Abstract

AbstrakKesadaran hukum merupakan fondasi penting dalam membangun masyarakat yang tertib, adil, dan berdaya. Namun, dalam praktiknya banyak warga yang masih menghadapi persoalan serius, mulai dari kekerasan dalam rumah tangga (KDRT), konflik pertanahan, lemahnya tata kelola usaha mikro, kecil, dan menengah (UMKM) serta koperasi, hingga rendahnya literasi hukum digital. Kondisi ini mendorong Fakultas Hukum Universitas Esa Unggul untuk melaksanakan kegiatan pengabdian masyarakat di Kelurahan Duri Kepa, Jakarta Barat, pada 12 Agustus 2025. Tujuan kegiatan adalah meningkatkan kesadaran hukum masyarakat dalam empat aspek krusial, yaitu pencegahan KDRT, pemahaman pendaftaran tanah dan e-Sertipikat untuk mencegah sengketa pertanahan, pemahaman hukum bisnis UMKM dan koperasi, serta perlindungan data pribadi di era digital. Metode yang digunakan mencakup penyuluhan, diskusi interaktif, studi kasus, dan simulasi. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat tentang pentingnya kesadaran hukum, hak atas tanah yang sah, penyelesaian sengketa secara legal dan damai, serta tata kelola bisnis yang sesuai hukum. Selain itu, warga lebih memahami hak dan kewajiban terkait perlindungan data pribadi. Kegiatan ini memberikan manfaat strategis dalam memperkuat fondasi masyarakat yang sadar hukum, melindungi hak-haknya, serta mampu berdaya secara ekonomi di tengah dinamika sosial yang semakin kompleks.Kata Kunci: Kesadaran hukum, KDRT, e-Sertipikat, UMKM, koperasi, data pribadi AbstractLegal awareness is an important foundation for building an orderly, just, and empowered society. However, in practice, many citizens still face serious problems, ranging from domestic violence (DV), land conflicts, weak governance of micro, small, and medium enterprises (MSMEs) and cooperatives, to low digital legal literacy. This condition prompted the Faculty of Law at Esa Unggul University to conduct community service activities in Duri Kepa Village, West Jakarta, on August 12, 2025. The purpose of the activity is to increase public legal awareness in four crucial aspects: preventing domestic violence, understanding land registration and e-certificates to prevent land disputes, understanding business law for MSMEs and cooperatives, and protecting personal data in the digital age. The methods used include counselling, interactive discussions, case studies, and simulations. The results of the activity show an increase in the community's understanding of the importance of legal awareness, legitimate land rights, legal and peaceful dispute resolution, and lawful business governance. Additionally, citizens have a better understanding of their rights and obligations regarding personal data protection. This activity provides strategic benefits in strengthening the foundation of a law-abiding society, protecting its rights, and enabling economic empowerment amidst increasingly complex social dynamics. Abstract

The settlement of sexual harassment cases through peace agreements based on contracts remains a practice commonly found in society. This practice raises complex legal issues as it lies at the intersection of civil law and criminal law. On one hand, civil law recognizes contracts as legally binding instruments provided that the legal requirements of validity are fulfilled. On the other hand, sexual harassment constitutes a criminal offense, meaning that its resolution cannot rely solely on the agreement of the parties involved. This study aims to analyze the settlement of sexual harassment cases through contractual peace agreements from the perspectives of civil law and criminal law. The research employs a normative legal method using statutory and conceptual approaches. The legal materials consist of primary and secondary sources, which are analyzed qualitatively. The findings indicate that peace agreements in sexual harassment cases may be considered legally valid only if they fulfill the legal requirements of a contract, particularly the existence of free consent and a lawful cause. From a criminal law perspective, a peace agreement between the perpetrator and the victim does not eliminate the unlawful nature of sexual harassment, as such acts involve public legal interests protected by the state. Therefore, peace agreements may only operate within the civil law domain and cannot be used as a basis to negate criminal law enforcement processes.
