Abstract

The judge's decision on corruption by the former minister of social affairs in Decision No. 29/Pid.Sus-TPK/2021/PN. Jkt. Pst who did not accommodate the reason for the ballast resulted in criminal sanctions received by the perpetrator being unworthy. The non-accommodation of ballast reasons related to office crimes in Article 52 of the Criminal Code and Article 2 paragraph (2) of the Law on the Eradication of Corruption Crimes even though the elements of the article have been fulfilled by criminal acts committed by Juliari Peter Batubara is the main problem studied. This study aims to determine the appropriate criminal sanctions for perpetrators of corruption of the Covid-19 Social Assistance. The type of research used by the author is normative juridical using primary and secondary legal materials, and takes a statutory approach (Statue approach), conceptual (Conceptual approach), and Case approach (Case approach). So as to get the result that the elements of the ballast article, namely Article 52 of the Criminal Code, have been fulfilled by the actions of Juliari Peter Batubara, so that in Decision No. 29 / Pid.Sus-TPK / 2021 / PN. PST sanctions imposed should have been more severe. And the elements of Article 2 paragraphs (1) and (2) of the Anti-Corruption Law have also been fulfilled, so Juliari Peter Batubara should be charged with the article and can be sentenced to death because of the fulfillment of the elements of "certain circumstances" in Article 2 paragraph (2) of the Anti-Corruption Law.

Abstract

The development of information technology is experiencing rapid development and has penetrated into all sectors both in terms of economy, business, industry, even in the entertainment world it also has its own technology. One technology that has penetrated the world of entertainment is consoles and video games. Someone plays games with the aim of just entertainment, notinfrequently they play games with the aim of achieving popularity in the game and to achieve the highest score. Seeing the number of enthusiasts in a game, there are time when gamers appear who want an instant achievement, by making system changes or entering fake commands called cheats. The addition of this cheat system in a game makes it easier for players to achieve their goals, but making other players cheat by playing fair causes the game to be unfair. The purpose of this study is to find out the legal regulations for using cheats in the games against the laws in force in the Republic id Indonesia, including the Criminal Code and the ITE Law. The legal sources in this research are literature, legislation, journals, and relates articles, the data collection method in this study used literature study and literature study.

Abstract

Corruption is an act that can directly or indirectly cause state losses. Current developments, both the quality level of crime and the quantity level of cases are increasing continuously every year. In order to reduce the swelling in the cost of resolving criminal acts in Indonesia, the Indonesian Attorney General's Office issued SE Jampidsus Number B-1113/F/FD.1/05/2010 which discusses Restorative Justice in resolving corruption crimes with relatively small losses prioritized not to be followed up when the perpetrator has returned state financial losses. However, this is contrary to Article 4 of Law No. 31 of 2019 concerning the Eradication of Corruption, which states that the return of state financial losses made by the perpetrator still does not climinate the criminalization of the perpetrator of the crime of corruption. The objective to be achieved is whether the settlement using restorative justice is contrary to Article 4 of the Anti-Corruption Law. This type of research uses normative research using a statutory approach and a conceptual approach. The results of this study use the concept of restorative justice in Resolving corruption using restorative justice is contrary to Article 4 of the PTPK Law because restorative justice only fulfills the element of benefit and does not fulfill the elements of justice and legal certainty.

Abstract

Part-time workers are workers who work only part of the time from the normal working hours.Provisions for working time are contained in Article 77 of the Labor Law jo. UU no. 6 of 2023, namely 7 hours/day for 6 days or 8 hours/day for 5 days. Part-time workers are not mentioned in any law.The purpose of this research is to analyze the proper arrangements for Part-Time Workers to obtain annual leave rights and legal protection measures that can be given to Part-Time Workers. The research method uses normative juridical research. The writing approach uses a statutory approach by dissecting legal materials collected by means of literature studies which are analyzed prescriptively,as well as a conceptual approach that refers to legal doctrines as well as the views of experts. Based on the results of the study,the criteria for the type of work of Part-Time Workers have similarities so that the rights and obligations for Part-Time Workers can use the provisions in accordance with the Specific Time Work Agreement (PKWT). Regarding the protection of workers' basic rights, in this case the right to annual leave can be given to Part-Time Workers in proportion to the length of service. As for the legal protection that can be given to part-time workers,it is necessary to realize it in the form of a clear legal basis by ratifying the Geneva Convention and implementing it in Indonesia in the form of adding substance to PP 35 of 2021 as a type of work derived from PKWT.

Abstract

Consumer protection in Indonesia is governed by Law No. 8 of 1999 (UUPK), which aims to ensure legal certainty and safeguard consumer rights. The law provides for criminal sanctions in Articles 61 to 63; however, these are often viewed as inadequate, as they emphasize punitive measures against business actors rather than restitution for consumers. A more effective approach would prioritize recovery and reparation of consumer losses, aligning better with the goals of criminal law reform. This research seeks to evaluate the accuracy and effectiveness of criminal law provisions within the UUPK in achieving justice and legal order. Employing normative juridical methods with statutory and conceptual approaches, the study analyzes both primary and secondary legal materials using prescriptive analysis. The findings reveal several shortcomings in the current formulation and implementation of criminal provisions in consumer protection. These include the lack of fulfillment of key criminal law principles: (1) the principle of reasonable loss, as not all violations result in criminal-worthy harm; (2) the principle of subsidiarity, since criminal law should be a last resort (ultimum remidium); (3) proportionality, where punishment should reflect the gravity of consumer loss; and (4) the principle of legality, particularly lex certa and lex stricta. On the other hand, the principle of tolerance in defining criminal acts is found to be fulfilled. Overall, a shift toward restorative justice and proportional sanctions is needed for more effective consumer protection.

Abstract

Sports competitions are a strategic forum for achievement, investment, and even noble values, but they are increasingly shrouded in match-fixing allegations. Arrangements regarding match fixing have not been regulated in their norms, so law enforcement and the government enforce the law without any basis. On the other hand, the government has the authority to take preventive measures before determining the cause of match fixing as an important study. This study examines the philosophy of alleged score fixing based on the function of criminal law based on legal interests in determining an adequate legal framework. The type of research is normative juridical based on a conceptual and comparative approach. This paper proves and confirms that score fixing violates the honor of the integrity of the state. Furthermore, efficient sports competitions with adequate industry revenues are important for the state. Based on this research, score fixing prevention is restoring the urgency of criminal law with the interest of honor in the form of state integrity, namely by restoring proper law enforcement

Abstract

Penjatuhan pidana penjara terhadap anak sebagai pengguna narkotika seringkali menjadi pilihan utama oleh hakim. Putusan Nomor 27/Pid.sus-anak/2021/PN.Bta hakim menjatuhkan pidana penjara terhadap anak yang terbukti menjadi penyalahguna narkotika Golongan I bagi diri sendiri tanpa menghiraukan amanat undang-undang nomor 35 tahun 2009 tentang Narkotika dan undang-undang nomor 35 tahun 2014 tentang Perlindungan Anak yang mewajibkan untuk rehabilitasi. Penelitian ini akan membahas mengenai pertama apakah pertimbangan hakim dalam penjatuhan pidana penjara terhadap anak sebagai pengguna narkotika dalam putusan nomor 27/Pid.sus-anak/2021/PN.Bta sesuai dengan ketentuan kewajiban rehabilitasi? dan apakah hakim dapat memutus rehabilitasi meskipun dalam surat tuntutan tidak ada permohonan rehabilitasi?. Peneliti menggunakan penelitian hukum normatif menganalisis terkait aturan-aturan yang relevan. Pertimbangan hakim Dalam menjatuhkan pidana terhadap anak pengguna narkotika tidak menerapkan ketentuan wajib rehabilitasi yaitu Undang-undang Nomor 35 tahun 2009 tentang Narkotika dan SEMA No. 4 tahun 2010. Hakim Dalam memutus suatu perkara harus sesuai dengan surat tuntutan berdasarkan Pasal 182 ayat (1) KUHAP, namun ada undang-undang khusus yang mengatur kewajiban rehabilitasi. Sehingga hakim memiliki kewenangan dalam memutus suatu perkara diluar tuntutan jaksa terutama dalam perkara narkotika dan anak yang terlibat dalam penyalahgunaan narkotika. Abstract

Abstract: Social change today is caused by the development of technological advances that lead to modern life. Rural communities are no longer excluded from the modernization process. Modernization is a systematic effort to or produce values (such as physical, material, and social) that are universal, rational, functional, and of high quality. This essay aims to explain the process of social change and explore the extent to which law can anticipate social change as a result of technological advances and modernization. Keyword: social change, modernisation, technological advancement. Abstrak: Hal ini karena modernisasi melalui kemajuan teknologi juga mempunyai dampak yang besar terhadap masyarakat tradisional pedesaan. Masyarakat pedesaan tidak lagi tersingkir dari proses modernisasi. Modernisasi adalah upaya sistematis untuk mencapai atau menghasilkan nilai-nilai (seperti fisik, material, dan sosial) yang bersifat universal, rasional, fungsional, dan berkualitas tinggi. Emmilia Rusdiana, S.H.,M.H Abstrak Pasal 134 Huruf g Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan yang berbunyi pengguna jalan yang memperoleh hak utama untuk didahulukan adalah kendaraan pemadam kebakaran yang sedang bertugas, ambulan yang mengangkut orang sakit, kendaraan untuk memberikan pertolongan pada kecelakaan lalu lintas, kendaraan pimpinan Lembaga Negara Republik Indonesia, kendaraan pimpinan dan pejabat Negara asing serta lembaga internasional yang menjadi tamu Negara, iring-iringan pengantar jenazah dan konvoi/kendaraan untuk kepentingan tertentu menurut pertimbangan petugas Kepolisian Negara Republik Indonesia.Tujuan penelitian ini untuk menganalisis kaitan konvoi moge dengan tindak pidana dan tindakan Kepolisian terhadap konvoi moge. Penelitian hukum ini merupakan penelitian hukum yuridis normatif. Pendekatan masalah dalam peneltian ini adalah pendekatan perundang-undangan dan pendekatan kasus. Analisis yang digunakan dalam penelitian ini dilakukan secara deskriptif. Konvoi moge bukan merupakan bagian dari kepentingan tertentu seperti yang teruang dalam Pasal 134 huruf g UU LLAJ, karena tidak memenuhi sebagai kendaraan yang harus diprioritaskan, serta konvoi moge tidak memenuhi kepentingan keagamaan, kepentingan kenegaraan, kegiatan olahraga, dam kegiatan seni dan budaya. Kegiatan yang dilakukan di Sleman tidak memenuhi kepentingan keagamaan, kepentingan kenegaraan, kegiatan olahraga, dan kegiatan seni budaya sehingga tidak perlu diprioritaskan untuk mendapatkan pengawalan. Konvoi moge tersebut juga mengabaikan pelanggaran lalu lintas dan tidak ditindak oleh kepolisian. Kepolisian tidak melaksanakan tugas pokok sebagai alat Negara yang berperan dalam memelihara keamanan, dan ketertiban masyarakat, menegakkan hukum, serta memberikan perlindungan, pengayoman dan pelayanan kepada masyarakat dalam rangka terpelihanya keamanan dan ketertiban umum. This study has a purpose to analyze whether the big motors convoy is a crime and how the police action against big motors convoy . This legal research is a normative juridical legal research. Problem approach in this research is approach of law and case approach (case approach). The analysis used in this research is done descriptively. The Moge convoy is not a part of a particular interest as it is contained in Article 134 Sub-Article g of the LLAJ Law, because it does not fulfill as a priority vehicle, nor does the convoy moge fulfill the religious interests, state interests, sports activities, and artistic and cultural activities. Activities undertaken in Sleman do not meet the interests of religion, state interests, sports activities, and cultural arts activities so it does not need to be prioritized to get escort. And in fact the big motors convoy is also a lot of neglect of traffic violations and not acted by the police. The police do not carry out the main duty as a tool of the State that plays a role in maintaining security, and public order, enforce the law, and provide protection, shelter and service to the public in order to maintain security and public order.
