Abstract

Banks, as essential financial institutions, play a critical role in facilitating businesses by providing loans secured with collateral, such as mortgage rights or land certificates. Auctions of collateral encumbered with mortgage rights often face challenges stemming from injustices perpetrated by creditors or debtors. This study aims to explore legal remedies available to debtors when the limit value is set below fair market value and to assess how the principles of justice are applied in mortgage collateral auctions. By analyzing the application of justice principles, procedural frameworks, and legal remedies, this research provides insights into improving auction processes and safeguarding debtor rights. Clear and equitable methods for setting limit values, combined with effective dispute resolution mechanisms, are essential for fostering a fairer and more transparent auction system. This research employs a normative legal methodology, utilizing primary data from webinars and seminars related to mortgage collateral auctions, particularly those organized by KPKNL, and secondary data from legal documents such as the Civil Code, Mortgage Rights Law, PMK on Auction Implementation Guidelines, and Indonesian Valuation Standards. The study underscores the critical importance of procedural justice in mortgage collateral auctions, highlighting the need for reforms in determining limit values. While existing procedures provide a legal foundation, the presence of regulatory gaps necessitates further attention to ensure auctions align with principles of justice and do not disadvantage debtors. Revising regulations and adopting improved practices will support the implementation of fairer and more efficient auctions.

Abstract

Settlement of labor disputes in court requires the application of a clear and uniform concept of justice. For labor disputes to be resolved fairly, courts must ensure that procedures are carried out in a manner that upholds the rights of the parties to the dispute, is fair and non-discriminatory. The main causes of conflict between workers and management include different viewpoints between workers and employers, employment contracts, rights and responsibilities, and competing interests. Improving dispute resolution processes and ensuring fairness can increase the effectiveness of the employment law system. Writing about a phenomenon using data and presenting facts and data factually and accurately based on case analysis and related matters is known as writing quantitative analysis. This writing is also accompanied by a discussion of court cases which function to uphold the principles of justice at the Industrial Relations Court. The current legal system offers both litigation and non-litigation means for resolving disputes. These mechanisms include industrial relations courts using bipartite negotiations, mediation and arbitration in accordance with law number 2 of 2004. The main problem is the high time and costs involved in resolving labor disputes, even with a clear legal framework. Before starting negotiations, labor organizations must also fulfill several prerequisites. The state plays an important role in encouraging the peaceful resolution of conflicts and fostering a peaceful environment between employers and workers. The social peace of industrial society is significantly affected by injustice in labor relations, in addition to the individuals affected. If justice is not achieved at every stage of industrial relations, disharmony will continue. It is important to improve the quality of procedural law, dispute resolution systems, and legal awareness among all parties.

Abstract

In an increasingly fast-paced and connected digital era, the protection of personal data privacy has become a very urgent and complex issue. Information and communication technologies have facilitated the widespread collection, storage and distribution of personal data, presenting new challenges to the protection of privacy rights, particularly in Indonesia. This phenomenon is exacerbated by various cases of data leakage and misuse of personal information that emphasize the importance of a strong and effective legal framework to protect individual privacy. This study aims to evaluate the effectiveness of existing regulations, such as Article 26 of the ITE Law and PP PSTE, in protecting personal data privacy in Indonesia, and to examine the draft personal data protection law (RUU PDP) which is expected to provide more comprehensive protection. The research method used is a normative juridical approach, with literature study as the main tool for collecting data. The results show that although the existing regulations already provide an important legal foundation, there are still weaknesses in implementation and law enforcement. Lack of public awareness about privacy rights, as well as weak law enforcement against data privacy violations, are the main obstacles in the protection of personal data privacy. The conclusion of this study is that improvements in regulation, stricter law enforcement, and better education to the public are needed to improve the protection of personal data privacy. The PDP Bill is expected to address some of these weaknesses by providing a clearer and more comprehensive legal framework.

Abstract

ABSTRAKNarkotika adalah obat atau bahan yang bermanfaat di bidang pengobatan, pelayanan kesehatan dan pengembangan ilmu pengetahuan, namun di sisi lain dapat menimbulkan ketergantungan yang sangat merugikan apabila dipergunakan tanpa adanya pengendalian, pengawasan yang ketat dan seksama. Abstract

Penegakan hukum pidana terhadap anak jalanan dalam sistem peradilan pidana anak di Indonesia merupakan isu kompleks yang menyentuh aspek hukum, sosial, dan kemanusiaan. Anak jalanan, sebagai kelompok rentan, sering kali terjebak dalam lingkaran pelanggaran hukum bukan karena niat kriminal, melainkan akibat kondisi sosial-ekonomi yang memaksa. Jurnal ini bertujuan untuk mengevaluasi efektivitas penegakan hukum pidana terhadap anak jalanan dengan menitikberatkan pada pendekatan humanis sebagaimana diamanatkan dalam Undang-Undang Sistem Peradilan Pidana Anak. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan analisis kualitatif terhadap studi kasus, peraturan perundang-undangan, dan data empiris. Hasil penelitian menunjukkan bahwa meskipun telah terdapat regulasi yang menekankan pada keadilan restoratif dan perlindungan hak anak, implementasi di lapangan masih menemui berbagai kendala, seperti minimnya pemahaman aparat penegak hukum, keterbatasan fasilitas diversi, serta stigma masyarakat terhadap anak jalanan. Oleh karena itu, perlu adanya penguatan kapasitas institusi peradilan anak, pelatihan berkelanjutan bagi aparat hukum, serta pendekatan interdisipliner yang melibatkan keluarga, masyarakat, dan negara untuk mewujudkan sistem peradilan pidana anak yang benar-benar berkeadilan dan berperikemanusiaan.

Abstract

Tindak pidana penyebarluasan konten asusila merupakan salah satu jenis kejahatan yang semakin marak di era digital. Kejahatan ini tidak hanya mengancam privasi individu, tetapi juga dapat menimbulkan dampak sosial dan psikologis yang serius bagi korban. Dalam banyak kasus, ancaman tersebut dilakukan melalui internet atau aplikasi pesan yang memungkinkan pelaku untuk menyebarkan ancaman secara cepat lewat media massa tersebut. Undang-Undang Nomor 1 Tahun 1946 tentang Kitab Undang-Undang Hukum Pidana di Indonesia belum mengatur sanksi hukum terhadap kejahatan tersebut. Dalam menghadai tantangan perkembangan teknologi yang pesat, maka pemerintah membentuk Informasi dan Transaksi Elektronik mengatur tentang tindak pidana pengancaman melalui media elektronik yang bertujuan memberikan hukuman terhadap pelaku agar jera dan tidak mengulangi perbuatan yang dapat merugikan orang lain. Penelitian ini menggunakan metode yuridis normatif yaitu menggambarkan peristiwa seolah-olah sama dengan yang sebenarnya.

Abstract

Kekerasan seksual terhadap anak merupakan masalah serius yang memerlukan perhatian serius dari berbagai pihak. Anak-anak berhak atas perlindungan maksimal dari segala bentuk kekerasan dan diskriminasi, namun realitanya, kasus kekerasan seksual terhadap anak masih marak terjadi di Indonesia. Metode penelitian yang digunakan pada penelitian ini, yaitu metode yuridis normatif. Metode ini dipilih karena sejalan dengan tujuan penelitian yang ingin mengkaji dan menganalisis norma hukum yang berlaku terkait dengan Perlindungan Hukum Terhadap Anak Sebagai Korban Kekerasan Seksual. Pengaturan hukum yang mengatur tentang perlindungan anak sebagai korban kekerasan seksual tertuang dalam UU No 31 Tahun 2014, Buku II Bab XIV KUHP, UU No 39 Tahun 1999 tentang Hak Asasi Manusia, UU No 11 tahun 2012 tentang Sistem Peradilan Anak. Bentuk perlindungan hukum untuk anak korban kekerasan seksual meliputi penyediaan fasilitas khusus, pendampingan khusus, pemantauan perkembangan anak secara berkelanjutan, jaminan untuk menjaga hubungan dengan keluarga, serta melindungi identitas anak dari eksposur media massa dan stigmatisasi.

Abstract

The copyright dispute between Lesti Kejora and Yoni Dores has drawn public attention due to its complexity and the broader challenges of intellectual property protection in the digital era. This study aims to examine the legal implications of alleged copyright infringement, inefficiencies in royalty management systems, and the influence of public response on the dispute resolution process. The research employs a normative juridical method with a qualitative approach by analyzing statutory regulations, case studies, and legal literature. The findings indicate that Lesti Kejora’s commercial use of a song owned by Yoni Dores without proper authorization may constitute a violation of Article 9 paragraph (1) and Article 113 paragraph (3) of the Indonesian Copyright Law. Key issues include the lack of effectiveness and transparency in the performance of Collective Management Organizations (LMK) and the National Collective Management Organization (LMKN), exacerbated by the absence of a national digital system. Additionally, there is widespread misunderstanding among creative industry players regarding licensing requirements. Compared to countries with integrated, technology-based copyright systems and strong legal culture, Indonesia still lags significantly. The Lesti Kejora Yoni Dores case highlights the urgent need for comprehensive reform in Indonesia's copyright protection system.

Abstract

This research aims to normatively examine the violations of consumer rights in the practice of fuel adulteration carried out by unscrupulous individuals within PT Pertamina Patra Niaga. This practice not only harms consumers economically and in terms of safety but also violates the statutory provisions that guarantee consumer protection. The method used is normative legal research with a statutory approach and literature review. The findings indicate that the practice of fuel adulteration constitutes a violation of Law Number 8 of 1999 concerning Consumer Protection, particularly the right to comfort, safety, and security in consuming goods and/or services. Furthermore, this action can also be classified as a criminal offense due to endangering public interests. Therefore, strict law enforcement and closer supervision of fuel distribution and processing are necessary to ensure the protection of consumer rights.

Abstract

The rapid development of artificial intelligence–based military technology poses significant conceptual and normative challenges to the application of International Humanitarian Law (IHL), particularly with regard to the deployment of Lethal Autonomous Weapon Systems (LAWS). The autonomous capacity of such systems to select and engage targets raises complex questions of legal accountability when violations of the laws of armed conflict or civilian harm occur. This article reassesses the doctrine of command responsibility in the context of LAWS by positioning the core principles of IHL—distinction, proportionality, precaution, and accountability—as evaluative benchmarks. Employing a normative juridical approach, this study analyzes the 1949 Geneva Conventions, Additional Protocol I of 1977, and the 1998 Rome Statute of the International Criminal Court, alongside relevant Indonesian national legislation, particularly Law No. 3 of 2002 on National Defense and Law No. 34 of 2004 on the Indonesian National Armed Forces (TNI). The findings demonstrate that although increasing technological autonomy may reduce direct human involvement in lethal decision-making, the legal obligations of military commanders cannot be disregarded. Nevertheless, algorithmic complexity, opacity in decision-making processes (the “black box” problem), and the involvement of multiple actors necessitate a reconceptualization of existing accountability frameworks, including the recognition of shared or joint responsibility. This article argues that in the absence of specific international regulations governing LAWS, a significant accountability gap risks undermining the effective enforcement of IHL in future armed conflicts. Accordingly, it calls for the strengthening of international legal frameworks to explicitly regulate LAWS, ensuring that humanitarian principles remain aligned with the realities of contemporary military operations.
