Abstract

This study explores the concept of Islamic law, culture, and social dynamics through a sociological approach. Islamic law is understood as a legal system derived from divine revelation rather than human construction, thus carrying strong spiritual and transcendental dimensions. Its implementation aims to promote the welfare of humanity as a whole, both in this world and in the hereafter. Culture, according to Ali Ahmad Madkur, represents the manifestation of divine values embedded in society; therefore, in Islam, culture cannot be separated from the principles of tawhid. The discussion also highlights the reciprocal relationship between law and society. Sociology, as the study of social life, helps to analyze patterns of social change and their impact on legal systems. In the modern context, social transformation often occurs more rapidly than legal reform, requiring law to adapt accordingly. This creates unique challenges for Islamic law to remain relevant in the face of changing times without compromising its foundational principles. Through mechanisms such as ijtihad, qiyas, and the concept of maslahah, Islamic law demonstrates the ability to respond to social changes with flexibility while remaining firmly rooted in the values of shari‘a. The study concludes that Islamic law functions not only as an instrument of adaptation but also as a guiding force for social transformation, balancing divine injunctions with the needs of contemporary society. Hence, Islamic law plays a vital role in maintaining harmony between religious teachings and evolving social realities.

Abstract

This research examines the concept of Islamic law's crucial role in shaping the direction of national legal policy in Indonesia. This is due to the fact that the majority of Indonesia's population is Muslim, and therefore, Islamic values naturally influence various aspects of national and state life, including the process of formulating legislation. Islamic values, derived from sharia and fiqh, prioritize the principles of justice, welfare, and morality, which align with the state's objectives as outlined in the Preamble to the 1945 Constitution. From an Islamic perspective, leadership is a sacred mandate, not merely a political office. Leaders must be able to realize social justice and the welfare of the people, and be exemplary in upholding religious values. However, the political reality in Indonesia shows that this idealism is often hampered by transactional political practices, such as money politics. Money politics creates a market for support that undermines the democratic process, as people's votes are treated as a commodity to be bought. As a result, many leaders are elected not because of their capabilities and integrity, but because of their financial resources. This reinforces corrupt power structures and is far from the spirit of justice as taught in Islam. For this reason, there needs to be consistent efforts to

Abstract

The study of Qur’an Surah An-Nisa verse 34 often becomes a crucial point in understanding gender relations within Islam. Textually, the verse positions men as qawwam (caretakers or leaders) of the family; however, its interpretation has evolved from traditional exegesis toward more contextual readings that are inclusive and gender-just. This research employs a qualitative approach through library research and Abdullah Saeed’s contextual hermeneutics to analyze both classical and contemporary interpretations of the verse. The findings indicate that male leadership in this verse is functional, grounded in social and economic responsibilities, rather than a form of domination or moral superiority. Patriarchal interpretations have often restricted women’s roles, particularly in access to education, economic participation, and leadership. In contrast, inclusive interpretations emphasize that men and women share equal spiritual standing before God and that their social roles are complementary rather than hierarchical. Patriarchal culture and social constructions remain major challenges in achieving gender justice. Therefore, a reinterpretation of religious texts based on maqasid al-shariah is necessary to build a just and harmonious social structure. This study contributes to reinforcing the understanding that Islam, as a religion upholding justice and compassion, supports gender equality as an integral part of its values.

Abstract

Manusia ialah makhluk sosial yang membutuhkan orang lain untuk memenuhi kehidupannya sehari-hari. Untuk memenuhi kebutuhannya tersebut manusia pasti akan mencari yang terbaik agar kebutuhan tersebut dapat terpenuhi, Pernikahan bukan hanya dilakukan saat kondisi normal terkadang pernikahan dilaksanakan dalam keadaan yang darurat. Hal ini tentu menjadi tantangan bagi para ulama fiqih saat ini sedang berusaha menjawab fenomena-fenomena baru tersebut yang mana timbul kebingungan dalam masyarakat bagaimana pandangan hukum syariatnya, salah satunya yaitu fenomena nikah Online. Nikah Online apabila dibandingkan dengan pernikahan biasa maka tidak terdapat perbedaan yang substansional terhadap ritual pernikahan seperti biasanya, perbedaan mengenai esensi ittihad al-majelis atau adanya pergeseran kebudayaan dalam hal melakukan akad. Yang mana nikah biasa dilakukan berhadapan secara langsung di suatu tempat. Sedangkan untuk nikah Online sama-sama dilakukan tapi tempatnya berbeda-beda dan terpisah jarak antara yang melaksanakan akad. Ijtima Ulama MUI soal akad nikah Online yang tertera dalam ketentuan hukum nomor 1 menyatakan bahwa akad nikah secara Online “hukumnya tidak sah, jika tidak memenuhi salah satu syarat sah ijab kabul akad pernikahan, yakni dilaksanakan secara ittihadu al-majelis (berada dalam satu majelis), dengan lafadz yang sharih (jelas), dan ittishal (bersambung antara ijab dan kabul secara langsung.

Abstract

Penelitian ini bertujuan untuk: 1) Mengetahui proses, akad, dan walimah dalam pernikahan mubarakah di Pondok Pesantren Hidayatullah Gunung Tembak Balikpapan; 2) Mengetahui faktor-faktor yang mempengaruhi terjadinya pernikahan mubarakah tersebut; dan 3) Mengetahui perspektif teori hukum tentang pernikahan mubarakah tersebut. Dalam penelitian ini, penulismenggunakan jenis penelitian sosiologi hukum yang bersifat empiris (realita). Metode pengumpulan datanya menggunakan dokumentasi, wawancara, dan observasi. Sifat penelitiannya adalah empirical research, dan pendekatan yang digunakan adalah pendekatan sosiologi hukum. Sedangkan teknik analisis data yang digunakan mencakup reduksi data (data reduction), sajian data (data display), dan pengambilan kesimpulan (conclusing drawing). Hasil penelitian ini menunjukkan bahwa: Pertama, proses pernikahan mubarakah di Pondok Pesantren Hidayatullah Gunung Tembak Balikpapan dilakukan dengan beberapa tahapan, yaitu pendataan, wawancara, penjodohan, proses ta’aruf, pelamaran, pembekalan, dan penandatanganan. Adapun rukun dan syarat pernikahan mubarakah, adalah: wali nikah; saksi yang meliputi wali mempelai wanita, warga Hidayatullah, santri Hidayatullah, dan tamu undangan; shigat akad nikah; dan mahar. Walimahtul ursy dalam pernikahan mubarakah diselenggarakan dengan sangat sederhana tanpa ada hiburan musik, apa lagi pesta yang berlebihan. Akan tetapi, suasana walimahtul ursy sangat berkesan baik,sakral serta tidak meninggalkan nilai-nilai Islam. Kedua, faktor-faktor yang mendorong munculnya pernikahan mubarakah di Pondok Pesantren Hidayatullah Gunung Tembak Balikpapan, adalah: a) keyakinan masyarakat tertentu berupa takhayul, bid’ah khurafat disekitar acara pernikahan; b) budaya menjalin hubungan antara laki-laki dengan wanita yang biasa dikenal dengan istilah pacaran yang tidak sesuai dengan budaya Islam; c) budaya penyerahan uang dalam jumlah besar yang dilakukan oleh pihak laki-laki kepada pihak keluarga wanita; dan d) pesta pernikahan yang menghabiskan dana puluhan juta rupiah bahkan ada yang sampai ratusan juta rupiah. Ketiga, berdasarkan perspektif teori living law, pernikahan mubarakahlahir karena adanya fenomena dalam kehidupan masyarakat Indonesia yang sampai saat ini masih dipertahankan, baik budaya adat di masyarakat pedesaan maupun budaya modern yang mengurangi kesucian dari pernikahan. Berdasarkan teori semi-autonomus social field, Pondok Pesantren Hidayatullah Gunung Tembak Balikpapan sebagai penyelenggara pernikahan mubarakah berhak membuat sebuah norma yang dilandasi dengan keadaan santrinya serta adat kebiasaannya, akan tetapi norma-norma yang dimiliki harus sesuai Undang- undang Perkawinan yang ada di Indonesia. Selanjutnya, perspektif hukum sebagai law as a tool of social engineering dalam pernikahan mubarakah digunakan untuk merubah budaya masyarakat, dan merumuskan usia pernikahan yang bersifat ideal. Budaya yang sampai saat ini dipertahankan baik budaya adat di masyarakat pedesaan maupun budaya modern (seperti: hitungan weton, pacaran, uang jujuran, dan pesta pernikahan mewah) dapat mengurangi kesucian dari pernikahan, karena dinilai tidak sesuai dengan syari‟ah Islam. Selain itu, ketentuan usia pernikahan sebagaimana termaktub dalam Undang-undang Perkawinan No.1 Tahun 1974 mengidap persoalan yang tidak mudah diselesaikan. Indikasi problematis usia pernikahan yang paling menonjol muncul ketika dihadapkan pada pasal 7 ayat 2 tentang dispensasi kawin yang wewenang yuridis untuk keperluan itu diberikan kepada Pengadilan atau Pejabat lain yang ditunjuk oleh kedua orang tua pihak laki-laki maupun perempuan sehingga dinilai mengurangi sakralitas pernikahan. Berdasarkan perspektif maqashid al-syari’ah, pernikahan mubarakah dilihat dari hifd al-din, akan membawa para santri yang sudah siap dalam melaksanakan pernikahan agar terhindar dari perbuatan asusila, seperti zina. Jika dilihat dari hifd al-nasl, perwalian anak perempuan menjadi jelas, begitupun juga dalam hal waris. Jika dilihat dari hifd al- nafs, pasangan suami istri yang menikah pada usia dewasa memiliki kesiapan psikologis/kejiwaan dalam membina rumah tangga. Jika dilihat dari hifd al-mal, pasangan suami istri yang memiliki kesiapan psikologis akan dapat mengatur keuangan rumah tangga dengan lebih baik. Dan jika dilihat dari hifd al-aql, pasangan suami istri yang sudah dewasa, otomatis caraberfikirnya pun lebih dewasa, sehingga dalam menghadapi berbagai persoalan yang muncul dalam rumah tangga akan lebih bijak dan tidak mudah stress.

Abstract

Research on the Effectiveness of Pre-Marital Counseling Programs in Samarinda City through field research methods delineates the pivotal role of this program in preparing prospective couples for marriage and establishing a harmonious family. The research conducted in Samarinda City allowed for data collection from pre-marital counselors and prospective couples who participated in this program. The results indicate the program's success in enhancing the physical, mental, and spiritual readiness of prospective couples. Various teaching methods such as lectures, group discussions, case simulations, and personal counseling sessions provide in-depth insights into various aspects of marriage, practical skills, and relevant spiritual values. However, the evaluation identified several challenges that need addressing, such as improving program accessibility, ensuring consistent implementation, accommodating diverse group needs, and ongoing evaluations. Nonetheless, the pre-marital counseling program in Samarinda City significantly contributes to comprehensively preparing prospective couples, including in knowledge, skills, and legal preparations. Thus, this study underscores the importance of ongoing evaluation and program adaptation to enhance its effectiveness. This supports the development of a more responsive and inclusive program, offering greater benefits to prospective couples as they prepare for married life.

Abstract

This study focused on disparities between decisions made by first-instance and appeal courts in handling the same case. Failure to register marriages and divorces leads to legal division of property and inheritance shares. First-instance judges prioritize legal certainty of marriage/divorce certificates and their legal implications. However, appeal courts lean towards sociological facts, disregarding the evidential value of authentic marriage certificates. Furthermore, their decisions conflict with the Marriage Registration Act, which mandates valid divorces to be confirmed by court-issued certificates. This study was normative research using case, legal, and conceptual approaches. The legal material was decision number 651/Pdt.G/2020/PA.Tgr and number 54/Pdt.G/2021/PTA.Smd, as well as legal provisions in the law of evidence. Based on these legal materials, legal analysis was conducted using deductive and inductive methods to strengthen the analysis of legal reasoning results of different judges hearing the same case. This study found that: firstly, the High Court of Religion in Samarinda's decision to disregard the divorce certificate did not uphold legal certainty, as certificates hold significant weight in inheritance cases, serving as conclusive evidence. Hence, there was ambiguity regarding the divorce status of Kasmawati binti Talle and Tajang bin Abu Bagenda in case number 54/Pdt.G/2021/PTA.Smd due to the absence of fully evidential documentation. Secondly, the legal ramifications of an unregistered divorce render it invalid and necessitate annulment, binding the wife to her former husband, a principle supported by Imam As-Syafi'i in Islamic jurisprudence, aligned with other scholarly opinions.

Abstract

This research aims to explore the dynamics of husband-wife relationships within Islamic family structures, focusing on both sociological and psychological perspectives. Utilizing a literature review methodology, a total of 17 scholarly articles published between 2004 and 2023 were analyzed to understand the factors influencing family relationships. The analysis techniques involved systematic selection, evaluation, and synthesis of relevant literature. The findings reveal that a harmonious husband-wife relationship is crucial for overall family well-being, highlighting the impact of emotional bonds and communication patterns. A harmonious relationship between husband and wife is identified as the key to the overall well-being of the family. Good interactions and healthy communication patterns enhance the quality of the relationship. Research has found that factors such as social pressure, individual differences, and changing times can affect the quality of the husband-wife relationship. From a sociological perspective, the husband-wife relationship is seen as part of a larger social structure. Additionally, the study provides recommendations for enhancing relationship quality in Islamic family contexts.
