Abstract

ABSTRAK: Penelitian ini bertujuan untuk mengetahui: (1) Pemenuhan hak dasar pendidikan bagi Penyandang Disabilitas di Kota Makassar berdasarkan Peraturan Daerah Kota Makassar Nomor 6 Tahun 2013, (2) Kendala yang dihadapi dalam memperoleh hak dasar pendidikan penyandang disabilitas di Kota Makassar, (3) Solusi yang tepat untuk mengatasi kendala yang dihadapi dalam memperoleh hak dasar pendidikan penyandang disabilitas di Kota Makassar. Penelitian ini merupakan penelitian yang menggunakan pendekatan deskriptif kualitatif, yang dimana sumber data primer yang menjadi informannya  adalah Siswa Penyandang disabilitas jenjang SMA, Mahasiswa penyandang disabilitas S1, pejabat Dinas Pendidikan Kota Makassar, angota DPRD Kota Makassar, Pengurus Organisasi disabilitas, Pembina LSM dan Orang tua Penyandang disabilitas. Adapun prosedur pengumpulan data yang digunakan adalah wawancara dan dokumentasi. Sedangkan analisis data yang digunakan adalah analisis deskriptif. Hasil penelitian menunjukkan bahwa: (1) Pemerintah Kota Makassar telah mengupayakan terpenuhinya hak dasar pendidikan bagi penyandang disabilitas di Kota Makassar. hal tersebut dibuktikan dengan adanya perda yang didalamnya mengharuskan setiap instansi pendidikan di Kota Makassar untuk memberikan kesempatan bagi penyandang disabilitas untuk memperoleh pendidikan. Efek dari hadirnya perda tersebut ialah pada saat ini penyandang disabilitas telah dapat bersekolah di instansi pendidikan manapun baik di sekolah SLB, Sekolah Reguler dan universitas. (2) masih dijumpai beberapa kendala yang diperoleh penyandang disabilitas dalam mendapatkan hak pendidikannya yakni masih ada instansi pendidikan yang belum mau menerima penyandang disabilitas untuk bersekolah di sekolah regular, sarana dan prasarana pendidikan yang belum aksesibel bagi penyandang disabilitas dan masih ada tenaga pendidik pada sekolah regular yang belum paham dalam menangani peserta didik penyandang disabilitas. (3) untuk mengatasi kendala tersebut, pemerintah harus lebih mensosialisasikan lagi tentang kebijakan yang menjamin pemenuhan hak dasar pendidikan penyandang disabilitas pada instansi pendidikan yang sejauh ini masih belum mau menerima peserta didik penyandang disabilitas. Selain itu, pemerintah harus mengidentifikasi penyandang disabilitas yang bersekolah di sekolah regular, kemudian mengalokasikan anggaran untuk pengadaan sarana dan prasarana serta pelatihan pada tenaga pendidik dalam menangani peserta didik penyandang disabilitas pada sekolah regular maupun universitas.Kata Kunci: Penyandang Disabilitas, Hak-hak Penyandang Disabilitas, Hak Dasar Pendidikan  ABSTRACT: This study aims to determine: (1) The fulfillment of basic rights to education for Persons with Disabilities in Makassar based on Local Regulation Makassar City No. 6 of 2013, (2) Obstacles encountered in obtaining the basic right of education of persons with disabilities in the city of Makassar, (3 ) the right solution to overcome the obstacles encountered in obtaining the basic right of education of persons with disabilities in the city of Makassar. This research is a study that used a qualitative descriptive approach, which is where the primary data source being informers are students with disabilities the high school level, students with disabilities S1, officials of Education Department of Makassar, members of Parliament of Makassar, the Management Organization disabilities, Pembina NGOs and Parents persons with disabilities. The data collection procedures used were interviews and documentation. While the analysis of the data used is descriptive analysis. The results showed that: (1) Makassar City Government has sought the fulfillment of the basic right to education for persons with disabilities in the city of Makassar. it is evidenced with the local regulations require every institution in which education in the city of Makassar to provide opportunities for persons with disabilities to education. The effect of the presence of these regulations is at the moment with disabilities have been able to attend school at any educational institutions both at school SLB, Regular schools and universities. (2) they encountered several obstacles that obtained with disabilities in getting the right to education that is still no educational establishments are not willing to accept persons with disabilities to attend regular schools, educational facilities are not accessible for persons with disabilities and there are educators at regular schools who do not understand in dealing with students with disabilities. (3) to overcome these obstacles, the government should socialize more about the policies that guarantee basic rights of education of persons with disabilities in educational institutions that are still not willing to accept students with disabilities. In addition, the government should identify the persons with disabilities who attend regular school, then allocate the budget for the procurement of infrastructure and training of educators in dealing with students with disabilities in regular schools and universities.Keywords: Disability Rights of Persons with Disabilities, Basic Rights Education,

Abstract

Penelitian ini bertujuan : 1) Untuk mengetahui persepsi Jaksa terhadap peninjauan kembali lebih dari satu kali di Kejaksaan Tinggi Sulawesi Selatan. 2) Untuk mengetahui peran Jaksa terhadap peninjauan kembali lebih dari satu kali. 3) Untuk mengetahu menfaat peninjauan kembali lebih dari satu kali. Penelitian ini menggunakan desain penelitian deskriptif kualitatif dengan memberikan gambaran persepsi Jaksa terhadap peninjauan kembali lebih dari satu kali di Kejaksaan Tinggi Sulawesi Selatan. Populasi dalam penelitian ini adalah 100 orang Jaksa. Sampel penelitian ini dilakukan secara Random Sampling yaitu 10% dari Jumlah populasi sebanyak 10 Orang Jaksa. Tehnik pengumpulan data yang digunakan adalah dengan melakukan wawancara dan dokumentasi. Data penelitian dianalisis dengan menggunakan analisis deskriptif. Hasil penelitian menunjukkan bahwa : 1) Persepsi jaksa di Kejaksaan Tinggi Sulawesi Selatan terhadap peninjauan kembali lebih dari satu kali yang lebih banyak tidak sepakat dengan adanya peninjauan kembali karena dalam proses peradilan tidak dibatasi sehingga tidak adanya kepastian hukum. 2) Menurut Jaksa di Kejaksaan Tinggi Sulawesi Selatan. Jaksa memiliki Peran untuk mengajukan peninjauan kembali lebih dari satu kali karena dalam undang-undang jaksa merupakan pihak-pihak yang berkepentingan dalam tugasnya mewakili Negara. Selain itu didalam undang-undang tidak terdapat larangan untuk jaksa mengajukan peninjauan kembali lebih dari satu kali. 3) Manfaat peninjauan kembali lebih dari satu kali menurut Jaksa yaitu memberikan kesempatan bagi terpidana,ahli waris dan Jaksa (mewakili Negara) untuk mendapatkan keadilan.Kata Kunci : Jaksa, Peninjauan Kembali, Kejaksaan Tinggi This study aims: 1) To determine the perception of the Prosecutor against the review of more than one time in the High Court of South Sulawesi. 2) To determine the role of the Prosecutor against the review of more than one. 3) To mengetahu menfaat review of more than one. This study design using qualitative descriptive study provides an overview of the review of the Prosecutor's perception more than once in the High Court of South Sulawesi. The population in this study were 100 prosecutors. The research sample conducted random sampling of 10% of Total population of 10 people Prosecutor. Data collection techniques used is by interview and documentation. Data were analyzed using descriptive analysis. The results showed that: 1) Perception prosecutor in the High Court of South Sulawesi to the review of more than one more does not agree with the reconsideration because the judicial process is not limited to the absence of legal certainty. 2) According to the High Court of South Sulawesi. The role of the prosecutor has to file a judicial review more than once because of the laws prosecutors are parties interested in its task of representing the State. Also in the legislation there are no restrictions to the prosecutor file a judicial review more than once. 3) The benefits of reviewing more than once according to the Prosecutor which gives an opportunity for the convict, the heir and prosecutor (representing the State) to get justice.Keywords: Attorney, Judicial Review, the High Court

Abstract

ABSTRAK: Penelitian ini bertujuan untuk mengetahui: (1) Tingkat kesadaran hukum masyarakat terhadap perpanjangan Plat nomor kendaraan bermotor roda dua di Desa GaringKabupaten Gowa, (2) Faktor yang mempengaruhi kesadaran hukum masyarakat terhadap perpanjangan plat nomor kendaraan bermotor roda dua di Desa Garing Kabupaten Gowa, (3) Upaya yang dilakukan Samsat Gowa untuk meningkatkan kesadaran hukum masyarakat dalam memperpanjang plat nomor kendaraan bermotor. Untuk mencapai tujuan tersebut maka peneliti menggunakan teknik pengumpulan data melalui observasi, wawancara dan dokumentasi. Data yang telah diperoleh dari hasil penelitian diolah dengan menggunakan teknik analisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa : (1)Tingkat kesadaran hukum masyarakat terhadap perpanjangan plat nomor kendaraan bermotor masihrendah hal tersebut tampak pada pelaksanaan indikator kesadaran hukum yang tidak terpenuhi secara keseluruhan dalam hal ini pemahaman hukum, sikap hukum dan pola perilaku hukum dan berdasarkan data yang diperoleh 30 dari 62 pemilik kendaraan tidak melakukan perpanjangan plat nomor kendaraan bermotor. (2) Faktor yang mempengaruhi tingkat kesadaran hukum masyarakat terhadap perpanjangan plat nomor kendaraan bermotor antara lain latar belakang pendidikan rendah, lokasi yang sulit dijangkau dan biaya registrasi yang tinggi. (3) Upaya yang dilakukan samsat gowa untuk meningkatkan kesadaran hukum masyarakat dalam memperpanjang plat nomor kendaraan bermotor yaitu memberikan sosialisasi registrasi perpanjangan plat nomor kendaraan bermotor kepada masyarakat dan meningkatkan pelayanan yang baik bagi masyarakat.Kata Kunci: Kesadaran Hukum, Masyarakat, Plat Nomor Kendaraan Bermotor.  ABSTRACT: This research is aimed to know: (1) The level of public legal awareness to the extension of the two-wheeled vehicle number plate in Garing Village, Gowa District, (2) The factor that influences the legal awareness of the community towards the extension of the license plate number in Garing Village, Gowa regency , (3) Efforts by Samsat Gowa to increase public legal awareness in extending the license plate of motor vehicles. To achieve these objectives, the researchers used data collection techniques through observation, interviews and documentation. The data have been obtained from the results of research processed by using qualitative descriptive analysis techniques. The results showed that: (1) The level of legal awareness of the community towards the extension of license plate number of motor vehicle is still low. It is seen in the implementation of the unfulfilled legal awareness indicator in this case in terms of legal understanding, legal attitude and behavioral pattern and based on the data obtained of the 62 vehicle owners did not renew their license plate number. (2) Factors affecting the level of legal awareness of the community towards the extension of license plate number of motor vehicles such as low education background, difficult location and high registration fee. (3) Efforts by samsat gowa to increase awareness of public law in extending license plate of motor vehicle that is to socialize registration of extension of license plate of motor vehicle to society and improve good service for society.Keywords: Legal Awareness, Society, Motor Vehicle Number Plate.

Abstract

Tujuan penelitian ini adalah untuk mengetahui: (1) Bagaimana prosedur pelaksanaan pungutan retribusi wisata alam Tanjung Bira Kabupaten Bulukumba; (2) Apakah yang menjadi kendala dalam pungutan retribusi wisata alam Tanjung Bira Kabupaten Bulukumba: (3) Upaya apakah untuk menyelesaikan kendala pungutan retribusi wisata alam Tanjung Bira Kabupaten Bulukumba. Penelitian ini menggunakan metode deskriptif kualitatif mengenai mekanisme pelaksanaan pungutan retribusi wisata alam Tanjung Bira Kabupaten Bulukumba.Populasi dalam penelitian ini adalah seluruh pihak yang terkait dalam pelaksanaan retribusi wisata alam Tanjung Bira. Adapun sampel dalam penelitian ini yaitu staf pariwisata dan kebudayaan,petugas penagihan retribusi, dan masyarakat atau pengunjung dengan tehnik  observasi, wawancara,dokumentasi, dan penyebaran angket Hasil penelitian ini menunjukkan bahwa: (1). Prosedur pembayaran dan penagihan retribusi adalah: (a). Bukti pembayaran atau karcis diserahkan oleh petugas penagihan retribusi,(b). pembayaran retribusi dilakukan di loket, (c).pembayaran disertakan bukti karcis,(d). pembayaran retribusi diserahkan kebendahara Dinas Pariwisata dan Kebudayaan, (e).Dinas pariwisata Dan Kebudayaan menyerahkan kepada bendahara Dinas pengelolaan keuangan daerah Kabupaten Bulukumba. (2). Kendala Dalam Pungutan Retribusi Wisata Alam Tanjung Bira Kabupaten Bulukumba adalah: (a).kendala administrasi, (b).kendala non administrasi, dan,(c).fasilitas,. (3). Upaya untuk menyelesaikan kendala dalam pungutan retribusi wisata alam tanjung Bira Kabupaten Bulukumba adalah: (a) menerapkan pengawasan yang melekat terhadap setiap petugas, dengan menanamkan kesadaran para petugas melaksanakan tanggung jawab dengan memberikan pengarahan terhadap petugas yang melakukan pelanggaran. (b) Mengenai pemukiman didalam sangat berat maka kami membebaskan masyarakat dengan menunjukkan lahan  untuk kelangsungan hidupnya sebab pendapatan yang dapat menghidupi mereka salah satunya berjualan di dalam.(c)  mengadakan secepatnya penertiban sosialisasi minimal satu kali beli tiket agar masyarakat dan petugas retribusi tidak lagi ragu melaksanakan kewajibannya seperti pemasangan reklame. Proof of payment or billing clerk handed over by the ticket levy, (b). levy payments made at the counter, (c) .pembayaran included proof of a ticket, (d). levy payments submitted kebendahara Department of Tourism and Culture, (e) .Dinas Tourism and Culture Department handed over to the treasury financial management Bulukumba. (2). Constraints In Nature Levy of Tanjung Bira Bulukumba are: (a) .kendala administration, (b) non .kendala administration, and, (c) .fasilitas ,. (3). Abstract

Penelitian ini bertujuan untuk mengetahui (1)Faktor-faktor empiris yang menyebabkan terjadinya tindak kekerasan di lembaga pemasyarakatan kelas I Makassar (2) Alasan terjadinya tindak kekerasan di lembaga pemasyarakatan kelas I Makassar (3) Upaya pihak lembaga pemasyarakatan dalam menangani tindak kekerasan di dalam lembaga pemasyarakatan Kelas I Makassar. Untuk mencapai tujuan tersebut maka peneliti menggunakan teknik pengumpulan data melalui observasi, wawancara dan Dokumentasi. Dari hasil data yang di peroleh dalam penelitan ini menggunakan analisis data yaitu Reduksi data, penyajian data dan penarikan kesimpulan. Verifikasi, Hasil penelitian ini menunjukan bahwa (1) Faktor-faktor yang memicu kekerasan di Lapas Kelas I makassar, karena adanya (a) Kelabihan Kapasitas atau Kepadatan penghuni Lapas, (b) Kesalah Pahaman,(c)Utang Piutang dan Penggunaan HP,(d) Rasa Dendam,(e) Pengaruh Kelompok atau geng di dalam lapas yang merasa berkuasa. (2) Alasan terjadinya tindak kekerasan di dalam lapas kelas I makassar yaitu (a) Karena adanya Pengaruh dari Teman dan Lingkungan Lapas (b) Karena Pengaruh Individu atau Internal narapidana. (3) Upaya yang dilakukan oleh pihak Lapas dalam menangani tindak kekerasan di dalam lapas Kelas I makassar yaitu (a) Mningkatkan pengawasan dan keamanan lapas, (b) Sosialisasi Nilai-nilai Hak Asasi Manusia dan Keagamaan dalam Pembinaan Narapidana.

Abstract

This research aims to: (1) To find out the eight points in the practice of just and civilized human values that are practiced in the daily lives of students at SMA Negeri 1 Gowa, especially class XI MIPA 3. (2) To find out the supporting factors in the practice of values fair and civilized human values in the daily lives of class XI MIPA 3 students. Data collection techniques through observation, interviews and documentation. Data obtained from interviews with teachers and students. Checking the validity of the data uses data source triangulation techniques. The results of this research found that the practice of fair and civilized human values was well practiced by students such as; recognize and treat human beings according to their dignity, recognize equality of human rights and obligations without discrimination, have an attitude of mutual love, tolerance for each other, not be arbitrary towards others, uphold human values, like to carry out humanitarian activities and have the courage to defend truth. Fair and civilized human values are carried out through the implementation of teaching and learning activities in the classroom and outside the classroom, and the factors that support the implementation of just and civilized human values are teacher example, teaching/guidance methods and the school environment.

Abstract

This research aims to determine the motives and control of political money in the election of members of the Central Buton Regency Regional People's Representative Council (DPRD) in 2019. To achieve this goal, researchers used data collection techniques through interviews. The research data that has been collected and obtained is then analyzed qualitatively to determine the motives and supervision of political money in the 2019 election of members of the Central Buton Regency Regional People's Representative Council. The results of the research show that (1) There are several motives for the money used in the 2019 Central Buton Regency DPRD Member Election (2) Supervision of political money in elections or elections for members of the Regional People's Representative Council (DPRD) is carried out by the election organizers, in this case the Commission General Elections (KPU) and the Election Supervisory Body (BAWASLU) by carrying out several supervision and action against election fraud, in this case political money.

Abstract

Supervised by Firman Umar and Ririn Nurfaathirany.Research This study aims to determine 1) the position of Pak Ogah in the Makassar City Regional Regulation,2) Supervision and Handling System of Mr. Ogah in Makassar City, 3) sanctions for Mr. Ogah's activities in Makassar City.pak ogah who are active in Makassar city.Approach qualitative approach is descriptive research and tends to use inductive method analysis.tends to use analysis with the inductive method. The results of this study indicate that The existence of Mr. Ogah is still reaping pros and cons as a result of the absence of a clear traffic management system from the authorities. clear traffic management system from the authorities. they remain illegal and cannot be legally illegal and cannot be said to be legitimate. The position of Mr. Ogah in the government is regulated in the Makassar City Regional Regulation No. 7 of 2021 concerning public order, tranquility, and protection of the community. a person then chooses Mr. Ogah as an alternative profession because of related to economic factors or poverty, low education level, inadequate work experience. low level of education, inadequate work experience. Monitoring and handling system carried out by stakeholders in accordance with the governing regulations. Threat of sanctions for pak ogah who continue their activities are regulated in article 41 paragraph (2) and (3) Makassar City Regional Regulation on Peace, Order and Community Protection.

The research approach used is qualitative research with a qualitative descriptive research type. Data collection techniques include observation, interviews and documentation using research instruments in the form of interview guides, recording and documentation tools. Triangulation and member checking are used as procedures to check the validity of the data, as well as using data reduction, data presentation, and drawing conclusions as data analysis techniques. The research results prove that the factors inhibiting diversion include a) legal substance factors in accordance with article 7 of the SPPA Law b) legal structure factors and law enforcement officers. Diversion failure occurred because the victim wanted to continue the case through legal channels. c) Legal culture or legal culture factors. People think that Butonese people usually have high levels of egoism.

Abstract

Socio-juridical Review of Mr. Ogahin Makassar City Area. Thesis Faculty of Social Sciences and Law, Study ProgramPancasila and Citizenship Education Study Program. Research This study aims to determine 1) the position of Pak Ogah in the Makassar City Regional Regulation,2) Supervision and Handling System of Mr. Ogah in Makassar City, 3) sanctions for Mr. Ogah's activities in Makassar City.pak ogah who are active in Makassar city. Approach qualitative approach is descriptive research and tends to use inductive method analysis.tends to use analysis with the inductive method. The results of this study indicate that The existence of Mr. Ogah is still reaping pros and cons as a result of the absence of a clear traffic management system from the authorities. clear traffic management system from the authorities. they remain illegal and cannot be legally illegal and cannot be said to be legitimate.
