Abstract

Penelitian ini menganalisis pengusiran masyarakat dari lokasi tanah hak ulayat marga sagisolobri di kabupaten sorong selatan dari perspektif hukum pidana. kasus ini berawal dari konflik politik lokal yang memicu pengusiran paksa tiga pulu kepala keluarga oleh marga sagisolobri. pengusiran ini dilakukan dengan alasan perbedaan dukungan politik dalam pemilihan kepala daerah dan kekecewaan terhadap ketidakmampuan memperjuangkan aspirasi komunitas dalam birokrasi pemerintahan. penelitian ini menyoroti dampak pengusiran terhadap hak asasi manusia, termasuk hak atas tanah, hak untuk menentukan nasib sendiri, dan hak atas kehidupan yang layak. selain itu, penelitian ini juga menekankan pentingnya konsultasi dan persetujuan yang bebas, didahulukan dan berdasarkan informasi dalam setiap tindakan yang mempengaruhi masyarakat adat. kesimpulan penelitian menunjukkan bahwa pengusiran ini melanggar hak asasi manusia yang diakui secara internasional dan nasional serta memperkuat pola dominasi dan marginalisasi terhadap masyarakat adat, mengancam pelestarian lingkungan dan keberlanjutan global.

Abstract

Pembaruan pelayanan publik dapat mendorong pengembangan terwujudnya good governance di indonesia adalah pertama, perbaikan kinerja pelayanan publik dinilai penting oleh semua stakeholders, yaitu pemerintah, warga masyarakat, dan para pelaku pasar. Pemerintah kepentingan dengan upaya perbaikan pelayanan publik, karena jika berhasil memperbaiki pelayanan publik, akan dapat memperbaiki legitimasi. Membaiknya pelayanan publik juga akan dapat memperkecil biaya birokrasi, yang pada gilirannya dapat memperbaiki kesejahteraan warga masyarakat dan efisiensi mekanisme pasar.

Abstract

Significant technological developments not only have an impact on the ease of access by the public as consumers of goods/services but also open up new business opportunities for business actors such as business opportunities in the field of e-commerce, namely the Jastip business or deposit services. Business actors often experience problems in the process of implementing their business. Some of the main problems or problems that are often found by just providers as business actors include related, unilateral cancellation from consumers, unclear information on goods, delivery of prohibited goods, and consumer dissatisfaction. This research aims to be an effective solution for just business actors in improving the online buying and selling experience for consumers and business actors. The research method carried out is descriptive field research that describes the results of research with a legislative approach as library data and interviews with business actors and just consumers as supporting data. The problematic settlement experienced by just providers in the implementation of their business has been supported by various laws and regulations in Indonesia, such as the Civil Code, government regulations and the Consumer Protection Law, this aims to protect consumer rights and ensure fair and transparent transactions. Non-compliance with these rules can result in legal and administrative sanctions for business actors.

Abstract

Law No. 27 of 2022 concerning Personal Data Protection (PDP Law) is an important milestone in Indonesia's efforts to protect the privacy and personal data of its citizens. This paper analyzes the background of the passage of the law, the main content of the regulation, implementation challenges, data leakage case studies, comparisons with international regulations, and recommendations for improving personal data protection in Indonesia.

Abstract

This study aims to examine how efforts to fulfill the rights of child prisoners and the implementation of child prisoner development in correctional institutions class II B Sorong City. The research used through empirical juridical legal research methods through a qualitative approach with material analysis using qualitative descriptive analysis techniques. The results of this study indicate that (1) Efforts to protect the rights of child prisoners in the Class II B Correctional Institution of Sorong City based on Law Number 22 of 2022 concerning Corrections. Its implementation runs in accordance with existing regulations. However, in granting these rights, it is necessary to pay attention to the development of child prisoners, including the growth and development of children, both physical, mental, and social, so it is not justified if the development and protection of child prisoners are equalized with adult prisoners. According to Lawrence M Friedmann, the success of law enforcement is determined by three elements of the legal system, namely: Legal structure, legal substance, and legal culture. First Legal Substance, in this case there is no new government regulation after Law Number 22 of 2022 concerning Corrections. Second Legal Structure, in this case the overcapacity that occurs in the Correctional Institution class II B Sorong City can affect the performance of the Institution itself so that extra services are needed for prisoners. Third Legal Culture, the existence of prisons that cannot keep up with the number of incoming prisoners, it is necessary to increase awareness of the legal culture of the community so that crime can be minimized and can reduce the number of incoming prisoners. (2) The existence of child prisoners who are still integrated with adult prisoners due to overcapacity needs to be addressed properly because the implementation should be specifically placed in the Child Special Development Institution (LPKA) based on the provisions of Article 47 of Law Number 22 of 2022 concerning Corrections.

Abstract

This research aims to analyze the implementation of traffic laws regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation in Indonesia. The methodology used is normative juridical research which involves analysis of normatively applicable laws to understand their implementation in a wider context. The relevance of this research lies in the need to identify the effectiveness of the implementation of the Law, the level of public compliance with traffic rules, the performance of law enforcement officers, as well as the factors that influence the effectiveness of traffic law enforcement in Indonesia. This research contributes in the form of an in-depth understanding regarding the implementation of traffic laws in Law Number 22 of 2009, by highlighting aspects of safety, compliance and law enforcement. The research results show the implementation of traffic laws through consistent enforcement of rules, effective handling of violations, and cross-sector cooperation can improve traffic security and order. Recommendations for this research include increased outreach and education to the community, stricter law enforcement, regular evaluation of the performance of law enforcement officers, as well as investment in improving road infrastructure. In conclusion, the implementation of traffic law in Law Number 22 of 2009 in Indonesia has a significant impact on the safety of road users and improving traffic quality. With a holistic approach and cross-sector collaboration, it is hoped that a traffic culture that is good, safe, orderly and adheres to the rules can be created in society.

Abstract

This study aims to analyze the investigation process of sexual abuse crimes against persons with disabilities at the Sorong City Police Station and identify the factors that cause children with disabilities to be vulnerable to becoming victims. The research method used an empirical juridical approach with qualitative methods. Data were collected through in-depth interviews with investigators from the Sorong City Police Station's PPA Unit, analysis of legal documents such as the Criminal Procedure Code, Law No. 8/2016 on Persons with Disabilities, and Law No. 12/2022 on Sexual Violence Crimes, as well as field observations and literature studies. The novelty of this research lies in the development of an integrative investigation model based on trauma-informed care, specifically designed for the context of Sorong City, taking into account the unique characteristics of Eastern Indonesia. Unlike previous studies, which tended to be partial and theoretical, this study presents a holistic approach that integrates various important dimensions into a single operational framework that is ready for implementation. The results of the study show that the investigation process faces obstacles in the form of difficulties in communicating with victims with disabilities, limited evidence, and a lack of supporting facilities. Effective solutions include adaptive communication approaches and multisectoral collaboration. Factors contributing to the vulnerability of victims include the exploitation of their powerlessness by perpetrators,  the lack of inclusive sex education, social stigma, and the victims' dependence on perpetrators, who are often people close to them. These findings indicate the need for a specialized investigation approach and holistic prevention strategies. In conclusion, the investigation process for sexual abuse cases against persons with disabilities requires a specific approach that considers the needs of victims, including investigator training, adaptive communication protocols, and strengthening of supporting infrastructure. Prevention efforts should focus on eliminating vulnerability factors through strengthening inclusive sex education and public awareness campaigns.
