Abstract

This research entitled "Manifestations of Gender Injustice in the Tradition of Divorced Marriage in Kabalutan" is motivated by mass media information which states that in that village, there are many widows of various ages. From young to old age. It was also stated that in this village, it was easy to marry and divorce. Therefore, it is crucial to analyze this tradition from a gender perspective. So that it can be known which parties are harmed by this tradition, to be given socialization of what laws are needed there. The method is an empirical research method with primary data sources from traditional leaders and community leaders in the village. The stages are from surveys, observations, and conducting interviews, as well as collecting data for analysis and giving conclusions. The results of his research are that the term "widows' village" is a term that appeared during the population census in the 90s. At that time, there were many widows in Kabalutan Village for various reasons. But now, not anymore. Thus, the conclusion is that the stereotype of "Kampung Widow" towards Kabalutan Village, Talatako District, Tojo Una Una Regency is a manifestation of gender injustice. The people in the village are not comfortable with this labelling. In addition, it is not proven by the many widows there; it is also not the name of their village. Therefore, they asked to give only Kabalutan Village.

Abstract

This study aims to find out the giving of dowry in the form of a white cloth/shroud in Balaesang Tanjung, Donggala Regency reviewed by Islamic Law. The initial survey was taken through direct information from the Head of the Religious Affairs Office (KUA) in the local sub-district, that the KUA had input data on marriage events as mentioned above. Dowry should be in the form of a materialistic item and can be used by the wife if it is in difficult circumstances. At least, these items can be used for worship as is common, namely a set of prayer tools. Death is a definite thing and not a personal obligation (fardu 'ain) of the wife in its management but is included in the category of fardu kifayah. Although Islam recommends giving the cheapest dowry so as not to be burdensome, dowry in the form of a white cloth/shroud is still very rare. On that basis, how is the review of Islamic Law on the tradition of giving dowry in the form of a white cloth/shroud in Balaesang Tanjung, Donggala regency? The method used is an empirical research method with primary data sources from the community, religious leaders, and community leaders in Balaesang Tanjung, Donggala Regency. The conclusion is that the tradition of dowry of white cloth/shroud in Balaesang Tanjung is in accordance with Islamic teachings, namely including 'urf in the rules of fiqh al-'adatul muhakkamah. Important aspects of dowry in Islam have been included in it such as the existence of women's rights, signs of seriousness in marriage, raising women's dignity, mandatory and should not be eliminated.

Abstract

Tanah merupakan sumber daya vital bagi keberlangsungan hidup manusia sekaligus objek peradaban yang memegang peranan penting dalam tatanan sosial dan ekonomi. Seiring dengan laju pertumbuhan penduduk dan arus modernisasi, permintaan terhadap lahan meningkat tajam hingga memicu kelangkaan serta tingginya angka sengketa pertanahan. Salah satu persoalan krusial dalam dinamika hukum agraria adalah banyaknya anggota masyarakat yang menguasai, mengelola, dan mendiami sebidang tanah secara nyata selama puluhan tahun secara turun-temurun, namun tidak memiliki bukti formal atas lahan tersebut. Ketiadaan sertifikat ini menempatkan masyarakat pada posisi rentan terhadap praktik penyerobotan lahan secara sepihak dan ancaman penggusuran. Kerentanan hukum inilah yang mendasari pentingnya kajian mengenai kekuatan kedudukan bagi warga negara yang menguasai tanah secara fisik dalam jangka panjang serta mekanisme perlindungan hukum bagi mereka. Metode penelitian yang digunakan adalah metode penelitian hukum normatif atau doktrinal yang berfokus pada analisis norma hukum positif, asas-asas pertanahan, dan doktrin ilmiah. Bahan hukum yang digunakan meliputi bahan hukum primer berupa dokumen hukum resmi negara, bahan hukum sekunder dari literatur akademik serta yurisprudensi peradilan, dan bahan hukum tersier berupa kamus hukum. Hasil penelitian ini menunjukkan bahwa Kekuatan hukum bagi warga negara yang menguasai tanah secara fisik selama lebih dari 20 (dua puluh) tahun berturut-turut tanpa sertifikat merupakan legitimasi yuridis bersyarat dalam sistem hukum agraria nasional. Berdasarkan Pasal 2 ayat (2) dan Pasal 4 UUPA, penguasaan fisik tidak otomatis melahirkan Hak Milik karena hak atas tanah bersumber dari Hak Menguasai dari Negara (HMN). Namun, Pasal 24 ayat (2) PP No. 24 Tahun 1997 mengakui penguasaan fisik sebagai dasar untuk mengajukan hak kepemilikan apabila dilakukan secara nyata, terbuka, beriktikad baik, tidak berada di kawasan hutan negara atau tanah adat, digunakan sesuai fungsi sosial, serta didukung bukti seperti girik, SKT/Sporadik, dan bukti pembayaran PBB. Penguasaan yang berlangsung lama juga memperoleh perlindungan melalui asas rechtsverwerking dan acquisitive prescription, yang melindungi pihak yang aktif menguasai dan memanfaatkan tanah.
