Abstract

The lack of law enforcement related to marine sand mining activities, which is not in line with the community in Lampung Province, certainly causes many problems. It can cause quite a high social conflict and environmental ecosystems as well as ecological disasters. In addition, the impact of the sea sand mining permit also overlaps the allocation of coastal areas and small islands. This article aims to analyze law enforcement against marine sand mining activities that conflict with the community in Lampung Province. This study uses an empirical normative method with a qualitative analysis model. The informant was from WALHI by Irfan Tri Musri and some miners. The results show that law enforcement for sea sand mining has to start from the law formulation, application, and execution stages of law enforcement. Another important thing is prevention efforts to control environmental impacts that must be performed by maximizing the usage of the monitoring and licensing instruments. In addition, Lampung Province Regulation Number 1 of 2018 concerning Zoning Plans for Coastal Areas and Small Islands must be appropriately implemented for law enforcement because it is sufficient to accommodate the interests of the community. The most dominant inhibiting factors in law enforcement of marine mining in conflict with the community in Lampung Province are statutory factors and law enforcement officers who are not firm in enforcing the law of sea sand mining.

Abstract

So far, corrupt convicts continue serving full sentences even though they have paid part of the replacement money. At the same time, there is no specific formulation regarding calculating the amount of compensation paid for the length of imprisonment for replacement money that needs to be paid more. This is certainly a problem for the prosecutor's office as law enforcement officers in Indonesia to eradicate corruption cases. So that a special formulation is needed in calculating the replacement money, which is then ratified in legal regulation; based on these legal issues, this research aims to examine the perspective of the formulation of criminal law calculations on insufficient replacement of money in corruption cases. This research uses a normative research methodology and examines written law from various perspectives, including theory, history, philosophy, comparison, structure and composition, scope and material, consistency, general explanation and article by article, formality, and binding power of a law-law. This research includes primary, secondary, and tertiary legal materials as data sources. Data processing includes data verification, data marking, data reconstruction, and data systematization. Furthermore, a qualitative descriptive analysis was carried out on the data. The study results indicate that the calculation of the criminal law on insufficient replacement money in corruption cases is based on a proportionality or comparability approach.

Abstract

Internet merupakan salah satu media perwujudan hak asasi manusia untuk berkomunikasi dan memperoleh informasi yang dilaksanakan secara tertib dan bertanggung jawab berdasarkan moral, nilai-nilai agama, keamanan, dan ketertiban umum berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pemerintah memfasilitasi pemanfaatan teknologi informasi dan transaksi elektronik serta melindungi kepentingan umum dari segala jenis gangguan sebagai akibat penyalahgunaan informasi elektronik yang mengganggu ketertiban umum sesuai dengan ketentuan peraturan perundang-undangan. Banyak masyarakat Indonesia, terutama di pedesaan di wilayah Lampung, masih belum memiliki pemahaman utuh tentang cara penggunaan internet yang positif dan sehat. Salah satu desa yang secara pemahaman masih kurang akan hal itu ialah Desa Margodadi, Kecamatan Padang Cermin, Kabupaten Pesawaran, Provinsi Lampung. Fakta tersebut membuat desa ini sebagai salah satu desa yang secara informasi teknologi masih merlukan sosialisasi & pendidikan terkait penggunaan dan tantangan teknologi ke depannya. Fakta tersebut membuat tim dari Fakultas Hukum Univeritas Lampung, Jurusan Hukum Internasional untuk melakukan pendampingan dan edukasi agar masyarakat desa dalam penggunaan internet paham akibat hukum yang timbul dari kegiatan di dunia virtual. Sehingga masyarakat dapat secara maksimal menikmati manfaat internet demi peningkatan potensi ekonomi daerah dengan tetap meminimalisir dampak negatif penggunaan internet. Masyarakat yang paham hak dan kewajibannya tidak akan mudah terjerumus ke dalam kejahatan di dunia virtual. Metode yang digunakan ialah pendekatan gabungan normative dan sosiologis secara kualitatif. Hasil dari yang didapat setelah dilakukan penyuluhan di Desa Margodadi ialah terdapat peningkatan pemahaman yang cukup signifikan dari warga setempat akan tata cara penggunaan internet yang sehat dan aman.

Abstract

Tourism has emerged as one of the foremost industries experiencing rapid growth. Over the past few decades, the sector has witnessed continuous development in Indonesia, evident from the increasing number of foreign tourist arrivals. The rapid growth of tourism in various regions has undeniably yielded positive impacts on both investment and the overall economy. However, it has also given rise to a multitude of challenges that need to be addressed. One of the challenges pertains to the issue of land ownership, specifically concerning the acquisition of residents' lands surrounding tourist destinations by foreign individuals, which is strictly prohibited under Indonesian law. Therefore, a comparative analysis between Indonesia and Malaysia is needed to identify regulation problems to potentially increase cases of legal smuggling of foreign land ownership transfers. This study explains the practice of land ownership by foreigners in the Pesisir Barat District of Lampung, along with the associated problems analyzed through a socio-legal approach. The results show that tourism undeniably benefits the economic sector, and resulted in legal infringements concerning land ownership, leading to the marginalization and displacement of local communities. This study adopts a comparative law method, elucidating the respective provisions of both Indonesia and Malaysia, supplemented by a normative juridical approach to examine legal principles, regulations, and systematics through the examination of relevant library materials. Consequently, it is essential to enhance the regulations surrounding the transfer of land to foreigners, including Foreign Citizens and Foreign Legal Entities with representatives in Indonesia, emulating the stringent land tenure restrictions imposed by Malaysia on foreign nationals.

Abstract

Hukum diplomatik merupakan bagian dari hukum internasional yang meliputi hubungan antar negara sebagai subyek hukum internasional. Dalam hal itu, diplomat yang ditempatkan di setiap negara tuan rumah dilengkapi dengan kekebalan diplomatik yang memungkinkan mereka untuk menghindari penangkapan atau penaklukan di bawah peraturan nasional negara tuan rumah. Selain itu, melalui kekebalan diplomatik ini, terdapat fakta yang tak terbantahkan bahwa beberapa diplomat terkadang melakukan kejahatan yang melanggar kekebalan diplomatik yang telah melekat pada mereka. Salah satu kejahatan yang paling umum adalah spionase sebagai bagian dari operasi intelijen. Spionase dalam beberapa tahun terakhir ini dilakukan dengan menggunakan teknologi yang dikenal dengan Spionase Siber (Cyber Espionage). Fenomena terkini adalah kasus spionase yang dilakukan Kedutaan Besar Australia di Indonesia terhadap pejabat tinggi Indonesia pada tahun 2013. Dengan demikian itu menghancurkan kepercayaan dan kerja sama antara kedua negara. Pendekatan hukum doktrinal dan komparatif akan digunakan. Salah satu rekomendasi yang dihasilkan dari penelitian ini adalah perlunya mengevaluasi kembali prosedur yang ada dalam melakukan spionase berdasarkan hukum internasional dan legalitasnya.

Abstract

This service aims to enhance awareness of personal data protection among Lampung residents in the digital era. As information technology advances, personal data has become a valuable yet vulnerable asset, at risk of theft, misuse, and privacy violations. Many individuals remain unaware of the importance of safeguarding their data and their rights. Through counseling, training, and outreach in schools, communities, and local institutions, this initiative educates the public on data protection regulations and best practices for securing personal information online. Using a participatory approach, the program engages participants in discussions, simulations, and case studies to foster deeper understanding. Results demonstrate increased knowledge, heightened awareness of data threats, and the adoption of safer digital practices. This initiative aims to empower Lampung's residents to better protect their personal data and mitigate privacy risks in an increasingly digital world.

Abstract

Article 54, paragraph 3, of the UN Convention Against Corruption (UNCAC) encourages countries to implement efforts to confiscate assets resulting from crimes committed without a criminal conviction, often known as in rem. Indonesia is one of the countries that ratified the UNCAC with Law No. 7 of 2006. Further implementation of in rem forfeiture is outlined in the Asset Forfeiture Bill, which regulates the mechanism for in rem forfeiture of assets in detail. The bill also regulates asset sharing, previously only accommodated by Article 57 of Law No. 1 of 2006 concerning Mutual Assistance. Aside from being a solution to overcoming the cost of forfeiture, which tends to be large, asset sharing is also intended to prevent the interference of other forces that cause the forfeiture process not to run effectively. This mechanism also precludes different parties from sharing burdens and benefits (a win-win solution). Asset sharing is practiced in some countries, such as the United States, Switzerland, and Canada.

Abstract

Introduction to the Problem: Various controversies over Indonesia's nickel downstreaming policy as a government move to add economic value to mining products are important issues that need to be studied. This problem is mainly because Indonesia is a developing country that has abundant natural resources, but has not been able to improve welfare and development for communities in mining areas, especially in the aspect of community participation. This research then highlights the perspective of the Natural Resource Curse (NRC) phenomenon for Third World Approaches to International Law (TWAIL) countries in the paradox of development stemming from the exploitation of natural resources. Purpose/Study Objectives: Community involvement in mining and other industrial activities is needed. This is related to decision making. For example, in Environmental Impact Assessment/ Analisis Mengenai Dampak Lingkungan (AMDAL) and other activities related to the lives and livelihoods of communities around mining activities. The basis of public participation is part of human rights as stated in the Constitution and International Conventions that have been ratified by Indonesia. Design/Methodology/Approach: This research uses legal normative research by examining legislation regarding nickel downstreaming as stated in Law No. 30 of 2020 on the Second Amendment to Law No. 4 of 2009 On Mineral and Coal Mining and Law No 6 of 2023 on Cipta Kerja, Findings: The findings in this study show the lack of community involvement in mining and other industrial activities in Indonesia. The existence of community participation as a human right is necessary to achieve a balance of economic growth and environmental protection as an anti-thesis to the curse of natural resources. In addition, governance and enforcement and supervision by the government in the mining sector need to be carried out effectively. Paper Type: Research Article

Abstract

The application of the fair use doctrine in software development in Indonesia still faces significant challenges, both in terms of regulation and law enforcement. The absence of specific arrangements in the Copyright Law leads to legal uncertainty that can hamper innovation in the technology sector. In the digital era, a balanced copyright policy is needed to support the growth of the creative industry while protecting the rights of creators. This article analyzes the problems of fair use regulation in Indonesia, especially in the context of software development, by comparing it with policies in other countries such as the United States. The results show the need to develop a more detailed evaluation framework to ensure a balance between copyright protection and technological innovation. In addition, education and socialization related to the concept of fair use is a strategic step to increase public understanding and industry players. With policies that support innovation, Indonesia can strengthen its global competitiveness while promoting sustainable economic development.
