Abstract

This article aims to examine the fairness of inheritance law, reviewing maslahah mursalah. Through searching primary and secondary sources, this article finds that inheritance means the transfer of something from one person to another, better known as the transfer of various rights and obligations regarding the assets of someone who has died to another person who is still alive. Men and women have equally strong rights in obtaining inheritance from their parents and their siblings. Therefore the 2:1 division between men and women is fair both from the perspective of inheritance law itself and from the maslahah murlah. by considering Islamic law to avoid undesirable things (harm).

Abstract

The urgency of this research arises from the strong belief held by the people of Tulung Indah Village regarding the prohibition of marriage during the month of Suro, which is considered a sacred month that may bring misfortune if violated. This belief persists despite lacking a clear basis in Islamic law. This study aims to explore the community’s views on the prohibition, identify the underlying factors, and examine the issue from the perspective of Islamic law. The research method employed is empirical research using a qualitative approach. Data sources consist of primary and secondary data, collected through observation, interviews, and documentation. Data validity was tested using triangulation techniques, while data analysis was conducted through data reduction, data presentation, and drawing conclusions. The results of the study show that the majority of Tulung Indah residents still believe in and adhere to the prohibition of marriage during the month of Suro due to cultural reasons, inherited beliefs, limited religious understanding, and environmental influence. From the perspective of Islamic law, there is no evidence from the Qur’an or Hadith that forbids marriage during the month of Suro. Therefore, this tradition is not legally binding in Islamic terms. However, if the tradition leads to polytheism or contradicts Islamic creed (aqidah), it cannot be justified. The researcher recommends that religious leaders and academics play an active role in educating the community to correct misconceptions and misguided beliefs.

Abstract

Penelitian ini bertujuan untuk menganalisis kompetensi kepala madrasah, strategi implementasi Merdeka Belajar, dan tantangannya. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Data diperoleh melalui wawancara mendalam, observasi, dan dokumentasi yang dianalisis secara deskriptif-kualitatif. Hasil penelitian menunjukkan bahwa kepala madrasah memiliki penguasaan pada lima kompetensi utama, yakni kepribadian, manajerial, kewirausahaan, supervisi, dan sosial. Strategi yang diterapkan kepala madrasah untuk mendukung Merdeka Belajar meliputi pemberian ruang inovasi kepada guru, pembelajaran berdiferensiasi berdasarkan minat siswa, asesmen fleksibel, pelatihan berkelanjutan bagi guru, serta kolaborasi aktif dengan orang tua dan masyarakat. Meskipun demikian, kepala madrasah juga menghadapi tantangan serius seperti keterbatasan dana dan sarana prasarana, kesenjangan kompetensi guru, serta resistensi dalam pelaksanaan supervisi. Penelitian ini menegaskan bahwa keberhasilan pelaksanaan Merdeka Belajar di madrasah sangat ditentukan oleh kapasitas kepala madrasah dalam menjalankan fungsi kepemimpinannya secara adaptif, kreatif, dan kolaboratif. Implikasi praktis dari penelitian ini adalah pentingnya penguatan kompetensi kepala madrasah melalui program pelatihan berkelanjutan dan dukungan sistemik dari pemerintah dan masyarakat.

Abstract

The phenomenon shows that some students do not have the ability to read the Qur'an according to the rules of tajweed and are not able to internalize the values of the Qur'an in controlling emotions and academic behavior. This condition is influenced by the heterogeneity of initial abilities, the limitation of the duration of coaching, and the implementation of the Ma'had Al-Jami'ah Program which runs in parallel with lectures. This situation requires a comprehensive evaluation to assess the effectiveness of the program in strengthening Qur'an literacy and students' emotional intelligence. A mixed methods approach with a concurrent embedded design is used, with qualitative data as the main data and quantitative data as support. The evaluation was carried out using the CIPP (Context, Input, Process, and Product) model to assess the relevance of policies, resource readiness, implementation dynamics, and overall program outcomes. The results show that the program is conceptually aligned with the needs of students and the vision of Islamic education. The implementation of the program is able to improve basic tahsin skills, worship habits, discipline, and emotional calm. However, the achievement of Qur'an literacy is not evenly distributed, especially in the aspect of fluent reading and understanding of the meaning of verses, due to differences in initial abilities and limited coaching time. The affective and spiritual aspects show stronger achievements than the cognitive aspects.
