Abstract

HAM merupakan hak dasar yang melekat pada manusia tanpa terkecuali. Bahkan perlindungan terhadap Hak Asasi Perempuan menjadi pusat perhatian secara global. Upaya mewujudkan pembangunan yang responsif gender menjadi bentuk upaya dalam perlindungan dan pemenuhan hak terhadap perempuan. Stigmasisasi perempuan yang dianggap lemah seringkali menjadikan pemenuhan hak asasi perempuan terbatas dan diabaikan. Desa sebagai satuan pemerintahan yang terkecil, menjadi tombak ujung dalam merefleksikan kehadiran negara dalam kehidupan masyarakat. Pemerintah desa dalam hal ini perlu memahami dan mampu menyelenggarakan pembangunan desa yang responsif gender. Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk mengedukasi dan meningkatkan keterlibatan perempuan dalam pembangunan desa sehingga mampu mewujudkan kesetaraan gender di desa, sehingga partisipasi perempuan dalam pembangunan semakin meningkat. Dengan demikian, sasaran khalayak dalam kegiatan ini adalah Pemerintah Desa, Badan Permusyawaratan Desa, dan perwakilan masyarakat desa. Lokasi kegiatan dilaksanakan di Desa Karang Anyar, Kabupaten Lampung Selatan. Pemerintah Desa Karang Anyar sebagai mitra pengabdian berperan dalam memfasilitasi peserta dan lokasi kegiatan sehingga proses kegiatan pengabdian dapat berjalan lancar dan berhasil. Metode yang akan digunakan dalam kegiatan ini yaitu melalui ceramah, dan diskusi. Hasil yang diharapkan dari kegiatan ini, yaitu peningkatan pemahaman peserta terhadap pengarusutamaan gender untuk meningkatkan peran dan partisipasi perempuan di desa. Abstract

The existence of the term "party officials" which is increasingly blatant, seems to normalize the power of political parties by party leaders who are subjectively able to subordinate their members who are in government. Several cases indicate a shift in popular sovereignty towards political party sovereignty through the instrument of recall rights. This becomes a problem regarding the position and portion of people's votes in general elections which can be negated by political parties. This research uses doctrinal research methods as well as legal and conceptual approaches. The results of the study show that: first, the existence of the instrument of political party recall rights can be degenerative to the essence of popular sovereignty that has been running through the general election mechanism, this is because the existence of political party recall rights causes a shift in popular sovereignty to political party sovereignty. Second, the constitutionalization of the dismissal of legislative members is an effort of preventive legal protection in maintaining popular sovereignty based on the constitution (constitutional democracy). Therefore, it is necessary to increase a high level of commitment in providing certainty of provisions for the dismissal of legislative members in the constitution.

Abstract

Human rights are basic rights inherent in every human being, including women. However, the stigmatization of women, which often makes the appearance of women's human rights limited, makes it difficult for them to develop themselves. Based on data from the UNDP Gender Inequality Index, Indonesia occupies the highest score in ASEAN with a gender inequality percentage of 48%. The participation of women in development is one of the reasons for the high preference for gender. The government has made various efforts to improve the dignity of women, one of which is through gender mainstreaming. In the context of decentralization, local governments need to elaborate on gender mainstreaming policies in local regulations as an effort to protect women's human rights laws in the regions. This paper aims to portray legal protection through gender mainstreaming within the framework of regional autonomy. The results of the study show that: first, local governments have the authority and responsibility in realizing gender-responsive regional development, both based on local government legal regimes and sectoral legal regimes. Regional autonomy should be able to address gender in accordance with the locality of the region. Second, gender mainstreaming is a necessity as well as a challenge for local governments, in the optics of law as a means of development, regional regulations regarding gender mainstreaming become the juridical basis for regions to ensure and realize conditions of gender equality at the regional level; increasing the contribution and role of women in the regions; and encourage gender-responsive regional development as a form of efforts to protect and fulfill women's rights.

Abstract

Violations of campaign regulations in Indonesian elections, such as using places of worship for legislative candidate campaigns, remain common and are strictly prohibited under Article 521 in conjunction with Article 280 paragraph (1) letter h of Law Number 7 of 2017 on Elections. A notable case is the decision of the Kotabumi District Court Number 43/Pid.Sus/2024/PN Kbu, which sentenced a legislative candidate to one month of imprisonment and a fine of IDR 5 million. This study analyzes the judge’s considerations in this case using normative and empirical juridical approaches through literature reviews and interviews. The findings show that the judge considered juridical, philosophical, and sociological aspects, not only relying on formal legality but also on social and moral values within the community. Factors influencing the judge’s considerations include personal integrity, institutional pressure, and understanding of law and justice. The sentence was imposed as a form of guidance and deterrence, not merely punishment. The study recommends enhancing judges’ understanding of philosophical and sociological values through continuous training, active legal education by the Election Supervisory Board (Bawaslu) to political parties and the public, and regulatory evaluation to ensure laws adapt to social changes. Judges are expected to maintain independence and act firmly without interference to establish a clean and integrity-based judicial system.

Abstract

This paper aims to see the influence of political aspects in legal reform. By using a conceptual approach, it was found that:In the context of legal reform, political aspects have a significant influence, this can be seen in the formation of the Constitutional Court. The formation of the Constitutional Court was realized because of the political desire to form a state institution that could control the legislative products of the DPR, synchronize it with the 1945 Constitution so that there would be no violations of the constitutional rights of citizens and to maintain the principle of checks and balances between state institutions. The establishment of the Constitutional Court is a form of legal reform in a formal institutional sense. Apart from the context of forming legislation for legal reform, political aspects can also actually influence law enforcement. This can be seen in the handling of protracted corruption cases, as well as the use of a reverse evidence system in corruption cases, making it easier for law enforcers to work. This reverse evidence system is a form of legal reform.

Abstract

Children have an important role in determining the quality of a nation's civilization. It is no wonder that preparing the next generation of the nation is an important dimension for state administrators. The guarantee for the protection of children's rights is not only regulated in the Indonesian constitution, but also emphasized in UU No.23 Tahun 2002 jo. UU No.17 Tahun 2016 on Child Protection. Various parties are obliged and responsible for ensuring the fulfillment of children's rights, starting from the smallest institutions, namely the family, community, village/kelurahan government, sub-district, district / city government, provincial government and government. Child rights protection is one of the important foundations that must be understood by all parties, including the village government as the government unit closest to the community. This is also part of realizing sustainable development through the fulfillment of children's rights. A rampant case and a problem for the Indonesian nation is the high rate of marriage at the age of a child. This community service activity aims to educate the community, especially the village government, about child rights protection as an effort to mitigate the risk of marriage at a child's age. This is important because the protection of children's human rights has been regulated in various laws and regulations in Indonesia, including the government's efforts to prevent child marriage. This is important for the community to understand so that they can avoid child marriage as a legally protected child right. This activity is a preventive solution to reduce the number of marriages at the age of children. So that the target audience in this activity is the community from various elements, BPD, and the Village Government. The location of the activity was Fajar Baru Village, South Lampung Regency. The methods used in this activity are through lectures, and discussions.

Abstract

Children play an important role in determining the quality of a nation's civilization. It is no surprise that preparing the next generation is an important dimension for state administrators. Guarantees for the protection of children's rights are not only regulated in the Indonesian constitution, but also reinforced in Law No. 23 of 2002 in conjunction with Law No. 17 of 2016 concerning Child Protection. Even Law No. 39 of 1999 on Human Rights contains provisions that children's rights are human rights and that for their benefit, children's rights are recognized and protected by law even from the moment of conception. Various parties have the obligation and responsibility to guarantee the fulfillment of these children's rights, starting from the smallest institutions, namely the family, community, village/sub-district government, sub-district, regency/city government, provincial government, and the government. One form of protection for children is by preventing child marriage. This community service activity aims to educate the community, especially students in schools, about children's rights. This is because the protection of children's human rights is regulated in various laws and regulations in Indonesia, including government efforts to prevent child marriage. It is important for students to understand this so that they can avoid marriage at a young age. This activity is a solution to reduce the number of child marriages. Therefore, the target audience for this activity is students. The activity held at YP UNILA High School in Bandar Lampung. The methods used in this activity will be lectures, and discussions.

Abstract

The amendment to Law Number 39 of 2008 concerning State Ministries has sparked controversy in society, particularly regarding the flexibility of the number of ministries, which is no longer limited. When a legal norm undergoes regulatory changes, there is certainly a background. Law Number 61 of 2024, issued amidst the government's “efficiency” agenda, is an interesting anomaly to study. This study aims to identify and analyze the legal politics of the flexibility of the formation of state ministries in relation to government administration. This research employs a normative, utilizing a statutory, philosophical, conceptual, and case-based approach, framework to examine laws and legal phenomena. The results of this study, namely the legal politics of the flexibility of the formation of state ministries, which was originally limited to a maximum of 34 (thirty-four) ministries, then changed to "unlimited", indicate an attempt to actualize the strengthening of the President's prerogative, which does not require restrictions on ministerial institutional organs. The change in legal norms does not lead to a reduction in the number of ministries, but to an increase in the number of ministries. Law Number 61 of 2024 does not regulate substantive criteria for the formation of the number of ministerial organs, through the clause “needs for the administration of government by the President”, thus giving the President great discretion to determine how many ministerial organs are needed in the administration of government affairs.

Abstract

Partisipasi masyarakat menjadi aspek krusial dalam proses pembangunan. Adanya otonomi yang dimiliki oleh desa berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa menuntut desa untuk turut berkontribusi dalam upaya pembangunan. Pembangunan yang dilakukan desa perlu mengakomodir dan mengaktualisasikan hak partisipasi masyarakat. Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk mengedukasi mengenai partisipasi masyarakat dalam pembangunan. Dengan demikian, sasaran khalayak dalam kegiatan ini adalah Pemerintah Desa, Badan Permusyawaratan Desa, dan perwakilan masyarakat di desa. Lokasi kegiatan dilaksanakan di Desa Way Huwi, Kabupaten Lampung Selatan. Pemerintah Desa Way Huwi sebagai mitra pengabdian berperan dalam memfasilitasi peserta dan lokasi kegiatan sehingga proses kegiatan pengabdian dapat berjalan lancar dan berhasil. Metode yang akan digunakan dalam kegiatan ini yaitu melalui ceramah, dan diskusi. Hasil yang diharapkan dari kegiatan ini, yaitu terbentuknya Peningkatan Pemahaman Hak Partisipasi Masyarakat dalam Pembangunan Desa.

Abstract

Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk menginisiasi desa tangguh bencana di Kampung Bumi Mas, Lampung Tengah. Potensi bencana yang ada di Kabupaten Lampung Tengah yang cukup tinggi, membutuhkan upaya yang sistematis dan terukur yang dimulai dari desa. Desa sebagai satuan wilayah pemerintahan kecil yang memiliki otonomi desa, memiliki peran dalam berkontribusi mengatasi bencana yang tidak pernah diketahui kapan munculnya. Namun dalam menggerakan upaya tersebut, perlu dilakukan pendampingan yang dilakukan agar kegiatan tersebut bisa berjalan efektif. Hal ini penting agar desa mendapat edukasi dan penerapan dengan cara-cara yang strategis melalui pendekatan hukum dan pemberdayaan masyarakat (Legal and Community Development) untuk menuju desa tangguh bencana. Metode yang digunakan dalam kegiatan ini yaitu melalui edukasi, diskusi, focus group discussion, dan bimbingan teknis (pendampingan). Adapun sasaran khalayak kegiatan ini yaitu aparatur desa dan warga. Hasil dari kegiatan pengabdian ini menunjukan bahwa kesadaran hukum dan pemahaman peserta terhadap Desa Tangguh Bencana telah meningkat hingga 80%. Hal ini ditunjukkan dengan beberapa indikator diantaranya: peningkatan pengetahun terkait dasar hukum Desa Tangguh Bencana, Partisipasi Masyarakat, fungsi dan kedudukan hukum sebagai alat pengendalian sosial, serta kepedulian dalam ikut berkontribusi memikirkan upaya yang pemerintah dapat lakukan dalam rangka mewujudkan desa tangguh bencana agar lebih baik.
