Abstract

Consumption behaviour is part of human life's needs, which are also regulated in Islam. However, the phenomenon of the emergence of Islamic economics has not completely changed people's consumption behaviour to be more in line with Islamic teachings. This research aims to determine the consumption behaviour of millennial homemakers in Pacitan and its suitability in terms of Al-Ghazali's consumption theory. This study used a case study in Pacitan by interviewing 20 informants in depth from various literature related to consumption behaviour in Islam. The research results show that their consumption behaviour always prioritizes fulfilling primary needs in the form of food, shelter, clothing, education and health. When faced with a choice between needs and desires, desires will be fulfilled after primary needs are met. Apart from that, they also always use halal assets and goods and make plans to save for their children's education costs or if there is a sudden need. However, a group of millennial housewives are still wasteful and stingy and have not paid zakat and alms as a form of concern for the surrounding environment. This research is an initial study revealing the study of people's consumption behaviour based on Islamic economic thinkers. The study can be a reference for studying Islamic consumption behaviour for academics and improving people's consumption behaviour.

Abstract

Riset ini bertujuan untuk mengeksplorasi pertimbangan hakim kasasi dalam putusan kasus Sambo dan implikasinya terhadap penerapan norma pembunuhan berencana dalam KUHP 2023. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus sebagai kerangka penelitiannya. Data diperoleh melalui analisis putusan hakim kasasi dalam kasus Sambo dan wawancara dengan beberapa ahli hukum. Teknik analisis data yang digunakan adalah analisis isi untuk mengidentifikasi faktor-faktor yang memengaruhi pertimbangan hakim dalam kasus tersebut. Hasil penelitian ini diharapkan dapat memberikan kontribusi dalam membangun argumentasi hukum yang lebih koheren dengan KUHP 2023 yang mengusung pendekatan yang berbeda dalam menilai tindak pidana. Putusan hakim kasasi dalam kasus Sambo memiliki potensi sebagai judge made law yang dapat digunakan sebagai yurisprudensi untuk memproyeksikan keselarasan antara formulasi norma hukum tertentu dengan pertimbangan hakim. Penelitian ini diharapkan dapat membantu dalam pengembangan hukum pidana yang lebih sesuai dengan perkembangan zaman dan rasa keadilan masyarakat.

Abstract

This study aims to determine the implementation of maqashid sharia in providing employee wages in Islamic Education Institutions. This research method is qualitative using a case study approach with the object of research is the Islamic Education Institution Ar Rahmah Pacitan Foundation. The data collection techniques were carried out by observation, interview, and documentation. The data that has been collected, arranged systematically, and analysed.  Data analysis used includes data collection, data reduction, data presentation, and verification. The results of the study explain that the provision of employee wages at the Ar Rahmah Pacitan Foundation Islamic Education Institution is carried out with a process that is by the provisions of the ijarah contract, namely; there is an agreement between the institution and employees, both in terms of obligations and rights. In terms of wages given by the principles of justice (Clear, transparent, and proportional), and feasible in the sense of fulfilling the basic needs of clothing, food, and shelter, also in accordance with (market standards) other similar institutions in the same area.  Providing employee wages at the Ar Rahmah Pacitan Foundation Islamic Education Institution has realized maqashid sharia, namely dhoruriyat al-khomsah or al-kuliyat al-khomsah including Hifz al-Din, Hifz al-Nafs, Hifz al-'Aql, Hifz al-Nasl, and Hifz al-Maal.

Abstract

The purpose of this study is to investigate the conceptual and practical implications of Progressive Islamic Jurisprudence (Risalah Islam Berkemajuan) within the legal thought school of Muhammadiyah. To bridge the difference between Muhammadiyah's legal thought and practice, the study adopts an ontological perspective. The research utilises a detailed analysis of the ontological notion of Progressive Islamic Law, examining its relationship with natural law and positivist perspectives. The study discovered that this legal ontology incorporates religious values, justice, and social change. The key contribution of the investigation is to develop principles of Progressive Islamic Law that can direct the advancement of Muhammadiyah's legal curriculum and practice. Although the research establishes a sound theoretical foundation, practical constraints in implementing the ontology may arise. The implications for the legal thinking of Muhammadiyah are to establish a foundation that is responsive and adaptable to essential legal ontological concepts. Such concepts must be reinforced by means of dissemination in law education at Muhammadiyah Higher Education Institutions (PTMA) in order to tackle contemporary challenges with relevant legal principles

Abstract

This research aims to analyze the judge's decision in considering child custody rights given to the father by referring to the Maqasid Syariah perspective. This research will explore the elements that are taken into consideration by judges, including economic, religious and child welfare aspects. By using a qualitative approach and content analysis, the data collected in this research will be analyzed comprehensively based on the judge's decision when considering child custody from the Maqashid Syariah perspective. The findings of this research conclude that the judge's decision regarding child custody is closely related to the psychological behavior of parents towards children in creating child welfare. This is because parents' psychology will influence the child's future development. The study also recommends effective steps to resolve child custody disputes between parents.

Abstract

This research aims to analyze judicial decisions regarding the prevalence of divorce in Indonesia from the perspective of Maqashid Syariah. The study holistically examines the high divorce rate of 23% per year in Indonesia within the framework of Islamic values inherent in Maqashid Syariah. It explores the factors that judges consider when making divorce decisions, including economic, family, and social aspects. Furthermore, the research discusses intervention strategies that can be implemented to enhance family resilience and prevent divorce. Employing a qualitative approach and content analysis, the study thoroughly analyzes the data to achieve a comprehensive understanding of judicial decisions concerning the prevalence of divorce in Indonesia from the perspective of Maqashid Syariah. The findings indicate that judges primarily base their divorce decisions on a legal-formal perspective, thereby contributing to the prevalence of divorce driven by economic reasons. The research also provides recommendations for effective intervention strategies to bolster family resilience.

Abstract

This research aimed to analysis: 1) how to importance renewal of criminal law in Indonesia, especially maqashid sharia perspective, 2) the formulation of banking criminal act based on Pasal 334 UU No. 1 Tahun 2023, 3) the characteristic of banking criminal act based on Pasal 334 UU No. 1 Tahun 2023, and 4) the elements of maqashid sharia perspective. At the end of this research say that there are 4 important things. First, the appearance of UU No. 1 Tahun 2023 are renewal of law applied in Indonesia based on era development and citizens dynamics. Second, the formulation of banking criminal act based on Pasal 334 UU No. 1 Tahun 2023 based on jalb al-maslahahwa wa daf’ al-mafsadah (menarik kemaslahatan serta menghindari kemudharatan) with the principal of rahmatan lil ‘aalamiin (rahmat untuk sekalian alam). Third, the characteristic of banking criminal act based on Pasal 334 UU No. 1 Tahun 2023 has consolidation democrate. Fourth, the formulation of banking criminal act based on Pasal 334 UU No. 1 Tahun 2023 were qualified from all of the aspect maqashid sharia. Because judge ruling have to be true and the judge has to take responsibility what they took, even just case or punishment.

Taxonomic analysis is the methodological approach to discern pivotal dimensions imperative for comprehensive IoT regulations. The outcomes underscore the imperative for regulatory inclusivity across boundaries to address the intricate nexus of technology, security, and device heterogeneity. The investigation underscores the importance of accessibility, anonymity, and interactivity in safeguarding user access and data within IoT networks. Furthermore, it accentuates the urgency for swift responses to security vulnerabilities. This research posits that Indonesia’s IoT regulations must adeptly navigate the intricacies and dynamism inherent in the IoT landscape while addressing the evolving security challenges within this technological milieu.

Abstract

Purpose: This article aims to analyse the bankruptcy of PT Asuransi Syariah Mubarakah by describing the profound legal implications for the regulation and protection of policyholders. It outlines the basic concepts of insolvency, the role of the courts, the conditions of insolvency and the legal consequences of bankruptcy status. The article combines bankruptcy law, the assessment of facts in court and the legal consequences of bankruptcy status in a comprehensive analytical framework. Methodology: The method of discussion of this research includes legal review, doctrinal legal analysis, review of judges' considerations (ratio decidendi) related to bankruptcy regulations. The results of the analysis of the judge's considerations study will be used as a basis for understanding the impact of the bankruptcy of Sharia insurance companies on the protection of consumers (policyholders), so that the conclusion of the research can provide a comprehensive and in-depth picture of the legal consequences and implications and projections of the bankruptcy of Sharia insurance companies on the losses of policyholders.. Applications/Originality/Value: The Shari'ah Insurance Bankruptcy Study concluded that financial management, solvency and consumer protection are three legal values that must be maintained not only for the survival of an insurance company, but also because of its systemic impact on policyholders. The application of Shari'ah principles in the management of insurance companies indicates improved consumer protection regulations and the company's responsibility towards its policyholders. The legal protection of policyholders is closely linked to three key concepts: compliance, policyholder confidence and consumer redress.

Abstract

This paper discusses the comparative legal reasoning of Asy Syatibi and Gustav Radbruch in their philosophical basis framework. By using a comparative analysis of reasoning models, both examine the influence between philosophical modalities and legal reasoning models developed by both legal theorists. The results of the research show that the ontological stance of Asy Syatibi is identical to transcendental-based foundationalism, while Gustav Radbruch positions himself on transcendental idealism. Meanwhile, the identification of epistemological modalities Asy Syatibi is more inclined to internal coherence, while Gustav Radbruch is influenced by the flow of methodical dualism and empirical realism. As for his axiological modality, Asy Syatibi is much influenced by maqashid ethics as a legal goal, while Gustav Radbruch is influenced by deontic ethics.
