Abstract

Children as the nation's next generation have an important role in national development. However, children involved in crime are often overlooked in legal protection. This research aims to explore the synchronization of the rights of children who commit crimes in Indonesian positive law, as well as analyzing the application of legal provisions by law enforcement officials. The research method used is normative juridical with a descriptive approach, involving the analysis of secondary data from legislation and jurisprudence. The results showed that there was a lack of conformity in the legal protection of child offenders, as well as the need for harmonization of regulations to ensure that children's rights were met. The recommendations of this study are the need for awareness-raising and more effective implementation of legal protection for children, as well as strengthening the role of society and government in supporting optimal child development.

Abstract

This article addresses the issue of a female president according to K.H. Husein Muhammad. This figure is used as a reference material, first, because of his high attention to gender issues. Second, women's leadership in Indonesia is a discourse and vehicle that develops dialectically and is very interesting to be used as a reference material, especially since Indonesia is the largest Muslim country in the world where gender issues are still in the "debateble" category. This article is a literature review using the inductive methodology, by compiling the works of the figures studied to draw conclusions related to the issues discussed. From this article conclusions are drawn; 1) Analysis in terms of women's leadership Kiyai Husein allowed it because the verse that spoke about male leadership was born from patriarchal culture. 2) While the traditions that talk about women's leadership are traditions that have asbabun nuzul about the leadership of women who are disputed / arbitrary and the traditions must be understood in terms of al ibrah bi specialization sabab la bi'umumil lafzhi and that hadith is not in the context of legal legitimacy but just a notification.

Abstract

OSS business licensing still encounters obstacles, including computer systems between ministries and institutions that are not well connected and very few districts/cities that have a Detailed Spatial Plan (RDTR) as the basis for granting location permits. Entrepreneurs have also complained that the OSS system is difficult to access. Chairman of the Central Java Association of Indonesian Entrepreneurs (Apindo) Frans Kongi stated that there are still a number of problems with the OSS system, for example, entrepreneurs cannot access it, even though all requirements have been met.In addition, the existence of PP No. 5 of 2021 tends to violate laws (UU), especially Law No. 25 of 2007 concerning Investment (Investment Law). This was reinforced by the Chairman of Commission VI of the House of Representatives, Teguh Juwarno, who signaled a violation of the law in the establishment of the OSS Institution. The OSS Institution has emerged to take over the authority of BKPM, while the Investment Law states that investment licensing is the domain of BKPM. Another member of Commission VI of the House of Representatives, Zulfan Lindan, asked that the implementation of the OSS system be revoked because it is considered to hamper the investment process in Indonesia and there is uncertainty over the management of the OSS. All licenses should be returned to BKPM.
