Abstract

This study aims to understand the application of Islamic business ethics in employee layoffs during the Covid-19 pandemic. This research method uses qualitative research methods. The data source is from the agenda of direct and indirect interviews with speakers selected by 10 participants: five entrepreneurs and five victims of layoffs. The finding shows that some business actors in Sukoharjo still need to understand the importance of instilling Islamic business ethics. This situation is proved by the discovery of ethical violations in doing business carried out by entrepreneurs, namely attaching importance to their business in the form of suddenly dismissing their employees, not giving severance pay to employees, being late in providing salaries, not being able to develop the business properly, and not instilling honesty. The violations committed by layoff victims are providing poor service, lack of expertise, and being undisciplined. This research should help future studies apply Islamic business ethics to layoffs. Islamic business principles protect entrepreneurs and layoff victims, allowing them to continue business during the pandemic and grow.

Abstract

يتناول هذا البحث رؤية الفقهاء لنظام المضاربة في الفقه الإسلامي، وتحليل عقد المضاربة في المحل التجاري (DISMART) عند كلية الإمام الشافعي للدراسات الإسلامية بجمبير (STDIIS JEMBER) هل يوافق الفقه الإسلامي. يعتبر هذا الموضوع مهمًا جدًا نظرًا لأن عقد المضاربة هو واحد من العقود التي يمكن أن تساعد الناس على إجراء المعاملات الاقتصادية في الحياة الاجتماعية. يهدف هذا البحث إلى معرفة حقيقة المضاربة وتحليل كيفية تطبيق عقد المضاربة بين الكلية الإمام الشافعي وبين DISMART. هذا البحث هو بحث ميداني نوعي يستخدم المنهج الوصفي التحليلي مع المقاربة المعيارية التي تعتبر وصفًا تحليليًا. تم جمع البيانات من الموضوع الرئيسي وهو الطرف الذي يتعاهد مباشرة عقد المضاربة، والأطراف الذين يعرفون العقد كعامل مفتعل، ومن مصادر الكتب سواء كانت على الإنترنت أو مطبوعة، والمقالات العلمية المحملة من الدوريات، والفتاوى من المجلس الشرعي الوطني لمجمع العلماء في إندونيسيا (DSN-MUI)، ولوائح سلطة الخدمات المالية (OJK)، وغيرها من مصادر البيانات. تقنية تحليل البيانات المستخدمة تشمل تلخيص البيانات، وتقديم البيانات، واستخلاص الاستنتاجات. من أهم نتائج البحث التي توصّل إليها الباحث أن عقد المضاربة بين طرفين، الطرف الأول كلية الإمام الشافعي للدراسات الإسلامية ما يتمثل مديرها عارفين بدري (رب المال) والطرف الثاني هو ترميذي مدير رأس المال (المضارب) يوافق الفقه الإسلامي حيث تتوفر الأركان والشروط في هذا العقد.

Abstract

This study introduces a new paradigm for interdisciplinary empirical legal research by presenting a groundbreaking perspective on the integration and interconnectedness of law and economics. Our research argues for the necessity of this shift. The conventional pragmatic paradigm, which risks fragmenting concepts and methods by reducing meaning to mere data and facts, is eschewed in favor of an integrationinterconnection theory. This paper investigates the theoretical foundations of the proposed paradigm through library research and philosophical inquiry. Our research uncovers two distinct approaches within the new empirical legal studies paradigm. Firstly, the historical approach requires a restructuring of the theory, leading to multidimensional and holistic models. Secondly, the philosophyasasystem approach necessitates method restructuring by utilizing cognitive, holistic, open, and purposeful models. The integration aspect of the paradigm necessitates a comprehensive theoretical restructuring, while the interconnection aspect requires a broadened viewpoint. The historical approach is demonstrated by historical reformation, which encompasses multidimensional and holistic models. In contrast, the philosophyasasystem approach entails methodical reforms through the incorporation of models that focus on cognition, wholeness, openness, and purposefulness. The historical and methodical restructuring prototypes can be seen in the Integrative Legal Theory Model and the Critical Legal Functionalism Model. Our study highlights the significance of incorporating economic behavior into the interdisciplinary framework of empirical legal studies. This will enable a more comprehensive understanding of the complex connections between law and economic dynamics.

Abstract

This research aims to evaluate the improvement in the Human Development Index (HDI), which encompasses health, education, and income, between 2021 and 2023. Furthermore, this research analyses the relationship between the human development index and the environmental performance index from the perspective of Maqāṣid al-Shari’ah. Employing a mixed-methods approach, this study integrates qualitative and quantitative methodologies. The quantitative method uses linear regression for data analysis and interpretation with descriptive pattern qualitative analysis. The findings reveal a negative correlation between Indonesia's HDI and its EPI. Individuals with higher levels of education, better health, and increased income tend to exhibit greater awareness of environmental sustainability. This finding supports Maqāṣid al-Shari’ah, which emphasizes the importance of protecting life, education, property and offspring. Improving human welfare and protecting the environment are key to achieving sustainable development. Government policies should simultaneously promote human development and environmental protection. This fostered sustainable prosperity in line with the principles of Maqāṣid al-Shari’ah.

Abstract

This study examines the correlation between Non-Performing Financing (NPF) and Capital Adequacy Ratio (CAR) in Indonesian Islamic finance from 2021 to 2023. The study employed Pearson and Spearman correlation tests to examine the correlation between NPF and CAR in Indonesian Islamic finance from 2021 to 2023. The significance was determined by Sig. (2-tailed) values (p < 0.05), accepting H0 and rejecting H1. The Pearson (r) and Spearman (ρ) coefficients indicated a strong negative correlation. The robust methodology reinforces the findings on the intricate dynamics between NPF and CAR in the specified financial data. The findings, obtained through Pearson and Spearman correlation tests, reveal a significant negative correlation (p < 0.05), indicating an inversely proportional relationship. The strong negative correlation suggests that as NPF increases, CAR decreases, and vice versa. The study provides valuable insights into the dynamic interplay between NPF and CAR in Islamic financial data.

Abstract

This study examines the impact of regulation, fintech adoption, and social media on the sustainability of halal tourism in Surakarta. The results of the statistical analysis indicate a strong correlation between social media adoption and sustainability, while regulatory support and fintech adoption do not have a significant impact. This study provides original insights by conducting exponential, taxonomic, and componential analyses, which reveal diverse stakeholder interpretations. The article recommends implementing inclusive social media strategies and regulatory support to enhance branding effectiveness. Despite its limitations, this research contributes to policy formulation, fosters collaboration, and enhances the sustainability of halal tourism through a nuanced understanding of regulatory, fintech, and social media influences.

Abstract

Islamic philanthropy has a significant role in helping to address socioeconomic problems in society and overcoming poverty. With humanitarian and disaster issues, the Action of Quick Response is one of the most trusted Islamic Philanthropic Institutions for the community to manage the funds of the people to be channeled to those who are entitled to receive it. But in recent years, there have been several cases of humanitarian funding deviations reported in the mass media. One of the most controversial cases is the alleged, deviation of humanitarian funds for personal benefit by the Quick Action Response agency’s leadership. Quick Action Response is alleged to have used humanitarian funds provided for the benefit of personal entities, and illicit activities (terrorism) and is not in accordance with its designation. Legal analysis is conducted with a qualitative descriptive, approach method used namely normative juridical approaches, and data collection in this study with library research. The Research results show that the management of humanitarian funds gathered by the Quick Action Response is contrary to Law Number 23 of 2011 on zakat, as Quick Action Response raises humanitarian funds by name of Zakat, Infaq, and Shodaqoh but is not managed under the provisions of the Zakat Act.

Abstract

This research explores modeling in environmental administrative law research, specifically the idealization of legal situations or phenomena, environmental law policy analysis, and specific contexts of environmental administrative law. This research is conducted through a library research approach that utilizes data from Scopus-indexed journal articles from 2022-2024. The analysis focuses on identifying trends, changes, and patterns in various fields of environmental administration law. The modeling research findings offer detailed insights into the dynamics of legal evolution, contributing to formulating policies that respond to complex environmental changes. The research concludes that the evolution of legal ideals and their contexts significantly influence preventive, repressive, curative, and rehabilitative legal research modeling.

Abstract

This service aims to increase employment opportunities for diasporas who take further education abroad, such as in Malaysia, Hong Kong, and Sweden, with manufacturing abroad, such as in Malaysia, Hong Kong, and Sweden, by creating and submitting articles to reputable journals. Submission of articles in reputable journals. The opportunities obtained by students simultaneously bring two challenges, namely the arrival and return stages. In the preparation stage, it is usually related to culture shock because they come to a new place with different weather, different cultures, and different value systems. Also a different value system. Furthermore, when implementing lectures, students are expected to be able to attend lectures and work on assignments to create scientific articles. Assignments to create scientific articles. Moreover, they will experience reverse culture shock at the return stage, such as limited job opportunities in their homeland. Community Service is carried out from September to November when this month is the new school year. In addition, this month, the preparation of students who take master's degrees ends, and they are preparing to return to their homeland. Furthermore, they prepare to return to their homeland. This community service is an effort to help students in the settlement stage deal with culture shock and prepare them for their return home. Shock and prepare students for repatriation. The method used two ways, the first is the delivery of hybrid material, namely through offline and online exposure. The hope is that acquiring journal-writing skills will make it easier for them to follow.
