Abstract

This study aims to determine and analyse the judges' considerations using gender justice in the Decision of the Madiun District Religious Court Number 1512/Pdt.G/2022/PA.Kab.Mn. Normatively, the permissibility of polygamy rests on the wife's consent and the husband's ability to be fair. In this case, the problem started with applying for a polygamy permit after the Applicant married his second wife. Argumentation: The Applicant, who was married before applying polygamy, was considered unlawful. This is doctrinal legal research with a case, conceptual, and statutory approach. Data sources for this research are court decisions, laws and regulations, books, journals, and research results. This research provides a conceptual basis for judges in making decisions on applications for polygamy licenses based on gender equity so that justice in society is created objectively.

Abstract

Families have a central role in building resilience to political, socio-economic, and cultural challenges, including vote-buying practices that are detrimental and hinder the achievement of Sharia objectives. This article aims to explore the practice of money politics impacting the resilience of Muslim families in the political year from a maqashid perspective, especially in the practice of politics in Indonesia. Family resilience here does not only concern the family's problems in facing the challenges of life but is related to the maintenance of religion, soul, mind, property and offspring. This research shows that families with high religiosity awareness tend to be able to act as a filter against vote-buying practices by teaching moral values, including rejecting unethical practices in politics. However, rejecting this practice cannot be fully guaranteed because of other influencing factors, including social, economic and regional political factors. It is necessary to develop political patterns more orientated toward human welfare following the maqashid Sharia values. Strict law enforcement and political awareness in social development are also essential to reduce vote-buying practices and ensure the integrity of the democratic process. The family, as the smallest unit in society, has a significant impact on shaping consumer behavior and building family resilience by instilling religious values, especially in the context of Islam.

Abstract

A cooperation is an agreement between two or more people to do business and achieve common goals. Cooperation can be necessary for human life, considering that humans are social creatures who need each other. People in various circles have practiced cooperation in various fields. In various cooperation practices, there are often deviations from the agreement when initially making cooperation. This article explores the problems of implementing the cooperation agreement at the Semoyo Jaya welding workshop in a review of Islamic law. By using a qualitative approach and field research methods. Meanwhile, for data collection, using observation and interview techniques. This research concluded that the implementation of the cooperation agreement at the Semoyo Jaya welding workshop was not following the principles and elements of the agreement, namely, not fulfilling any of the rights and obligations contained in the contract. Meanwhile, the profit-sharing does not meet one of the syirkah inan requirements because one party is arbitrary in providing profits to the other party. This research can contribute practically to the parties that carry out cooperation to fulfill the agreement's terms based on Islamic legal values.

Abstract

Global climate change and environmental problems significantly threaten the Earth's ability to support human needs and well-being. This crisis is exacerbated by increased economic development activities that rely heavily on the exploitation of natural resources. Indonesia, facing similar challenges, requires the implementation of a sustainable and environmentally friendly economic model. This study examines budgeting in the context of local government budget documents and regional development reports, focusing on the integration of green economic principles in the Mataraman region of East Java, Indonesia. Using a qualitative approach, the research examines local government budget and economic development reports from Madiun City and Ponorogo Regency. It involves a comprehensive analysis of both primary and secondary sources related to local development and budgeting. The findings aim to contribute to the promotion and acceleration of green economic development in the region, thereby influencing the allocation of resources to foster an inclusive and prosperous community.

Abstract

Pro bono legal aid must be provided by Advocates to underprivileged people, as written in Article 22 Paragraph 1 of Law No. 18 of 2003 concerning Advocates. Pro bono assistance is provided to fulfill access to justice. The high poverty rate in Ponorogo Regency and the limited amount of pro bono assistance provided each year make it difficult for underprivileged people to access and obtain legal aid, because not all advocates have carried out their obligations to provide pro bono assistance at the Ponorogo Religious Court . This research is a qualitative research with empirical legal research type. Data collection techniques using snowball sampling. The analysis method uses qualitative analysis. From this research it can be concluded that first, each advocate has its own criteria, namely that the client pays the costs of the case because the Advocate only provides free legal aid services and the Court has no special budget for pro bono assistance. Although they have their own criteria, the assistance has fulfilled the values of justice, helping and Maqāshid al-Sharī'ah , namely the protection of the soul. Second, the process of providing pro bono assistance has not been carried out optimally because not all advocates have fulfilled their obligations to provide pro bono assistance. Although it has not been done optimally, it has fulfilled the principles of Islamic law, namely the value of tolerance, Amar Ma'ruf Nahi Munkar, equality and Maqāshid al-Syarī'ah on the protection of offspring and property.

Abstract

This research is based on the problem of isbat nikah request which was rejected by the Ponorogo Religious Court through a determination with case number 402 / Pdt.P /2018/PA.Po. The purpose of this research focuses on the study of the legal interpretation paradigm of judges for rejection of marriage wives which is then analyzed based on the perspective of critical legal studies. This type of research is normative legal research which includes library research with descriptive analysis method. While the data collection technique is a documentation analysis study. The findings of this study: first, the legal interpretation used by the panel of judges in this determination is a systematic interpretation. Meanwhile, the method used by the panel of judges in this case used grammatical interpretation. This can be seen from the basis of legal considerations that the judge rejected the request for marriage is the hadith of the Prophet Muhammad regarding the existence of a marriage guardian as narrated by Ibn Hibban, Article 20 and Article 23 KHI, Article 1 paragraph (2) PMA No. 30 of 2005, Article 2 paragraph ( 1) Law No. 1 of 1974 concerning Marriage. Second, from the perspective of critical legal studies, the panel of judges uses a posivistic paradigm, namely not making any legal breakthroughs. This happens because the law is deemed capable of answering cases, the judge then does not grant marriage requests in order to prioritize the value of legal certainty over the value of justice and the value of benefit. This judge's decision contradicts Gustav Radbruch's standard priority theory, which is the first priority order of justice, second benefit and third legal certainty. Penelitian ini berangkat dari problem permohonan isbat nikah karena menikah siri yang ditolak oleh Pengadilan Agama Ponorogo melalui Penetapan dengan nomor perkara 402/Pdt.P /2018/PA.Po. Tujuan penelitian ini memfokuskan kajian pada paradigma interpretasi hukum hakim atas penolakan isbat nikah yang kemudian dianalisis berdasarkan perspektif studi hukum kritis. Jenis penelitian yang digunakan adalah penelitian hukum normatif yang termasuk studi kepustakaan (library research) dengan metode analisis deskriptif. Sedangkan teknik pengumpulan data adalah studi analisis dokumentasi. Temuan dari penelitian ini: pertama, Interpretasi hukum yang digunakan majelis hakim dalam penetapan ini adalah Interpretasi sistematis. Sedangkan metode yang digunakan majelis hakim dalam perkara ini menggunakan interpretasi gramatikal. Hal ini dapat dilihat dari dasar pertimbangan hukum hakim menolak permohonan isbat nikah adalah hadis Rasulullah tentang harus adanya wali nikah yang diriwayatkan oleh Ibnu Hibban, Pasal 20 dan Pasal 23 KHI, Pasal 1 ayat (2) PMA No 30 Tahun 2005, Pasal 2 ayat (1) UU No 1 Tahun 1974 Tentang Perkawinan. Kedua, Dilihat dari perspektif studi hukum kritis, majelis hakim menggunakan paradigma posivistik yaitu tidak melakukan terobosan hukum. Hal ini terjadi karena undang-undang dianggap telah mampu menjawab kasus, hakim kemudian tidak mengabulkan permohonan isbat nikah demi mendahulukan nilai kepastian hukum daripada nilai keadilan dan nilai kemanfaatan. Keputusan hakim ini berseberangan dengan teori prioritas baku Gustav Radbruch yang dengan urutan prioritas pertama keadilan, kedua manfaat dan ketiga kepastian hukum.

Abstract

This research began with the problem of providing children with post-divorce rights which were not fulfilled by both parents. The aim of this research is to see the extent to which children's rights after divorce are implemented. This research is a type of qualitative field research. The approach used is normative juridical with a type of clinical research. The findings of this research show that explaining children's rights after divorce in Bekiring Village, Pulung District, Ponorogo Regency from a positive legal perspective, of the 6 (six) residents who were used as informants in the parenting aspect, two informants were in compliance while the other four were not. The aspect of paying for a living (father) has been fulfilled by the father with all his efforts, but one informant enjoys the living carried out by the mother. Aspects of caring for children who are not mumayyiz yet with their mother, one is suitable while the other five are in the care of the father. Furthermore, the implementation of positive law regarding the granting of children's rights after divorce in Bekiring Village, Pulung District, Ponorogo Regency, from the perspective of Gustav Radbruch's theory of legal objectives, in the aspect of legal justice regarding children who have the right to choose to live with their father/mother has not been implemented. In the aspect of legal benefits, some of it has been implemented, but regarding the care of children who are not yet mumayyiz, it has not been implemented well. While the aspect of legal certainty has not been implemented well, the value of certainty in obtaining support from the father has been implemented.

Abstract

Artikel ini mengeksplorasi Penetapan Pengadilan Agama Tulungagung Nomor: 287/Pdt.P/2017/PA.TA, tentang pencabutan surat penolakan perkawinan dalam masa ‘iddah. Perkawinan dalam masa ‘iddah secara hukum positif tidak dapat dilaksanakan sebelum masa ‘iddah-nya habis, akan tetapi majelis hakim berpendapat lain yang berseberangan dengan KUA Kedungwaru Kabupaten Tulungagung, pihak KUA menyatakan bahwa calon mempelai wanita masih dalam masa ‘iddah hamil. Berdasarkan analisis,dalam putusannya majelis hakim menggunakan dasar hukum terhadap perkara tersebut, yakni Pasal 153 Ayat 2 Huruf b KHI, QS. At-Thalaq ayat 4, serta Pasal 53 KHI, yang diketahui berdasarkan metode penemuan hukum (rechtvinding), diantaranya: Pertama, Metode Interpretasi Sistematis digunakan untuk mengetahui masa ‘iddah W (pemohon) bukan ‘iddah hamil akan tetapi ‘iddah qurû’; Kedua, Metode A Contrario (Argumen a Contrario) terhadap Pasal 153 Ayat (2) Huruf c KHI, untuk mengetahui siapa pria yang menghamili W (pemohon), sekaligus sebagai dasar untuk mencabut surat penolakan perkawinan dari KUA; dan Ketiga, Silogisme terhadap Pasal 53 KHI, untuk mengetahui diantara W (pemohon) dengan S (calon suami) tidak ada halangan untuk melangsungkan perkawinan.Selain itu, perlu upaya preventif dan mengadvokasi masyarakat secara dini mengenai pelaksanaan perkawinan pasca perceraian terutama bagi pihak wanita yang masih dalam masa ‘iddah.

Abstract

Selling online through various digital platforms is an alternative business. Many successful people have made huge profits from it. However, fraud, deception, the spread of fake accounts, and counterfeit transactions often occur and harm many people. This research explores the practice of buying and selling with bogus and counterfeit accounts on digital platforms. This research is qualitative research with a case study approach. Bahtsul Masail is the highest forum that discusses actual community problems for which no evidence or legal solution has been found. The answer to this problem was sought and taken from Politikul Mu'tabaroh. This research resulted in the finding that the law of asking buyers for postage in the above cases is not permitted because (1) the postage is not used correctly, instead as an additional income; (2) if the buyer knows this reality, it is inevitable that he will not be willing to pay the postage to the seller. It is not permitted because it is fraud. This study provides clarity on deviant buying and selling practices on digital platforms.

Abstract

This study began with differences in views from several researchers about the relationship between digital marketing innovation and marketing performance. With the results of this study, the research we conducted tried to conduct research by implementing business process agility so that there is a significant relationship between digital marketing innovation and marketing performance. This study was conducted by collecting data through direct distribution of questionnaires or through the use of Google Forms to respondents who are SME owners in Central Java Province. The sampling technique was carried out purposively with the criteria that SMEs have been operating for at least 5 years, where the number of samples obtained was 211 SME owners who met these criteria. The data was analyzed using Amos 22, where the results of the study showed a positive and significant relationship between digital marketing innovation and marketing performance. In addition, there is a positive and significant relationship between digital marketing innovation and business process agility and a positive and significant relationship between business process agility and marketing performance.
