Abstract

The State Administrative Court (PTUN) is a place to find the real truth about the actions of state administrative officials that are not under the General Principles of Good Governance (AAUPB), for people whose interests and rights are taken away by parties who are deemed to be acting arbitrarily against other parties. The decisions that have been produced during the proceedings at the PTUN will undoubtedly have an impact which is expected to make a positive contribution in formulating a system of legal protection that is just, harmonious, and under the State Administrative Court Law and the 1945 Constitution of the Republic of Indonesia as the basis of the Indonesian state.

Abstract

The same significant risk also overshadows the lure of high wages to be a migrant worker abroad. The number of workers moving from home to foreign countries is increasing. The high risk and high interest cause migrant workers to be vulnerable to being deprived of their rights; therefore, they need to be protected by the state. This study seeks to examine the application of the pattern of sanctions obtained by companies providing labor services as migrant workers and protection for Indonesian migrant workers. The research was conducted using an empirical juridical approach where the reality that occurred in the field was studied and compared with the applicable legal provisions. The aim is to find out the legal protections for migrant workers and the sanctions for Indonesian Manpower Service Providers.

Abstract

This study provides an overview of the state administrative law dispute surrounding the granting of clemency to Antasari Azhar, a prominent figure involved in a high-profile legal case. The controversy stems from the exercise of executive power and the application of clemency within the framework of state administrative law. Antasari Azhar, a former Indonesian Corruption Eradication Commission (KPK) chairman, was convicted in a notable corruption case. Subsequently, his request for clemency sparked debates, legal challenges, and concerns about the integrity of the administrative process. This study delves into the legal dimensions of Antasari Azhar’s clemency case, examining the constitutional and administrative law aspects involved. Key issues include the discretionary powers of the executive in granting clemency, the potential influence of political considerations, and the adherence to legal procedures during the decision-making process. The research aims to shed light on the broader implications of this case for the rule of law, the separation of powers, and the accountability of public officials. Through a comprehensive analysis of relevant legal frameworks, court decisions, and scholarly perspectives, this study seeks to contribute to the understanding of the complex interplay between executive powers and the legal principles governing clemency in the context of state administrative law. Furthermore, it addresses the implications of such disputes for the overall legal and political landscape, emphasizing the importance of transparency, due process, and accountability in the exercise of executive clemency.

Abstract

Lahirnya positivisme merupakan langkah awal dari modernisasi karena mundurnya pengaruh agama dan raja sebagai wakil Tuhan. Era renaissance membuat manusia bukan hanya percaya pada Hukum Tuhan semata. Hal tersebutlah yang melandasi lahirnya paham positivisme. Positivisme hanya mendasarkan pada kenyataan dan hanya menggunakan metode secara ilmiah. Pola berfikir positivisme yang mengandalkan empirisme filosofis mulai dibawa masuk ke wilayah hukum pada abad ke-19, dimana positivisme mengedepankan adanya kepastian hukum dengan mengambil sumber hukum formal berupa peraturan perundang-undangan. Tidak selamanya positivisme hukum mengabaikan moral begitu saja, ia masih terbuka untuk perbaikan menjadi yang lebih baik namun tetap diperlukan prosedur yang berlaku. Namun apa yang dianggap kebaikan oleh positivisme hukum itulah keburukan dari positivisme hukum ini. Positivisme yang mempunyai aspek ontologis dalam positivisme yang dianggap sebagai norma positif dalam sistem perundang-undangan suatu negara sehingga terlepas dari masalah moral. Di sisi lain, implikasi dari positivisme terhadap hukum dan penegakkannya adalah dipakainya hukum sebagai alat untuk mempertahankan kekuasaan pemerintah untuk terus membuat kedudukan itu menjadi langgeng dan abadi

Abstract

The plurality of religions in Indonesia presents significant challenges to the multidimensional implementation of the existing inheritance law. A particularly complex issue arises when heirs hold differing religious beliefs, which may occur due to interfaith marriages among their parents or individual conversions by the heirs themselves. This divergence in faith introduces a dualism of norms, as it contrasts the exclusive normative provisions of Islamic law with the inclusive approach espoused by Indonesian positive law, which seeks to promote substantive justice. This current research aims to investigate juridical disparities within interfaith inheritance law through a normative and comparative juridical approach. The findings suggest that the absence of an integrated legal framework leads to legal uncertainty, creating interpretative gaps that adversely affect individual civil rights. Consequently, this research advocates for the reformulation of national inheritance law arrangements and policies, emphasizing a foundation of sustainable and equitable legal pluralism.

Abstract

Peraturan hukum di Indonesia tidak hanya mengatur warga negara pada umumnya, tetapi pejabat negara juga ikut masuk dalam peraturan hukum. Hal ini merupakan konsekuensi logis dari sebuah bentuk negara hukum yang di anut oleh para the founding fathers dan mothers Republik Indonesia. Pejabat Tata Usaha Negara atau sering kali disebut dengan Pejabat TUN, tidak bisa lepas dari tanggung jawab hukum bilamana pejabat TUN melaksankan kebijakan bertentangan dengan undang-undang. Undang-Undang No. 51 Tahun 2009 tentang Perubahan Kedua atas UndangUndang No. 5 Tahun 1986 Tentang Peradilan Tata Usaha Negara (UU Peradilan Tata Usaha Negara) mengatur terdapat dua jenis eksekusi putusan pengadilan tata usaha negara yang dalam doktrin biasa dikenal sebagai eksekusi otomatis dan eksekusi hierarkis. Dalam eksekusi hierarkis maka dibutuhkan kesadaran hukum dari pejabat pemerintahan untuk melaksanakan putusan peradilan tata usaha negara yang telah berkekuatan hukum tetap. Seringkali pejabat pemerintahan tidak bisa atau tidak mau melaksanakan putusan tersebut dengan berbagai alasan yang membuat seolah-olah peradilan tata usaha negara tidak memiliki wibawa untuk memaksa pemerintah melaksanakan putusannya.

Abstract

The internationalization of higher education encourages Indonesian universities to recruit foreign lecturers to enhance academic quality and global collaboration. However, foreign lecturers must comply with legal requirements regarding Indonesian language use as stipulated in Law No. 24 of 2009, Government Regulation No. 57 of 2014, Government Regulation No. 34 of 2021, and Ministerial Regulation of Education and Culture No. 70 of 2016. These regulations mandate foreign lecturers to obtain the Indonesian Language Proficiency Test (UKBI) certificate as official proof of language competence. This study investigates the regulation and implementation of Indonesian language proficiency standards for foreign lecturers, analyzing their legal implications within employment law. Using a normative juridical approach, the research analyzes legal materials through library research, assessing norm compliance and practical implementation. Findings indicate weak enforcement of language proficiency requirements due to unclear sanctions and regulatory inconsistencies. Hiring foreign lecturers without language proficiency certification results in defective employment contracts, potential administrative penalties, and industrial relations imbalances. Furthermore, inadequate language skills among foreign lecturers negatively impact educational quality and students' rights. The study recommends harmonizing language and employment regulations, reinforcing oversight of UKBI implementation, and mandating language proficiency certification for foreign lecturer recruitment. These actions are vital to ensure legal certainty, protect local workforce rights, and uphold Indonesian as a key national language for academic and legal purposes.

Abstract

This study examines the urgent need to reform the legal culture of advocates in Indonesia, specifically in relation to the use of e-court and e-litigation systems in civil law enforcement. These systems were designed to streamline legal processes, offering faster, cheaper, and more accessible trials for material parties. However, advocates have been slow to adopt these technologies, often sticking to traditional methods, which undermines their potential effectiveness. The novelty of this research lies in its exploration of how the legal culture of advocates can be reformed to better leverage e-court and e-litigation. Rather than focusing solely on the technical aspects of these systems, the study emphasizes the socio-legal implications of such reforms. Advocates, as both legal professionals and agents of social change, play a critical role in bridging the gap between new technologies and the material parties they represent. This research contributes to the development of civil procedural law and aims to improve the legal culture of both advocates and clients. Using a qualitative, socio-legal approach, the study gathers data through interviews, observations, document analysis, and personal experiences. The urgency of this reform is underscored by the need for advocates to fully embrace their role in Indonesia’s digital transformation of justice. The study also examines how regulatory tools like PERMA No. 1 of 2019 and No. 7 of 2022 can support these reforms, ultimately driving systemic change in Indonesia’s legal culture and enhancing the effectiveness of e-court and e-litigation.
