Abstract

Pengadilan Tata Usaha Negara menjadi salah satu instansi peradilan yang ada di Indonesia guna menyelesaikan sebuah sengketa atau tindakan dari pejabat tata usaha negara yang dirasa melangggar peraturan perundangan yang telah ditetapkan maupun asas-asas pemerintahan yang baik. Sebagai lembaga peradilan di Indonesia, Pengadilan Tata Usaha Negara perlu menyesuaikan dengan dinamika yang ada, salah satunya adalah penerapan Electronic Court atau E-Court yang dalam hal ini kemudian akan menggantikan adanya sistem peradilan yang konvensional. Dalam penelitian ini ditemukan adanya upaya peningkatan dan penggunaan sistem E-Court di Pengadilan Tata Usaha Semarang dengan metode penelitian non-doktrinal dengan pendekatan kualitatif bersama dengan peneliti terjun langsung ke Pengadilan Tata Usaha Semarang. Kesimpulan dari penelitian ini adalah upaya dari Pengadilan Tata Usaha Semarang dalam menerapkan dan meningkatkan adanya sistem E-Court sebagai kunci dari penyelesaian sengketa di Pengadilan Tata Usaha Semarang yang kemudian akan dijelaskan secara terperinci pada bagian pembahasan.

Abstract

This study provides an overview of the state administrative law dispute surrounding the granting of clemency to Antasari Azhar, a prominent figure involved in a high-profile legal case. The controversy stems from the exercise of executive power and the application of clemency within the framework of state administrative law. Antasari Azhar, a former Indonesian Corruption Eradication Commission (KPK) chairman, was convicted in a notable corruption case. Subsequently, his request for clemency sparked debates, legal challenges, and concerns about the integrity of the administrative process. This study delves into the legal dimensions of Antasari Azhar’s clemency case, examining the constitutional and administrative law aspects involved. Key issues include the discretionary powers of the executive in granting clemency, the potential influence of political considerations, and the adherence to legal procedures during the decision-making process. The research aims to shed light on the broader implications of this case for the rule of law, the separation of powers, and the accountability of public officials. Through a comprehensive analysis of relevant legal frameworks, court decisions, and scholarly perspectives, this study seeks to contribute to the understanding of the complex interplay between executive powers and the legal principles governing clemency in the context of state administrative law. Furthermore, it addresses the implications of such disputes for the overall legal and political landscape, emphasizing the importance of transparency, due process, and accountability in the exercise of executive clemency.

Abstract

Alat bukti dalam Undang Undang Peradilan Tata Usaha Negara (Peratun) bersifat enumeratif dan closed-system menghadapi tantangan ketika munculnya alat bukti elektronik yang diatur dalam Undang Undang Informasi dan Transaksi Elektronik (ITE). Demi menjamin kepastian hukum mengenai alat bukti elektronik, diperlukan harmonisasi ketentuan alat bukti elektronik ke dalam UU Peratun yang dalam belum di atur bahkan dalam pembaharuan ke-2. Tujuan penelitian ini mengharmonisasi ketentuan alat bukti elektronik dalam UU Peratun dan UU ITE. Penelitian ini menggunakan metode penelitian yuridis normatif yang meneliti bahan kepustakaan maupun bahan sekunder. Hasil penelitian menunjukkan diperlukannya konsep, prosedur verifikasi alat bukti elektronik, dan pembaharuan pada pasal tentang alat bukti dalam UU Peratun sehingga dapat memberikan keabsahan terhadap alat bukti elektronik yang digunakan dalam pemeriksaan di Pengadilan Tata Usaha Negara (PTUN), mengingat perkembangan teknologi menjadi salah satu tantangan dalam memastikan keaslian alat bukti elektronik. Hal terpenting yang harus diperhatikan yaitu proses verifikasi dan kebutuhan atas hukum yang mengakomodasi sahnya alat bukti elektronik dan proses verifikasi alat bukti dalam proses pemeriksaan acara PTUN. Kesimpulan penelitian ini perlu menambahkan ketentuan alat bukti elektronik pada Pasal 100 ayat (1) huruf f dan g serta menambahkan ketentuan verifikasi keaslian alat bukti elektronik pada Pasal 100 ayat (2).

Abstract

This study aims to identify the factors contributing to the low absorption of local workers in Indonesia, focusing on the skills gap, the impact of digital transformation, and the effectiveness of labor policies. The methodology employed is qualitative, utilizing interviews, questionnaires, and literature reviews. The results indicate that the skills gap between the local workforce and the requirements of modern industries is a significant issue, as many workers lack skills relevant to market demands. Furthermore, rapid digital transformation has caused disruptions across various sectors, yet the local workforce’s readiness to adapt remains low. Government initiatives, such as the Pre-Employment Card Program, have not been entirely effective in upskilling the local workforce, and competition with foreign workers exacerbates this problem. This study recommends enhancing the education and training system to better align with industry needs, increasing access to quality training programs, and developing policies that support local skills development. These findings are expected to contribute to the formulation of more effective and sustainable labor policies in Indonesia.

Abstract

The electronic court (E-Court) system implemented in this study utilizes online technology to facilitate the legal process. This system is based on the principles of fast, simple, and low-cost, and it is designed to address the challenges of traditional court procedures. The objective of this research is to evaluate the effectiveness of E-Court implementation in the Kendal and Semarang Religious Courts in accordance with the Supreme Court Regulation No. 1 of 2019, No. 3 of 2022 and No. 7 of 2022 as well as the Directorate General of Religious Courts Agency No 5374/DJA/HM.01/X/2019, in achieving the principles of fast, simple, and low-cost. This study employs a juridical-empirical approach, using data gathered through interviews, observations, and literature review. The findings indicate that the online justice system, implemented with the aim of expediting the legal process, has been well received by the community, and has proven to be highly efficient in the Kendal and Semarang Religious Courts. Overall, this research highlights the importance of E-Court implementation in delivering fast, simple, and low-cost for the community, while acknowledging the need for continued efforts to enhance the system's accessibility and inclusivity.

Abstract

Keberadaan sistem peradilan bertujuan untuk memastikan bahwa setiap pelanggaran atau kejahatan yang dilakukan oleh seseorang dapat dipertanggungjawabkan. Apabila hakim telah mengeluarkan putusan pengadilan dan telah berkekuatan hukum tetap, maka wajib bagi para pihak yang terkait dengan putusan tersebut untuk melaksanakan putusan tersebut. Rendahnya kesadaran pejabat TUN dalam menaati putusan pengadilan TUN, ditambah dengan adanya kepentingan pribadi terkait eksistensi keputusan TUN yang telah diterbitkan, serta lemahnya pemahaman hukum di kalangan Badan atau Pejabat TUN, memberikan pengaruh besar terhadap kepatuhan terhadap putusan Hakim Peratun. Sehingga diperlukan pembentukan sebuah lembaga eksekutor yang bertanggung jawab untuk memastikan setiap putusan pengadilan tata usaha negara dapat dilaksanakan secara paksa, sekaligus mengawasi implementasi putusan tersebut di Indonesia.

Abstract

This article examines the role of the Administrative Court (PTUN) in judicial control over abuse of power (abusus potestatis) by administrative officials and its contribution to restoring public trust. Guided by Montesquieu's separation of powers and A.V. Dicey's rule of law, PTUN acts as a mechanism to correct administrative excesses. However, abuse of power remains prevalent in Indonesia. The PTUN's execution mechanism, including dwangsom (coercive fines), is vital in enforcing rulings. Despite the legal framework under Undang-Undang Nomor 5 Tahun 1986 dan Undang-Undang Nomor 51 Tahun 2009 PTUN faces challenges in enforcement due to resistance from officials and inadequate measures. This article explores how PTUN can improve its role by strengthening its execution mechanisms and institutional support. Using normative legal research, the study analyzes relevant laws and jurisprudence to evaluate the effectiveness of PTUN’s execution process and propose reforms to enhance its ability to protect citizens' rights and restore public trust.

Abstract

The quality of labor resources in a country is an important part of development. A qualified workforce will encourage the acceleration of development in an effective, efficient, and competitive manner. In addition, a qualified workforce will also encourage massive economic growth. However, in improving the quality of the workforce, there are still many challenges, one of which is related to the distribution of skills and competencies of workforce certification. This study aims to analyze strategies and patterns of improving the quality of the workforce through community and community strengthening. This study is part of a community service program in the Gunungpati area, Semarang City, Indonesia. Such an approach is expected to support the validity of the devotion results as a helpful output. Observation will be carried out using field studies about the subject matter studied. This devotion uses socialization, games, and motivational training as an effective strategy to instill awareness in the target audience of the dangers and threats to tax blindness as well as the importance of public awareness of the importance of tax payments, not only for themselves but for the state, to ensure the fulfillment of the rights of the community, mainly traders and entrepreneurs as fellow citizens will be increasingly guaranteed and accountable.

Abstract

The principle of public information openness is a cornerstone of democratic governance, yet its implementation within Indonesia’s State Administrative Court remains underexplored. This research addresses the urgent need to assess how transparency and public access to information can enhance justice in administrative litigation. In a time when citizen trust in the legal system is fragile, and the accessibility of court decisions is increasingly crucial, the study explores whether the openness of public information can serve as a catalyst for greater accountability and fairness in the administrative justice system. The novelty of this research lies in its critical examination of the relationship between information transparency and judicial effectiveness in the context of administrative courts. By analyzing existing practices and identifying gaps in public access to court processes, the study presents an innovative approach to improving the delivery of justice. Through qualitative case studies and a comparative analysis of international practices, the research proposes actionable recommendations for reform. This study contributes to ongoing discussions on judicial transparency and its impact on public perception, aiming to create a more open, inclusive, and accountable State Administrative Court. The findings suggest that public information openness is not merely a procedural formality, but a fundamental aspect of building trust in the judiciary and empowering citizens in their pursuit of justice.

Abstract

The implementation of forced money (dwangsom) in Indonesia’s administrative courts is a legal tool aimed at ensuring compliance with court decisions, particularly in cases where government bodies fail to fulfill their obligations. This research explores the effectiveness of the dwangsom policy and its implications for improving compliance with administrative court rulings. Using a normative juridical approach, the study analyzes how dwangsom is applied in practice and its impact on the level of compliance by state institutions. The findings reveal that while the dwangsom policy has the potential to encourage compliance, its practical application remains inconsistent. In many instances, government agencies either evade or delay the payment of forced money, leading to minimal impact on ensuring timely enforcement of decisions. The research highlights the need for stricter enforcement mechanisms and greater accountability for public officials who fail to comply with court orders. This study introduces a novel perspective on the role of dwangsom in the broader context of administrative justice in Indonesia. It also addresses the urgency of enhancing its effectiveness to improve the credibility of the administrative courts. The contribution of this research lies in its critical evaluation of the dwangsom policy and its potential for reform. By offering recommendations for strengthening enforcement and compliance, this research aims to contribute to the ongoing discourse on improving the efficiency and accountability of Indonesia's administrative justice system. The findings are particularly relevant to policymakers, legal practitioners, and reform advocates working towards a more responsive legal system.
