Abstract

Abstract

This article seeks to examine the legal culture of the Samin community in relation to their preferences in family law, the persistence of the customary law in the community, and the transformations that have taken place in Samin family law. The data of this article is derived from an ethnographic study conducted at various Samin villages in Central Java between 2022 and 2023. Information was gathered via in-depth interviews, observation, and document analysis. The study's findings suggest that the government does not officially recognize marriage within the Samin community. However, the Samin family law has undergone a significant transformation. It underwent a substantial change which involved the government officially acknowledging the Samin beliefs. The research findings reveal symptoms of the Samin family law which underwent a transformation from customary law to local fiqh characterized by a mystical style. Efforts are being made to establish formal legal frameworks that accept the belief in God Almighty and incorporate legal practices. The legal negotiations led to the emergence of natural law plurality which in practice, is influenced by politics, social, and culture.

Abstract

This study examines the concept of ihyā’ al-mawāt as implemented by Sheikh Muhammad Arshad al-Banjari in 18th-century Banjarese society, focusing on its socio-economic and legal significance. While ihyā’ al-mawāt—the revitalization of abandoned land—is well-documented in Islamic jurisprudence, its practical application by Sheikh Muhammad Arshad remains underexplored. Using a historical approach and a normative legal framework, the research investigates the methods employed in land cultivation, the establishment of communal agricultural systems, and their integration into pesantren institutions. The findings reveal that Sheikh Muhammad Arshad spearheaded land reclamation through the collective efforts of his community, transforming swampy and neglected areas into fertile agricultural land. This initiative not only enhanced the community’s economic welfare but also laid the groundwork for an agro-economic model within pesantren education. The study underscores the enduring relevance of Islamic legal principles in addressing societal challenges and fostering sustainable community development.

Abstract

The era of modernization has presented various challenges and significant changes in every aspect of life, including education. In the context of these changes, tradition still plays an important role as a medium for conveying religious values in society. This study employs a qualitative methodology with an ethnographic approach, utilizing Clifford Geertz's interpretative framework for analysis. This research aims to analyze the Betumbang Apam tradition as a medium of Islamic education in understanding and strengthening the religious values of the community at the Palajau Sacred Mosque. The results of this study show that the Betumbang Apam tradition is a reflection of cultural wealth and a strong medium in conveying religious values. This tradition reflects faith values, such as belief in Allah, gratitude and early introduction to the mosque to children; moral values, such as respect for scholars and parents; and social values, such as togetherness and friendship. In the context of modernization, this tradition remains relevant because it strengthens people's religious understanding through deep symbolism. The results of this study reinforce Clifford Geertz's “thick description” theory, showing that the Betumbang Apam tradition has layers of meaning that enrich spiritual and social understanding in the Muslim community in Palajau.

Abstract

This study examines the influence of service quality, religiosity, zakat knowledge, and digitalization on the zakat payment preferences of muzakki (people who pay zakat) and investigates the mediating role of trust in shaping these preferences within the Banjar community of South Kalimantan, Indonesia. Employing a quantitative field research design, data was gathered through structured questionnaires distributed to muzakki who pay zakat through formal institutions. Using purposive sampling, 500 questionnaires were distributed to muzakki across Banjarmasin, Banjarbaru, and Banjar Regency, yielding 397 responses, of which 201 were deemed valid for analysis. The findings reveal that service quality, religiosity, and digitalization have a significant direct effect on zakat preferences, while zakat knowledge does not exhibit a direct influence. Notably, trust serves as a mediating variable, enhancing the impact of service quality, religiosity, zakat knowledge, and digitalization on muzakki's zakat preferences. These results underscore the pivotal role of trust in encouraging the use of formal zakat institutions. This study contributes to the existing literature by introducing trust as a mediating factor offering a nuanced understanding of its role in the zakat ecosystem and by highlighting the growing relevance of digitalization in influencing contemporary zakat behavior.
