Abstract

The issue of violence against wife physically and psychologically, today more frequent in the community. The factual reality shows that domestic violence against wife is a phenomenon that sometimes considered to be prevalent in society. The common assumption must not be separated from social construction in the society that the husband is the head of the family and has full authority to the family members, including his wife. In that context, this study attempts to analyze how the concept of the women protection as victims of domestic violence in Islamic law. In the context of the protection of women in the household, the texts of the Quran give many answers that require embodiment household with ma'ruf relationship in the sense of equal, fair and democratic. It is confirmed that Islamic law carries a mission ofprotection, which is a mercy for all human beings on earth. It also harmonized with applicable laws protecting women in Indonesia today.Persoalan kekerasan terhadap istri secara fisik maupun psikis, dewasa ini semakin sering terjadi di masyarakat. Realita tersebut secara faktual menunjukkan bahwa kekerasan dalam rumah tangga terhadap istri, merupakan suatu fenomena yang terkadang dianggap lazim di lingkungan masyarakat. Anggapan lazim ini tentunya tidak terlepas dari konstruksi sosial yang berkembang di tengah masyarakat bahwa suami adalah kepala keluarga dan memiliki otoritas penuh terhadap anggota keluarga termasuk isteri. Dalam konteks itu kajian ini berupaya mengupas tentang bagaimana konsep perlindungan terhadap perempuan korban KDRT dalam hukum Islam. Dalam konteks perlindungan perempuan dalam rumah tangga,teks-teks al-Qur’an memberikan banyak jawaban yang mengharuskan perwujudan hubungan rumah tangga secara ma’ruf dalam arti setara, adil dan demokratis. Hal ini menegaskan bahwa hukum Islam membawa misi perlindungan, yaitu sebagai rahmat bagi seluruh manusia di muka bumi. Hal ini juga diharmonisasikan dengan hukum perlindungan perempuan yang berlaku di Indonesia saat ini.

Abstract

Abstract:Waqf is still interesting to do a study. Apart from being a form of worship to Allah SWT, waqf is also an instrument of welfare for Muslims. The object of waqf continues to expand. One model of the object of waqf in Muslim countries is the company akaf. This study aims to describe the management and ways of developing corporate waqf in Malaysia and Singapore. This governance is then used as material for the development of corporate waqf in Indonesia. This article is the result of a doctrinal law research with a comparative approach. The results of this study indicate that the company-based waqf concept in Indonesia needs to be developed transformatively. As practice in Malaysia and Singapore. So that it can be an instrument in improving the welfare of the people in a sustainable manner. The formulation of a corporate waqf legal development model in Indonesia needs to be adjusted and strengthened. Regulators as well as an integrative and holistic understanding of the ulama. So that company waqf can be a strategic alternative in an effort to accelerate national economic development.Keywords: waqf, south east Asia, welfare.Abstrak:Wakaf masih menarik untuk dilakukan kajian. Selain merupakan bentuk ibadah kepada Allah SWT, wakaf juga merupakan instumen kesejahteraan bagi umat Islam. Objek wakaf terus mengalami perluasan. Salah satu model objek wakaf di negara-negara muslim adalah wakaf perusahaan. Penelitian ini bertujuan untuk mendeksripsikan pengelolaan dan cara pengembangan wakaf perusahaan di Malaysia dan Singapura. Tata kelola ini kemudian dijadikan bahan pengembangan wakaf perusahaan di Indonesia. Artikel ini merupakan hasil penelitian hukum doktrinal dengan pendekatan perbandingan. Hasil kajian ini menunjukkan bahwa konsep wakaf berbasis perusahaan di Indonesia perlu dikembangkan secara transformatif. Sebagaimana praktik di Malaysia dan Singapura. Sehingga dapat menjadi instrumen dalam meningkatkan kesejahteraan umat secara berkelanjutan. Rumusan model pengembangan hukum wakaf perusahaan di Indonesia perlu disesuaikan dan dikuatkan. Pemangku regulasi sekaligus pemahaman yang integratif dan holistik di kalangan ulama. Agar wakaf perusahaan dapat menjadi alternatif strategis dalam upaya percepatan pembangunan ekonomi nasional.Keywords: wakaf; asia tenggara; kesejahteraan.

Abstract

Illegitimate children born from incest present complex issues in civil law, particularly concerning their legal status and the protection of their rights. The main legal problem concerns the position of the biological father. Under Islamic law, the biological father has no legal relationship of lineage, guardianship, or inheritance with the child. However, from a moral, constitutional, and human rights perspective, the father still bears responsibility for fulfilling the child’s basic rights. This study examines the legal consequences and obligations of biological fathers toward illegitimate children using the perspectives of Progressive Law and Islamic Human Rights. The research employs a normative legal method, focusing on Article 283 of the Civil Code, which prohibits the recognition of illegitimate children. This provision is analyzed in relation to the Child Protection Law, the Human Rights Law, the International Covenant on Civil and Political Rights, and other relevant regulations. In addition, conceptual and philosophical approaches are used to reinterpret rigid legal norms by emphasizing justice, humanity, and social reality. The study finds that recognition of illegitimate children by their biological fathers may be permitted to the extent that it ensures the fulfillment of the child’s fundamental rights, such as financial support, education, and health care. However, recognition should not extend to lineage, inheritance, or guardianship, in order to uphold the principle of hifz al-nasl (protection of lineage). These limitations are not discriminatory but aim to harmonize child protection with the principles of Islamic law. Furthermore, responsibility for protecting children does not rest solely on parents; the state and society also have a duty to ensure that all children receive equal protection. This research offers a legal reconstruction that bridges Islamic law and human rights, providing a normative basis for child protection policies consistent with maqāṣid al-sharīʿah.
