Abstract

Penerapan hukum adat dalam pengelolaan sumber daya alam telah menjadi subjek penting dalam upaya pembangunan berkelanjutan. Peluang yang kiranya sangat berkaitan dengan penerapan hukum adat mencakup peningkatan pelestarian lingkungan, pemeliharaan keanekaragaman hayati, dan pemberdayaan masyarakat lokal. Hukum adat juga memberikan landasan bagi praktik-praktik pengelolaan yang berkelanjutan, memungkinkan adaptasi terhadap perubahan lingkungan, dan mempromosikan ketahanan lokal. Namun, penerapan hukum adat juga dihadapkan pada sejumlah tantangan. Sehingga penelitian ini bertujuan untuk mengetahui bagaimana seharusnya masyarakat adat mendapatkan perlindungan hak terhadap tantangan utama sulitnya mendapatkan pengakuan dan perlindungan hukum terhadap Hutan Adat sebagai sumber daya alam di Kalimantan Tengah menurut perspektif hukum adat. Menurut hasil penelitian, konflik kepentingan antara masyarakat adat dan pihak-pihak lainnya seperti pemerintah, serta ketidaksesuaian dengan kerangka hukum nasional menjadi pemicu permasalahan antara Masyarakat adat dan pemerintah. Dalam konteks pembangunan berkelanjutan, pemerintah seharusnya memegang kepentingan untuk memperkuat pengakuan dan perlindungan hukum terhadap hukum adat, serta memperkuat keterkaitan antara hukum adat dan hukum formal. Langkah-langkah tersebut dapat menciptakan kerangka kerja yang inklusif dan berkelanjutan bagi pengelolaan sumber daya alam, yang menghargai pengetahuan lokal, mendorong partisipasi masyarakat, dan memperkuat resiliensi ekosistem dalam rangka pengelolaan dan pemanfaatn hutan adat sebagai Upaya Pembangunan Berkelanjutan.

Abstract

Indonesia sebagai negara multikultural memiliki adat istiadat dan ragam kesenian budaya untuk mendukung perekonomian melalui bidang pariwisata. Hukum perlindungan hak kekayaan intelektual dapat mencegah pelanggaraan terhadap hak cipta kesenian daerah. Namun, studi terdahulu menemukan rendahnya literasi hukum. Penelitian ini bertujuan menyelidiki tentang perlindungan hak kekayaan intelektual tari daerah di Provinsi Kalimantan Tengah. Penyelidikan ini berpedoman pada metode kajian hukum dan pendekatan yuridis normatif. Sumber data kepustakaan dan peraturan Undang-Undang yang relevan digunakan peneliti. Temuan pertama mengungkapkan bahwa peraturan pemerintah ditingkat nasional telah memadai dalam memberikan perlindungan HKI kesenian daerah setelah diterbitkannya Undang-Undang tentang Hak Cipta. Temuan kedua menjelaskan bahwa perliungan HKI tari daerah belum memiliki kepastian hukum yang kuat. Karena beberapa wilayah di tingkat daerah dibawah kepemimpinan bupati belum memiliki payung hukum. Kesimpulannya adalah perlindungan hukum terhadap hak kekayaan intelektual tari daerah masih belum maksimal. Implikasi yang diharapkan agar pemerintah daerah diseluruh wilayah potensial merancang regulasi yang mampu melindungi dan memberdayakan kesenian daerahnya untuk kesejahteraan masyarakat seluas-luasnya.

Abstract

The quality of news translation has a significant impact on global understanding and communication, especially in an era of rapid information exchange and international media consumption. Speeches by high-profile figures, such as presidents, monarchs, and public figures, carry substantial international importance. As one of the leading news portals, CNN Indonesia plays a vital role in translating such content; however, its quality has not been thoroughly examined. This study adopts a qualitative descriptive approach using a comparative conceptual method to analyze source and target texts. It applies Vinay and Darbelnet’s (1995) translation procedure theory and Nababan, Ardiana Nuraeni, and Sumardiono’s (2012) translation quality assessment model. Findings reveal that transposition is the most frequently used procedure (66%), followed by modulation and literal translation (13%) each. Correspondingly, the overall TQA score is 2.35 out of 3, comprising accuracy at 2.19, acceptability at 2.44, and readability at 2.71. These results indicate that while the translation achieves a high level of readability and acceptability, there remains room for improvement in accuracy to fully capture the nuances of the source text. This study contributes to translation studies by demonstrating how Vinay and Darbelnet’s procedures can inform effective linguistic and cultural strategies to enhance translation accuracy and comprehension. By emphasizing the role of strategic linguistic and cultural adaptation, the study offers practical insights for improving translation quality in journalistic contexts, particularly in political and ceremonial speeches.

Abstract

The development of digital technology, especially blockchain, has given birth to a new innovation in the world of contract law known as smart contracts. These contracts work automatically through programming code, so their execution no longer relies on human intervention. This provides various advantages such as a faster, more transparent process, and minimal risk of breach of agreement. However, the emergence of smart contracts also raises an important question: whether this form of agreement is in accordance with the applicable legal provisions in Indonesia, especially regarding the requirements for the validity of agreements and the recognition of electronic agreements. This study shows that basically smart contracts can be considered valid as long as the parties really understand and agree on the mechanisms embedded in the system. This means that even if the agreement is done digitally and automatically, the important elements of the agreement can still be met. On the other hand, there are still several challenges that need to be considered, such as difficulties in proving in the event of a dispute, limitations in making contract changes, and the possibility of inequality in technology understanding between parties. Compared to countries such as the United States, which are already more adaptive, Indonesia still needs more specific arrangements so that the use of smart contracts can provide legal certainty as well as adequate protection for the parties.

Abstract

Unlawful acts are a fundamental concept in Indonesian civil law as stipulated in Article 1365 of the Civil Code as the basis for liability for losses incurred to other parties. Along with the development of society, the meaning of unlawful acts is not only limited to violations of the law, but also includes violations of subjective rights, legal obligations, moral norms, and the principle of propriety. This study aims to analyze the concept and application of unlawful acts in Indonesian civil law by using normative legal research methods through legislative, conceptual, and case approaches. The results of the study show that unlawful acts play an important role in legal protection, but there are still differences in judges' interpretations of its elements that have the potential to cause legal uncertainty. Therefore, consistency of interpretation and strengthening of jurisprudence is needed to realize justice, legal certainty, and utility.
