Abstract

Artikel ini melakukan analisis yuridis tentang kebijakan pemerintah mengenai perlindungan korban HAM dan penyelesaian pelanggaran HAM yang signifikan. Berdasarkan Undang-Undang No. 26 Tahun 2000 tentang Pengadilan HAM, pelanggaran HAM berat sebelumnya dibahas dalam pembahasan artikel ini. Terlepas dari kebijakan pemerintah sebelumnya yang memungkinkan penyelesaian pelanggaran HAM berat melalui jalur non-yudisial, undang-undang ini menetapkan bahwa pelanggaran HAM berat harus diselesaikan melalui jalur yudisial. Artikel ini mencapai kesimpulan bahwa prinsip-prinsip umum peradilan HAM harus diterapkan saat menyelesaikan pelanggaran HAM berat untuk melindungi hak asasi warga negasi.

Abstract

Perkembangan teknologi yang semakin pesat dan akses yang mudah dijangkau menyebabkan informasi yang beredar di publik semakin terbuka. Era informasi menimbulkan tidak adanya batasan di antara kehidupan orang-orang di negara manapun. Arus informasi yang semakin tidak terbendung sehingga masyarakat harus memilah informasi yang layak atau tidak layak. Kemunculan berita hoaks dalam wujud tulisan, gambar, dan video mengakibatkan masyarakat terjerumus ke dalam persepsi yang keliru, sehingga sangat penting untuk mengetahui cara mengidentifikasi berita hoaks dan melaporkan berita hoaks tersebut pada wadah yang disediakan pemerintah. Metode yang kami gunakan yaitu melaksanakan observasi lapangan, melakukan persiapan, dan melakukan sosialiasi kepada kelompok teruna teruni di kelurahan tersebut. Jika dihitung nilai rata-rata peserta menunjukkan nilai rata-rata pre-test sebesar 70,46, sedangkan nilai rata-rata post-test sebesar 77,23 dari 65 peserta yang mengikuti sosialisasi yang dilakukan oleh kolaborasi antara empat program studi, yaitu S1 Hukum, S1 Ilmu Administrasi Negara, S1 Hubungan Internasional,  dan S1 Ilmu Administrasi Niaga Universitas Bali Internasional. Secara keseluruhan peserta lebih memahami dengan jelas mengenai informasi hoaks dan dapat mengidentifikasi informasi hoaks atau sebaliknya. Mereka juga memberikan tanggapan positif atas pengemasan materi narasumber. Penulis menghimbau agar seluruh pihak saling bersinergi untuk memberikan edukasi atas informasi hoaks kepada orang-orang di sekitarnya.

Abstract

This article examines the current of postmodern legal theory and its relevance in the context of Indonesian law. Legal postmodernism was born as a critique of the failure of modernism projects that were considered too rigid, schematic, and ignored the complexity of social reality. Postmodern legal theory is influenced by deconstructivism, relativism, and pluralism, and is significantly influenced by the school of legal realism and Critical Legal Studies. The main characteristics of postmodern legal theory include the rejection of absolute truth, criticism of grand narratives, recognition of plurality of values, and attempts to legitimize laws that are biased in political and economic interests. In Indonesia, postmodern thought has influenced the development of law through various manifestations such as feminist legal theory and progressive law. However, the implementation of postmodern legal theory in Indonesia requires contextualization by considering the cultural values and religious norms of the Indonesian people. This study concludes that postmodern legal theory is a form of critical and dynamic theoretical reflection, which can be used to understand, study, and apply law in Indonesia, which is complex and pluralistic, noting the need for caution in deconstructing the law to remain relevant to the local context of Indonesia.
