adanya izin usaha yang dimiliki oleh pelaku dalam pengangkutan bahan bakar minyak bersubsidi. Adapun faktor yang menjadi hambatan yakni kurangnya jumlah aparat penyidik dalam mengatasi tindak pidana larangan niaga bahan bakar minyak bersubsidi, Kurangnya kendaraan operasional yang dimiliki pihak Kepolisian dalam melakukan kegiatan/operasi, serta masih tertutupnya masyarakat untuk memberikan informasi kepada Kepolisian dan keterlibatan masyarakat dalam membantu oknum penyalahgunaan pengangkutan dan perniagaan bahan bakar minyak bersubsidi, dan sulitnya mengungkap barang bukti.

Abstract

Merangin Village is one of the villages included in the Kuok District area which was previously called West Bangkinang District with an area of 10,037 Ha. Which initially consisted of five hamlets, including Dusun Pulau Terap II, Dusun Pulau Terap Tengah, Dusun Pulau Terap I, Dusun Lereng, and Dusun Rantau Berangin. Merangin was expanded, for the smooth running of government in this village. A criminal act can be defined as an act which, if violated, will result in clear sanctions and in accordance with the Criminal Code. The presence of criminal law in society is intended to provide a sense of security to individuals and groups of society in carrying out their daily activities. Criminal cases arise because there is a criminal act that is handled by law enforcement. Criminal cases always arise whenever there is a criminal process. Criminal acts or crimes are an inseparable part of life in society. One of the criminal cases that often occurs in society is criminal acts that have value or are light and not dangerous, namely petty theft.

Abstract

The rule of law is one of the principles of the Republic of Indonesia and is regulated in the 1945 Constitution. As the principle states that Equality Before The Law is a form of legal guarantee and provides certainty that everyone is equal before the law without any discrimination, besides that there is also the right to recognition and protection. Based on the principle and the right to protection, the Advocate profession is one of the professions that can be relied on. The role and function of an Advocate who is free, independent and responsible provides a glimmer of hope that the guarantee of certainty and justice will be fulfilled for people who really need legal assistance. The existence of Advocates also plays a role in the scope of justice which also has an important aspect, legal aid services from Advocates open up wide opportunities for the thirst for legal knowledge for the community. Therefore, as Officum Nobile or an honorable profession, Advocates must be truly reliable by the community.

Abstract

Execution is a matter of carrying out a court decision which has permanent legal force. The court verdict that is being executed is the one that has substance order to one of the parties to pay some money or in other case the implementation of the judge’s decision that has ordered to empty fixed object, while the losing party does not want to implement the decision voluntarily so that it requires coercive effort from the court to implement the following matter. Therefore, the land clearing execution in accordande to the civil court decisions that have permanent legal force at Bangkinang District Court is the real execution as well as an execution of some money payment in accordance with the applicable provision. The obstacles within the execution of land clearing of civil case decisions that have permanent legal force at the Bangkinang District are various such as the executed wealth does not exist, the decision’s trait is declarator, the object of execution in the hands of third-parties, execution of the tenants, the object being executed were guaranteed to the third-parties, the land to be executed has no clear boundary, the change in the status of land to state land, the object of execution is abroad, two decisions are different from each other, and for the last, the execution of shared assets. The efforts made in the execution of land clearing of civil case decisions that have permanent legal force at the Bangkinang District Court are ordinary legal efforts divided into resistance (verzet), appeals, and also cassation while the special legal remedies are divided into judicial review (civil request) and the resistance from a third party (derdenverzet).

Abstract

Ganja merupakan tanaman yang ilegal di indonesia saat ini. Hal ini diatur dalam undang-undang 35 tahun 2009 tentang narkotika. Hingga saat ini masih melarang peredaran dan penggunaan ganja di Indonesia. Tanaman ganja digolongkan ke dalam narkotika Golongan I yang penggunaannya dilarang untuk pengobatan medis. Meski demikian, tanaman ganja dinilai memiliki potensi untuk pengobatan dan lebih dari 50 negara telah mengadopsi program ganja untuk medis. Penelitian ini bertujuan untuk mengetahui kualifikasi tanaman ganja masuk ke dalam narkotika golongan I menurut UURI Nomor 35 Tahun 2009 tentangNarkotika. Akibat dari penyalahgunaan Narkotika jenis ganja sendiri dapat menimbulkan terjadinya suatu kejahatan atau tindakan-tindakan yang membahayakan seperti pembunuhan, pemerkosaan, pencurian, dan seks bebas. Di Indonesia, kejahatan narkotika jenis ganja telah diklasifikasikan sebagai kejahatan extra ordinary crime atau kejahatan luar biasa yang membutuhkan perhatian dan upaya khusus yang tinggi Metode yang digunakan dalam penelitian ini adalah penelitian Pendekatan sosiologis dipilih peneliti karena peneliti langsung terjun kelapangan. Kesimpulan dari penelitian ini yaitu pemerintah tetap melarang adanya legalisasi dan pemanfaatan ganja untuk kepentingan medis dengan tujuan untuk melindungi seluruh masyarakat Indonesia dari masalah baru yang berisiko muncul. Sanksi bagi Pengguna Ganja Narkotika Golongan 1 itu ada dalam Undang-Undang Nomor 35 Tahun 2009, Pasal 127 ayat 1 menayatakan Narkotika Golongan 1 bagi diri sendiri dipidana dengan pidana penjara paling lama 4 (empat) tahun. Sedangkan dalam Pasal 111 ayat 1 Menanam, Memelihara, Memiliki, Menyimpan, Menguasai atau Menyediakan Narkotika Golongan 1 dalam bentuk tanaman dipidana dengan pidana paling singkat 4 tahun atau paling lama 12 tahun dan pidana denda paling sedikit Rp 800.000.000.00 dan paling banyak Rp 8.000.000.000,00.
