Abstract

Forests play an important role in supporting the lives of Indonesian and even international communities. However, the problem of forestry crimes today is a fairly complicated problem to overcome. This is due to, among other things, the lack of regional boundaries, low intensity and effectiveness of patrol/supervision, very limited and unprofessional forest security personnel and facilities, weak coordination among law enforcement officers, weak law enforcement against violators and the lack of perception from community members themselves of the importance of forest resources for all mankind. Supreme Court Decision Number 121 K/PID.SUS-LH/2024 is the focus of this study, because it highlights the challenges and complexities in law enforcement against perpetrators of forestry crimes. In this regard, there are problems related to legal uncertainty, differences in legal interpretation, and the complexity of cases that influence judges' decisions at the cassation level. The problem in this study is how is the basis for the judge's considerations in sentencing perpetrators of forestry crimes and whether the decisions given are in accordance with the principles of substantive justice. This research method is carried out using a normative juridical approach and an empirical juridical approach. The data used are primary data and secondary data. The data collection procedure in writing this research is by means of literature and field studies. Data analysis uses qualitative analysis.

Abstract

This study aims to identify the challenges and strategies in developing inmates' potential at Class 1 Correctional Facility in Bandar Lampung. Effective rehabilitation enables inmates to acquire skills and mental preparedness for reintegration into society. Using a qualitative case study approach, data were collected through interviews with inmates and correctional officers, analysis of rehabilitation program documents, and direct field observations. The findings reveal that major obstacles to inmates’ self-development include inadequate facilities, low individual motivation, social stigma, and a shortage of educators and mentors. However, several strategies have been implemented to address these challenges, including vocational training, character education, and spiritual guidance. The active role of correctional officers and collaboration with external organizations, such as NGOs and the private sector, also contribute to the success of rehabilitation programs. This study concludes that a holistic rehabilitation approach—encompassing technical skill development, psychosocial support, access to employment opportunities, and a strong mentoring system—can enhance rehabilitation effectiveness. Therefore, strengthening synergy between the government, society, and the business sector is crucial to ensuring the sustainability and long-term impact of inmate development programs.

Abstract

This study aims to analyze the efforts made by correctional institutions to eradicate the use of cell phones, extortion practices, and narcotics distribution among inmates. The research employs a normative juridical approach, with data collected through literature review and qualitatively analyzed to draw comprehensive conclusions. The findings indicate that eradication efforts are conducted through two main approaches: prevention and enforcement. Prevention measures include inspecting visitors, providing legal and narcotics education to inmates, and conducting narcotics tests on inmates. Enforcement actions involve conducting raids on inmates, investigating inmates suspected of narcotics distribution within the prison, and legally processing inmates who commit narcotics-related crimes. However, the study also identifies several obstacles to these efforts. A significant barrier is the limited technology available to detect the presence of cell phones and narcotics within the prison. Additionally, there are challenges posed by individuals who smuggle cell phones and narcotics into correctional facilities, which complicates the institution's efforts to address these issues. In conclusion, while correctional institutions have undertaken various measures to combat the use of cell phones, extortion, and narcotics, there are ongoing challenges that require further attention, particularly in enhancing technology and supervision to reduce external smuggling.

Abstract

This study discusses the strategy for overcoming drug crimes by children in the digital era so that the government pays attention to the problem of drug abuse, by implementing Law Number 22 of 1997 concerning Narcotics, which gives consequences to anyone who abuses drugs can undergo criminal penalties, if they meet the demands in accordance with the articles contained in the law (BPHN, 1997). The purpose of this study is to be able to Repeated criminal acts or recidivism to be given more attention in handling drug crime cases, which are a familiar phenomenon in Indonesia, especially narcotics recidivism, many factors cause someone to repeat their crime, such as economic interests, narrow job opportunities, low levels of education. The author will conduct research using qualitative methods and data obtained from interviews, observations, and literature studies. Based on the results of research conducted on prisoners, previous research, documents, and discussions conducted by the author. Insights used in children information from the BNN: Based on the BNN annual report, the dominance of opiate use among young people is increasing. Abstract

Penelitian ini membahas tentang penjatuhan sanksi pidana di bawah batas minimum khusus dalam Pasal 120 Ayat (2) Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian, yang mengatur mengenai tindak pidana penyelundupan manusia. Latar belakang penelitian ini adalah fenomena penjatuhan pidana yang tidak sesuai dengan ketentuan batas minimum yang ditetapkan oleh undang-undang dalam Putusan Nomor 440/Pid.Sus/2023/PN JKT.SEL. Penelitian ini menggunakan metode yuridis normatif dan yuridis empiris dengan pendekatan perundang-undangan dan konseptual, serta analisis terhadap putusan pengadilan yang terkait. Data diperoleh melalui wawancara, studi pustaka dan analisis yuridis terhadap putusan pengadilan. Hasil penelitian menunjukkan bahwa meskipun telah ada ketentuan pidana minimal yang tegas, hakim memberikan diskresi dalam menjatuhkan sanksi dengan alasan pertimbangan yuridis, sosiologis, dan filosofis. Faktor-faktor seperti tingkat kesalahan terdakwa, dampak sosial terhadap keluarga terdakwa, serta tujuan rehabilitasi dan keadilan substantif menjadi pertimbangan hakim dalam menilai kelayakan pidana.

Abstract

The advancement of artificial intelligence (AI) has led to the emergence of new crimes, including the misuse of deepfake technology to produce and distribute pornographic content without the victim's consent. This form of digital sexual harassment has serious impacts on victims' dignity, mental health, and social life. This study aims to examine the efforts of Police in addressing sexual harassment crimes using deepfake porn and to identify the obstacles faced. Using normative and empirical legal approaches, data were collected through literature review and interviews. The findings reveal that the police efforts involve both penal (law enforcement) and non-penal (preventive) approaches, including public education, cross-institutional collaboration, and cyber patrols. However, the handling of such crimes is still hindered by regulatory gaps, limited technology, and low public awareness. Strengthening legal frameworks and police capacity is essential to effectively combat digital-based sexual crimes.

Abstract

Penelitian ini bertujuan menganalisis penerapan Pasal 363 Ayat (1) ke-1 KUHPidana dalam menangani pencurian hewan ternak di Kecamatan Natar, Lampung Selatan, serta mengidentifikasi hambatan penegakan hukumnya. Metode penelitian menggunakan pendekatan yuridis normatif melalui analisis hukum tertulis dan yuridis empiris melalui wawancara dengan aparat penegak hukum dan masyarakat terdampak. Hasil penelitian menunjukkan bahwa pencurian ternak berdampak signifikan pada ekonomi dan sosial masyarakat agraris. Penerapan pasal ini memberikan pemberatan pidana bagi pelaku yang melakukan pencurian secara terorganisir atau dengan modus operandi canggih. Namun, penegakan hukum menghadapi kendala berupa keterbatasan teknologi, rendahnya pelaporan masyarakat, dan kesulitan pembuktian. Upaya yang dilakukan meliputi langkah preventif, seperti sosialisasi dan edukasi hukum, serta langkah represif berupa penangkapan pelaku dan pengungkapan jaringan kriminal. Kesimpulannya, efektivitas penerapan pasal ini membutuhkan peningkatan kapasitas aparat, kolaborasi antar lembaga, dan kesadaran hukum masyarakat.

Abstract

Online gambling has grown rapidly with various types and forms that are always changing. Gambling has developed since ancient times which makes this game always in demand, online gambling is often misinterpreted as just entertainment but a place to find sources of daily income, such as online gambling Higgs Domino, where gambling is a game that can be downloaded on the playstore, the game consists of several types of games such as Domino, Poker, Ludo, and Slot Games which are the same as jackpot machines, where for each game, players must have chips to bet on. based on legal regulations in Indonesia and knowing the negative impacts of online gambling Higgs Domino. Using a legislative approach, this study employs a normative legal method that draws from government documents, legal journals, and primary and secondary legal materials. According to the study's findings, Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions regulates online gaming.

Abstract

This research aims to provide an overview of Legal Protection for Victims Who Act in Self-Defense. In this study, the author employs a normative juridical approach. The theoretical framework used is the Theory of Factors Influencing Law Enforcement, by examining the obstacles that affect law enforcement in cases where victims attempt to defend themselves. The secondary data used in this research is sourced from various materials such as statutory regulations and legal journals. The findings show that the Indonesian Criminal Code (KUHP) regulates self-defense (noodweer) and excessive self-defense (noodweer exces) as stipulated in Article 49 paragraph (1) and paragraph (2) of the KUHP. Article 49 serves as the legal basis for providing legal protection to individuals who act in self-defense. Under this Article, a criminal act committed may be exempted from criminal liability, allowing the perpetrator to be free from any legal charges, provided that the elements of self-defense are fulfilled. Obstacles in law enforcement for cases involving self-defense include unclear legal provisions, limited understanding among law enforcement officers of the noodweer concept, lack of supporting infrastructure such as CCTV, low public awareness in reporting crimes, and a weak legal culture. Of all the factors, law enforcement is considered the most dominant because the central role of officers in enforcing regulations professionally, objectively, and fairly is crucial in determining the true realization of justice.

Abstract

The Correctional Center class I Bandar Lampung, hereinafter referred to as Bapas, plays an important role in providing guidance to juvenile and adult clients so that the clients can live well in society. Bapas itself has the main task and function of being a community supervisor who has the responsibility of guiding WBP (Correctional Prisoners) based on the rules and regulations of the institution that are still valid. The aim is to guide WBP to have awareness in order to make themselves better and not commit criminal acts that they have committed before or more severe criminal acts. The role of Community Counselors is carried out in the form of tasks and functions of community counseling in the stages of the criminal justice system for everyone who commits a crime, starting from the pre-sentencing and post-sentencing stages. During the pre-sentencing and sentencing process, Community Counselors are tasked with conducting community investigations and assisting ABH (Children in conflict with the law) as well as adult prisoners or adult clients.
