Abstract

Interpreting law enforcement as a process carried out in an effort to uphold or function real legal norms, which can serve as a guide in conducting relationships in the life of society and the state in various aspects. In Ternate City, current theft often occurs both on a large and small scale, it can be seen that since 2019, there have been two quite large cases of theft at PT Aneka Tambang and Bank Teras BRI Gamalama Terna, both cases can be categorized as acts theft is based on Law Number 30 of 2009 concerning Electricity, but there is no prosecution by PT Perusahan Listrik Negara or the legal investigation process carried out by the authorized party.

Abstract

Tulisan ini menganalisis Efektivitas penyelenggaraan dan pemeliharaan pelabuhan pengumpan lokal oleh Kantor Unit Penyelenggara Pelabuhan Kelas II Babang. Tipe penelitian ini adalah penelitian hukum normatif, dengan menggunakan pendekatan konsep (conceptual approach), dan pendekatan perundang-undangan (statute approach). Bahan hukum yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tertier, yang diperoleh melalui studi kepustaakan dan dilengkapi dengan wawancara. Bahan hukum yang terkumpul kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa penyelenggaraan dan Pemeliharaan Pelabuhan Pengumpan Lokal oleh Kantor UPP Kelas II Babang, Direktorat Jenderal Perhubungan Laut, Kementerian Perhubungan dengan tolak ukur dari beberapa Faktor Efektifitas Yaitu Faktor Hukum (Undang-Undang, Faktor Penegak Hukum, Faktor Sarana dan Fasilitas, Faktor Masyarakat Penegak hukum dan Faktor Kebudayaan telah menunjukan dampak yang baik dalam implentasinya dan telah dapat menunjukan tujuan dari hukum itu sendiri sebagaimana terdapat dalam Pembukaan UUD 1945 yaitu keadilan sosial dalam hal ini keadilan sosial bagi seluruh rakyat Indonesia sesuai sila kelima dari Pancasila yaitu dengan mengedepankan keadilan yang seadil-adilnya, perlindungan hak, persamaan derajat dan kedudukan di hadapan hukum dan kesejahteraan umum masyarakat namun sejauh ini belum bisa dikatakan efektif karena ada factor-factor pengahambatnya yaitu konfilik norma, budaya kerja dan masih kurangnya fasilitas lain dalam penyelenglenggaraan dan pemeliharaan Pelabuhan, namun hal ini telah dilakukan upaya-upaya dalam penyelengsaiannya dalam upaya peningkatan pelayanan kepada masyarakat di bidang kepelabuhanan.

Abstract

This study aimed at determining and finding: (1) whether the unlawful act of the State Administrative Officers as a Defendant was caused by the Article formulation 116 (2) and paragraph (3) of Law Number 51 of 2009 concerning the Second Amendment of Law Number 5 of 2009 1986 concerning the State Administrative Court; and 2) the legal consequences if the defendant (TUN official) does not implement the decision of the State Administrative Decision. By using normative legal research methods which is examining secondary data or library materials that are focused on testing the application of norms in positive law; Analyzing unlawful acts committed by State Administrative Officers (Mayor of Tidore Kepulauan) because State Administrative Court Decisions State which has permanent legal force were not implemented. The results of the study indicated that (1) There was an unlawful act committed by the State Administrative Officers, in this case the Mayor of Tidore Kepulauan, which was not carried out by Ambon State Administrative Court Decision Number: 10/G/2015/PTUN.ABN on November 12, 2005. (2) There was a legal uncertainty as the decisions by the Mayor of Tidore Kepulauan were not implemented, so Ambon State Administrative Court's decision had neither been effective nor legally certain. (3) Those problems were caused by Article 116 paragraph (2) and paragraph (3) of Law Number 5 of 1986 which handed over the implementation of Ambon Administrative Court decision to the defendant (Contrarius Atus principle). (4) There was a legal uncertainty for the plaintiff. 5) Unclear guarantees of the rights of the plaintiffs

Abstract

The Supreme Court Regulation Number 3 of 2017 has not been implemented as a whole in divorce cases in the Religious Courts, women who file for divorce (divorce lawsuits) have not fully obtained their rights due to divorce, and divorces that occur in religious courts are mostly divorce lawsuits. The purpose of the study is to find out the extent to which judges apply Supreme Court Regulation Number 3 of 2017 in deciding cases, especially divorce cases against Verstek's decision, and the obstacles faced by judges in implementing Supreme Court regulations Number 3 of 2017. This study uses empirical normative research methods, while data collection techniques are carried out by interviewing, observing and reviewing literature, books and other information relevant to the study. The results of the study show that the Supreme Court Regulation Number 3 of 2017 is very important and very helpful for judges in making decisions but until now Judges are still having difficulty executing Verstek Divorce Decisions if in the decision there are ex-wife rights due to divorce, especially non-civil servants

Abstract

This research focuses on the implementation of people’s sovereignty in the 1945 Constitution of the Republic of Indonesia and its implementation in the working relationship of the Supreme Audit Agency (BPK) and the Regional People's Representative Council (DPRD). The research problem raised is how people's sovereignty affects the relationship between DPRD and BPK and what are the relationships between the two institutions that are influenced by people's sovereignty. To reveal the research problem, normative legal research is used which prioritizes secondary data with two approaches, namely the legal approach and the conceptual approach. The results of the study show that the people's sovereignty in the constitution is realized through one of its principles, namely accountability. Accountability is the embodiment of people's sovereignty as a form of accountability to the people as the giver of the mandate. This principle also underlies the relationship between the DPRD and the BPK which independently has the authority to implement accountability. The relationship between the two institutions is the implementation of accountability in the horizontal dimension, namely (1) checks and balances, namely the examination of the BPK to the DPRD and the submission of the report on the results of the examination by the BPK to the DPRD; (2) Form of Follow-up on Examination Results; and (3) DPRD involvement in planning the examination. As well as accountability to the people, both by the BPK and DPRD in the dimension of vertical accountability.

Abstract

This study aims to analyze in-depth the fraud based on Article 1328 of the Civil Code on the agreement that can result in default, as well as to examine the legal consequences of the agreement containing elements of fraud based on Article 1328 of the Civil Code, fraud can be canceled or null and void. The research method used in this research is normative research on the rule of law contained in Article 1328 of the Civil Code. The data used in this study is secondary data. The secondary data used in this study consists of primary legal materials that are authoritative which means they have authority, secondary legal materials, and tertiary legal materials. The results of this study indicate that fraud based on Article 1328 of the Civil Code in the Agreement does not result in Default. Because default and fraud in civil law have different elements. Default is regulated in Article 1243 of the Civil Code, while fraud in civil law is regulated in 1328 of the Civil Code. The consequences of an agreement containing an element of fraud can be canceled or null and void by law. The condition for canceling the agreement is that the agreement to be canceled must be reciprocal, namely an agreement that gives rights and obligations to both parties, cancellation is carried out through the court so that the cancellation of the agreement is through a judge's decision, and there must be a default. An agreement can be canceled as stipulated in article 1321 of the Civil Code, while an agreement that has prohibited things causes the agreement to be null and void, based on Article 1254 of the Civil Code.

Abstract

This study aims to assess the authority of provincial governments related to mining business permits. Moreover, DPRD supervision of local governments related to overlapping of overlapping mining business permits in North Maluku Province. The research method used in this study is the type of research used in the research is normative legal research as a process to find the rule of law, legal principles, and legal doctrines to answer the legal issues faced. The scientific logic that in normative legal research is built on scientific discipline and the ways in which normative legal science works, legal science whose object is law itself. The results of this study show that the authority of provincial governments related to mining business permits is explicitly regulated in the provisions of Article 14 paragraph (1) Law Number 23 of 2014 concerning Regional Government which reads "the implementation of government affairs in the fields of forestry, marine, as well as energy and mineral resources becomes a concurrent affair which is a division of authority between the central and provincial governments", The provisions of Article 14 paragraph (1) regulate mining business permits (IUP) which are no longer the authority of the regency government anymore, but become the authority of the provincial and central governments. The transfer of authority to issue mining business licenses (IUP), has a juridical impact on the provisions related to this matter will certainly change, but in its implementation the old provisions are used until there are new provisions that adapt to these rules.

Abstract

Penelitian ini mengkaji pelaksanaan diversi terhadap anak pada tahap penyidikan perkara tindak pidana lalu lintas di Kepolisian Resor Kota Tidore serta menelaah aspek yang mempengaruhinya. Tipe penelitian yang digunakan ialah penelitian hukum empiris dengan menggunakan data yang bersumber dari data primer dan sekunder. Teknik pengumpulan data melalui studi kepustakaan dan lapangan yang kemudian diolah dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pelaksanaan diversi belum terlaksana secara optimal sebagaimana ketentuan dalam undang-undang sistem peradilan pidana anak maupun dalam peraturan pemerintah yang mengatur tata cara pelaksanaan diversi, dimana diversi pada tahap penyidikan di Kepolisian Resor Kota Tidore kurang melibatkan masyarakat dalam proses pelaksanaannya sehingga lebih banyak penyelesaian diversi dilakukan dengan musyawarah keluarga. Pelaksanaan diversi pun dipengaruhi oleh pelbagai aspek diantaranya aspek aparat penegak hukum, aspek sarana prasarana dan fasilitas yang dapat menunjang pelaksanaan diversi serta aspek masyarakat itu sendiri baik dari pihak pelaku maupun dari pihak korban. Abstract

This study analyzes the factors causing criminal homicides in West Taliabu Regency from a criminological perspective, as well as criminal behavior and societal reactions to such crimes. The research methodology employed is empirical legal research using a qualitative field approach, collecting primary and secondary data. The findings indicate internal factors including personal, economic, educational, and familial aspects, while external factors encompass environmental and cultural influences. Some causes include alcohol consumption before homicide and land disputes. The societal response to homicides demonstrates concern and fear, creating discomfort within the community. Formal societal responses involve actions taken by state-recognized community institutions.

Abstract

Usaha penyediaan tenaga listrik dikuasai oleh negara dan dipergunakan untuk sebesar-besarnya kemakmuran rakyat, bukan sebaliknya, justru memberikan dampak kerugian kepada masyarakat. Penelitian ini adalah penelitian hukum empirik. Penelitian dilakukan pada PT. PLN (Persero) UP3 Ternate, Maluku Utara. Hasil penelitian menunjukkan bahwa bentuk perlindungan hukum terhadap hak pemilik tanah terhadap pendirian tiang listrik yaitu pertama perlindungan hukum preventif dengan melibatkan atau mengikutsertakan masyarakat terdampak dalam penentuan titik serta memastikan pembangunannya sesuai jarak aman dan keselamatan. Wajib pula dilakukan pengawasan dari pemerintah terhadap pendirian jaringan listrik yang merupakan bagian dari perlindungan preventif terhadap hak-hak masyarakat di Kelurahan Fitu, Kota Ternate Selatan. Hak dan kewajiban pendirian tiang listrik yaitu pihak PT. PLN (Persero) berhak menggunakan tanah untuk fasilitas umum dalam hal ini untuk pendirian tiang listrik namun harus memenuhi kewajibannya dengan pemberian ganti rugi atau kompensasi kepada pemilik tanah berdasarkan ketentuan dalam Undang-Undang Ketenagalistrikan.
