Abstract

Kontroversi pernyataan Ahok yang menyinggung surat Al-Maidah ayat 51 di Kepulauan Seribu, menimbulkan reaksi luar biasa dari sebagian umat Islam di Indonesia dengan melakukan beberapa kali aksi demontrasi besar-besaran menuntut Ahok untuk dipenjarakan karena telah menistakan ayat Al-Qur’an dan Menghina ulama. Majelis Ulama Indonesia sebagai pemegang otoritas tertinggi dalam menentukan fatwa atau pendapat yang diajukan oleh orang Islam mengeluarkan fatwa bahwa Ahok telah menistakan agama Islam dan harus diproses secara hukum. Ketika perintah larangan memilih pemimpin non muslim sebagai pemimpin muslim dalam surat Al-Maidah ayat 51, bisa dikatakan bahwa terdapat “ketidak adilan” Allah dalam menentukan boleh tidaknya muslim dipimpin oleh non muslim. Jika hal ini diterapkan di negara yang konstitusi utamanya merujuk pada Al-Qur’an dan Hadits, maka hal ini tidak menjadi persoalan. Dalam konteks Indonesia, pluraitas agama tidak bisa dipungkiri, semua agama bisa hidup berdampingan di bawah pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dari penjelasan nahi, ‘aam, khas dan musytarak yang terdapat pada surat Al-Maidah ayat 51 lebih menunjukkan pelarangan kepada orang-orang mukmin untuk tidak menjadikan orang-orang Yahudi dan Nasrani sebagai teman setia atau membuat persekutuan dengan mereka. Karena ayat ini diturunkan kepada Nabi Muhammad ketika para orang Yahudi membangkang kepadanya. Ketika Nabi mengajak mereka yang membangkang untuk bertaubat dan memeluk Islam, justru mereka menantang untuk berperang. Maka penjelasan tentang surat Al-Maidah ayat 51 yang selama ini dipahami oleh sebagian umat Islam tentang larangan menjadikan Yahudi dan Nasrani sebagai pemimpin kurang tepat. Pada dasarnya ayat ini sebagai himbauan untuk tidak menjadikan Yahudi dan Nasrani yang mengolok-olok agama Islam dijadikan sebagai sekutu. Kata Kunci: Metode Bayani, Penafsiran, Kemimpinan

Abstract

According to Islamic law, interfaith marriages are not permitted because they involve differences in faith. Based on the MUI fatwa Number: 4/MUNAS VII/MU/8/2005 which was issued as a result of the Second National Deliberation on 26 May to 1 June 1980 which determined that marriage between different religions is haram, the reasons are: a. Al-Qur'an Surah Al-Baqarah verse 221 explains that it is forbidden for Muslim men to marry non-Muslim women until they become believers. Apart from that, it also explains that it is forbidden for guardians to marry women under their responsibility to non-Muslim men. b. Al-Quran Surah Al-Mumtahanah verse 10 explains that believing men should not maintain their marriages with non-Muslim women, as well as non-Muslim women should be returned to Muslim men, because their marriages are forbidden by Allah. c. Al-Qur'an Surah Al-Tahrim verse 6 commands believers to guard and protect themselves and their families from the fire of hell. d. The words of the Prophet Muhammad SAW narrated by Imam Al-Tabarani taught that marriage is half of the teachings of religion. And we are instructed to be careful of the rest. e. The words of the Prophet Muhammad SAW narrated by Ibn. Al-Sura'i who taught about the importance of teaching religious education for parents to their children. Law Number 39 of 1999 concerning Human Rights in Indonesia, there is an explanation about freedom of religion, there is also freedom to marry and continue offspring, as stated in Article 10 paragraph (1 ) which states that every person has the right to form a family and continue their offspring through legal marriage. Thus, the right to carry out a marriage is limited by the Marriage Law. Meanwhile, in Article 2 of the Marriage Law, a valid marriage is a marriage carried out based on their respective religions and beliefs. This article is often seen as a prohibition against interfaith marriages, because marriages must be carried out according to their respective religions and beliefs, whereas it is impossible for one marriage to be carried out with two religious ceremonies. Therefore, in carrying out an interfaith marriage, one party should follow the religion of the other party. Religious freedom in Indonesia cannot be fully implemented, because there has been coercion by the institution of marriage on someone to embrace a certain religion in order to carry out a marriage. Abstract

This research aims to analyze the resolution of inheritance disputes from the perspective of Islamic law and civil law in Indonesia. Islamic inheritance law, which is based on the Al-Quran and Sunnah, provides clear guidelines for the distribution of inherited assets with the principles of justice and legal certainty. Meanwhile, civil law regulated in the Civil Code (KUHPerdata) offers flexibility and freedom in managing inheritance through wills and agreements between heirs. The research method used is descriptive-analytical with a qualitative approach, examining statutory regulations, court decisions and related literature. The research results show that although there are fundamental differences in the approaches of these two legal systems, they both have the same goals, namely achieving fair distribution of inheritance and effective dispute resolution. Religious courts and district courts as institutions with authority to resolve inheritance disputes, each have different but complementary mechanisms and procedures. This research suggests the importance of harmonization between Islamic law and civil law in resolving inheritance disputes in Indonesia, as well as strengthening mediation and arbitration mechanisms to reduce conflicts and reach fair agreements for all parties involved.

Abstract

This research discusses the employment of underage workers from the perspectives of Islamic Law and Law No. 13 of 2003 on Employment. In Islam, the protection of children and underage workers is strictly regulated, emphasizing the importance of justice and safeguarding their basic rights. Law No. 13 of 2003 also sets forth various provisions aimed at protecting underage workers, though its implementation in the field often faces numerous challenges and deviations. This study aims to analyze how Islamic Law and Law No. 13 of 2003 regulate the employment of underage workers and assess the application of these regulations in practice. The research questions posed in this study are: 1) How does Islamic Law regulate the employment of underage workers? 2) How does Law No. 13 of 2003 on Employment provide protection for underage workers, and how is it implemented in practice? The research method used is a normative juridical approach with an analysis of legal texts and their implementation in the field. The findings show that although there are clear provisions in Islamic Law and national legislation, the implementation in the field still requires improvement to achieve optimal protection for underage workers.

Abstract

This research aims to analyze the effectiveness of mediation as an alternative resolution for domestic violence cases. The primary objective of this research is to evaluate how mediation can provide a supportive and constructive environment for resolving conflicts between victims and perpetrators, while also promoting healing and restoration of relationships. The research employs qualitative methods, utilizing interviews and case studies as data collection techniques to gather insights from mediators, victims, and relevant stakeholders. The findings indicate that mediation can significantly reduce tension and foster communication between parties, leading to more amicable resolutions compared to traditional judicial processes. However, challenges such as power imbalances and the need for trained mediators remain critical factors influencing the success of mediation in domestic violence cases. This research highlights the potential of mediation to serve as an effective tool in addressing domestic violence, while also calling for improved training and support systems for mediators involved in such sensitive matters

Abstract

Law is not merely a set of formal binding rules but also a reflection of society's social consciousness. Hugo Grotius, a philosopher and the father of international law, developed a theory on the universality of law rooted in human rationality and moral awareness. This article aims to examine Grotius' thoughts on law as a manifestation of social consciousness. Using a normative-philosophical approach, this study explores how Grotius' concept of universality of law serves as a foundation for harmonizing positive law with universal moral values. The study finds that law, according to Grotius, possesses universal characteristics as it is based on human reason, which is inherently social, rational, and moral. Thus, Grotius' theory remains relevant in the modern context to create more inclusive and just legal systems.

Abstract

Based on data from the Crisis Centre belonging to the National Agency for the Placement and Protection of Indonesian Migrant Workers which is called BNP2TKI, there were 1,759 complaints from workers assigned abroad as of/January-March 2019, where 71 cases were confirmed as human trafficking. and 2,430 cases which have indicators of human trafficking and there are 32 cases of trafficking in persons from the province of Nusa Tenggara Barat where as many as 59 victims are from West Lombok Regency. Using normative empirical research or also best known as field research, this paper applied the descriptive analysis method in analysing the data and found the following: forms and models of human trafficking in West Lombok Regency, Nusa Tenggara Barat done by a scalper who approached potential target induvidually ( home-to-home / door-to-door), then offered a job with a big number of salary to the victim, using nonprocedural ways, document falsification and persuading victims to escape from legal corporate. The duties of the West Lombok government are to prevent the occurrence of the criminal act of human trafficking there for socialization in the community and schools in West Lombok about procedurally being legal workers migrants and law enforcement on the criminal offender are crucial to be born in mind.

Abstract

This research aims to analyze policy models for the government to prevent sexual violence against children, identify obstacles faced in its implementation, and formulate a more ideal integrative research policy model. This is research normative with a socio-legal research approach, namely analyzing normative law with an understanding of the social context and the dynamics of society. The research data, namely primary data, regulations, relevant legislation, and secondary data, were obtained from books, journals, and a report study. This research discloses that the Indonesian government has implemented several policies to handle cases of sexual violence against children. Policies that cover regulatory law, such as the Child Protection Act and the sexual violence crime act, prevention programs like child-friendly schools, as well as the provision of protective services for the victims. The implementation still faces challenges, such as a lack of coordination between institutions, limited source power, human and infrastructure, and low societal awareness, resulting in a lack of reported cases. To overcome obstacles, a more integrative and practical policy model is needed, including strengthening coordination between agencies to form a unit task special, improving source power and infrastructure, such as the regional technical implementation unit for the protection of women and children, as well as implementing more firm and restorative measures. In addition, public awareness needs to be improved through education and the public, as well as the utilization of technology in system reporting, based on big data analysis for supporting prevention, as well as handling cases of sexual violence against children more optimally.

Abstract

Perdagangan orang merupakan kejahatan transnasional yang sering kali menjadikan calon pekerja migran Indonesia (CPMI) sebagai korban, terutama akibat lemahnya sistem perlindungan dan kurangnya koordinasi antar lembaga. Penelitian ini bertujuan untuk merumuskan model kebijakan integratif antara pemerintah pusat dan pemerintah daerah dalam melindungi CPMI guna mencegah terjadinya perdagangan orang. Dengan menggunakan pendekatan yuridis-sosiologis dan metode kualitatif, data diperoleh melalui studi pustaka, wawancara mendalam dengan pemangku kepentingan, serta observasi di wilayah kantong migran. Hasil penelitian menunjukkan bahwa kebijakan yang ada masih bersifat sektoral dan belum responsif terhadap perkembangan modus eksploitasi modern. Oleh karena itu, diperlukan model kebijakan integratif yang melibatkan sinergi regulasi, kelembagaan, dan anggaran, serta mengedepankan prinsip keadilan restoratif, partisipasi masyarakat, dan pemanfaatan teknologi digital. Model ini diharapkan mampu memperkuat sistem pencegahan, pengawasan, dan perlindungan terhadap CPMI secara berkelanjutan.

Abstract

Kekerasan dalam rumah tangga (KDRT) merupakan salah satu permasalahan sosial yang kompleks dan berdampak luas terhadap korban, terutama perempuan dan anak. Sistem peradilan pidana sering kali dianggap tidak mampu memberikan solusi yang memuaskan bagi para pihak yang terlibat, terutama dalam konteks relasi keluarga yang bersifat emosional dan berkelanjutan. Mediasi muncul sebagai salah satu alternatif penyelesaian konflik yang menekankan pada pemulihan hubungan dan penyelesaian damai. Penelitian ini bertujuan untuk menganalisis sejauh mana mediasi dapat dioptimalkan dalam penyelesaian kasus KDRT, serta mengkaji efektivitas, tantangan, dan potensi pengembangannya di Indonesia. Metode yang digunakan adalah pendekatan yuridis normatif dengan analisis data kualitatif. Hasil penelitian menunjukkan bahwa mediasi memiliki potensi besar dalam menyelesaikan konflik KDRT secara humanis, namun perlu didukung dengan regulasi yang tegas, pelatihan mediator yang profesional, dan perlindungan maksimal bagi korban. Optimalisasi mediasi dapat menjadi solusi alternatif yang menyeimbangkan keadilan dan keharmonisan dalam keluarga.
