Abstract

This research is motivated by the fact that public services provided by government officials often tend to be complicated, such as: Service procedures, low level of education of officials, work discipline. This greatly influences the quality of public services in village government. This research has the main objective of establishing the government, namely to maintain a peaceful system in which society can live a normal life and improve the welfare of its people. In other words, in essence it is service to the community which is the main function of the government and is the government's obligation in managing its government, both central, regional and especially village governments which have direct contact with the community. This research using normative juridical research methods, normative juridical, namely legal research carried out by examining library materials or secondary data. The research results concluded that the effectiveness of village officials' performance in serving the community is very important in the context of implementing Law no. 23 of 2014. The success of village officials in understanding and implementing it has a direct impact on the welfare of the community at the local level. Therefore, it is necessary to continue to improve the quality of human resources, facilities and infrastructure at the village level to ensure optimal services in accordance with the provisions of the Law.

Abstract

This study analyzes factors that influence this understanding and perception, such as education level, family environment, media influence, personal experience, and involvement in daily customary life. Data collection techniques are carried out through observation, interviews, and documentation in order to gain a deeper understanding of the young generation of Toba Batak towards customary divorce law. The purpose of this study is to determine the extent of the understanding of the young generation towards the customary divorce process, the role of the family, and the factors that influence their views. This study discusses the perception and understanding of the young generation of Toba Batak towards customary divorce law amidst the influence of modernization. Through the understanding and perception of the young generation towards customary divorce law, this study attempts to provide an overview of the relevance of the young generation of Toba Batak towards customary divorce law. The results of the study show that although most still respect customs and the value of family deliberation, there are doubts about customary justice, especially regarding the position of women. The young generation tends to support the preservation of customs, but hopes for adjustments to be fairer and in accordance with the times. The results of the study are expected to be input for traditional leaders and the government in designing targeted cultural preservation policies.

Abstract

This study is entitled "The Role of Parboru and Hula-Hula in the Settlement of Divorce Disputes in Batak Toba Customs". The main focus of this study is to analyze the role and position of Parboru (the woman's family) and Hula-Hula (the wife's family) in the divorce settlement process according to Batak Toba customs. This study also presents the dynamics of the interaction of the two elements in customary mediation, as well as how customary values ​​and norms are implemented to maintain the harmony and dignity of the extended family. The method used in this study is a qualitative method with a descriptive approach. Data obtained through interviews and library studies of relevant literature on Batak Toba customary law, Dalihan Na Tolu, and the role of Parboru and Hula-Hula in traditional ceremonies and the resolution of marital conflicts in Batak Toba customs. The results of the study indicate that Hula-Hula has a central position as a decision maker and mediator, while Parboru plays a role as a technical implementer, mediator, and balancer in the customary deliberation forum. The active involvement of both parties is very important to ensure that the divorce process runs according to customary norms and maintains the social harmony of the Batak Toba community. This study is expected to enrich the literature on Batak customary law and become a reference for students, the community, and customary leaders in understanding the importance of the role of kinship in resolving divorce.

Abstract

This study is entitled Harmonization and Disparity: Comparative Analysis of the Division of Inheritance for Adopted Children According to Civil Law and Karo Customary Law. The main focus of this study is to identify and analyze the differences and common ground between the national legal system in this case civil law and Karo customary law in determining inheritance rights for adopted children. In civil law, adopted children are legally recognized as having equal standing with biological children. This provision strengthens the rights of adopted children to receive inheritance from their adoptive parents. On the other hand, in the context of Karo customary law, recognition of adopted children as heirs is still limited. Generally, only male adopted children are given inheritance rights to searched property, while inheritance remains inherited by male descendants from the bloodline. The problems studied in this proposal include how the law treats adopted children in the division of inheritance according to the two legal systems, the challenges faced in realizing the inheritance rights of adopted children, and how to formulate efforts to harmonize civil law and customary law in order to create equal justice. This study uses a qualitative approach with a library research type. The results of the study indicate that there is a fundamental disparity between civil law and Karo customary law in granting inheritance rights to adopted children. Civil law stipulates that adopted children who are legally adopted through the courts have equal rights to biological children, including the right to legitieme portie. Thus, a more inclusive, adaptive legal system can be created that guarantees justice for all children without discrimination based on birth status or gender.

Abstract

The development of science and technology has positive and negative impacts on human life. Likewise with cyberspace, one of the advances in technology, of course it is a reality that is faced with a legal metanarrative. Overcoming the ineffectiveness of legal metanarratives in addressing cyber challenges requires an innovative and comprehensive approach. Currently the world is facing changes in the industrial world which can be called the Industrial Revolution 4.0 which has a major impact on industrial life, especially in the form of rapid technological developments. The rapid development of technology has given birth to a new concept of "creative industry" which utilizes human creativity and thinking abilities. Intellectual property rights play a very important role in the creative industry, and the state recognizes the efforts and perseverance of creators/inventors in producing new innovations and minimizing the occurrence of intellectual property rights. Therefore, intellectual property must be protected legally. Violation of rights. However, in reality there are several challenges and difficulties in implementing laws related to intellectual property rights in Indonesia. This journal uses normative research methods based on legal regulations and literature studies, and considers aspects of theoretical, structural and legal explanations. The main problem that occurs in Indonesia is the low level of public awareness and education regarding intellectual property, and this problem can give rise to other problems. Intellectual property protection in Indonesia not only provides peace of mind and legal certainty for creators/inventors, but also has a psychological impact that motivates creators/inventors to continue to innovate. Indonesia will be a country that has great potential to implement Industry 4.0 because of its large workforce. The digital information era not only brings progress to industry, but can also pose challenges to labor laws. The aim of this research is to analyze labor problems due to the absence of regulations that are appropriate to the situation in the Industrial Revolution 4.0 era.

Abstract

Online shopping transactions through e-commerce platforms such as Tokopedia have become increasingly popular. However, with the growing number of online transactions, there are risks and responsibilities that need to be addressed. This study aims to explore the implications of keperdataan (law relating to civil matters) on the risks and responsibilities in online shop agreements in Tokopedia. The research will focus on analyzing the legal framework that governs online transactions, particularly in terms of consumer protection, contractual obligations, and dispute resolution mechanisms. By examining relevant laws and regulations, as well as case studies of online shop agreements in Tokopedia, the study seeks to identify key legal issues that may arise in online transactions and provide recommendations for both consumers and online sellers.

Abstract

Abstract The purpose of marriage in Islam is to continue the lineage, which will become heirs both from the father and the mother. In Islamic law, there are regulations regarding inheritance rights, such as the inheritance rights of children born out of wedlock. The aim of this research is to understand the inheritance rights of children born out of wedlock from the perspective of Islamic law. The research method used is a qualitative approach through a literature review. Data for this research are obtained through the study of literature such as journals, books, laws, and others. The data analysis involves three stages: reduction, display, and verification. The findings of this research reveal that Islamic law provides specific regulations, so children born out of wedlock only have a lineage relationship with their mother, and their inheritance rights are obtained only from their mother due to their lineage. Keywords: Children born out of wedlock, Inheritance rights, Islamic law   Abstrak Tujuan dari perkawinan adalah untuk melanjutkan keturunan yang nantinya akan menjadi ahli waris baik dari ayah ataupun ibu. Dalam hukum islam tentunya terdapat aturan-aturan dalam hak waris, seperti hak waris anak diluar nikah. Adapun tujuan penelitian ini adalah mengetahui hak waris anak diluar nikah dalam perspektif hukum islam. Metode pada penelitian ini adalah metode kualitatif pendekatan studi Pustaka. Data penelitian ini diperoleh melalui kajian literatur seperti Jurnal, buku, Undang-Undang dan lainnya. Analisis Data yang digunakan yaitu melalui tiga tahap reduksi, display dan verifikasi. Hasil penelitian pada penelitian ini adalah hukum Islam memberikan ketentuan khusus, sehingga anak yang lahir di luar perkawinan sah hanya memiliki hubungan nasab dengan ibunya, sehingga hak waris anak diluar nikah tidak diperoleh dari ayahnya hanya diperoleh dari ibunya karena nasabnya. Abstract

Abstract Inheritance law is an integral part of the legal system that governs the transfer of rights and ownership of a person's assets after their death. Adopted children, who have been legally accepted by their adoptive parents, are involved in this complex dynamic. In many jurisdictions, the inheritance rights of adopted children can vary depending on the applicable laws. The purpose of this research is to determine the position and legal aspects of inheritance for adopted children according to Islamic law. The research method used is a qualitative descriptive method with a literature review approach, which is employed to trace and gather relevant information and data from various books, journal articles, and online media related to the Legal Aspects and Psychosocial Effects of Inheritance Rights on Adopted Children. The data sources used are secondary. Unlike the distribution of inheritance to biological children or heirs, the inheritance rights of adopted children granted through a mandatory will must be executed first. Article 175 of the Compilation of Islamic Law regulates the obligations of heirs to the deceased, one of which is to fulfill all the wishes of the deceased. Keywords: Adopted Children, Inheritance Rights, Islamic law Abstrak Hukum waris merupakan bagian penting dari sistem hukum yang mengatur transfer hak dan kepemilikan atas harta benda seseorang setelah meninggal dunia. Anak angkat, yang telah diterima secara hukum oleh orang tua angkatnya, terlibat dalam dinamika kompleks ini. Dalam banyak yurisdiksi, hak waris anak angkat dapat bervariasi tergantung pada undang-undang yang berlaku. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana kedudukan dan aspek hukum waris pada anak angkat menurut hukum Islam. Metode penelitian yang digunakan yaitu metode deskriptif kualitataif dengan pendekatan studi pustaka, yang digunakan untuk menelusuri dan mengumpulkan informasi dan data yang relevan dari berbagai buku, artikel jurnal dan media internet yang berkenaan dengan Aspek Hukum Dan Efek Psikososial Hak Waris Pada Anak Angkat. Sumber data yang digunakan yaitu sekunder. Tidak seperti pembagian warisan terhadap anak kandung atau ahli waris, hak waris anak angkat yang diberikan melalui wasiat wajibah harus dilaksanakan terlebih dahulu. Pasal 175 Kompilasi Hukum Islam mengatur kewajiban ahli waris terhadap pewaris, salah satunya adalah memenuhi semua wasiat pewaris. Kata Kunci: Anak Angkat, Hak Waris, Hukum Islam

Abstract

Abstract The research uses library research sources.The data is obtained from document materials in a normative way, namely interpreting what is countained in law books, as well as existing documents in legislation (Statute Approach). After the data is collected, the data analyzed using qualitative-normative techniques with discussion deductive which discusses child protection in polygamous families in terms of Islamic law. Child protection in polygamous families is viewed from Islamic Law (KHI) and its practive still needs to be improved.Even though the KHI regulates the protection of children in polygamous families, in reality there are still many children who experience violence, discrimination and neglect in polygamous families. For the rights of children who face challenges. In polygamous families, it is hoped that these efforts can produce more optimal child protection designs in polygamous families, so that children can grow develop optimally. Keywords: protection, children, polygamy Abstrak Penelitian ini menggunakan sumber penelitian kepustakaan (library research), data diperoleh dari bahan dokumen dengan cara normatif, yaitu menafsirkan apa yang tertera dalam buku-buku hukum, serta dokumen-dokumen yang ada dalam peraturan perundang-undangan (Statute Approach). Setelah data terkumpul, data dianalisis dengan menggunakan teknik kualitatif-normatif dengan pembahasan secara deduktif yang membahas tentang perlindungan anak dalam keluarga poligami ditinjau dari hukum Islam. Perlindungan anak dalam keluarga poligami ditinjau dari Hukum Islam (KHI) dalam praktiknya masih perlu ditingkatkan, meskipun KHI telah mengatur tentang perlindungan anak dalam keluarga poligami, namun pada kenyataannya masih banyak anak yang mengalami kekerasan, diskriminasi, dan penelantaran dalam keluarga poligami. Untuk hak-hak anak yang menghadapi tantangan. Dalam keluarga poligami, diharapkan upaya-upaya tersebut dapat menghasilkan desain perlindungan anak yang lebih optimal dalam keluarga poligami, sehingga anak dapat tumbuh kembang secara optimal. Abstract

This research discusses the influence of Islamic law on the development of the civil law and common law systems in Indonesia, a country founded on the rule of law with diverse ethnicities, cultures, and religions. With a majority Muslim population, Islamic law plays a significant role in complementing the legal certainty of the civil law system through substantive justice values, such as in the regulation of waqf and zakat. In the common law system, Islamic law is accommodated formally or informally depending on the societal context. The research employs a normative juridical method, which refers to analyzing legal norms and concepts relevant to the issues being studied. Data sources are obtained through literature studies, including journal articles, books, and previous research. The findings indicate that Islamic law holds an essential role in both civil law and common law systems. In the civil law system, Islamic law complements legal certainty with values of substantive justice, as seen in the regulations of waqf and zakat. Meanwhile, in the common law system, Islamic law is formally or informally accommodated, depending on the majority or minority Muslim context of a given society.
