Abstract

Motor vehicle hire purchase agreements with installment payments under fiduciary guarantees are an important topic in the context of civil law. Problems that often occur include violations of agreements, the debtor's lack of understanding of the contents of the agreement, and the practice of forcibly withdrawing vehicles without a valid legal process. This research method uses normative legal analysis by referring to applicable laws and regulations, literature studies, and various related sources of information. The results of the research show the legal rules that apply to parties who violate the agreement, legal protection efforts for debtors, as well as procedures for valid withdrawal of vehicles by creditors in the context of motor vehicle rental purchase agreements with installments in fiduciary guarantees.

Abstract

This study aims to examine the implementation of inheritance distribution for daughters under the Batak Toba customary inheritance law. The research employs a qualitative method with an empirical juridical approach. The empirical juridical approach is used to analyze the interaction between customary law and its application within the Batak Toba indigenous community. The data used in this study consist of primary and secondary data. Data collection techniques include interviews, observations, and documentation. The data analysis technique applied is qualitative analysis, which involves data reduction, data presentation, and verification or conclusion drawing. The findings reveal that the implementation of Batak Toba customary inheritance law in Belang Malum Village remains based on the patrilineal principle. Although the community still upholds the patrilineal system that positions sons as the main heirs, this practice has gradually shifted in line with societal changes, particularly regarding the recognition of daughters as heirs and their entitlement to inheritance. In practice, daughters now receive a share of the inheritance, with the form and proportion determined by family consensus, the economic condition of each child, and local traditions. This study recommends openness to social developments and national legal principles that promote justice and gender equality, as well as the enhancement of legal awareness and education through both formal and non-formal means.

Abstract

This study aims to analyze the vagrancy rehabilitation policy implemented by the Social Service Office of Kabanjahe City from the perspective of social justice principles and to identify the factors contributing to the high number of vagrants in the area. The research employs a descriptive method with a normative-empirical approach, utilizing both primary data (interviews, observations, and documentation) and secondary data. The findings indicate that the vagrancy rehabilitation policy has a strong legal foundation, as stipulated in Article 34 paragraph (1) of the 1945 Constitution, Law No. 11 of 2009 on Social Welfare, and relevant regional regulations. Normatively, the policy aligns with the principle of social justice, which emphasizes equal opportunities and protection for vulnerable groups. However, its implementation still faces several challenges, including limited funding, insufficient social workers, inadequate facilities, and weak dissemination of program information. Consequently, the benefits of the rehabilitation program are unevenly distributed and have yet to effectively promote sustainable independence among the vagrant population.
