Abstract

Penelitian ini bertujuan menganalisis penerapan Pasal 363 Ayat (1) ke-1 KUHPidana dalam menangani pencurian hewan ternak di Kecamatan Natar, Lampung Selatan, serta mengidentifikasi hambatan penegakan hukumnya. Metode penelitian menggunakan pendekatan yuridis normatif melalui analisis hukum tertulis dan yuridis empiris melalui wawancara dengan aparat penegak hukum dan masyarakat terdampak. Hasil penelitian menunjukkan bahwa pencurian ternak berdampak signifikan pada ekonomi dan sosial masyarakat agraris. Penerapan pasal ini memberikan pemberatan pidana bagi pelaku yang melakukan pencurian secara terorganisir atau dengan modus operandi canggih. Namun, penegakan hukum menghadapi kendala berupa keterbatasan teknologi, rendahnya pelaporan masyarakat, dan kesulitan pembuktian. Upaya yang dilakukan meliputi langkah preventif, seperti sosialisasi dan edukasi hukum, serta langkah represif berupa penangkapan pelaku dan pengungkapan jaringan kriminal. Kesimpulannya, efektivitas penerapan pasal ini membutuhkan peningkatan kapasitas aparat, kolaborasi antar lembaga, dan kesadaran hukum masyarakat.

Abstract

Online gambling has grown rapidly with various types and forms that are always changing. Gambling has developed since ancient times which makes this game always in demand, online gambling is often misinterpreted as just entertainment but a place to find sources of daily income, such as online gambling Higgs Domino, where gambling is a game that can be downloaded on the playstore, the game consists of several types of games such as Domino, Poker, Ludo, and Slot Games which are the same as jackpot machines, where for each game, players must have chips to bet on. based on legal regulations in Indonesia and knowing the negative impacts of online gambling Higgs Domino. Using a legislative approach, this study employs a normative legal method that draws from government documents, legal journals, and primary and secondary legal materials. According to the study's findings, Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions regulates online gaming.

Abstract

This research aims to provide an overview of Legal Protection for Victims Who Act in Self-Defense. In this study, the author employs a normative juridical approach. The theoretical framework used is the Theory of Factors Influencing Law Enforcement, by examining the obstacles that affect law enforcement in cases where victims attempt to defend themselves. The secondary data used in this research is sourced from various materials such as statutory regulations and legal journals. The findings show that the Indonesian Criminal Code (KUHP) regulates self-defense (noodweer) and excessive self-defense (noodweer exces) as stipulated in Article 49 paragraph (1) and paragraph (2) of the KUHP. Article 49 serves as the legal basis for providing legal protection to individuals who act in self-defense. Under this Article, a criminal act committed may be exempted from criminal liability, allowing the perpetrator to be free from any legal charges, provided that the elements of self-defense are fulfilled. Obstacles in law enforcement for cases involving self-defense include unclear legal provisions, limited understanding among law enforcement officers of the noodweer concept, lack of supporting infrastructure such as CCTV, low public awareness in reporting crimes, and a weak legal culture. Of all the factors, law enforcement is considered the most dominant because the central role of officers in enforcing regulations professionally, objectively, and fairly is crucial in determining the true realization of justice.

Abstract

The Correctional Center class I Bandar Lampung, hereinafter referred to as Bapas, plays an important role in providing guidance to juvenile and adult clients so that the clients can live well in society. Bapas itself has the main task and function of being a community supervisor who has the responsibility of guiding WBP (Correctional Prisoners) based on the rules and regulations of the institution that are still valid. The aim is to guide WBP to have awareness in order to make themselves better and not commit criminal acts that they have committed before or more severe criminal acts. The role of Community Counselors is carried out in the form of tasks and functions of community counseling in the stages of the criminal justice system for everyone who commits a crime, starting from the pre-sentencing and post-sentencing stages. During the pre-sentencing and sentencing process, Community Counselors are tasked with conducting community investigations and assisting ABH (Children in conflict with the law) as well as adult prisoners or adult clients.

Abstract

Terrorism is a complex global threat, and its handling requires a comprehensive approach, including the stage of coaching terrorist prisoners (napiter) in correctional institutions (prisons) until reintegration into society. This study aims to analyze the main challenges in implementing the Soft Approach method in the napiter coaching program in Indonesia and explore the potential for utilizing this method to develop a more holistic and sustainable coaching program. The research method used is normative law, by analyzing laws and regulations, legal literature, and other relevant publications. The results of the study identified several significant challenges in implementing the Soft Approach, including the closed and radical attitudes of prisoners, limited human resources and facilities, regulations and institutions that are not yet optimal, resistance to change, and the need for a sustainable approach. Furthermore, this study examines how the humanistic and dialogical principles of the Soft Approach can be utilized to develop a more holistic coaching program, including mental, social, and emotional recovery of prisoners. The development of a sustainable program requires improving the quality of officer resources, provision of facilities and infrastructure, religious reeducation and national insight, development of independence and skills, implementation of social reintegration programs, multi-stakeholder involvement, and ongoing evaluation and monitoring. Thus, this study provides insight into the challenges and potential of the Soft Approach in efforts to provide more effective guidance for terrorist convicts in Indonesia.

Abstract

This study aims to analyze the main inhibiting factors in identifying and finding perpetrators of Online Gender-Based Violence (OGBV) crimes in Indonesia, as well as evaluating the effectiveness of existing criminal policies in providing protection to victims. The research method used is normative law by analyzing related laws and regulations, legal literature, and relevant publications. The results of the study identified several significant obstacles in handling OGBV, including limited capacity and investigative facilities for law enforcement officers, difficulties in collecting and authenticating digital evidence, anonymity of perpetrators in cyberspace, low reporting rates by victims due to fear and shame, and limited specific regulations and suboptimal law enforcement. Furthermore, this study examines the criminal policy in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence which specifically regulates OGBV, including definitions, sanctions, and victim protection mechanisms. Although this law is a step forward, this study highlights the need to strengthen implementation, increase the capacity of law enforcement officers, and provide more comprehensive support for victims to overcome challenges in handling OGBV in Indonesia.

Abstract

The high rate of recidivism indicates that the rehabilitation programs available in correctional institutions have not been fully effective in assisting inmates with their rehabilitation and reducing the likelihood of reoffending after release. The Class IIA Women's Correctional Facility in Bandar Lampung is a specialized institution for female inmates, including those with a history of recidivism. This study aims to analyze the rehabilitation programs for female recidivist inmates at the Class IIA Women's Correctional Facility in Bandar Lampung and identify the challenges encountered in their implementation.  A qualitative approach with a descriptive framework is employed to evaluate the rehabilitation programs at the institution in addressing female inmate recidivism. Data collection methods include interviews with prison staff, former inmates, and experts in the field of corrections, complemented by a literature review and direct observations.  The findings reveal that while rehabilitation programs at the Class IIA Women's Correctional Facility in Bandar Lampung have an impact on inmates, they remain suboptimal. Vocational training programs are not sufficiently aligned with labor market demands, and psychological and social support services are limited, despite many inmates facing trauma and mental health issues. Societal stigma and a lack of family support further hinder reintegration efforts.  To reduce recidivism and enhance reintegration, it is crucial to provide relevant vocational training, improve psychological services, and implement strategies to foster societal acceptance. Collaboration between the government, correctional institutions, and community organizations is essential in supporting former inmates and minimizing the risk of reoffending.

Abstract

Parole is an important instrument in the social reintegration of inmates, with the Correctional Center (Bapas) playing a role in guidance, assistance, and supervision. This study analyzes the implementation of supervision by the Class I Correctional Center in Bandar Lampung for parole clients, as well as the obstacles encountered. The research employs a normative juridical and empirical approach, using both primary and secondary data, with sources including the Head of the Adult Client Guidance Section and a Criminal Law Lecturer at the University of Lampung. The findings indicate that supervision has been optimal, with no cases of parole revocation. The main obstacles include the absence of clear administrative sanctions, limited authority, weak law enforcement, inadequate facilities and technology, lack of inter-agency coordination, low public participation, and unsupportive client behavior. Improvements in regulations, enhancement of human resources quality, provision of adequate facilities, and strengthening community involvement are required to support the success of social reintegration

Abstract

This research aims to analyze the relevance of applying restorative justice in resolving counterfeiting cases committed by children, by examining the normative, juridical, and practical aspects within Indonesia’s juvenile criminal justice system. The background of this study arises from the dilemma between protecting the rights of children as offenders and the state’s obligation to maintain economic stability and public trust in the national currency. The research method employed is juridical-descriptive with a normative approach,. The implementation of restorative justice can still safeguard public interests, provided it involves relevant institutions such as Bank Indonesia and produces measurable recovery agreements. Thus, restorative justice serves as an alternative approach that balances child protection and legal certainty, while also contributing to the prevention of counterfeit money circulation in society.

Abstract

Drug abuse among university students is a serious phenomenon that affects the social, moral, and intellectual aspects of the younger generation. Students, who are ideally positioned as agents of change and drivers of national development, are often found to be vulnerable to drug abuse. This study aims to analyze the implementation of Law No. 35 of 2009 on Narcotics in preventing drug abuse among university students in Lampung Province, as well as to identify its inhibiting factors. The research employs a normative juridical and empirical juridical approach, using primary and secondary data obtained through interviews, field studies, and literature reviews. Key informants include the Narcotics Directorate of the Lampung Regional Police, P4GN Unila, the Vice-Rector III for Student Affairs and Alumni at Unila, and lecturers from the Criminal Law Department at Unila. The findings show that the Lampung Regional Police have implemented preventive strategies such as counseling, campaigns, urine tests, and drug abuse education on campuses, as well as repressive strategies through law enforcement against students involved in narcotics distribution, with 283 recorded cases over the past five years. However, the effectiveness of implementation is still hindered by limited campus facilities (counseling centers, safe reporting systems), the lack of regulatory responsiveness to digital challenges, and low student trust in law enforcement. Therefore, prevention efforts need to be strengthened through cross-sectoral synergy, policy updates, and the enhancement of the role of universities in creating a safe, healthy, and drug-free campus environment.
