Abstract

This paper analyzes Supreme Court Decision No. 179 K/Ag/2017 on murabahah financing disputes. It focuses on force majeure, the principle of pacta sunt servanda, and good faith in assessing debtor business losses. This analysis helps explain the Supreme Court's decision within the framework of Islamic economic law. The method used is philosophical jurisprudence, with a descriptive-analytical approach to the decision. This approach clarifies how judges consider force majeure, pacta sunt servanda, and the good-faith standard. The study found that the force majeure argument was rejected because there was no direct causal link between the BPJS policy and the business losses. As a result, pacta sunt servanda still applies. The debtor's good faith was not enough to exempt them from murabahah payment obligations. Theoretically, the decision affirms that the limits of force majeure in murabahah contracts reinforce the principles of pacta sunt servanda and good faith. The practical implication is that the decision guides Islamic banking practitioners and customers. Proof of force majeure must include direct causality between regulatory uncertainty and business risk. Without this proof, the judge will apply the principles of pacta sunt servanda and good faith. This study contributes to the development of Islamic contract law by emphasizing the consistency of judicial interpretations of extraordinary circumstances. It highlights the importance of the burden of proof in establishing the existence of force majeure in Islamic nancing disputes. By strengthening legal certainty, this decision promotes responsible risk management and contractual compliance in murabahah transactions. Ultimately, the ruling supports a balance between justice and legal certainty in resolving disputes under Islamic economic law.

Abstract

This study aims to reconstruct contemporary legal methodology by proposing the Noetic Triadic Spiral Model as a trans-epistemological framework that integrates revelation (waḥy), reason (ʿaql), and empirical reality (wāqiʿ) in a dynamic and iterative structure. The research responds to the growing epistemic fragmentation between normative-textual approaches and socio-empirical legal reasoning in contemporary Islamic legal thought. It seeks to formulate a methodological model that bridges classical uṣūl al-fiqh with contemporary interdisciplinary demands without undermining its theological foundations. This research employs a qualitative normative-philosophical approach combined with conceptual analysis and critical hermeneutics. Primary sources include classical works of uṣūl al-fiqh and modern reformist legal theories, which are analyzed through a comparative-constructive method. The study also incorporates epistemological mapping to identify structural tensions between scriptural authority, rational deliberation, and socio-historical contingencies. Through this approach, the Noetic Triadic Spiral Model is formulated as a spiral (rather than linear) interaction among three epistemic domains, emphasizing continuous reinterpretation, reflexivity, and contextual validation. The findings demonstrate that the proposed model offers a coherent methodological reconstruction that transcends the dichotomy between textualism and contextualism. By conceptualizing legal reasoning as a spiral process of noetic engagement—where revelation provides normative orientation, reason ensures coherence and systematicity, and empirical reality functions as a field of verification—the model strengthens methodological adaptability while preserving doctrinal integrity. The spiral nature ensures that interpretation remains open to revision without collapsing into relativism. The scientific contribution of this study lies in its formulation of a trans-epistemological paradigm that rearticulates legal methodology beyond classical dualisms. It provides a theoretical bridge between traditional jurisprudential structures and contemporary legal challenges, contributing to ongoing debates on reform, renewal (tajdīd), and methodological integration in legal theory. The Noetic Triadic Spiral Model thus offers an innovative framework for rethinking legal reasoning in a plural, complex, and rapidly evolving global context.

Abstract

Monetary transmission has become increasingly constrained by transmission frictions and the non-linear relationship between the BI Rate and credit growth, reducing the effectiveness of monetary policy in the banking sector. Bank Indonesia’s 2025 Financial Stability Review indicates that the relationship between the BI Rate and credit growth is non-linear, challenging the assumptions of traditional monetary theory. Despite a relatively stable and accommodative policy rate, credit growth slowed considerably, declining from 12.36% (year-on-year) in June 2024 to 7.77% (year-on-year) in June 2025, indicating weaker banking intermediation. Although banking liquidity remained adequate, as reflected in 6.96% growth in Third-Party Funds (DPK), this did not translate into stronger credit expansion. Credit growth is projected to remain within the 8–11% range in 2025, suggesting that credit demand remains relatively unresponsive to monetary easing. These findings suggest the presence of transmission frictions, including banks’ risk-averse lending behaviour, weak credit demand, and structural constraints within the banking sector. This study aimed to analyse the effectiveness of monetary transmission using an explanatory sequential mixed-methods design that integrates quantitative and qualitative data analysis. The study examines whether reductions in the BI Rate stimulate credit growth or whether banking frictions constrain the effectiveness of monetary transmission. highlighting that the effectiveness of such policies depends on the behaviour of the banking sector, which serves as the main transmission channel. This study contributes to the literature by demonstrating that the effectiveness of monetary policy depends not only on policy rate adjustments but also on the banking sector’s role as the primary transmission channel.

Abstract

Murabaha to the purchase orderer is one financing models adopted by Islamic banks as a Sharia-compliant alternative to interest-based transactions. With the expansion of Islamic banking in Indonesia, the need to regulate this contract in accordance with Islamic principles has increased. The National Sharia Council of the Indonesian Ulema Council (DSN-MUI) plays a key role in issuing fatwas to ensure its compliance with Sharia. This research employs a descriptive-analytical approach by reviewing jurisprudential sources and DSN-MUI fatwas to clarify the concept of Murabaha to the purchase orderer, assess its Sharia compliance, and analyze the impact of DSN-MUI fatwas on its implementation in Islamic banks.The study identifies a research gap regarding the extent to which Indonesian banks adhere to the Murabaha contract in accordance with Sharia-based fatwas and the impact of these fatwas on the stability of Islamic finance. It also highlights the need for a comparative analysis between DSN-MUI fatwas and jurisprudential rulings in other countries, in addition to assessing the awareness of bank employees and customers regarding the contract’s terms. The findings indicate that Murabaha is permissible under Sharia if  of the most essential Islamicspecific conditions are met, such as the bank taking ownership of the goods before selling them to the customer. DSN-MUI fatwas provide a clear legal framework that promotes transparency and prevents uncertainty and usury. The study recommends enhancing awareness among banking staff and customers regarding Sharia conditions, improving regulatory oversight to ensure compliance, and encouraging further research to develop Islamic financing models that meet growing market demands.

Abstract

Intellectual Property (IP) protection in Indonesia remains primarily oriented toward individual and capitalist interests, thereby failing to reflect the values of distributive justice fully. This research aims to analyze Geographical Indications (GIs) as an instrument of economic justice from the perspective of Maqāṣid al-Sharī‘ah. The study employs a normative legal research method, utilizing both conceptual and legislative approaches. Data were gathered through a literature review of primary, secondary, and tertiary legal sources, which were then analyzed qualitatively to examine the relationship between the principles of positive law and the values of Maqāṣid al-Sharī‘ah. The findings indicate that the principles of Maqāṣid al-Sharī‘ah, such as hifz al-mal (protection of property), hifz al-nafs (protection of life), and hifz al-'aql (protection of intellect), provide a strong philosophical foundation for the reconstruction of a just and inclusive IP system. GIs' protection not only provides legal recognition of product origins but also serves as an instrument for the economic empowerment of local communities and the equitable distribution of financial benefits. Incorporating Sharia values into IP policies can broaden the moral, social, and ecological dimensions of a sustainable creative economy. This research recommends reformulating national IP policies by incorporating the principles of Maqāṣid al-Sharī‘ah, strengthening the role of producer communities in GIs governance, and fostering quadruple-helix collaboration among government, academia, industry, and communities. In this way, GIs can serve as an instrument of economic justice and contribute to achieving sustainable development goals.

Abstract

This research highlights the limitations of the pragmatic paradigm in empirical legal research and offers a conceptual alternative using Jasser Auda's Maqasid Shariah theory. The limitations of the pragmatic paradigm include theoretical constraints, pragmatism, limited method accuracy with data, social reductionism, and weak contextualization of research findings. To address these issues, a hermeneutical approach can be employed, utilizing a more holistic theoretical framework and expanding the scope of pragmatic applications. The historical restructuring and methodological restructuring of the empirical legal research model are carried out through Jasser Auda's Maqasid Shariah theory, providing a broader understanding of legal behavior within social contexts.

Abstract

The discussion in this study is how the implementation of the determination of the cost of maintaining pawn goods in the review of sharia economic law. The purpose of this research is to find out the determination of the cost of maintaining pawned goods at PT Pegadaian and the analysis of sharia economic law in determining the cost of maintaining pawned goods. The research method used in this research is descriptive qualitative research with data collection conducted through observation and in-depth interviews with the leadership and staff of the Samarinda branch pawnshop. The results showed that the cost of maintaining pawned goods in practice, the costs are charged to the customer and the amount of costs incurred is based on the size of the loan and is termed capital rent but the Pawnshop will compensate according to the collateral if the customer is harmed or the collateral is damaged then it will maintain and take care as well as possible of the valuables that are collateral from the community, pawnshops are still the main choice of the community to pawn their valuables, so that the presence of pawnshops can reduce the development of pawn practices that harm the community. The Islamic economic law review of the implementation of determining the cost of maintaining pawn goods is still not based on sharia principles and is not in accordance with the Fatwa of the National Sharia Council (DSN), this is because the amount of the cost of maintaining pawn goods cannot be determined based on the amount of the loan.

Abstract

إن حياتنا في هذه الدنيا لا تخلو عن الأحكام الشرعية المبحوث في علم الفقه و تطبيقها في المعاملة بين الناس بالأخلاق الإسلامية ولكن المشكلة الظاهرة بين أيدينا أن كثير من الناس يرركز في الفقه و الأحكام فحسب دون رؤية إلى الأخلاق و هناك التقسيم التقليدي للإسلام فمنهم من يفرق بين عقيدة و شريعة و أخلاق وهذا الإشكال يوهم الفصل بين الأخلاق و الشريعة من جهة، كما أنه يجعل الأخلاق قسيماً للشريعة و العقيدة من جهة أخرى مع أن بين الفقه و الأخلاق علاقة مترابطة و مهمة. ولهذا أراد الباحث كتابة هذا البحث لمعرفة العلاقة بين الفقه و الأخلاق و أثرها في الأعمال التجارية. و الباحث في هذا البحث يستخدم المنهج الكيفي و هو المنهج على طريقة جمع الحقائق العلمية و كذلك بالمراجعة إلى الوثائق العلمية و البحوث السابقة النوعية كي تؤكد المقصد المخصصة بدلاً من التعميمات. و من نتائج هذا البحث أن كل الفروع الفقهية مبنية على مبادئ علم الأخلاق؛ و يكون كل حكم شرعي معلقا بالقيمة الأخلاقية، فالمقصود الشرعي إذن مقصود أخلاقي. و من بين الفقه و الأخلاق لها أثر في الأعمال التجارية من التطبيق الآلي هناك ثلاثة أقسام خاصة في الأمور العقودية. وهي إما لفسخ العقد أو تعديله أو إقراره مع الإثم و كل ذلك نظراً للأخلاق.

Abstract

To determine how musyarakah contracts affect the profitability (ROA and ROE) of KSPPS BMT Green Earth financial institutions, this study employs a quantitative method that correlates with secondary data extracted from their financial statements for the years 2020-2022. The analysis includes descriptive statistical tests, linear regression, correlation, and hypothesis testing. The results indicate that the musyarakah contract has a strong correlation with and can boost profitability. To demonstrate the importance of musyarakah contracts to a company's profitability, they have a significant impact on ROE, but not on ROA. This study is limited by its reliance on homogeneous sample data and its exclusive focus on the relationship between two profitability measures. In order to obtain a deeper understanding, future research should examine a more diverse sample and include additional variables.

Abstract

دراسة فقه المقاصدي تنال اهتماما بالغا من العلماء المعاصرين، وذلك نظرا لأهميته في التعامل مع مستجدات الوقائع لاسيما في تناول قضايا نوازل الاقتصاد الإسلامي التي تتسع مجالاتها وتتفرع أغصان فروعها وتتعدد مشكلاتها وتكثر الأسئلة عن حكمها. ومن العلماء البارزين الذين لهم اهتمام بالغ وأبحاث موفقة هو العالم الشيخ عبد الله بن الشيخ المحفوظ بن بيه حفظه الله تعالي، فإن مؤلفاته شاهدة علي أنه خبير في البحث والتدقيق لعلم المقاصد. ومؤلفاته في تناول مستجدات الاقتصاد الإسلامي وربطها بالنظر في المقاصد كثيرة وموفورة. وعلي ذلك لفت نظر الباحث للبحث والتحقيق في نظرياته المقاصدي في التعامل مع مستجدات الاقتصاد الإسلامي وتطبيقها في بيع دفع الثمن عند تسليم السلعة (COD)، لأنه من مستجدات الاقتصاد الإسلامي التي تكثر السؤال عن حكمه. وسوف يتناول الباحث في هذا البحث عما يلي: ما هي أهمية علم المقاصد في البحث والنظر لأمور المستجدات والنوازل في المعاملات المعاصرة؟، كيف يكون تطبيق علم المقاصد عند تناول المستجدات والنوازل في الاقتصاد الإسلامي عند الشيخ عبدالله بن الشيخ المحفوظ بن بيه؟. وهذا البحث بحث مكتبي، ينتهج فيه الباحث منهج الاستقرائي التحليلي الوصفي. ومن أهم نتائج البحث التي توصل إليه الباحث : يظهر لنا أهمية علم المقاصد في البحث والنظر لأمور المستجدات والنوازل في الاقتصاد الإسلامي عند الشيخ عبد الله بن الشيخ المحفوظ بن بيه، ويظهر لنا حكم بيع دفع الثمن عند تسليم السلعة من خلال نظرية المقاصدي للشيخ عبد الله بن بيه.
